
Construction Amnesty Processes | Real Estate Lawyer in Izmir
This process, known as the zoning amnesty, covers all structures built before December 31, 2017, that are unplanned, without a project, or in violation of zoning laws. Both structures built in violation of zoning regulations and additions made over time, even if they have occupancy permits, are evaluated under this law.
1. Who can benefit from the zoning amnesty?
Owners of buildings constructed without proper planning and projects can have administrative fines imposed on their buildings cancelled by applying for zoning permits. They can also have any existing demolition orders overturned. Furthermore, they can have any pending public lawsuits dismissed. Additionally, owners of properties with land deeds can convert their land deeds into condominium deeds by applying for zoning permits.
There are also some property owners who are excluded from the scope of this zoning amnesty process. For example, if the land on which the building is located belongs to a third party, the building in question will be excluded from the scope of this law. On the other hand, structures located in industrial, storage, tourist, agricultural areas, military zones within municipalities and adjacent areas, and structures located along the Bosphorus are excluded from the scope of the zoning amnesty.
2. How to Apply for the Zoning Amnesty?
Those entitled to apply can do so through the provincial directorates of the Ministry of Environment and Urbanization or through specially established authorized organizations. Applications can also be easily submitted via the e-Government system. Applications for the zoning amnesty can be tracked through the e-Government system.
3. What Documents Are Required for the Construction Amnesty Application?
The required documents for application under the Zoning Amnesty process are listed below:
- E-Government Password
- A valid mobile phone number
- A valid email address
- The address of the structure to be declared
- Title deed and plot information, if available.
- Total construction area; total area of residences and workplaces separately (m2)
- Number of residential and commercial units in the building
- Property tax unit value of the land/plot (TL/m2) (Can be obtained from the relevant municipality.)
- The area of the land on which the building is located; the area stated in the title deed if available, otherwise the declared area (m2)
- Building class (to be selected from the options offered by the system)
- Defining violations of zoning regulations.
- One photograph showing the structure and one showing the separation part.
4. Has the Zoning Amnesty Process Been Extended? Will it be Extended?
The application period for the zoning amnesty, which was last introduced in 2018, ended on December 31, 2019. In this program, where at least 25% of the fee required to obtain a building registration certificate had to be paid, the deadline for the remaining payment also expired on December 31, 2019.
Another question that those who could not benefit from the zoning amnesty for any reason (for example, missing the application deadline) are wondering about is whether the zoning amnesty has been extended. Unfortunately, the official statement made by the Minister of Environment and Urbanization states that there is no new zoning amnesty process yet.
5. How to Check the Status of the Zoning Amnesty Process?
As we previously mentioned, eligible individuals can check their zoning amnesty status through the e-Government portal. Citizens who have applied for zoning amnesty must log in to the system using their Turkish Republic identity number and password and follow the relevant instructions to check their status on the e-Government portal.
