What is joint ownership?
The term "müşterek," which literally means common or shared, is frequently used in our legal system to refer to co-ownership in partition or inheritance proceedings. Co-ownership can be summarized as the division of the property rights of the co-owners into specific proportions.
What is a Joint Account?
Joint accounts, which have become increasingly common in recent years, are bank accounts where more than one person has the authority to control the account. Unless otherwise agreed upon by the parties, the amount in such an account is generally required to be divided equally between the parties in the event of a divorce.

Bankacılıkta, birden çok kişinin birlikte açtırdığı ve anlaşmaya göre her birinin veya birlikte para çekme yetkisinin bulunduğu hesaplar müşterek hesaplardır. Hesap sahiplerinden her birinin tek başına dilediği miktarda para çekme yetkisi tanınmış ve bankanın bu yüzden sorumluluğunun doğmayacağı kabul edilmiş ise, ortada teselsüllü müşterek hesap var demektir. Uygulamada hesap cüzdanına ve hesap kartonuna hesabın teselsüllü olduğu yolunda kayıt yazılması yeterli görülmektedir. BK’nun madde 148 (6098 s.TBK.m.169) gereğince hesap sahipleri bankaya karşı müteselsil alacaklı durumundadır. Ortak hesapların diğer bir türü de, hesap sahiplerinin birlikte imzaları ile para çekmeye yetkili oldukları hesaplardır. Böyle bir hesap tarzında alacaklılar tasarruf yetkilerini sınırlamış olurlar. Ortak hesap bir tasarruf kaydını içermiyorsa ve hesap açtıranlar, hesaptaki parada tasarruf yetkisini birlikte veya münferiden kullanacaklarını belirtmeden hesap açtırmışlar ise, bu durumda bölünebilir hesaptan söz edilir ve somut olayın özelliklerine göre hesap sahiplerinin eşit oranda pay sahibi olduklarının kabulü gerekir (Prof. Dr. Haluk Tandoğan, Müştereken Hesaplar- Ankara 1959, sh 6-7 ve Prof. Dr. Ünal Tekinalp, Banka Hukuku’nun Esasları, İstanbul 1988 Sh. 330-331 ).
Unless otherwise agreed upon when opening a joint account, the account is considered a joint account with joint and several liability. The shares in the account are equal unless disputed and proven otherwise. If the deposit account belongs to more than one person, in the event of the death of one of the depositors, unless otherwise agreed upon, the funds in the account will be divided into equal shares, and the surviving depositor will receive their share. Somut uyuşmazlık incelendiğinde Mahkemece, tarafların merkez bankası müşterek hesaptaki parası yönünden yazılı şekilde hüküm tesis edilmiş ise de bu görüşe katılmak mümkün değildir. Hesaba dair evraklar incelendiğinde, evlilik birliği içinde tarafların serbest iradeleri ile “müşterek” hesap olarak açıldığı anlaşılmaktadır.
The court should have ruled that the account was jointly owned by both parties on an equal basis, as the individual shares were not specified, and therefore determined that half of the foreign currency in the account belonged to the plaintiff. However, the court's decision to calculate the Turkish Lira equivalent of the foreign currency in the account at the exchange rate on the date of the lawsuit and to order the defendant to pay half of this amount is erroneous, as it creates a disadvantage for the plaintiff who appealed, and therefore warrants reversal.
