What are the different types of adoption?

According to the adoptive parents;

  • Joint Adoption
  • Single Adoption
  • Step-Adoption

They are divided into three categories.

According to the Adopted Individuals;

  • Adoption of Minors
  • Adoption of Adults
  • Adoption of Individuals with Limited Capacity

They are divided into three categories.

The adoption of a minor is conditional upon the child having been cared for and educated by the adoptive parent for a period of one year. The adoption must in all cases be in the best interest of the minor and must not unfairly prejudice the interests of the adoptive parent's other children. (Article 305)

Couples Adopting Children

Spouses can only adopt together; unmarried individuals cannot adopt together. Spouses must have been married for at least five years or be at least thirty years old. One spouse may adopt the child of the other, provided they have been married for at least two years or are at least thirty years old. (Article 306)

Single Adoption Requirements

An unmarried person who has reached the age of thirty may adopt a child alone. A spouse who has reached the age of thirty may adopt a child if the other spouse is permanently incapacitated or lacks the capacity to make reasoned decisions.
If a parent can prove that joint adoption is not possible because their whereabouts have been unknown for more than two years, or because they have been separated from their spouse by court order for more than two years, they may adopt alone. (Article 307)

Formal Requirements for Adoption

Adoption requires the consent of the minor's biological parents. This consent is given orally or in writing and recorded in a court in the place where the minor or their parents reside. The consent is valid even if the names of the adoptive parents are not specified or if the adoptive parents have not yet been identified.

Consent cannot be given before six weeks have passed since the birth of the child. Consent can be withdrawn in the same manner within six weeks from the date it is recorded. Consent given again after withdrawal is final.

What are the legal requirements for adoption?

  • Obtaining the consent of a minor who has the capacity to make reasoned decisions.,
  • Except for the provisions in Articles 311 and 312 of the Turkish Civil Code, the consent of the minor's parents is required as specified in Article 309.,
  • If the minor is under guardianship, the permission of the guardianship authorities stipulated in Article 397 of the Turkish Civil Code must be obtained.,
  • The spouses must have been married for at least five years or both must be at least thirty years old.,
