Ancak bu t\u00fcr maddeler, T\u00fcrk Bor\u00e7lar Kanunu\u2019na ayk\u0131r\u0131 h\u00fck\u00fcmler i\u00e7erdi\u011fi i\u00e7in ge\u00e7ersiz say\u0131l\u0131r.\u00a0Kanun koyucu, kirac\u0131n\u0131n ola\u011fan kullan\u0131mdan kaynaklanan a\u015f\u0131nma ve eskimelerden sorumlu tutulamayaca\u011f\u0131n\u0131 a\u00e7\u0131k\u00e7a belirtmi\u015ftir. Yasal mevzuat ve Yarg\u0131tay kararlar\u0131 incelendi\u011finde, kirac\u0131n\u0131n boyama zorunlulu\u011fundan s\u00f6z edebilmek i\u00e7in duvarlarda ola\u011fan kullan\u0131m\u0131n \u00f6tesinde bir zarar tespiti yap\u0131lmas\u0131 gerekti\u011fi ortaya \u00e7\u0131kmaktad\u0131r. Kanunun \u201cola\u011fan kullan\u0131mdan\u201d do\u011fan y\u0131pranmalar\u0131 kirac\u0131n\u0131n sorumlulu\u011fu d\u0131\u015f\u0131nda b\u0131rakmas\u0131, bu konuda temel \u00f6l\u00e7\u00fct\u00fc olu\u015fturmaktad\u0131r.<\/p>\n\n\n\n<p>\u00d6rne\u011fin, birka\u00e7 y\u0131ll\u0131k kullan\u0131m sonucunda boyan\u0131n solmas\u0131 veya hafif \u00e7iziklerin olu\u015fmas\u0131 normal kabul edilmektedir. Kirac\u0131n\u0131n, evi s\u00f6zle\u015fmeye uygun ve \u00f6zenli kullanmas\u0131na ra\u011fmen bu tarz bir y\u0131pranma olu\u015fmas\u0131 durumunda, herhangi bir boya masraf\u0131n\u0131n kirac\u0131dan talep edilmesi hukuka uygun de\u011fildir. Yarg\u0131tay&#8217;da s\u00f6z konusu kararlar\u0131nda, bu t\u00fcr \u201cd\u00fc\u015f\u00fck seviyeli\u201d y\u0131pranmalar\u0131n ola\u011fan kullan\u0131m kategorisinde say\u0131laca\u011f\u0131n\u0131 a\u00e7\u0131k\u00e7a belirtir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-kiraci-evden-cikarken-evi-boyatmak-zorunda-mi\">Kirac\u0131, Evden \u00c7\u0131karken Evi Boyatmak Zorunda m\u0131?<\/h2>\n\n\n\n<p class=\"has-black-color has-text-color\"> 6098 say\u0131l\u0131 Bor\u00e7lar Kanunu\u2019muzun kiralanan\u0131n geri verilmesi\u201d ba\u015fl\u0131kl\u0131 334 \u00fcnc\u00fc maddesine g\u00f6re, <em>\u201c Kirac\u0131 kiralanan\u0131 ne durumda teslim alm\u0131\u015fsa, kira s\u00f6zle\u015fmesinin bitiminde o durumda geri vermekle y\u00fck\u00fcml\u00fcd\u00fcr. Ancak kirac\u0131 s\u00f6zle\u015fmeye uygun kullanma dolay\u0131s\u0131yla kiralananda meydana gelen eskimelerden ve bozulmalardan sorumlu DE\u011e\u0130LD\u0130R.\u201d<\/em><\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u00d6rnek bir karar ile a\u00e7\u0131klayacak olursak;<br><strong>Yarg\u0131tay 6. Hukuk Dairesinin esas: 2013\/9132, karar: 2014\/2227 ve 27.02.201<\/strong>4 tarihli karar\u0131nda \u00f6zetle a\u015fa\u011f\u0131daki ifadeler yer almaktad\u0131r;<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\"><em>\u201c\u2026 O halde, somut olayda daval\u0131 kirac\u0131, sadece ve ancak, kira s\u00fcresi i\u00e7erisinde kiralanan\u0131n hor kullan\u0131lmas\u0131 nedeniyle olu\u015fan zararlarla s\u0131n\u0131rl\u0131 olarak kiralayana kar\u015f\u0131 sorumludur. Dolay\u0131s\u0131yla, hor kullanma iddias\u0131n\u0131n ileri s\u00fcr\u00fcld\u00fc\u011f\u00fc eldeki davada, yerel mahkemece \u00f6ncelikle bu y\u00f6n \u00fczerinde durulmal\u0131, kiralananda varl\u0131\u011f\u0131 saptanan hasarlar\u0131n hor kullan\u0131m sonucunda olu\u015fup olu\u015fmad\u0131\u011f\u0131 belirlenmelidir. Delil tespiti raporunda kiralananda mevcut hasarlar tek tek a\u00e7\u0131klanm\u0131\u015f ve ta\u015f\u0131nmazda hor kullan\u0131mdan kaynaklanan ve normal kullan\u0131mdan kaynaklanan hasarlar ayr\u0131 ayr\u0131 belirtilmi\u015ftir. Nitekim bu ay\u0131r\u0131m mahallinde yap\u0131lan ke\u015fif sonucu al\u0131nan bilirki\u015fi raporuyla da ortaya konulmu\u015ftur. <strong>Buna g\u00f6re tavandaki kirlenmeden dolay\u0131 ve boya badanada meydana gelen hasarlar normal kullan\u0131m, k\u0131r\u0131lan cam bedeli de hor kullan\u0131m olarak belirlenmi\u015ftir. Bu durumda, normal kullan\u0131mdan kaynaklanan hasarlardan dolay\u0131 Bor\u00e7lar Kanunu\u2019nun 266\/2 nci maddesi uyar\u0131nca ve tersini \u00f6ng\u00f6ren bir s\u00f6zle\u015fme h\u00fckm\u00fcn\u00fcn de bulunmamas\u0131 kar\u015f\u0131s\u0131nda, kirac\u0131n\u0131n tazminat sorumlulu\u011fu bulunmad\u0131\u011f\u0131ndan yaz\u0131l\u0131 \u015fekilde hem normal hem de hor kullan\u0131mdan kaynaklanan hasarlara h\u00fckmedilmesi do\u011fru de\u011fildir.\u201d<\/strong> <\/em>Denilmektedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-peki-sozlesmeye-kiracinin-tasinmazi-bosaltirken-soz-konusu-tasinmazi-boyatmasi-yonunde-bir-madde-konulursa-ne-olur\">Peki s\u00f6zle\u015fmeye kirac\u0131n\u0131n ta\u015f\u0131nmaz\u0131 bo\u015falt\u0131rken s\u00f6z konusu ta\u015f\u0131nmaz\u0131 boyatmas\u0131 y\u00f6n\u00fcnde bir madde konulursa ne olur? <\/h2>\n\n\n\n<p class=\"has-black-color has-text-color\">D\u00fczenlemeye bakacak olursak:<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">6098 say\u0131l\u0131 <a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuat?MevzuatNo=6098&amp;MevzuatTur=1&amp;MevzuatTertip=5\" target=\"_blank\" rel=\"noreferrer noopener\">Turkish Code of Obligations<\/a>\u2019nun kiralanan\u0131n geri verilmesi ba\u015fl\u0131kl\u0131 334 \u00fcnc\u00fc maddesine g\u00f6re, <em>\u201c Kirac\u0131n\u0131n s\u00f6zle\u015fmenin sona ermesi h\u00e2linde, s\u00f6zle\u015fmeye ayk\u0131r\u0131 kullanmadan do\u011facak zararlar\u0131 giderme d\u0131\u015f\u0131nda, ba\u015fkaca bir tazminat \u00f6deyece\u011fini \u00f6nceden taahh\u00fct etmesine ili\u015fkin anla\u015fmalar <strong>GE\u00c7ERS\u0130ZD\u0130R<\/strong>.\u201d<\/em><\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u0130lgili kanun h\u00fckm\u00fcnden de anla\u015f\u0131laca\u011f\u0131 \u00fczere, kira s\u00f6zle\u015fmesinde \u201cboyal\u0131 al\u0131nd\u0131-boyal\u0131 teslim edilecektir\u201d ibaresinin yer almas\u0131 hi\u00e7bir h\u00fck\u00fcm ifade etmemektedir. Yani kirac\u0131 boya badana yapmakla y\u00fck\u00fcml\u00fc de\u011fildir. Bir ba\u015fka ifade ile, yukar\u0131daki ilk \u00f6rnekte de yer ald\u0131\u011f\u0131 \u00fczere evi boyal\u0131 teslim etmek zorunda de\u011fildir. Burada s\u00f6z konusu eksilmelerin normal kullan\u0131mdan kaynaklanmas\u0131 hususu atlanmamal\u0131d\u0131r. \u00d6rne\u011fin duvarlar\u0131n kas\u0131tl\u0131 olarak \u00e7izilmesi, resimler yap\u0131lmas\u0131 gibi durumlar bu kanun h\u00fckm\u00fcnden ayr\u0131k tutulmakta olup kirac\u0131 bu durumda ta\u015f\u0131nmaz\u0131 eski haline getirerek teslim ile y\u00fck\u00fcml\u00fcd\u00fcr. <\/p>\n\n\n\n<p class=\"has-text-align-justify\">Yarg\u0131tay&#8217;\u0131n emsal nitelikli kararlar\u0131na bak\u0131ld\u0131\u011f\u0131nda kirac\u0131 her ne kadar kiralanan\u0131 kiralad\u0131\u011f\u0131 \u015fekliyle iade etme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc alt\u0131ndaysa da uygulamalar evin boyas\u0131n\u0131n ola\u011fan eskime kapsam\u0131nda oldu\u011fu ve hor kullanma halinin vuku bulmad\u0131\u011f\u0131 hallerde kirac\u0131n\u0131n badana yapma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn olmad\u0131\u011f\u0131 y\u00f6n\u00fcndedir. B\u00f6ylece s\u00f6zle\u015fmelerde dairenin yeniden boyas\u0131n\u0131 yapma borcu kararla\u015ft\u0131r\u0131lm\u0131\u015f olsa bile, kirac\u0131 taraf\u0131ndan k\u00f6t\u00fc kullanma s\u00f6z konusu de\u011filse kirac\u0131 bu bor\u00e7tan sorumlu olmayacakt\u0131r. Yine bu minvalde depozitodan kesinti yap\u0131lmas\u0131 da m\u00fcmk\u00fcn de\u011fildir.  Depozitonun iadesinden imtina edilmesi ya da kesinti yap\u0131labilmesi i\u00e7in, mutlaka dava a\u00e7\u0131lmas\u0131 ve mahkeme karar\u0131 ile tespiti zorunludur.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Ayr\u0131ca ve \u00f6nemle belirtmek gerekir ki, kiralayan ya da ev sahipleri teslim esnas\u0131nda boya yap\u0131lmad\u0131\u011f\u0131 gerek\u00e7esiyle kirac\u0131dan herhangi bir tazminat talebinde bulunamayacak ve yukar\u0131da bahsetti\u011fimiz \u00fczere mahkeme karar\u0131 olmaks\u0131z\u0131n depozitodan da kesinti yapamayacakt\u0131r.&nbsp; B\u00f6ylece ki\u015filerin haklar\u0131n\u0131 bilmesi ve bilin\u00e7li \u015fekilde hareket etmesi olas\u0131 hak kay\u0131plar\u0131n\u0131n da \u00f6n\u00fcne ge\u00e7ecektir.<\/p>\n\n\n\n<p
