Curfew Violation Fines | During this extraordinary period, many obligations have been imposed, such as the mandatory wearing of masks. One of these is the curfew imposed on certain days and times. Citizens who violate these restrictions may face administrative fines as well as criminal prosecution under the Turkish Penal Code. So, what is the fine for violating curfews?
Curfew fine Public Health LawThis is regulated under Article 282, and the administrative fine stipulated in the article, adapted to current times, will be 3250 TL.
Public Health Law No. 1593
Article 282 – Those who act contrary to the prohibitions written in this Law or who fail to comply with the obligations, unless their actions constitute a separate crime, shall be subject to an administrative fine of between two hundred and fifty Turkish Liras and one thousand Turkish Liras.
Time Limit and Place of Appeal Against Administrative Fines
Appeals against administrative fines must be filed with the Magistrates' Court within 15 days of the notification or pronouncement of the fine. If no appeal is filed within the specified period, the administrative fine will become final.
Another point to note is that, as emphasized in local court decisions, the police or gendarmerie have the authority to draw up violation reports.
In accordance with the decision of the Ankara 3rd Magistrates' Criminal Court cited above “"Since the Public Health Law does not include curfews among the measures to be taken, no fines can be imposed."” The relevant court ruled to annul the administrative fine, stating that the administrative fine should be imposed by the governorship or district governorship. Furthermore, the aforementioned decision and similar decisions emphasize that administrative fines must be imposed by the governorship or district governorship; it is possible to have the administrative fine annulled through an appeal based on procedural and substantive grounds.
