{"id":8962,"date":"2023-09-26T12:39:27","date_gmt":"2023-09-26T09:39:27","guid":{"rendered":"https:\/\/www.efeshukuk.com\/?p=8962"},"modified":"2026-04-01T15:39:37","modified_gmt":"2026-04-01T12:39:37","slug":"iscinin-ise-gelmemesi","status":"publish","type":"post","link":"https:\/\/efeshukuk.com\/en\/iscinin-ise-gelmemesi\/","title":{"rendered":"Employee Absence from Work"},"content":{"rendered":"<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"538\" src=\"https:\/\/www.efeshukuk.com\/wp-content\/uploads\/2023\/09\/Markanin-Kullanmama-Sebebi-Ile-Iptali-26-1024x538.webp\" alt=\"\u0130\u015f\u00e7inin \u0130\u015fe Gelmemesi\" class=\"wp-image-8969\" srcset=\"https:\/\/efeshukuk.com\/wp-content\/uploads\/2023\/09\/Markanin-Kullanmama-Sebebi-Ile-Iptali-26-1024x538.webp 1024w, https:\/\/efeshukuk.com\/wp-content\/uploads\/2023\/09\/Markanin-Kullanmama-Sebebi-Ile-Iptali-26-300x158.webp 300w, https:\/\/efeshukuk.com\/wp-content\/uploads\/2023\/09\/Markanin-Kullanmama-Sebebi-Ile-Iptali-26-768x403.webp 768w, https:\/\/efeshukuk.com\/wp-content\/uploads\/2023\/09\/Markanin-Kullanmama-Sebebi-Ile-Iptali-26-18x9.webp 18w, https:\/\/efeshukuk.com\/wp-content\/uploads\/2023\/09\/Markanin-Kullanmama-Sebebi-Ile-Iptali-26.webp 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p><strong>\u0130\u015f\u00e7inin \u0130\u015fe Gelmemesi &#8211; \u0130zmir Avukat<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-justify\">\u0130\u015f\u00e7inin hastalanmas\u0131 ya da kaza ge\u00e7irmesi durumunda doktor taraf\u0131ndan i\u015f\u00e7iye istirahat raporu verilir. \u0130\u015f g\u00f6remezlik belgesi olarak da bilinen bu rapor, doktor taraf\u0131ndan verilse de baz\u0131 yasal s\u0131n\u0131rlamalar\u0131 bulunmaktad\u0131r. <a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuatmetin\/1.5.4857.pdf\">Labor Law |<\/a>\u2019na g\u00f6re i\u015f\u00e7inin sa\u011fl\u0131\u011f\u0131 e\u011fer i\u015f\u00e7inin kast\u0131ndan veya ya\u015fant\u0131s\u0131ndan \u00f6t\u00fcr\u00fc bozulmu\u015f ise bu durumda i\u015fveren i\u015f\u00e7inin i\u015fe gelmemesi nedeniyle i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle feshedebilir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Bilindi\u011fi \u00fczere, 4857 say\u0131l\u0131 \u0130\u015f Kanunu&#8217;nun i\u015fverenin hakl\u0131 nedenle i\u015f s\u00f6zle\u015fmesini feshini d\u00fczenleyen 25. maddesinin II-g. bendinde \u201ci\u015f\u00e7inin i\u015fverenden izin almaks\u0131z\u0131n veya hakl\u0131 bir sebebe dayanmaks\u0131z\u0131n ard\u0131 ard\u0131na iki i\u015fg\u00fcn\u00fc veya bir ay i\u00e7inde iki defa herhangi bir tatil g\u00fcn\u00fcnden sonraki i\u015f g\u00fcn\u00fc yahut bir ayda \u00fc\u00e7 i\u015fg\u00fcn\u00fc i\u015fine devam etmemesi\u201d halinde i\u015fverenin ahlak ve iyi niyet kurallar\u0131na uymayan sebeplerle i\u015f s\u00f6zle\u015fmesini i\u015f\u00e7inin i\u015fe gelmemesi nedeniyle&nbsp; hakl\u0131 nedenle ve derhal feshedebilece\u011fi yer almaktad\u0131r.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Bahsi ge\u00e7en maddede yer alan devams\u0131zl\u0131k i\u015f\u00e7inin, kas\u0131tl\u0131 ya da kusurlu olup olmamas\u0131na bak\u0131lmaks\u0131z\u0131n, i\u015fe gelmesinin beklendi\u011fi i\u015fg\u00fcnlerinde hakl\u0131 bir neden olmaks\u0131z\u0131n ve i\u015fverenden izin almaks\u0131z\u0131n \u201ci\u015fe gelmemesi\u201d \u015feklinde ifade edilebilir. Dolay\u0131s\u0131yla, \u00fccretsiz izin gibi s\u00f6zle\u015fmenin ask\u0131ya al\u0131nd\u0131\u011f\u0131 ve i\u015f\u00e7inin i\u015fe gelmesinin gerekmedi\u011fi di\u011fer t\u00fcm hallerde devams\u0131zl\u0131k olgusu olu\u015fmu\u015f say\u0131lmayacakt\u0131r. Bu ba\u011flamda, i\u015f\u00e7inin devams\u0131zl\u0131\u011f\u0131ndan s\u00f6z edilebilmesi i\u00e7in, i\u015f\u00e7inin i\u015fe gelmesi beklenen s\u00fcrelerde hakl\u0131 bir neden olmaks\u0131z\u0131n ve i\u015fverenden izin almaks\u0131z\u0131n i\u015f\u00e7inin i\u015fe gelmemesi olmas\u0131 gerekmektedir. Aksi halde i\u015f\u00e7inin devams\u0131zl\u0131\u011f\u0131ndan s\u00f6z edilemeyecektir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Konuya ili\u015fkin emsal yarg\u0131 kararlar\u0131nda da, i\u015fverenin, i\u015f\u00e7inin i\u015fe gelmemesi nedeniyle hakl\u0131 nedenle fesih maddesinden yararlanabilmesi i\u00e7in; i\u015f\u00e7inin bir mazereti olup olmad\u0131\u011f\u0131n\u0131 ara\u015ft\u0131rmas\u0131 gerekti\u011fi, i\u015fe d\u00f6nmesi veya mazeretini bildirmesi i\u00e7in i\u015f\u00e7iye bir \u00e7a\u011fr\u0131 yap\u0131lmas\u0131 gerekti\u011fi, ayr\u0131ca devams\u0131zl\u0131k durumunun i\u015fverenin en az iki \u015firket \u00e7al\u0131\u015fan\u0131n\u0131n imzalayaca\u011f\u0131 devams\u0131zl\u0131k tutana\u011f\u0131 ile yaz\u0131l\u0131 \u015fekilde ispatlamas\u0131 gerekti\u011fi y\u00f6n\u00fcndedir.<\/p>\n\n\n\n<p>4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nda i\u015f\u00e7inin i\u015fe devam etmedi\u011fi haller \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Bunlar\u0131 \u015fu \u015fekilde \u00f6rnekleyebiliriz.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u0130\u015f\u00e7inin hastal\u0131k nedeniyle ardarda 3 i\u015f g\u00fcn\u00fc rapor almas\u0131 veya bir ayda ald\u0131\u011f\u0131 raporlar\u0131n toplam 5 i\u015f g\u00fcn\u00fcn\u00fc ge\u00e7mesi (\u0130K 25\/1)<\/li>\n\n\n\n<li>\u0130\u015f\u00e7inin herhangi bir izin almaks\u0131z\u0131n ve hakl\u0131 sebebi olmaks\u0131z\u0131n ardarda 2 i\u015f g\u00fcn\u00fc yahut 1 ay i\u00e7erisinde iki defa herhangi bir tatil g\u00fcn\u00fcnden sonraki i\u015f g\u00fcn\u00fc, yahut bir ay i\u00e7erisinde toplam 3 i\u015f g\u00fcn\u00fc devams\u0131zl\u0131\u011f\u0131 (\u0130K 25\/2-g)<\/li>\n\n\n\n<li>\u0130\u015f\u00e7iyi i\u015fyerinde 1 haftadan fazla s\u00fcre ile \u00e7al\u0131\u015fmaktan al\u0131koyan zorlay\u0131c\u0131 bir sebebin s\u00f6z konusu olmas\u0131 (\u0130K 25\/3)<\/li>\n\n\n\n<li>\u0130\u015f\u00e7i tutukland\u0131\u011f\u0131 veya g\u00f6zalt\u0131na al\u0131nd\u0131\u011f\u0131 zaman bunlardan \u00f6t\u00fcr\u00fc i\u015fe gelememesinin madde 17\u2019de yer alan fesih ihbar s\u00fcrelerini a\u015fmas\u0131 (\u0130K 25\/4)<\/li>\n<\/ul>\n\n\n\n<p class=\"has-text-align-justify\">\u0130\u015f\u00e7inin devams\u0131zl\u0131\u011f\u0131 genel olarak kanunda bu \u015fekilde yer alm\u0131\u015ft\u0131r. Yukar\u0131da belirtilen devams\u0131zl\u0131k hallerinin tamam\u0131 \u0130\u015f Kanunu madde 25\u2019de yer alan, i\u015fverenin hakl\u0131 nedenle i\u015f\u00e7i \u00e7\u0131karma yapabilece\u011fi hallerdir. Yani bu hallerde i\u015f\u00e7inin i\u015fe gelmemesi nedeniyle hakl\u0131 nedenle i\u015ften \u00e7\u0131kar\u0131labilir. \u0130\u015f\u00e7inin i\u015fe gelmemesi nedeniyle i\u015ften \u00e7\u0131kar\u0131lmas\u0131 s\u0131k\u0131 usul kurallar\u0131na tabidir. Uygulamada i\u015f\u00e7inin i\u015fe gelmemesinde usul kurallar\u0131na uyulmamas\u0131 sebebi ile hak kay\u0131plar\u0131na yol a\u00e7\u0131ld\u0131\u011f\u0131 g\u00f6zlemlendi\u011finden bu konudaki genel usul kurallar\u0131n\u0131 a\u015fa\u011f\u0131daki gibi olmal\u0131d\u0131r:<\/p>\n\n\n\n<ol style=\"list-style-type:1\" class=\"wp-block-list\">\n<li>Tutanaklar :&nbsp;\u0130\u015fe gelinmeyen veya i\u015f yerinden izin almadan ayr\u0131l\u0131nan her g\u00fcn i\u00e7in ayr\u0131 tutanak tutulur. Tutanaklara imza atacak olan b\u00f6l\u00fcm m\u00fcd\u00fcrleri sabit olmak kayd\u0131 ile \u015fahitlerin farkl\u0131 ki\u015filer olmas\u0131na dikkat edilmelidir. Bunun m\u00fcmk\u00fcn olmamas\u0131 halinde ancak ayn\u0131 ki\u015filere imza att\u0131r\u0131lmal\u0131d\u0131r.<\/li>\n\n\n\n<li>\u0130htarname :&nbsp;\u0130\u015f\u00e7inin i\u015fverenden izin almaks\u0131z\u0131n veya hakl\u0131 bir sebebe dayanmaks\u0131z\u0131n ard\u0131 ard\u0131na 2 i\u015fg\u00fcn\u00fc i\u015fine devam etmemesi halinde son devams\u0131zl\u0131k g\u00fcn\u00fcnden itibaren 6 i\u015f g\u00fcn\u00fc i\u00e7erisinde \u00f6nce i\u015fe ba\u015flamas\u0131 veya ge\u00e7erli mazeretini bildirmesi i\u015f\u00e7iye i\u00e7in ihtarname g\u00f6nderilir. \u0130htarnamede i\u015f\u00e7iye verilecek olan s\u00fcre genellikle 2-3 i\u015f g\u00fcn\u00fc olur. 6 i\u015f g\u00fcn\u00fcne dikkat etmek gerekir, bu s\u00fcrenin ka\u00e7\u0131r\u0131lmas\u0131 halinde i\u015f\u00e7inin o g\u00fcnlerdeki devams\u0131zl\u0131\u011f\u0131 fesih sebebi olarak kullan\u0131lamaz.<\/li>\n\n\n\n<li>\u0130htarnamenin tebli\u011fi ve s\u00fcreler :&nbsp;\u0130\u015f\u00e7iye i\u015fe davet ve mazeret ihtar\u0131 g\u00f6nderildikten sonra derhal noter ile ileti\u015fime ge\u00e7ip g\u00f6nderilen ihtarnamenin barkod numaras\u0131 al\u0131nmal\u0131 ve en ge\u00e7 3-4 g\u00fcn sonra gonderitakip.ptt.gov.tr adresinden tebligat\u0131n i\u015f\u00e7iye ula\u015f\u0131p ula\u015fmad\u0131\u011f\u0131 kontrol edilmelidir. Tebligat\u0131n i\u015f\u00e7iye tebli\u011f tarihinden itibaren, ihtarnamede i\u015f\u00e7iye verilen 2-3 g\u00fcnl\u00fck s\u00fcre beklenmeli ve bu s\u00fcrede i\u015f\u00e7inin i\u015fe ba\u015flamamas\u0131 veya mazeretini bildirmemesi halinde \u00e7\u0131k\u0131\u015f i\u015flemleri yap\u0131lmal\u0131d\u0131r.<\/li>\n\n\n\n<li>\u00c7\u0131k\u0131\u015f i\u015flemleri :&nbsp;\u0130\u015f\u00e7i verilen s\u00fcreye ra\u011fmen i\u015fe ba\u015flamamas\u0131 veya mazeretini bildirmemesi halinde, i\u015f\u00e7iye&nbsp;verilen s\u00fcrenin sona erdi\u011fi g\u00fcnden itibaren 6 i\u015f g\u00fcn\u00fc i\u00e7erisinde,(\u00d6rne\u011fin i\u015fe ba\u015flama veya mazeret i\u00e7in i\u015f\u00e7iye 2 i\u015f g\u00fcn\u00fc s\u00fcre verildi ise \u00e7\u0131k\u0131\u015f i\u015flemleri en ge\u00e7 2+6=8 i\u015f g\u00fcn\u00fc sonuna kadar yap\u0131lm\u0131\u015f olmas\u0131 gerekmektedir.)<\/li>\n<\/ol>\n\n\n\n<p class=\"has-text-align-justify\"><strong>\u0130lgili Yarg\u0131 Kararlar\u0131<\/strong> : Devams\u0131zl\u0131\u011f\u0131n fesih sebebi olabilmesi i\u00e7in ge\u00e7erli mazerete dayanmamas\u0131 gerekir. \u0130\u015fverenin \u00fccretli ya da \u00fccretsiz olarak izin verdi\u011fi bir i\u015f\u00e7inin izin s\u00fcresince i\u015fyerine gitmesi beklenemeyece\u011finden, bu durumda bir devams\u0131zl\u0131ktan s\u00f6z edilemez. Ancak y\u0131ll\u0131k izin zaman\u0131n\u0131 belirlemek i\u015fverenin y\u00f6netim hakk\u0131 kapsam\u0131nda oldu\u011fundan, i\u015f\u00e7inin kendili\u011finden ayr\u0131lmas\u0131 s\u00f6z konusu olmaz. \u0130\u015f\u00e7inin y\u0131ll\u0131k iznini kulland\u0131\u011f\u0131n\u0131 belirterek i\u015fyerine gelmemesi, i\u015fverence izinli say\u0131lmad\u0131\u011f\u0131 s\u00fcrece devams\u0131zl\u0131k halini olu\u015fturur. ( 9. HD 2007\/ 21656 E. 2008\/ 18647 K)<\/p>\n\n\n\n<p class=\"has-text-align-justify\">\u0130\u015f\u00e7inin i\u015fe gelmemesi her durumda i\u015fverene hakl\u0131 fesih imkan\u0131 vermez. Devams\u0131zl\u0131\u011f\u0131n hakl\u0131 bir nedene dayanmas\u0131 halinde, i\u015fverenin derhal ve hakl\u0131 nedenle fesih imkan\u0131 bulunmamaktad\u0131r. \u0130\u015f\u00e7inin hastal\u0131\u011f\u0131, aile fertlerinden birinin ya da yak\u0131nlar\u0131n\u0131n \u00f6l\u00fcm\u00fc veya hastal\u0131\u011f\u0131, i\u015f\u00e7inin tan\u0131kl\u0131k ve bilirki\u015filik yapmas\u0131 gibi haller, i\u015fe devams\u0131zl\u0131\u011f\u0131 hakl\u0131 k\u0131lan nedenlerdir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Devams\u0131zl\u0131k s\u00fcresi, ard\u0131 ard\u0131na iki i\u015fg\u00fcn\u00fc veya bir ay i\u00e7inde iki defa herhangi bir tatil g\u00fcn\u00fcnden sonraki i\u015f g\u00fcn\u00fc ya da bir ayda \u00fc\u00e7 i\u015fg\u00fcn\u00fc olmad\u0131k\u00e7a, i\u015fverenin hakl\u0131 fesih imkan\u0131 yoktur. Belirtilen i\u015fg\u00fcnlerinde hi\u00e7 \u00e7al\u0131\u015fmam\u0131\u015f olunmas\u0131 gerekir. Devams\u0131zl\u0131k saatlerinin toplanmas\u0131 suretiyle belli bir g\u00fcn say\u0131s\u0131na ula\u015f\u0131lmas\u0131yla i\u015fverenin hakl\u0131 fesih imkan\u0131 do\u011fmaz.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Devams\u0131zl\u0131k, i\u015f\u00e7inin i\u015fine devam etmemesi halidir. \u0130\u015fyerine gitti\u011fi halde i\u015f g\u00f6rme borcunu ifaya hi\u00e7 ba\u015flamayan bir i\u015f\u00e7i devams\u0131zl\u0131kta bulunmu\u015f say\u0131lmamal\u0131d\u0131r. \u0130\u015f\u00e7inin yapmakla y\u00fck\u00fcml\u00fc oldu\u011fu \u00f6devleri hat\u0131rlat\u0131ld\u0131\u011f\u0131 halde yapmamakta \u0131srar etmesi ayr\u0131 bir fesih nedeni olup, bu durumda 4857 say\u0131l\u0131 \u0130\u015f Kanunu&#8217;nun 25\/II-h bendi uyar\u0131nca de\u011ferlendirme yap\u0131lmal\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Maddede ge\u00e7en &#8220;bir ay&#8221; ifadesi takvim ay\u0131n\u0131 de\u011fil ilk devams\u0131zl\u0131ktan sonra ge\u00e7ecek olan bir ay\u0131 ifade eder. \u0130lk devams\u0131zl\u0131\u011f\u0131n yap\u0131ld\u0131\u011f\u0131 g\u00fcn ay\u0131n ka\u00e7\u0131nc\u0131 g\u00fcn\u00fcyse takip eden ay\u0131n ayn\u0131 g\u00fcn\u00fc bir ayl\u0131k s\u00fcre sona erer. Son ayda ilk devams\u0131zl\u0131\u011f\u0131n\u0131n ger\u00e7ekle\u015fti\u011fi g\u00fcn\u00fcn bulunmamas\u0131 halinde son ay\u0131n son g\u00fcn\u00fc bir ayl\u0131k s\u00fcre dolmu\u015f olur. Sonraki devams\u0131zlar s\u00f6z konusu ise takip eden ayl\u0131k d\u00f6nemler i\u00e7inde de\u011ferlendirilir.( 9.HD. 2007\/ 15152 2008\/ 10326)<\/p>\n\n\n\n<p class=\"has-text-align-justify\">\u0130\u015f Kanunu 25\/II-g maddesinde belirtilen tatil g\u00fcn\u00fcnden kas\u0131t sadece resmi tatil g\u00fcnleri de\u011fildir. \u0130\u015f s\u00f6zle\u015fmesi ile kararla\u015ft\u0131r\u0131lm\u0131\u015f tatil g\u00fcnleri de dikkate al\u0131nmal\u0131d\u0131r. \u0130\u015f g\u00fcn\u00fcnden kestedilen de i\u015f\u00e7inin \u00e7al\u0131\u015fmas\u0131 gereken g\u00fcnlerdir. \u0130\u015f\u00e7i hafta tatilini hafta i\u00e7inde bir g\u00fcn kullan\u0131yor, pazar g\u00fcn\u00fc \u00e7al\u0131\u015fmas\u0131 gerekiyorsa o i\u015f\u00e7i i\u00e7in pazar i\u015f g\u00fcn\u00fcd\u00fcr.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Yarg\u0131tay 9. Hukuk Dairesi 2012\/ 23462 E. 2012\/ 37672 K. Say\u0131l\u0131 karar\u0131nda cumartesi yar\u0131m g\u00fcn \u00e7al\u0131\u015f\u0131lan i\u015fyerinde, yar\u0131m g\u00fcn \u00e7al\u0131\u015f\u0131lsa dahi Cumartesinin de i\u015f g\u00fcn\u00fc oldu\u011funu, Cuma ve Cumartesi devams\u0131zl\u0131k yapan i\u015f\u00e7inin ard arda iki g\u00fcn devams\u0131zl\u0131k yapm\u0131\u015f say\u0131laca\u011f\u0131na karar vermi\u015ftir. Devams\u0131zl\u0131k yap\u0131ld\u0131\u011f\u0131n\u0131 ispat etmek i\u015fverene, mazeretin bulundu\u011funu ispatlamak y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc i\u015f\u00e7iye aittir. Devams\u0131zl\u0131k yap\u0131lan her g\u00fcn i\u00e7in ayr\u0131 ayr\u0131 tutanak d\u00fczenlenmelidir.&nbsp;Devams\u0131zl\u0131k yap\u0131lan g\u00fcnler i\u00e7in topluca tek bir tutanak d\u00fczenlenmesi halinde bu tutana\u011fa itibar edilmemektedir. Ayr\u0131ca d\u00fczenlenen tutanaklar\u0131n tan\u0131klarca da do\u011frulanmas\u0131 gerekir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Yap\u0131lan devams\u0131zl\u0131k nedeniyle disiplin cezas\u0131 verilmi\u015f &nbsp;ya da affedilmi\u015f ise, bu devams\u0131zl\u0131k daha sonra yap\u0131lacak fesih i\u00e7in hakl\u0131 neden say\u0131lamaz. \u0130\u015f\u00e7iye m\u00fckerrer ceza verilemez.
