Copyright, author's rights, and royalties are all rights arising from an idea or work of art created by that person.

What is Copyright?

Copyright, as defined by the General Directorate of Copyrights. “Kişinin her türlü fikri emeği ile meydana getirdiği ürünler üzerinde hukuken sağlanan haklardır.”.

Under which legal regulations is copyright regulated?

Copyright Law on Intellectual and Artistic Works It is regulated by the relevant regulations.

What rights are covered by copyright?

According to Law No. 5846, the rights of the author are in the form of financial and moral rights.

Moral Rights:

  • Public offering right
  • The authority to mention the name,
  • The authority to prohibit alterations to the work.
  • The rights of the author against the owner and possessor.

Financial rights include:;

  • Adaptation Rights (Article 21): The right to create intellectual and artistic products by utilizing another work, which are not independent of that work and which bear the characteristics of the adapter.,
  • Right of Reproduction (Article 22): The right to produce a copy or copies of an original work, in whole or in part, directly or indirectly, temporarily or permanently, in any form or by any method.
  • Distribution Rights (Article 23): This is the right to rent, lend, sell, or otherwise distribute the original work or its physical copies.
  • Right of Performance (Article 24): The right to benefit from a work by means of performance, such as reading, playing, performing, and displaying, in public places, either directly or through devices that transmit signs, sounds, or images.
  • Right of Public Disclosure (Article 25): The right to broadcast the original or reproduced copies of a work through wired or wireless broadcasting organizations such as radio, television, satellite and cable, or by means of means for the transmission of signals, sound and/or images, including digital transmission.
  • Right to share and pursue (Article 45).

How long does copyright protection last?

The protection period lasts for the lifetime of the author and for 70 years after their death. If the author is a legal entity, the protection period is 70 years from the date of public disclosure. For works that become public after the author's death, the protection period is 70 years after the date of death. If the author is unknown, the protection period is 70 years from the date the work becomes public.
