Receiving a Notification from the Courthouse

Every document you receive from the court, the Public Prosecutor's Office, or enforcement offices is sent to inform you about an official process. Documents sent by these institutions are called official notifications.

A summons from the courthouse serves to inform you about a legal or criminal matter. In other words, summonses from civil and criminal courts mostly concern the case against you, the hearing date, etc. Another possibility is that you are listed as a witness in the case. If you are a witness, the hearing date will be notified to you via summons. Documents from the Public Prosecutor's Office are mostly for you to give a statement. Any document sent from official institutions such as the Public Prosecutor's Office, courthouse, court, or enforcement office is considered a summons. Summonses serve as a form of information or warning regarding official procedures.

Code of Criminal Procedure Individuals to be heard by judicial officials are summoned with a duly issued invitation. A duly issued invitation is a notification. The invitation clearly states the reason for the summons, the capacity in which the person is summoned, and that they will be brought before the court by force if they do not appear. If a complainant, suspect, defendant, victim, witness, or expert witness fails to appear before the court or prosecutor's office despite receiving a notification from the courthouse, they will be brought before the prosecutor, judge, or court by force. A decision to bring someone before the court by force is a protective measure that restricts their freedom.

In practice, law enforcement usually goes to the home of the person for whom an arrest warrant has been issued and serves the warrant to the person or their relative. Even if the person does not open the door, they cannot enter the house as required by law and leave a warning notice. An arrest warrant can be issued for a specific date, requiring the person to be brought to the designated location for questioning, or it can be issued without a specific date, meaning the person must be apprehended day or night and brought to the designated location for questioning.

Upon receipt of a summons from the courthouse, a warrant for compulsory appearance is issued for suspects, defendants, witnesses, and expert witnesses who have been duly summoned. If these individuals cannot be brought to court under this warrant, an arrest warrant is subsequently issued.

It is particularly important to pay attention to documents from enforcement offices. If the document relates to an enforcement proceeding, missing the objection period, which begins to run from the date of service, will result in the proceeding becoming final and you being obligated to make a payment. Remember that every document received from the courthouse is sent for official business reasons and is most likely time-sensitive. Notifications sent to you by courts, public prosecutor's offices, or enforcement offices may contain very important information. Therefore, you should read their contents and take any action required of you. Otherwise, you may miss deadlines, especially those related to forfeiture periods, and face the situation of not being able to exercise your rights.
