SGK \u00e7\u0131k\u0131\u015f kodu, \u00e7al\u0131\u015fan bireylerin sahip oldu\u011fu haklar ve s\u00f6zle\u015fmelerinin do\u011fru ve ge\u00e7erli nedenlerle feshedilip feshedilmedi\u011fini kesinle\u015ftirir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-sgk-cikis-kodu-neden-onemlidir\">Sgk \u00c7\u0131k\u0131\u015f Kodu Neden \u00d6nemlidir ?<\/h2>\n\n\n\n<p class=\"has-text-align-justify\">SGK \u00c7\u0131k\u0131\u015f kodunun se\u00e7imi s\u0131radan uygulama de\u011fildir. Aksine, hem i\u015fveren hem de i\u015f\u00e7i i\u00e7in \u00f6nemli sonu\u00e7lar\u0131 olan bir i\u015flemdir. \u0130\u015f\u00e7inin k\u0131deme ba\u011fl\u0131 haklar\u0131, fesih sonras\u0131 takip edece\u011fi yol ve i\u015fsizlik \u00f6dene\u011fi al\u0131p alamayaca\u011f\u0131 gibi hususlar do\u011frudan \u00e7\u0131k\u0131\u015f koduyla ilgilidir. Hatal\u0131 bir sgk \u00e7\u0131k\u0131\u015f kodu se\u00e7imi i\u015f\u00e7iyi veya i\u015fvereni ma\u011fdur edebilece\u011fi gibi her iki taraf\u0131 hukuken kar\u015f\u0131 kar\u015f\u0131ya getirebilecektir. Yap\u0131lan yarg\u0131lamada, her ne kadar i\u015fveren taraf\u0131ndan tutulan 01\/04\/2017- 07\/04\/2017 tarihlerini kapsayan devams\u0131zl\u0131k tutanaklar\u0131 dosya kapsam\u0131nda mevcut olsa da, davac\u0131n\u0131n i\u015f akdinin feshi tarihinde \u00e7al\u0131\u015fmakta olan tan\u0131\u011f\u0131n\u0131n davac\u0131n\u0131n \u00e7\u0131kar\u0131ld\u0131\u011f\u0131n\u0131 beyan etmesi ve t\u00fcm dosya kapsam\u0131 de\u011ferlendirildi\u011finde davac\u0131n\u0131n i\u015f akdinin i\u015fveren taraf\u0131ndan yap\u0131lan g\u00f6r\u00fc\u015fmede feshedildi\u011fi, fesihten sonra tutulan devams\u0131zl\u0131k tutanaklar\u0131n\u0131n hukuki bir h\u00fck\u00fcm ve sonu\u00e7 do\u011furmayaca\u011f\u0131, bu durum kar\u015f\u0131s\u0131nda daval\u0131 i\u015fveren taraf\u0131ndan, terk ve devams\u0131zl\u0131k iddias\u0131n\u0131n teredd\u00fcte yer vermeyecek \u015fekilde kesin olarak ispatlanamad\u0131\u011f\u0131 anla\u015f\u0131ld\u0131\u011f\u0131ndan mahkemenin feshin ge\u00e7ersizli\u011finin tespitine ve davac\u0131n\u0131n i\u015fe iadesine karar verilmi\u015ftir (T.C. Somut durumda sadece \u00e7\u0131k\u0131\u015f kodu dikkate al\u0131narak inceleme yap\u0131lmam\u0131\u015f, t\u00fcm olgu ve deliller dikkate al\u0131narak i\u015f\u00e7inin i\u015f g\u00fcvencesi korunmu\u015ftur.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">\u0130\u015fe iade talepli bir ba\u015fka dosyada, davac\u0131 i\u015f\u00e7inin 13\/06\/2018 tarihli yaz\u0131s\u0131 ayn\u0131 tarihte daval\u0131 i\u015fverene ula\u015ft\u0131\u011f\u0131 halde daval\u0131 i\u015fverence SGK\u2019ya 28\/06\/2018 tarihinde i\u015ften ayr\u0131l\u0131\u015f bildirgesinin verildi\u011fi, daval\u0131 i\u015fverence dilek\u00e7enin i\u015fleme konulmam\u0131\u015f olmas\u0131 ve i\u015f\u00e7inin i\u015fyerinde \u00e7al\u0131\u015fmaya devam etmesi halinde ger\u00e7ek bir istifadan s\u00f6z edilemeyece\u011fi, i\u015fverenin bask\u0131s\u0131 ile d\u00fczenlenen istifa dilek\u00e7esine de\u011fer verilemeyece\u011fi, i\u015f s\u00f6zle\u015fmesinin ikale ile feshedilebilmesi i\u00e7in s\u00f6zle\u015fmenin t\u00fcm objektif ve s\u00fcbjektif esasl\u0131 unsurlar\u0131 \u00fczerinde kar\u015f\u0131l\u0131kl\u0131 ve birbirine uygun irade beyanlar\u0131n\u0131n bulunmas\u0131n\u0131n ve ayn\u0131 zamanda i\u015f\u00e7iye \u2018makul yarar\u2019\u0131n sa\u011flanmas\u0131n\u0131n gerekti\u011fi, davac\u0131 i\u015f\u00e7inin 13\/06\/2018 tarihli yaz\u0131s\u0131 ile \u2018k\u0131dem ve ihbar tazminat\u0131m\u0131n \u00f6denmesi kayd\u0131yla\u2019 talebi halinde, ikale teklifi (icap) olsa bile davac\u0131 i\u015f\u00e7i ve daval\u0131 i\u015fverenin i\u015f s\u00f6zle\u015fmesinin t\u00fcm objektif ve subjektif esasl\u0131 unsurlar\u0131 \u00fczerinde kar\u015f\u0131l\u0131kl\u0131 ve birbirine uygun irade beyanlar\u0131 ile k\u0131dem tazminat\u0131 d\u0131\u015f\u0131nda i\u015f\u00e7iye ayr\u0131ca \u2018makul yarar\u2019 sa\u011flanarak i\u015f s\u00f6zle\u015fmesinin feshi konusunda anla\u015fmad\u0131klar\u0131n\u0131n anla\u015f\u0131ld\u0131\u011f\u0131, daval\u0131 i\u015fverence davac\u0131 i\u015f\u00e7inin k\u0131dem ve ihbar tazminat\u0131 hakk\u0131n\u0131n varl\u0131\u011f\u0131 kabul edilerek kuruma 04 kod ile i\u015ften ayr\u0131l\u0131\u015f bildirgesinin verildi\u011fi, i\u015f\u00e7inin istifas\u0131 halinde kuruma 03 kod, bozma s\u00f6zle\u015fmesinin (ikale) varl\u0131\u011f\u0131 halinde kuruma 22 kod (di\u011fer nedenler) ile i\u015ften ayr\u0131l\u0131\u015f bildirgesinin verilmesi gerekti\u011fi, bu durum kar\u015f\u0131s\u0131nda, daval\u0131 i\u015fverence yap\u0131lan feshin ge\u00e7ersiz oldu\u011fu ve i\u015f\u00e7inin i\u015fe iadesinin gerekti\u011fi belirtilmi\u015ftir (Sakarya BAM, 10. HD., E. 2019\/1846 K. 2020\/857 T. 23.9.2020).<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Yarg\u0131tay 22. Hukuk Dairesi\u2019nin bir karar\u0131nda, i\u015f\u00e7inin vefat\u0131ndan sonra yasal miras\u00e7\u0131lar\u0131 taraf\u0131ndan k\u0131dem tazminat\u0131 talepli a\u00e7\u0131lan i\u015f\u00e7ilik alaca\u011f\u0131 davas\u0131nda, i\u015fveren taraf\u0131ndan murise ait iki adet \u00e7\u0131k\u0131\u015f bildirgesinin verildi\u011fi, 27.05.2015 tarihli bildirgede i\u015ften \u00e7\u0131k\u0131\u015f kodunun 10 (\u00f6l\u00fcm), \u00e7\u0131k\u0131\u015f tarihinin ise 23.07.2015 olarak g\u00f6sterildi\u011fi, ikinci \u00e7\u0131k\u0131\u015f bildirgesinde ise bildirimin 01.08.2015 tarihinde verildi\u011fi, i\u015ften \u00e7\u0131k\u0131\u015f kodunun 29 (ahlak ve iyi niyet kurallar\u0131na ayk\u0131r\u0131l\u0131k) olarak, \u00e7\u0131k\u0131\u015f tarihinin de 23.07.2015 tarihi olarak belirtildi\u011fi, murisin i\u015f yerinde ba\u015fka bir \u00e7al\u0131\u015fanla g\u00f6n\u00fcl ili\u015fkisi i\u00e7inde oldu\u011fu ve bu durumun i\u015f yerinde huzursuzluk \u00e7\u0131kartt\u0131\u011f\u0131na ili\u015fkin tutana\u011f\u0131n ise 10.07.2015 tarihinde tutuldu\u011funun tespit edildi\u011fi, murise ait \u00f6l\u00fcm belgesi ve veraset ilam\u0131nda ise i\u015f\u00e7inin \u00f6l\u00fcm tarihinin 23.07.2015 oldu\u011fu anla\u015f\u0131ld\u0131\u011f\u0131 belirtilerek t\u00fcm bu kay\u0131tlar \u0131\u015f\u0131\u011f\u0131nda her ne kadar muris hakk\u0131nda i\u015f yerinde ya\u015fad\u0131\u011f\u0131 g\u00f6n\u00fcl ili\u015fkisi sebebi ile bir soru\u015fturma y\u00fcr\u00fct\u00fclmekte ise de s\u00f6z konusu soru\u015fturma bitirilmeden murisin \u00f6ld\u00fc\u011f\u00fc ve s\u00f6zle\u015fmenin \u00f6l\u00fcm ile son buldu\u011fu kanaatine var\u0131lmas\u0131ndan hareketle davac\u0131lar\u0131n k\u0131dem tazminat\u0131 talebinin kabul\u00fc gerekti\u011fine karar verilmi\u015ftir (Yarg\u0131tay Karar\u0131 \u2013 22.
