What is KVKK?
Law No. 6698 on the Protection of Personal Data‘nun kısaltması olan KVKK özellikler mevzuattan habersiz olanlar için kafa karıştırıcı olabilir. Uygulamada 6698sayılı kanunun yanı sıra kimi zamanlar Kişisel Verileri Koruma Kurumu’nun da kısaltılması olarak kullanıldığı görülmektedir.
What is its purpose?
6698 Sayılı KVKK’nın amacı başta özel hayatın gizliliği olmak üzere kişilerin temel hak ve özgürlüklerini korumak ve kişisel verileri (gerçek kişilerin kimliğini tanımlanabilir kılan verileri ) işleyen gerçek ve tüzel kişilerin yükümlülükleri düzenlemek olup; Avrupa Birliği uyum süreci nezdinde Türkiye’de 2016 yıında yürürlüğe girmiştir.
Scope of the Personal Data Protection Law (KVKK)
The Personal Data Protection Law applies to natural persons whose personal data is processed, and to natural and legal persons who process this data, wholly or partly automatically, or through non-automatic means as part of a data recording system. It should be emphasized that no distinction is made between public and private legal entities. Public legal entities, like private legal entities, are obliged to fulfill their responsibilities under the law.
Basic Principles
The law contains five fundamental principles, which are regulated by Article 4 of the law.
- Compliance with the law and principles of honesty.
- Being accurate and up-to-date when necessary.
- Processing for specific, explicit, and legitimate purposes.
- Being relevant to the purpose for which they are committed, limited, and proportionate.
- Retention for the period stipulated in the relevant legislation or for the period necessary for the purpose for which they were processed.
