What is IYS?
Published in the Official Gazette dated 04.01.2020 Regulation Amending the Regulation on Commercial Communication and Commercial Electronic Messages’Within the scope of personal data protection activities carried out in Türkiye, a new system has been established that mandates registration for individuals and legal entities wishing to send commercial electronic communications. In other words, the IYS (Commercial Electronic Communication System) is a system that allows for obtaining consent for commercial electronic communications, exercising the right to refuse, and managing complaint processes.
What is a commercial electronic message?
Any type of commercial communication conducted by natural and legal persons through electronic communication tools for the purpose of promoting, marketing their goods and services, or increasing the recognition of their business in line with their commercial activities. commercial electronic communication It is called.
Customers must also give their consent before sending commercial electronic messages such as congratulatory messages and greetings, which are intended to increase brand awareness.
IYS Registration Obligation
- Individuals and legal entities wishing to send commercial electronic messages must register with the Message Management System (İYS). According to the relevant regulation, businesses can only send commercial electronic messages to recipients whose consent has been obtained through the system.
- For consents not obtained through the Message Management System (MMS), the burden of proof that the consent was obtained rests with the service provider. Consents not obtained from the MMS must be registered with the MMS by the service provider within 3 days (business days). Consents not registered with the Message Management System will be considered invalid.
- The recipient can also exercise their right to refuse through the Message Management System. Complaint applications will be evaluated through a preliminary review via the Message Management System.
IYS Registration Dates
Businesses must upload their existing permissions to the Message Management System by January 1, 2021. Permissions not uploaded by this date will be considered invalid. This date applies to service providers with 150,000 or fewer commercial electronic message consents (total number of phone numbers and email addresses). June 1, 2021‘'dir.
How to Apply for IYS?
Application via e-government
For IYS registration, if the business owner has a MERSİS registration, you can log in to the system with your e-Government password.
Application with E-Signature
If the business owner's e-signature is available for IYS registration, they can also log in to the system by signing the relevant commitment form.

(The IYS Usage Commitment Form must be sent by courier with all pages stamped and signed. Other documents do not need to be sent.).
