Türk Ceza Kanunu Madde 226 kapsamında tanımlanan “Müstehcenlik Suçu”, özellikle çocukların veya hayvanların içerisinde bulunduğu cinsel içerikler aracılığı ile işlenen bir suç tipidir. Farklı materyaller aracılığı ile işlenmesi mümkün olan müstehcenlik suçu yalnızca çocukların içerisinde yer aldığı cinsel içerikler ile sınırlı olarak düşünülmemelidir.

Crime of Obscenity
Article 226-
- a) One products containing obscene images, writings, or words for childrengiving, showing, reading, teaching or listening to the content of these,
b) Their contents places where children can enter or see or openly displaying, visible
exhibiting, reading, teaching, speaking, causing to be spoken, in this way,
c) Those who offer these products for sale or rent in a way that allows the contents to be understood,
d) These products may not be sold outside of places of sale specifically designated for their sale.offering for sale, selling or renting,
e) Those who give or distribute these products free of charge alongside or in connection with the sale of other goods or services,
f) These products advertising,

- The provisions of this article shall not apply to scientific works; and, with the exception of the third paragraph, to works of artistic and literary value, provided that their access to children is prevented.

“Sanık hakkında özel hayatın gizliliğini ihlal suçundan kurulan mahkûmiyet ve müstehcenlik suçundan kurulan beraat hükümlerinin temyiz incelemesine gelince;
Sanığın çocuk yaşta bulunan mağdure ile rızasıyla cinsel ilişkiye girip, bu ilişkiye ait müstehcen görüntüleri mağdurenin bilgisi dahilinde kendisine ait cep telefonuna kaydettiği, bu görüntülerin CD’ye aktarılmasını sağladıktan sonra yine çocuk yaştaki tanıklar D.. ve D..’ın görmesini sağlayan sanığın eylemlerinin ayrı ayrı TCK’nın 236/3-c-1 ve 226/5. maddesindeki suçları oluşturduğu, sanığın bu eylemleri ayrıca mağdure H..’ye yönelik özel hayatın gizliliğini ihlal suçunu da oluşturmakla birlikte, TCK’nın 44. maddesinde düzenlenen fikri içtima kuralı gözetilerek sanığın ceza miktarı itibariyle ağır nitelikteki aynı Kanunun 226/3-c-1 ve 226/5. maddelerine göre cezalandırılması gerekirken suç vasfının tayininde yanılgıya düşülerek özel hayatın gizliliğinin ihlali suçundan mahkûmiyeti ile müstehcenlik suçundan beraatine karar verilmesi,
Kanuna aykırı, katılan vekili ile O Yer Cumhuriyet Savcısının temyiz itirazları bu itibarla yerinde görüldüğünden, hükmün 5320 sayılı Kanunun 8/1. maddesi gözetilerek 1412 sayılı CMUK’nın 321. maddesi uyarınca TO DETERIORATE, 20.10.2015 tarihinde oybirliğiyle karar verildi.”

“1- Sanığın evinde yapılan arama sonucu ele geçirilen bilgisayar, hard diskler ve CD’lerin bir kısmında çocukların kullanıldığının, bir kısmında ise hayvanlarla yapılan cinsel ilişkiye ait görüntüler bulunduğunun anlaşılması karşısında, sanığın eyleminin TCK’nın 44. maddesindeki fikri içtima kuralları gereği en ağır cezayı öngören aynı Kanunun 226/3. maddesindeki suçu oluşturduğu gözetilmeden ayrı ayrı hüküm kurulması,
2- Considering the number and nature of the obscene content found on the computer, hard disks, and CDs seized from the defendant, it was not considered necessary to determine the basic sentence by deviating from the lower limit.,
3- The possibility of applying the provision regarding the deprivation of rights stipulated in Article 53/1-b of the Turkish Penal Code has been eliminated due to its annulment by the Constitutional Court's decision dated 08/10/2015, numbered 2014/140 and 2015/85.,
