Who owns the wedding jewelry?
Boşanma süreçlerinde en sık karşılaşılan sorulardan biri takıların hangi tarafa ait olduğudur. Yargıtay’ın bu konuda vermiş olduğu yerleşmiş içtihatlar incelendiğinde bu konuda kararların istikrarlı olduğu görülecektir. Kararlarda düğün sırasında takılan ziynet eşyalarının kadına ait olduğu ve kadının kişisel eşyası niteliğinde olduğu ifade edilmektedir.

According to the fundamental principles and procedural rules of our legal system, in a lawsuit, the person who derives a favorable outcome from the facts of the case bears the burden of proof. To prove the validity of wedding gifts, any kind of evidence such as witness testimonies, photographs, and videos can be used.

Boşanmada düğün takıları kadına aittir. Boşanma halinde geri verme yükümlülüğü yoktur. Mahkemenin davayı kabul gerekçesi olaya ve içtihatlara uygun değildir. Şu durumda, eşyaların geri alınması için bir neden olmadığına göre davanın reddi gerekirken yazılı şekilde kabul edilmiş olması bozmayı gerektirmiştir. (Yargıtay 4. According to Article 1 of the Civil Code, the judge has the authority to decide according to custom and tradition in cases where there is no provision in the law. Since the parties can prove the contrary of the presumption of possession with any kind of evidence, determining custom and tradition is important here. If there is a well-established custom and tradition in the region where the parties reside, followed by everyone without exception, that the jewelry given at the wedding, regardless of who gave it as a gift, belongs to the bride, then the woman should be considered the legal holder. It is incorrect to decide, without considering this aspect and without investigating custom and tradition, that the jewelry given to the husband during the wedding belongs to the husband and to order its return from the woman, based on an incomplete investigation. As a rule, jewelry given during a wedding ceremony, regardless of who gives it to whom, is considered a gift to the woman and is henceforth her personal property. (Supreme Court of Appeals, 3rd Civil Chamber, 2015/17417 K.)
Jewelry and ornaments given as gifts at a wedding belong to the woman and are considered her personal property. (Supreme Court of Appeals, 2nd Civil Chamber, Decision No. 2017/9893)
