What Is a Pre-Information Form?

The pre-information form is a legal requirement regulated under Law No. 6502 on Consumer Protection and related regulations; it must be provided by the seller to the consumer before the contract is signed. The purpose of the pre-information form is to prevent consumers from getting lost in long and complex contracts, and to clearly state any malicious terms and conditions before the contract is signed.

Preliminary Information in Distance Selling Contracts

Regulation on Distance Selling Contracts Within this scope, the consumer must be informed by the seller or provider, prior to the conclusion of a distance contract or acceptance of any corresponding offer, of all the following points.

  • Essential characteristics of the goods or services that are the subject of the contract,
  • Name or title of the seller or supplier, MERSİS number if applicable,
  • Information that enables the consumer to quickly contact the seller or supplier, such as the seller or supplier's full address, telephone number and other contact information, and, if applicable, the identity and address of the person acting on behalf of or for the account of the seller or supplier.,
  • If the seller or provider has different contact details for consumers to submit complaints, information regarding these details should be provided.,
  • The total price of the goods or services, including all taxes, or, if this is not possible to calculate in advance due to the nature of the goods or services, the method of calculating the price, any additional transportation, delivery and similar costs, and information on when these additional costs can be paid if they cannot be calculated in advance.,
  • In cases where the cost of using the remote communication tool cannot be calculated at the standard fee schedule during the contract formation phase, the additional costs imposed on consumers are as follows:,
  • Payment, delivery, and performance information, including any related commitments, and the seller's or supplier's methods for resolving complaints.,
  • In cases where a right of withdrawal exists, the conditions for exercising this right, its duration, procedure, and information regarding the carrier designated by the seller for returns are provided.,
  • The full address, fax number, or email address to which the cancellation notice should be sent,
  • In cases where the right of withdrawal cannot be exercised, information regarding the consumer's inability to exercise this right or the conditions under which the right of withdrawal is lost should be provided.,
  • Deposits or other financial guarantees, if any, that the consumer is required to pay or provide, and the terms and conditions thereof, at the request of the seller or supplier.,
  • Any technical protection measures that may affect the functionality of digital content,
  • Information that the seller or provider knows, or can reasonably be expected to know, about which hardware or software the digital content is compatible with.,
  • Information regarding consumers' ability to submit disputes to the Consumer Court or the Consumer Arbitration Board.

Preliminary Information in Pre-Paid Housing Sales Contracts

 Regulation on Prepaid Housing Sales Within this scope, it is mandatory to provide the consumer with a pre-information form, prepared in an understandable language, in a font size of at least twelve points, and containing the following points, at least one day before the sales contract is concluded:

  • Seller's name or title, full address, telephone number and, if applicable, MERSİS number and other contact information.,
  • The basic descriptive information regarding the independent unit in question, such as the island, parcel, block, location, floor, etc., as well as the net and gross areas of the independent unit determined according to the Planned Areas Type Zoning Regulation,
  • The total sale price of the property in Turkish Lira, including all taxes, for both cash and installment payments; information regarding delivery and other costs, if any.,
  • If applicable, the amount of interest and the annual rate at which the interest was calculated,
  • Information regarding the consumer's right to withdraw from and terminate the contract.,
  • The handover date of the house,
  • Information regarding the collateral to be provided,
  • Date the building permit was obtained,
  • Information regarding contribution to general expenses in accordance with the management plan.

In addition to the preliminary information form containing the information above, the consumer is provided with a unit plan, site plan, floor plan, and room list.

Preliminary Information in Package Tour Contracts

Package Tour Contracts Regulation Within the scope of this agreement, it is mandatory to provide the participant with a brochure for preliminary information purposes before the contract is concluded. The brochure or its annex provided to the participant must include the total price of the package tour including taxes, the amount of the down payment, and the date on which the remaining balance is to be paid. Furthermore, if included in the services comprising the package tour, the following information must also be included:

  • The start and end dates and locations of the trip.
  • The type of transportation used and the class of journey, as well as the dates, times, and locations of departure and return.
  • The type, location, characteristics, and class of accommodation, along with the dates of stay, should be specified, and a warning should be given if this classification differs from that applied in Türkiye.
  • Meal plan.
  • The route to be followed during the journey.
  • Information regarding passport, visa, age, and health requirements, in accordance with the package tour specifications.
  • If a minimum number of participants is required for the package tour to take place, this number is also specified, and the deadline by which participants will be notified of the tour's cancellation if this number is not reached.
  • Information regarding mandatory insurance as stipulated by the Travel Agencies and Travel Agencies Association Law, and other insurance policies, if any.
  • Information regarding tourist guide services.

The information contained in the brochure given to the participant is binding on the package tour organizer and agent.
