What is IYS?
Published in the Official Gazette dated 04.01.2020 Regulation Amending the Regulation on Commercial Communication and Commercial Electronic Messages’te Türkiye’de gerçekleştirilen kişisel verileri koruma faaliyetleri kapsamında ticari elektronik ileti göndermek isteyen gerçek ve tüzel kişilere kayıt zorunluluğu getirilen yeni bir sistem oluşturulması düzenlenmiştir. Bir başka deyişle İYS, Ticari Elektronik İleti onayı alınmasına, reddetme hakkının kullanılmasına ve şikayet süreçlerinin yönetilmesine imkan tanıyan bir sistemdir.

Customers must also give their consent before sending commercial electronic messages such as congratulatory messages and greetings, which are intended to increase brand awareness.
IYS Registration Obligation
- Ticari elektronik ileti göndermek isteyen gerçek ve tüzel kişiler İleti Yönetim Sistemi (İYS)’ne kaydolmak zorundadır. İlgili yönetmelik kapsamında işletmeler yalnızca sistem üzerinden onayı alınan alıcılara ticari elektronik ileti gönderilebilecektir.
- İleti Yönetim Sistemi üzerinden alınmayan onaylarda, onayın alındığına dair ispat yükümlülüğü, hizmet sağlayıcıya aittir. İYS’den alınmayan onaylar, hizmet sağlayıcı tarafından 3 gün (iş günü) içinde İYS’ye kaydedilmek zorundadır. İleti Yönetim Sistemi kaydedilmeyen onaylar geçersiz sayılacaktır.
- Alıcı, reddetme hakkını İleti Yönetim Sistemi üzerinden de kullanabilecektir. Şikayet başvuruları, İYS üzerinden ön incelemeyle değerlendirilecektir.
IYS Registration Dates
İşletmeler, 1 Ocak 2021’ye kadar mevcut izinlerini İleti Yönetim Sistemi’ne yüklemek zorundadır. Bu tarihe kadar yüklenmeyen izinler geçersiz kabul edilecektir. 150 bin adet ve altında ticari elektronik ileti onayı (telefon numarası ve eposta adresi sayısı toplamı) olan hizmet sağlayıcılar için bu tarih June 1, 2021‘dir.
How to Apply for IYS?
Application via e-government
For IYS registration, if the business owner has a MERSİS registration, you can log in to the system with your e-Government password.
Application with E-Signature
If the business owner's e-signature is available for IYS registration, they can also log in to the system by signing the relevant commitment form.
Other
If the service provider does not have a MERSİS number;

Required Documents
- Photocopy of tax registration certificate (or document containing tax identification number if tax registration certificate is not available)
- Photocopy of the business owner's identity card.
- Signature circular of the business official issued under the company name.
- Chamber of commerce (professional organization) registration certificate, if any.
- Document demonstrating authorization to use the trademark (trademark registration certificate, authorization letter, etc.)
- Stamped and signed undertaking
(The IYS Usage Commitment Form must be sent by courier with all pages stamped and signed. Other documents do not need to be sent.).
