How long do employment lawsuits last?
Labor law cases, according to the average released by the Ministry of Justice in 2019, take approximately 555 days to process. Considering the preliminary hearing, witness testimonies, and expert reports, approximately 3 to 5 hearings are held in these cases. In other words, labor cases take an average of 555 days, or about two years. The Ministry of Justice has implemented a target timeframe to shorten judicial processes; in labor courts, this period is generally set at 540 days.
Furthermore, mandatory mediation is a requirement in legal proceedings arising from labor law; filing a lawsuit without first applying to a mediator will result in the dismissal of the case. Therefore, the employee or employer who intends to file a lawsuit may need to apply to a mediator before initiating the proceedings.
The appeal process begins when one of the parties objects to the decision of the labor court; the appeal process itself can take 2 to 3 years, and if an appeal is filed against the decision of the appellate court, the cassation process can take an average of 2 years.
If an appeal is filed by one of the parties acting in bad faith, compensation for bad faith and accrued interest must be taken into consideration.
