What is Etbis?
The Electronic Commerce Information System, or ETBIS for short, is an information system created by the Ministry for the purpose of registering service providers and intermediary service providers, collecting electronic commerce data, processing this data and producing statistical information, and enabling registration and notification within the scope of the Communiqué on the Electronic Commerce Information System and Notification Obligations. In short, it can be described as a system created by the Ministry of Trade to track statistics and information related to electronic commerce.
ETBİS’e Nasıl Giriş Yapılır?
- Eticaret.gov.tr üzerinde bulunan “ETBİS GİRİŞ” butonuna tıklanır.
- Butona tıkladıktan sonra “İşletme Girişi”ne tıklanır.
- Açılan e-devlet sayfası üzerinden ilk olarak yetkili temsilci tarafından giriş yapılır. Daha sonra gerekli görülmesi halinde yetkili tarafından alt yetkili atanabilir.
ETBİS’e Kimler Kayıt Olmalı?
- Service providers operating within their own e-commerce environment.
- Intermediary service providers.
- Service providers who are based in Turkey but do not conduct e-commerce activities within Turkey, yet enter into contracts or receive orders through an intermediary service provider based abroad.
Do those selling through intermediary service providers (e-commerce marketplaces) have an obligation to register and report to ETBİS?
Those selling through intermediary service providers within the country are not subject to registration and notification obligations. On the other hand, in accordance with clause (c) of the first paragraph of Article 5 of the Communiqué, service providers who are domiciled in Turkey but do not conduct electronic commerce activities within Turkey, but who enter into contracts or receive orders through an intermediary service provider domiciled abroad, are subject to registration and notification obligations.
Do I need to be registered with a tradesmen's association or chamber of commerce to register with ETBİS?
ETBİS’e giriş için tacirler için MERSİS’de, esnaf ve sanatkârlar için ESBİS’de bulunan yetkili temsilcilerinin e-devlet sistemine kendi T.C. kimlik numarası ve şifreleri ile giriş yapmaları gerektiğinden önce MERSİS ya da ESBİS’e kaydolup daha sonra da ETBİS’de kayıt ve bildirim yükümlülüğünüzü yerine getirmeniz gerekmektedir.
Who should report it?

2021 yılı için ETBİS’e kayıt olmamanın cezası nedir?
Law No. 6563 Law on the Regulation of Electronic Commerce Within the scope of Article 12;
Natural or legal persons engaged in electronic commerce activities;
- If the company fails to fulfill its legal obligations regarding information provision, if the total amount the consumer is obligated to pay for orders placed via electronic communication is not clearly displayed, if commercial electronic messages are sent without the recipient's consent, or if the content of the transmitted commercial message contradicts the consent given, a fine of 2,071 to 10,381 TL may be imposed.,
- If the seller fails to promptly confirm receipt of the order, does not provide the necessary infrastructure to confirm and correct the information provided before the order, does not ensure that commercial communication and the person with whom it is communicated can be identified, does not include the necessary information to identify themselves in the commercial message they send, or does not specify on whose behalf the communication is made, the penalty will range from 2,071 to 20,764 TL.,
- If promotions such as discounts and gifts are offered, and the terms and conditions for participation and use are not easily accessible, clear, and unambiguous, or if the option to refuse the commercial message is not provided easily and free of charge, or if the sender does not stop sending messages within three days of the request date, a fine of 4,149 to 31,146 TL may be imposed.,
- Failure to provide the information and documents requested by the Ministry will result in fines ranging from 4,149 to 10,381 TL.,
- Failure to register with the ETBİS system will result in a fine of between 10,381 and 41,490 TL.,
