What is additional damage?
Munzam, Türk Dil Kurumu’na göre eklenmiş, katılmış anlamına gelmektedir. Munzam zarar, alacaklının borcunun faizile birlikte ödenmesi durumunda dahi bu ödenen bedelin üzerinde bir zarara uğraması halinde söz konusu olmaktadır. Borçlunun kusuru sabebile uğramış olduğu bu munzam zarar aynı zamanda aşkın zarar olarak da ifade edilmektedir.
Examples of additional damages include the costs of issuing a notice or court order to collect a debt, penalty payments incurred due to a creditor's inability to pay a debt to another party, and lost profits for the creditor.
Türk Medeni Kanunu – Love is Harmful
Article 122- If the creditor suffers damages exceeding the default interest, the debtor is obligated to compensate for these damages as well, unless the debtor proves that they are not at fault. If the amount of damages exceeding the default interest can be determined in the ongoing lawsuit, the judge, upon the plaintiff's request, will also rule on the amount of these damages when making a decision on the merits of the case.
Conditions for Additional Damages
In order for additional damages to be considered, in the specific case;
- The Existence of the Original Debt
- The debtor is in default.
- The Debtor is Responsible for Additional Damages Incurred

Proof of Additional Damages
Within the framework of legal regulations and fundamental legal principles, the burden of proof for additional damages must be placed on the creditor who has suffered these damages and is demanding compensation. The creditor is obligated to concretely demonstrate these damages within the legal process.
