Code of Civil Procedure Within this scope, the judgment given by the Local Court legally stipulates that the court costs and the unspent advance payments received from the parties must be recovered.
The refund of the portion must also include any legal remedies and their time limits, if any. The litigation costs (court expenses to be refunded) listed under the law are as follows:
- Application, decision, and judgment fees.
- Expenses for service of process and postage related to the lawsuit.
- File and other document expenses.
- Expenses related to provisional legal protection measures and the preparation of protests, notifications, warnings, and power of attorney documents.
- Exploration expenses.
- Fees and expenses paid to witnesses and expert witnesses.
- Fees, taxes, charges, and other expenses paid for documents obtained from official institutions.
- In cases not represented by legal counsel, the amount to be determined by the judge to cover the daily travel and accommodation expenses of the parties for the days they are present; and for a party who is summoned by the court to be heard in person, interrogated, or sworn in, despite having legal counsel, the daily allowance, travel, and accommodation expenses to be determined.
- Attorney's fees to be determined in accordance with the law in cases pursued by attorney.
- Other expenses incurred during the trial.
