For a person residing abroad to be represented in a lawsuit being heard in Türkiye, they must grant power of attorney to a lawyer in Türkiye. Similarly, in matters related to public institutions (such as social security, hospitals, or judicial authorities), representation by a lawyer in Türkiye is necessary to ensure that the person living abroad's affairs are not disrupted. Sometimes, a lawyer is needed to facilitate the rental of a property in Türkiye, to ensure smooth title deed transactions, and to maintain communication with a tenant.

In a power of attorney relationship, the person granting the power of attorney is called the client, and the person receiving the power of attorney is called the agent. Being abroad does not prevent the granting of power of attorney. Notarial matters abroad are handled by consulates. Individuals wishing to obtain a power of attorney abroad must apply in person to the Turkish Consulate in the relevant country and obtain the power of attorney through the consulate. An appointment must first be made with the consulate.

To specify the necessary documents: For a person living abroad to authorize someone in Türkiye to act on their behalf, they must apply to the nearest Turkish Consulate in their country of residence with their national identity card, passport, and two photographs. For powers of attorney requiring transactions at the land registry office, it is advisable to also include a copy of the land registry document or relevant information.

The language of the power of attorney to be drawn up here for representation in Türkiye is Turkish. If a person residing in Türkiye is to be appointed as a representative, those who do not speak Turkish must have an interpreter with them during the procedures at the consulate. As with all notarial procedures, the person must present their national identity card (or identity document if they are a foreign national, and also their blue card if applicable) when drawing up the power of attorney.

The following points should be considered when granting power of attorney from abroad:;

  2. For cases such as property deeds or divorce proceedings, a power of attorney must include a photograph.
  3. Each page of the power of attorney must be signed by the person granting the power of attorney.
  4. The powers granted must be stated in clear language.
  5. Finally, the completed power of attorney must be delivered to the designated person by mail.
