Is Carrying a Knife Forbidden?
About Firearms, Knives, and Other Tools Law with dagger, dirk, assault knife, spiked cane, switchblade, machete, sword, bayonet, pointed and grooved knives, club, mace whip, choke wire or chain, brass knuckles Article 5 prohibits the manufacture of similar specialized tools intended solely for attack and defense, while Article 6 prohibits the sale, transportation, and possession of such tools.
Law No. 6136, Article 4 – Within the country, the manufacture of daggers, dirks, assault knives, spiked canes, switchblade knives, machetes, swords, bayonets, pointed and grooved knives, clubs, spiked whips, strangling wires or chains, brass knuckles, and similar tools of a special nature intended solely for attack and defense is prohibited. The manufacture of those tools deemed necessary for the performance of an art or profession may be permitted according to the rules determined in a regulation to be issued by the Ministry of Interior.
Article 5 – The sale, purchase, transportation, and possession of knives and tools whose importation and manufacture are prohibited and which fall within the scope of Article 4, paragraph 1, are forbidden. Knives permitted for use in the performance of an art or profession according to Article 4 are exempt from this prohibition.
Exceptions
About Firearms, Knives, and Other Tools LawWith this regulation, certain exceptions have been made to this prohibition; only rifled firearms and ammunition used in sports, smoothbore rifles and ammunition, household appliances or tools used in medicine, industry, agriculture, or sports, as well as knives, skewers, scrapers and similar items necessary for the practice of a profession or art are permitted to be used.
Furthermore, it has been stipulated that the manufacture of knives and tools mentioned above that are essential for the performance of an art or profession will be permitted according to the rules determined in a regulation to be issued by the Ministry of Interior.
What is the penalty for bringing prohibited weapons into the country?
Anyone who, in violation of the provisions of this Law, imports, attempts to import, or facilitates the importation into the country, or manufactures, or transports, or sends from one place to another, or facilitates the transportation of, the aforementioned knives or other tools or similar items, shall be punished with imprisonment from two to five years and a judicial fine of not less than two hundred days.
Qualifying Circumstances
- If the type or number of knives and tools used in the crime is small, the sentence may be reduced by up to half.
- If the crime of smuggling prohibited knives into the country is committed by those who form or lead an organization, or by members of such an organization, the perpetrators shall be sentenced to imprisonment for five to ten years and a judicial fine of one thousand to ten thousand days.
- If the crime is committed by two or more people without forming an organized group, the penalties shall be increased by one-fold.
- If the quantity of knives and other tools or similar items that are prohibited is significant, the penalties imposed shall be increased by half.
What are the penalties for selling, possessing, or transporting weapons that are prohibited from being carried?
Those who sell, act as intermediaries in the sale of, buy, transport, or possess the knives or other tools or similar items mentioned above shall be sentenced to imprisonment for a period of six months to one year and a judicial fine of not less than twenty-five days.
Qualifying Circumstances
- If the number or nature of the specified knives or other tools or similar instruments are serious, the penalties imposed shall be increased by half to one-fold.
- Those who sell, act as intermediaries in the sale of, purchase, transport, or possess knives or other tools or similar items whose manufacture is permitted, for purposes other than their intended use, shall be subject to the penalties stipulated in the first paragraph; and if the number and nature of such knives or other tools or similar items are serious, the penalties stipulated in the second paragraph shall be applied.
- Those who carry rifled or smoothbore firearms, knives, and other tools solely for the purpose of assault, depending on the circumstances, shall be punished with imprisonment of up to three months or a judicial fine.
