On y\u0131ll\u0131k uzama s\u00fcresi sonunda kiraya veren, bu s\u00fcreyi izleyen her uzama y\u0131l\u0131n\u0131n bitiminden en az \u00fc\u00e7 ay \u00f6nce bildirimde bulunmak ko\u015fuluyla, herhangi bir sebep g\u00f6stermeksizin  On y\u0131ll\u0131k kirac\u0131n\u0131n tahliyesi ger\u00e7ekle\u015ftirilerek s\u00f6zle\u015fmeye son verebilir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-fesih-bildirimi\">Fesih Bildirimi<\/h3>\n\n\n\n<p class=\"has-text-align-justify\">On y\u0131ll\u0131k kirac\u0131n\u0131n tahliyesi&nbsp;i\u015flemi i\u00e7in kiraya verenin fesih bildirimini yaz\u0131l\u0131 olarak yapmas\u0131 gerekir. Yaz\u0131l\u0131 bi\u00e7imde yap\u0131lmayan fesih bildirimlerinin hukuki bir de\u011fere sahip olmamas\u0131 nedeni ile ge\u00e7erlili\u011fi de s\u00f6z konusu olmayacakt\u0131r. Fesih bildirimi haz\u0131rlan\u0131rken kanunda belirlenen \u015fekle uygunlu\u011fu \u00f6nem ta\u015f\u0131r. ihtarnamenin i\u00e7erik a\u00e7\u0131s\u0131ndan amac\u0131na uygun olarak haz\u0131rlanmas\u0131 gerekirken kirac\u0131n\u0131n kiralanandan \u00e7\u0131kmas\u0131 i\u00e7in g\u00f6nderildi\u011fi a\u00e7\u0131k ve anla\u015f\u0131l\u0131r bi\u00e7imde ifade edilmelidir. On y\u0131ll\u0131k kirac\u0131n\u0131n tahliyesi&nbsp;i\u00e7in g\u00f6nderilecek ihtarnamede yer almas\u0131 gerekenler aras\u0131nda kirac\u0131n\u0131n kiralanan\u0131 tahliye etmemesi durumunda hukuk yoluna ba\u015fvurulaca\u011f\u0131 da bulunur. Bu durumda tahliye davas\u0131 a\u00e7\u0131lmak sureti ile kiralayan\u0131n yasal haklar\u0131n\u0131 kullanabilece\u011fi a\u00e7\u0131k bir \u015fekilde ifade edilmelidir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Kiralayan, kirac\u0131s\u0131na on y\u0131ll\u0131k uzama s\u00fcresinin dolmas\u0131 ile ilgili olarak tahliye i\u015flemi yapmak istedi\u011finde resmi bir ihtarname g\u00f6ndermelidir. Noter kanal\u0131 ile g\u00f6nderilmi\u015f bir belgenin hukuki de\u011fere haiz olmas\u0131 nedeni ile bu yolla bildirim yap\u0131lmas\u0131 \u00f6nerilir. Noter kanal\u0131 ile g\u00f6nderilen ihtarnameler hukuki a\u00e7\u0131dan ispat \u00f6zelli\u011fi ta\u015f\u0131malar\u0131 sebebi ile kabul g\u00f6r\u00fcr. On y\u0131ll\u0131k kirac\u0131n\u0131n tahliyesi\u00a0i\u015flemi yap\u0131lmak isteniyorsa kiraya veren yaz\u0131l\u0131 bir tebligat yapmal\u0131d\u0131r. S\u00f6zle\u015fmenin bitmesine en ge\u00e7 \u00fc\u00e7 ay kala yap\u0131lmas\u0131 gereken bu tebligat s\u00f6zl\u00fc olarak beyan edildi\u011finde hukuki de\u011fer ta\u015f\u0131maz. Bu sebeple \u015fekil \u015fart\u0131na uygunlu\u011fun yan\u0131 s\u0131ra do\u011fru zamanda yap\u0131lmas\u0131 da fesih bildiriminin ge\u00e7erlili\u011fini destekleyici bir unsurdur.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">(<a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuatmetin\/1.5.6098.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Turkish Code of Obligations<\/a> Article 347) &quot;...In this case, the landlord does not need to give any reason for termination. The eviction notice must be given at least three months before the end of the lease agreement.&quot;\u2018<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-sozlesmenin-fesih-suresi-baslangici\">S\u00f6zle\u015fmenin Fesih S\u00fcresi Ba\u015flang\u0131c\u0131<\/h3>\n\n\n\n<p class=\"has-text-align-justify\">On y\u0131ll\u0131k uzama s\u00fcresi&nbsp;sonunda&nbsp;kirac\u0131n\u0131n tahliyesinde dikkat edilmesi gereken husus, kira s\u00f6zle\u015fmesinin ba\u015flang\u0131\u00e7 tarihi \u00fczerinden ge\u00e7mesi gereken s\u00fcrenin hesab\u0131d\u0131r. Kanun, belirli s\u00fcreli kira s\u00f6zle\u015fmelerinde&nbsp;on y\u0131ll\u0131k s\u00fcrenin ba\u015flang\u0131c\u0131nda, kira s\u00f6zle\u015fmesinin ba\u015flang\u0131\u00e7 tarihini esas almam\u0131\u015ft\u0131r. D\u00fczenlemeye g\u00f6re, kira s\u00f6zle\u015fmesinin&nbsp;on y\u0131l&nbsp;uzam\u0131\u015f olmas\u0131 gerekmekte ve bundan sonraki her y\u0131l i\u00e7in s\u00f6zle\u015fmeyi sonland\u0131rma hakk\u0131 olmaktad\u0131r. Bu durumda, kira s\u00f6zle\u015fmesinin ilk y\u0131l\u0131 hesaba kat\u0131lmayacakt\u0131r. S\u00f6zle\u015fmenin uzama s\u00fcresi, ikinci y\u0131l\u0131n ba\u015f\u0131nda ba\u015flam\u0131\u015f olacakt\u0131r. <strong>Kira s\u00f6zle\u015fmesinin ba\u015flang\u0131c\u0131ndan itibaren toplamda on bir y\u0131l ge\u00e7tikten sonra, kiraya veren bildirim ko\u015fuluna uymak \u015fart\u0131yla ancak&nbsp;on ikinci y\u0131l\u0131n sonunda kirac\u0131n\u0131n bu yolla tahliyesini&nbsp;talep edebilecektir.<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-on-yillik-kiracinin-tahliyesi-sureci-ve-sartlari\">On Y\u0131ll\u0131k Kirac\u0131n\u0131n Tahliyesi S\u00fcreci ve \u015eartlar\u0131<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>S\u00fcre Hesab\u0131:<\/strong>&nbsp;\u0130lk s\u00f6zle\u015fme s\u00fcresinin (\u00f6rne\u011fin 1 y\u0131l) bitiminden itibaren 10 y\u0131l daha uzam\u0131\u015f olmas\u0131 gerekir (toplam 11. y\u0131l\u0131n sonu).<\/li>\n\n\n\n<li><strong>\u0130htarname \u015eart\u0131:<\/strong>&nbsp;Uzama y\u0131l\u0131n\u0131n bitiminden&nbsp;en az 3 ay \u00f6nce&nbsp;noterden yaz\u0131l\u0131 fesih bildirimi g\u00f6nderilmelidir. Bu ihtarname, kirac\u0131ya s\u00f6zle\u015fmeyi yenilemeyece\u011finizi bildirir.<\/li>\n\n\n\n<li><strong>Gerek\u00e7e G\u00f6stermeme:<\/strong>&nbsp;10 y\u0131l dolduktan sonra, ev sahibinin ihtiyac\u0131 veya ba\u015fka bir sebep g\u00f6stermesine gerek kalmaks\u0131z\u0131n tahliye talep edilebilir.<\/li>\n\n\n\n<li><strong>Dava A\u00e7ma:<\/strong>&nbsp;\u0130htarnameye ra\u011fmen \u00e7\u0131kmayan kirac\u0131ya kar\u015f\u0131, yeni kira d\u00f6nemi i\u00e7inde tahliye davas\u0131 a\u00e7\u0131lmal\u0131d\u0131r<\/li>\n<\/ul>\n\n\n\n<p class=\"has-text-align-justify\">In indefinite-term lease agreements, the law takes the commencement date of the lease relationship as the basis. In this case, from the start of the lease...<strong>&nbsp;<\/strong>on y\u0131l&nbsp;ge\u00e7tikten sonra, \u00fc\u00e7 ay \u00f6nceden bildirimde bulunmak kayd\u0131yla, kiralaya veren&nbsp;kirac\u0131n\u0131n tahliyesini isteyebilir. A\u00e7\u0131lacak tahliye davalar\u0131nda g\u00f6revli mahkeme Sulh Hukuk Mahkemesidir. Bu t\u00fcr tahliye davalar\u0131 i\u00e7in yetkili mahkeme ise kiralanan ta\u015f\u0131nmaz\u0131n oldu\u011fu yer mahkemeleridir. Tahliye davas\u0131 s\u00f6z konusu oldu\u011funda kiraya verenin hukuki a\u00e7\u0131dan istenilen sonuca k\u0131sa s\u00fcrede ula\u015fabilmesi i\u00e7in i\u015flemlerinin yasal yollarla yap\u0131lm\u0131\u015f olmas\u0131 \u00f6nem ta\u015f\u0131r. Bu durumda da kirac\u0131ya yap\u0131lacak fesih bildirimlerinde \u015fekil \u015fart\u0131na uygunlu\u011fun yan\u0131 s\u0131ra fesih bildirimi s\u00f6zl\u00fc olarak yap\u0131lmamal\u0131 ve noter kanal\u0131 ile bu belge kirac\u0131ya iletilmelidir. On y\u0131ll\u0131k kirac\u0131n\u0131n tahliyesi&nbsp;i\u015flemleri i\u00e7in dava a\u00e7\u0131lmas\u0131 gerekti\u011finde fesih bildirimi g\u00f6nderilirken s\u00f6zle\u015fme s\u00fcrelerinin do\u011fru hesaplanmas\u0131 da ayr\u0131 bir \u00f6nem ta\u015f\u0131yacakt\u0131r. Bu t\u00fcr davalarda hukuki destek al\u0131nmas\u0131 taraflar\u0131n haklar\u0131n\u0131n korunabilmesi a\u00e7\u0131s\u0131ndan \u00f6nem ta\u015f\u0131r.<\/p>\n\n\n\n<p><mark
