Bu \u00e7er\u00e7evede yukar\u0131da an\u0131msatt\u0131\u011f\u0131m\u0131z olaydaki gibi y\u00fcksek tazminat bedelleri ile uygulamada kar\u015f\u0131la\u015fmamaktay\u0131z.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Manevi Tazminat Nedir?<\/h2>\n\n\n\n<p class=\"has-text-align-justify\">T\u00fcrk Dil Kurumu manevi kavram\u0131n\u0131 \u201cg\u00f6r\u00fclmeyen, duyularla sezilebilen, ruhani, tinsel, maddi kar\u015f\u0131t\u0131\u201d olarak tan\u0131mlamaktad\u0131r. Manevi tazminat, haks\u0131z bir olay ile kar\u015f\u0131la\u015fan ki\u015finin u\u011fram\u0131\u015f oldu\u011fu maddi kay\u0131plar (sa\u011fl\u0131k giderleri veya i\u015ften yoksun kalma sebebi ile gelirde ya\u015fanan eksiklikler gibi) haricinde, olay\u0131n ki\u015fide yaratt\u0131\u011f\u0131 elem, keder, \u00fcz\u00fcnt\u00fc veya ya\u015fam sevincini kaybetme sonucu meydana gelen zararlar\u0131n kar\u015f\u0131l\u0131\u011f\u0131 olarak \u00f6denmesi gereken tazminat bedeli olarak tan\u0131mlanabilir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\"><a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.6098-20120704.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Turkish Code of Obligations<\/a> Madde 56 kapsam\u0131nda, ki\u015filerin manevi tazminat talebinde bulunabilece\u011fi ifade edilmi\u015f olup; ilgili madde <em>\u201cH\u00e2kim, bir kimsenin bedensel b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fcn zedelenmesi durumunda, olay\u0131n \u00f6zelliklerini g\u00f6z \u00f6n\u00fcnde tutarak, zarar g\u00f6rene uygun bir miktar paran\u0131n manevi tazminat olarak \u00f6denmesine karar verebilir. A\u011f\u0131r bedensel zarar veya \u00f6l\u00fcm h\u00e2linde, zarar g\u00f6renin veya \u00f6lenin yak\u0131nlar\u0131na da manevi tazminat olarak uygun bir miktar paran\u0131n \u00f6denmesine karar verilebilir.\u201d \u015feklinde d\u00fczenlenmi\u015ftir.<\/em><\/p>\n\n\n\n<p class=\"has-text-align-justify\">Manevi&nbsp;tazminat, zarara u\u011frayan ki\u015fide bir nebze de olsa&nbsp;manevi&nbsp;huzuru do\u011furmay\u0131 ama\u00e7lamaktad\u0131r. Hukuk sistemimizde manevi tazminat niteli\u011fi itibari ile bir ceza olmad\u0131\u011f\u0131 gibi para ile \u00f6l\u00e7\u00fclebilen <strong><em>maddi<\/em><\/strong> zararlar\u0131n kar\u015f\u0131lanmas\u0131na ili\u015fkin bir bedel de de\u011fildir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Manevi tazminat niteli\u011fi itibariyle tek olup; b\u00f6l\u00fcnmesi s\u00f6z konusu de\u011fildir. Dolay\u0131s\u0131yla, mahkeme nezdinde a\u00e7\u0131lacak manevi tazminat taleplerinde k\u0131smi dava s\u00f6z konusu olmayacak ve ilk davada manevi tazminat\u0131n bir k\u0131sm\u0131 talep edilerek fazlaya ili\u015fkin b\u00f6l\u00fcm\u00fc sakl\u0131 tutulamayacakt\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Uygulamada Manevi Tazminat<\/h2>\n\n\n\n<p class=\"has-text-align-justify\">Uygulamada manevi tazminat davas\u0131n\u0131n; ki\u015finin bir su\u00e7a maruz kalmas\u0131, kar\u015f\u0131 taraf\u0131n s\u00f6zle\u015fmeye ayk\u0131r\u0131 hareketleri, ki\u015finin trafik kazas\u0131 gibi durumlarda beden b\u00fct\u00fcnl\u00fc\u011f\u00fcnde meydana gelen zarar sebebi ile veya ki\u015filik haklar\u0131na y\u00f6nelik yap\u0131lan sald\u0131r\u0131lar neticesinde a\u00e7\u0131ld\u0131\u011f\u0131n\u0131 g\u00f6rmekteyiz.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Manevi tazminat ile ama\u00e7lanan \u015fey, zarar g\u00f6ren ki\u015finin u\u011fram\u0131\u015f oldu\u011fu psikolojik s\u0131k\u0131nt\u0131lar\u0131n denkle\u015ftirilmesidir. Burada psikolojik s\u0131k\u0131nt\u0131lar veya zarar g\u00f6ren ki\u015filik haklar\u0131, rakamlar ile g\u00f6sterilmek i\u00e7in \u00e7ok soyut kavramlar olmas\u0131 sebebi ile mahkeme kararlar\u0131nda da s\u0131kl\u0131kla farkl\u0131l\u0131klar g\u00f6r\u00fclmektedir. Yasal mevzuat\u0131m\u0131zda veya uygulamada manevi tazminat\u0131n hesaplamas\u0131n kullan\u0131lmas\u0131 gereken kesin kurallar\u0131 olmad\u0131\u011f\u0131 gibi bu do\u011frultuda dikkate al\u0131nmas\u0131 gereken g\u00f6r\u00fc\u015f birli\u011fine var\u0131lm\u0131\u015f somut kriterlerin dahi bulunmamaktad\u0131r. Mahkemeler benzer olaylar i\u00e7in \u00e7ok farkl\u0131 tazminatlara karar verebilmekte ve hemen hemen hepsi de 22.6.1966 tarihli Yarg\u0131tay \u0130\u00e7tihad\u0131 Birle\u015ftirme karar\u0131na at\u0131f yapmaktad\u0131r. Maalesef, elli y\u0131l\u0131 a\u015fan s\u00f6z konusu karar\u0131n manevi tazminat hesaplanmas\u0131 s\u00fcre\u00e7lerinde g\u00fcncelli\u011fini yitirmi\u015f oldu\u011fu d\u00fc\u015f\u00fcncesindeyiz. &nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How is moral damage calculated?<\/h2>\n\n\n\n<p class=\"has-text-align-justify\">Eski tarihli bor\u00e7lar kanunumuz ile h\u00e2kimin manevi tazminat\u0131 belirlerken ki\u015filerin unvan\u0131, i\u015fi ve di\u011fer sosyal ve ekonomik durumlar\u0131n\u0131 g\u00f6zetilmesi gerekti\u011fini belirtmekte ise de g\u00fcncel kanunumuzda bu kriterlere yer verilmemi\u015ftir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">G\u00fcncel yasal mevzuat\u0131m\u0131zda manevi tazminat i\u00e7in a\u00e7\u0131k\u00e7a \u00f6denmesi gereken miktar\u0131 veya bunun nas\u0131l hesaplanaca\u011f\u0131n\u0131 belirtmemi\u015f, bu bedelin olay\u0131n niteli\u011fine g\u00f6re h\u00e2kim taraf\u0131ndan belirlenmesi gerekti\u011fi ifade edilmi\u015ftir. Burada manevi&nbsp;tazminat\u0131n tutar\u0131n\u0131 belirleme g\u00f6revi h\u00e2kimin takdirine b\u0131rak\u0131lm\u0131\u015f ise de h\u00fckmedilen tutar\u0131n u\u011fran\u0131lan&nbsp;manevi zararla orant\u0131l\u0131, duyulan \u00fcz\u00fcnt\u00fcy\u00fc hafifletici olmas\u0131 gerekmektedir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">H\u00e2kim takdir hakk\u0131n\u0131 kullan\u0131rken, \u00fclkenin ekonomik ko\u015fullar\u0131, taraflar\u0131n sosyal ve ekonomik durumlar\u0131, paran\u0131n sat\u0131n alma g\u00fcc\u00fc, taraflar\u0131n kusur durumu,&nbsp;manevi&nbsp;zarara neden olan olay\u0131n a\u011f\u0131rl\u0131\u011f\u0131 gibi \u00f6zellikleri g\u00f6z \u00f6n\u00fcnde tutmas\u0131 ve makul bir oranda&nbsp;manevi&nbsp;tazminat&nbsp;takdir edilmesi gerekmektedir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Tazminat miktar\u0131n\u0131n belirlenmesinde hakimlerin s\u0131kl\u0131kla somut olay ve emsal karar kar\u015f\u0131la\u015ft\u0131r\u0131lmas\u0131 y\u00f6netime ba\u015fvurmakta oldu\u011fu g\u00f6r\u00fclmektedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Manevi tazminat ne zaman talep edilebilir?<\/h2>\n\n\n\n<p class=\"has-text-align-justify\">Manevi tazminat davalar\u0131na ili\u015fkin zamana\u015f\u0131m\u0131 s\u00fcreleri a\u00e7\u0131lacak davan\u0131n ve haks\u0131z fiilin niteli\u011fine g\u00f6re de\u011fi\u015fiklik g\u00f6sterebilmektedir. U\u011fran\u0131lan bir haks\u0131z fiil sebebi ile a\u00e7\u0131lacak manevi tazminat davalar\u0131nda zarar g\u00f6ren ki\u015finin zarar\u0131 ve zarar veren ki\u015fiyi \u00f6\u011frenmesinden itibaren iki y\u0131l, herhalde ise on y\u0131l i\u00e7inde davan\u0131n a\u00e7\u0131lmas\u0131 gerekmektedir. \u0130\u015flenen bir su\u00e7 sebebi ile meydana gelen manevi zararlar\u0131n tazmini i\u00e7in bir dava a\u00e7\u0131lacak ise burada su\u00e7un dava zamana\u015f\u0131m\u0131na bak\u0131lmas\u0131 gerekecektir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">22.6.1966\u00a0tarih ve 1966\/7-7 Say\u0131l\u0131 Yarg\u0131tay \u0130\u00e7tihad\u0131 Birle\u015ftirme Karar\u0131<\/h2>\n\n\n\n<p>\u0130stihdam edilenin eylemi ile i\u015fin yap\u0131lmas\u0131 s\u0131ras\u0131nda bedence zarara u\u011frayan ki\u015finin veya \u00f6lenin ailesinin, istihdam edenden manevi tazminat isteyebilip isteyemeyece\u011fi, isteyebilmesi halinde m\u00fcstahdemin kusurunun aran\u0131p aranmayaca\u011f\u0131, m\u00fcstahdemin kusuru aranacaksa, B.K.nun 47. maddesindeki hususi haller deyiminin a\u011f\u0131r kusur anlam\u0131nda uygulan\u0131p uygulanmayaca\u011f\u0131, kusurun a\u011f\u0131rl\u0131\u011f\u0131 s\u00f6z\u00fcn\u00fcn kapsam\u0131, hafif kusur halinde sorumlu tutulup tutulmayaca\u011f\u0131 konular\u0131nda daire kararlar\u0131 aras\u0131nda i\u00e7tihat ihtilaf\u0131 bulundu\u011fundan bahisle ihtilaf\u0131n, i\u00e7tihad\u0131 birle\u015ftirme yolu ile giderilmesi 4. Hukuk Dairesi Ba\u015fkanl\u0131\u011f\u0131nca 1. Ba\u015fkanl\u0131\u011fa g\u00f6nderilen 24.4.1966 tarih ve 131 say\u0131l\u0131 yaz\u0131 ile istenilmesi \u00fczerine, keyfiyet hukuk k\u0131sm\u0131 \u0130\u00e7tihad\u0131 Birle\u015ftirme Genel Kurulunda incelenip g\u00f6r\u00fc\u015f\u00fcld\u00fc:<\/p>\n\n\n\n<p>Daire kararlar\u0131 aras\u0131nda, istihdam edilen Bor\u00e7lar Kanunun 47. maddesi gere\u011fince manevi tazminatla sorumlu tutulabilmesi i\u00e7in bu h\u00fckm\u00fcn uygulama \u015fartlar\u0131nda, \u00f6zellikle m\u00fcstahdemin a\u011f\u0131r kusurunun aran\u0131p aranmamas\u0131 konusunda ve zarar g\u00f6renin olaya birlikte sebebiyet verme nispetinin tazminat istenemeyece\u011fi gibi, ayn\u0131 kanunun 47. maddesinin de ancak fail hakk\u0131nda uygulanabilip, istihdam edene bu madde gere\u011fince manevi tazminat y\u00fckletilemeyece\u011fi d\u00fc\u015f\u00fcncesi ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n\n\n\n<p>Bor\u00e7lar Kanununun 47. maddesi, haks\u0131z eylemden do\u011fan \u00f6l\u00fcm veya cismani zarar olaylar\u0131nda, mesnedi ister kendi hareketi, isterse ba\u015fkas\u0131n\u0131n hareketi olsun b\u00fct\u00fcn maddi sorumluluk hallerinde uygulanabilecek bir h\u00fck\u00fcm oldu\u011fu i\u00e7in bu d\u00fc\u015f\u00fcnce, \u00fc\u00e7 muhalif oya kar\u015f\u0131 b\u00fcy\u00fck \u00e7o\u011funluk taraf\u0131ndan kabule de\u011fer g\u00f6r\u00fclmemi\u015ftir.<\/p>\n\n\n\n<p>II-Filhakika s\u00f6z\u00fc ge\u00e7en 47. madde gere\u011fince, hakim hususi halleri nazara alarak cismani zarara du\u00e7ar olan kimseye yahut adam \u00f6ld\u00fc\u011f\u00fc takdirde \u00f6l\u00fcn\u00fcn ailesine manevi zarar namiyle adalete muvaf\u0131k tazminat verilmesine karar verebilir.<\/p>\n\n\n\n<p>G\u00f6r\u00fc\u015fmeler s\u0131ras\u0131nda beyan edilen bir fikre g\u00f6re, 47. madde kusura dayanan bir sorumluluk vazeden 41. maddeden sonra gelen maddeler aras\u0131nda yer ald\u0131\u011f\u0131ndan ve kusursuz sorumluluk hallerini derpi\u015f eden 55,56 ve 58. maddeler meyan\u0131nda bulunmad\u0131\u011f\u0131ndan kanundaki yeri itibariyle kusura istinat eden bir h\u00fck\u00fcm oldu\u011fu gibi, madde metnindeki &#8220;hususi haler&#8221; i\u00e7inde nazara al\u0131nmas\u0131 gereken 1. amilin de kusur oldu\u011fu tabi bulundu\u011fundan 47. madde mucibince manevi tazminata h\u00fckmedebilmek i\u00e7in tazminat\u0131n miktar\u0131na tesir edebilece\u011fini ileri s\u00fcrm\u00fc\u015flerdir.<\/p>\n\n\n\n<p>G\u00f6r\u00fc\u015fmelere kat\u0131lanlar\u0131n \u00e7o\u011funlu\u011fu bu d\u00fc\u015f\u00fcnceye i\u015ftirak etmemi\u015f ve istihdam edenin 47. madde gere\u011fince manevi tazminatla sorumlu tutulaca\u011f\u0131 kabul edildi\u011fi i\u00e7in, bu maddenin uygulama \u015fartlar\u0131 \u00fczerinde durulmu\u015f ve 47. maddenin kusura veya kusursuzlu\u011fa dayanan bir h\u00fck\u00fcm olmad\u0131\u011f\u0131 sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>a) \u0130\u015fvi\u00e7re Bor\u00e7lar Kanunun 1881 tarihli metninde, hususi hal ve \u015fartlar olarak kas\u0131t ve a\u011f\u0131r ihmal zikredilmi\u015fti. 1911 y\u0131l\u0131ndaki tadilde &#8220;Kas\u0131t ve a\u011f\u0131r ihmal&#8221; tabirleri, 47. madde metnine al\u0131nmayarak \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r. (Becker, 41. madde \u015ferhi, No. 5; Oser &#8211; Seh\u00fcnenberger, 47. madde \u015ferhi, No. 1.). Bu maddeye tekab\u00fcl eden eski, 54. maddenin mer&#8217;i oldu\u011fu zamanda dahi, uygulamada kas\u0131t ve a\u011f\u0131r ihmal bir misal olarak telakki edilmi\u015f ve bundan dolay\u0131 manevi tazminata h\u00fckmedilmesi, hafif kusur hallerinde bile imkan dahiline girmi\u015fti. (Becker, M. 47, No. 5).<\/p>\n\n\n\n<p>b) Esasen isabetli bir neticeye vas\u0131l olabilmek i\u00e7in 47. madde metni incelenirce, bu h\u00fckm\u00fcn uygulama \u015fartlar\u0131 aras\u0131nda kusurun da bulundu\u011funu g\u00f6steren herhangi bir ibareye tesad\u00fcf edilmez. \u0130svi\u00e7re metnine g\u00f6re, bir kimsenin \u00f6ld\u00fcr\u00fclmesinde veya cismani zarara u\u011frat\u0131lmas\u0131nda hakim, \u00f6zel hal ve \u015fartlar\u0131 takdir ederek, mutazarr\u0131na veya \u00f6ld\u00fcr\u00fclenin yak\u0131nlar\u0131na uygun bir paran\u0131n manevi tazminat olarak \u00f6denmesine h\u00fckmedebilir (Oser- Sch\u00f6nenberger, Recai Se\u00e7kin Terc\u00fcmesi; Becker Kemal Reiso\u011flu Terc\u00fcmesi).<\/p>\n\n\n\n<p>Metindeki &#8220;\u00f6zel hal ve \u015fartlar&#8221;dan maksat, kendine mahsus yani olaya has hal ve \u015fartlar, bir ba\u015fka olay\u0131n \u00f6zellikleri-hususiyetleri-dir.<\/p>\n\n\n\n<p>c) Her ne kadar g\u00f6r\u00fc\u015fmelerde az\u0131nl\u0131kta kalan noktai nazara mesnet yap\u0131lan V. Turh&#8217;un Bor\u00e7lar Hukuku adl\u0131 eserinin T\u00fcrk\u00e7e terc\u00fcmesinde &#8220;Kusurun fevkalade a\u011f\u0131r bulunmas\u0131 halinde, i\u015f sahibi manevi zarar namiyle bir tazminat \u00f6demeye de mahkum edilebilir&#8221; denmekte ise de (C. Edege Terc\u00fcmesi, Sah. 422-423), V. Tuhr- Siegwart. ikinci bas\u0131 Almanca metninde bu c\u00fcmle, &#8220;kusurun \u00f6zel a\u011f\u0131rl\u0131\u011f\u0131 istihdam edeni 49. madde g\u00f6re\u011fince manevi tazminatla sorumlu k\u0131labilir&#8221; \u015feklinde ifade edilmi\u015f bulunmakta (Sah. 382-383) ve ayn\u0131 eserin manevi tazminat ba\u015fl\u0131kl\u0131 paragraf\u0131nda da &#8220;bir manevi tazminat hakk\u0131 49. maddedeki genel h\u00fckme g\u00f6re, kanun ba\u015fka t\u00fcrl\u00fc d\u00fczenlenmemi\u015fse (Not 4 a: mesela, 47. maddede b\u00f6yledir. Federal Mahkeme bu h\u00fckm\u00fcnden, kusur olmadan bir \u00f6l\u00fcm veya cismani zarardan sorumlu olana, manevi tazminat tahmil edilmesinin gayri m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 sonucunu \u00e7\u0131kar\u0131yor) yaln\u0131z zarar\u0131n ve kusurun \u00f6zel a\u011f\u0131rl\u0131\u011f\u0131 hakl\u0131 k\u0131larsa husul bulur&#8221; denmektedir. (sah.117).<\/p>\n\n\n\n<p>\u0130svi\u00e7re&#8217;de yay\u0131nlanm\u0131\u015f eserlerden Oser-Sch\u00fcnenbegerin Bor\u00e7lar Hukukunda &#8220;\u00f6l\u00fcm\u00fcn veya cismani zarar\u0131n vukuunda kusuru bulunan, 47. madde gere\u011fince manevi tazminatla sorumludur, fakat kusur nazara al\u0131nmaks\u0131z\u0131n bir eylemin sonucunu tekabb\u00fcl etmeye mecbur olan dahi, manevi tazminatla m\u00fcvekelleftir, zira zarar\u0131n tazminine ili\u015fkin h\u00fck\u00fcmler burada da k\u0131yasen uygulama yeri bulur. \u015e\u00fcphesiz kusurun bulunmad\u0131\u011f\u0131 durumlarda hakimin takdir hakk\u0131, ancak \u00f6zel hal ve \u015fartlar alt\u0131nda manevi tazminata h\u00fckmedilmesine imkan verir&#8221; (madde 47, No. 10) dendi\u011fi gibi, H. Becker dahi Bor\u00e7lar Hukuku adl\u0131 eserinde 47. maddeye konu olan manevi tazminat\u0131n \u015fartlar\u0131n\u0131 anlat\u0131rken, &#8220;adam \u00f6ld\u00fcrmenin veya cismani zarar\u0131n kusurlu surette yap\u0131lm\u0131\u015f olmas\u0131n\u0131n \u015fart olmad\u0131\u011f\u0131n\u0131&#8221; (madde 47, No. 2), tebar\u00fcz ettirmi\u015ftir.<\/p>\n\n\n\n<p>47. maddeye dayanan manevi tazminat i\u00e7in kusurun \u015fart olmad\u0131\u011f\u0131 art\u0131k \u0130svi\u00e7re Federal Mahkemesinin kararlar\u0131nda da kabul edilmektedir. (Karl Oftinger, \u0130svi\u00e7re Sorumluluk Hukuku, 1. cilt, 1958, sahife 262)<\/p>\n\n\n\n<p>\u00e7) 47. madde gere\u011fince manevi tazminata h\u00fckmedebilmek i\u00e7in kusurun aranmas\u0131, bu h\u00fckm\u00fcn uygulanaca\u011f\u0131 maddi tazminat sorumlulu\u011funun b\u00fct\u00fcn halleri ile de kabili telif de\u011fildir.<\/p>\n\n\n\n<p>Her ne kadar hars\u0131z eylemlerde kusur sorumlulu\u011funun temelini te\u015fkil eden 41. madde h\u00fckm\u00fc i\u00e7in b\u00f6yle bir durum meydana gelmez ise de, temyiz kudreti bulunmayan \u015fah\u0131slar\u0131n sorumlulu\u011fu (madde 54), istihdam edenin sorumlulu\u011fu (madde 55), hayvanlar i\u00e7in sorumluluk (madde 56), eser malikinin sorumlulu\u011fu (madde 58), hatta aile ba\u015fkan\u0131n\u0131n sorumlulu\u011fu (Medeni K. madde 320) gibi kusur aranmayan sorumluluk hallerinde, maddi tazminata h\u00fckmedebilmek i\u00e7in kusur \u015fart olmad\u0131\u011f\u0131 gibi, bu durumlarda \u00f6l\u00fcm veya cismani zarar vuku bulmu\u015fsa ayr\u0131ca 47. maddeye m\u00fcsteniden manevi tazminat istenebilmesi i\u00e7in de yine kusurun mevcudiyeti \u015fart de\u011fildir.<\/p>\n\n\n\n<p>Bu konuda \u015fu cihete de i\u015faret etmek gerekir ki, mesela ilkokula giden \u00e7ocu\u011fu bir nakliyat \u015firketinin kamyonunun ezmesi sebebiyle veya k\u00fc\u00e7\u00fck bebe\u011fi ba\u015fkas\u0131n\u0131n k\u00f6pe\u011finin \u0131s\u0131rmas\u0131 sonucu \u00f6len yahut da t\u00fcrl\u00fc me\u015fakkatlerle yeti\u015ftirdi\u011fi gen\u00e7 evlad\u0131 yolu kenar\u0131ndaki binan\u0131n \u00e7\u00f6kerek alt\u0131nda kald\u0131\u011f\u0131 i\u00e7in ayn\u0131 ak\u0131bete maruz kalan ana ve baba lehine, Bor\u00e7lar Kanununun 45. maddesinin 2. f\u0131kras\u0131na g\u00f6re ayn\u0131 kanunun s\u0131rasiyle 55,56 ve 58, maddesi gere\u011fince maddi tazminata h\u00fckmedebilmek i\u00e7in kusur \u015fart tutulmad\u0131\u011f\u0131 halde, manevi tazminatta kusurun aranmas\u0131, normal hayat m\u00fcnasebetlerine ve itiyatlara da ayk\u0131r\u0131 d\u00fc\u015fer.<\/p>\n\n\n\n<p>47. madde, \u015fartlar\u0131 tahakkuk etti\u011fi takdirde, yaln\u0131z yukar\u0131da s\u00f6z\u00fc edilen sorumluluk hallerinde de\u011fil, \u00f6zel kanunlar\u0131n sorumluluk y\u00fckleyen h\u00fck\u00fcmlerinin uyguland\u0131\u011f\u0131 yani maddi tazminata h\u00fckmedilen b\u00fct\u00fcn hallerde ve bunlar\u0131n yan\u0131 ba\u015f\u0131nda tatbik yeri bulur (Becker, 47. madde \u015ferhi No. 2; Oftinger, a.g.e. Sh. 262) Bu arada Karayollar\u0131 Trafik Kanunu zikredilebilir.<\/p>\n\n\n\n<p>d) Bor\u00e7lar Kanunun (haks\u0131z eylemlerden do\u011fan bor\u00e7lar) k\u0131sm\u0131nda maddi tazminat sorumlulu\u011funa mesnet te\u015fkil eden 41,54,55,56 ve 58. madelere mukabil manevi tazminat talebi hakk\u0131n\u0131 veren 47. maddeden ba\u015fka bir de 49. maddenin bulundu\u011fu malumdur.<\/p>\n\n\n\n<p>49. Maddeye g\u00f6re, \u015fahsi menfaatleri ihlal edilen kimse, kusurun mevcudiyeti halinde zarar\u0131n tazminini; ihlalin ve kusurun \u00f6zel a\u011f\u0131rl\u0131\u011f\u0131n\u0131 hakl\u0131 k\u0131larsa, manevi tazminat olarak bir para miktar\u0131n\u0131n \u00f6denmesini isteyebilir. Hakim bu \u00f6demenin yerine veya onun yan\u0131 ba\u015f\u0131nda, manevi tazminat\u0131n diger bir nevine de karar verebilir.<\/p>\n\n\n\n<p>Demek oluyor ki, 49. madde mucibince maddi tazminat i\u00e7in kusurun mevcudiyeti manevi tazminat i\u00e7in de kusurun bilhassa a\u011f\u0131r olmas\u0131, \u015fartt\u0131r.<\/p>\n\n\n\n<p>47. maddede kusur \u015fart\u0131n\u0131n aranmamas\u0131, 49. maddenin \u015fahsi menfaatlere, 47. maddenin ise hayata ve v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcne ili\u015fkin bulunmas\u0131n\u0131n meydana getirdi\u011fi sonu\u00e7lara da uygun d\u00fc\u015fer.<\/p>\n\n\n\n<p>47. madde, 41-53. maddelere tanzim edilen genel kurallar aras\u0131nda yer alm\u0131\u015ft\u0131r. Bu itibarla, 47. maddenin tanzim tekni\u011fi bak\u0131m\u0131ndan kanunda i\u015fgal etti\u011fi yer, bu madde h\u00fckm\u00fcn\u00fcn unsurlar\u0131 aras\u0131na kusuru da ithal etme\u011fe, hem kifayet etmez hem de elveri\u015fli de\u011fildir.<\/p>\n\n\n\n<p>III-Bor\u00e7lar Kanunun 47. maddesi gere\u011fince manevi tazminata h\u00fckmolunabilmesi i\u00e7in, bu maddenin metninden do\u011fan \u00f6zel \u015fartlarla birlikte hatta daha \u00f6nce genel \u015fartlar\u0131n yani olayda maddi tazminata h\u00fcmedebilmenin tabi bulundu\u011fu \u015fartlar\u0131n tahakkuk etmi\u015f olmas\u0131 laz\u0131md\u0131r.<\/p>\n\n\n\n<p>a) Genel \u015fartlar, kusur unsuru istisna edilirse, kusur sorumlulu\u011fu ile kusura dayanmayan sebebiyet (illiyet) sorumlulu\u011funun b\u00fct\u00fcn hallerinde ayn\u0131d\u0131r.<\/p>\n\n\n\n<p>Bunlar, 1) bir eylem (yahut imtina), 2) bir zarar, 3) zarar ile eylem aras\u0131nda iliyet ba\u011f\u0131, 4) eylemin hukuka ayk\u0131r\u0131 olmas\u0131ndan ibarettir (H. Becker, m. 41 \u015ferhi, No. 1; Sch\u00f6nenberger, m. 41 \u015ferhi, No. 2)<\/p>\n\n\n\n<p>Bu \u015fartlardan en \u00f6nemlisi, zarar ile eylem aras\u0131ndaki illiyet ba\u011f\u0131d\u0131r. E\u011fer olayda b\u00f6yle bir illiyet ba\u011f\u0131 yoksa, sorumluluk da yok demektir.<\/p>\n\n\n\n<p>Genel \u015fartlar\u0131n sorumlul\u011fun nevine g\u00f6re baz\u0131 \u00f6zellikler arz edece\u011fi tabiidir. \u0130\u00e7tihad\u0131n birle\u015ftirilmesine konu olan istihdam edenin 47 inci madde gere\u011fince manevi tazminatla sorumlu tutulabilmesi i\u00e7in, 55 inci maddeye dayanan sorumlulu\u011funun tahakkuk etmesi icap eder. Mamafih \u00f6lenin yak\u0131nlar\u0131 veya cismani zarara u\u011frayan, maddi ve manevi tazminat\u0131 birlikte dava edebilecekleri gibi, yaln\u0131z manevi tazminata h\u00fckmedilmesini de isteyebilirler. Her iki halde 55 inci maddeden do\u011fan genel \u015fartlar\u0131n yani \u00f6nce bunlardan m\u00fcspet \u015fartlar\u0131n ger\u00e7ekle\u015fmesi, ondan sonra da menfi \u015fartlar\u0131n tahakkuku, bir ba\u015fka deyi\u015fle istihdam edenin ikame etti\u011fi kurtulu\u015f beyyinesinin amc\u0131na ula\u015fmamas\u0131 laz\u0131md\u0131r (K. Oftinger, a.g.e., clit: 2\/1, 1960, Sah. 142-177; K. Reiso\u011flu, \u0130stihdam Edenlerin Mesuliyeti, 1985, Sah. 30-59).<\/p>\n\n\n\n<p>b) Bor\u00e7lar Kanunun 47 inci maddesinden do\u011fan \u00f6zel \u015fartlara gelince; bunlar, ba\u015fl\u0131ca \u00fc\u00e7 grupta toplanabilir :<\/p>\n\n\n\n<p>1) Bir kimse \u00f6lm\u00fc\u015f veya cismani zarara u\u011fram\u0131\u015f olmal\u0131d\u0131r.<\/p>\n\n\n\n<p>2) Davay\u0131 \u00f6lenin yak\u0131nlar\u0131 veya cismani zarar u\u011frayan kimse a\u00e7mal\u0131d\u0131r.<\/p>\n\n\n\n<p>3) \u00d6zel hal ve \u015fartlar, manevi tazminat h\u00fckmedilmesi gerektirmelidir.<\/p>\n\n\n\n<p>Bu \u015fartlardan sonucusu, i\u00e7tihad\u0131 birle\u015ftirmenin esas konusunu te\u015fkil etmektedir. Her ne kadar Kanunumuzda, \u0130svi\u00e7re metninden farkl\u0131 olarak hakimin manevi tazminata adelete tevfikan h\u00fckmedece\u011fi yaz\u0131l\u0131 ise de, hakim esasen \u00f6zel hal ve \u015fartlar\u0131 takdir ederken Medeni Kanunun 4 \u00fcnc\u00fc maddesi mucibince hak ve nasafet kurallar\u0131na tabi olaca\u011f\u0131na g\u00f6re, bu h\u00fckm\u00fc 4 \u00fcnc\u00fc maddeyi teyit edici olarak telakki etmek gerekir.<\/p>\n\n\n\n<p>\u00d6zel hal ve \u015fartlar, her olaya g\u00f6re de\u011fi\u015fir. Esasen maksat, yukar\u0131da da a\u00e7\u0131kland\u0131\u011f\u0131 gibi, olaya has hal ve \u015fartlar, yani olay\u0131n \u00f6zellikleridir.<\/p>\n\n\n\n<p>Bu \u00f6zelliklerin ba\u015f\u0131nda, manevi zarar\u0131n \u00f6nemli olmas\u0131 gelir. Eli \u00e7izilen bir kimseye cismani zarara u\u011frad\u0131 diye kural olarak manevi tazminat h\u00fckmedilmesi icap etmez. Demek ki, cismani zarara u\u011fruyan kimsede veya \u00f6lenin yak\u0131nlar\u0131nda \u00f6nemli bir manevi zarar (elem, \u0131zd\u0131rap) husule gelmeli, yani ger\u00e7ekten manevi bir tatmin ihtiyac\u0131 do\u011fmu\u015f bulunmal\u0131d\u0131r. \u00d6l\u00fcm vukubulmu\u015fsa, sa\u011fl\u0131\u011f\u0131nda \u00f6len ile davac\u0131 aras\u0131ndaki m\u00fcnasebetin mahiyeti ve derecesi bu hususun takdirinde b\u00fcy\u00fck rol oynar.<\/p>\n\n\n\n<p>Bundan ba\u015fka olay\u0131n olu\u015f \u015fekli, nazara al\u0131n\u0131r. Feci bir olay ile normal \u015fartlar alt\u0131nda meydana gelmi\u015f olan olay bir tutulamaz.<\/p>\n\n\n\n<p>Nihayet ilgilerin yani failin, olaydan ba\u015fka sorumlu varsa onun, mesela istihdam edenin, \u00f6lenin, davac\u0131lar\u0131n i\u00e7timai vekilerinin, tahsil ve iktisadi durumlar\u0131n\u0131n g\u00f6z \u00f6n\u00fcnde tutulmas\u0131 laz\u0131md\u0131r.<\/p>\n\n\n\n<p>K\u0131sacas\u0131 kanun vaz\u0131\u0131, her olayda meydana \u00e7\u0131kan ihtiyac\u0131 kar\u015f\u0131layan kesin bir kural koymaktaki zorlu\u011fu d\u00fc\u015f\u00fcnerek, 47 inci madde metnini kasten elastiki bir \u015fekilde form\u00fcle etmi\u015f ve manevi tazminat h\u00fckmedilmesini gerekli k\u0131lan hal ve \u015fartlar\u0131, hakimin takdirine b\u0131rakm\u0131\u015ft\u0131r. Tabiat\u0131yla bu takdirde, bir yan\u0131lma durumu olmamal\u0131d\u0131r.<\/p>\n\n\n\n<p>E\u011fer olayda failin veya onun hareketinden sorumlu olan \u015fahs\u0131n, mesela istihdam edenin kusuru varsa, bu kusurun veya cismani zarara u\u011frayan yahut da \u00f6len, zarara birlikte sebebiyet vermi\u015fse, sebebiyet verme nispetlerinin veya kar\u015f\u0131l\u0131kl\u0131 kusurlar\u0131n\u0131n manevi tazminat h\u00fckmedilmesinde ve miktar\u0131nda nazara al\u0131nmas\u0131 icap eder. M\u00fccerret m\u00fcterafik kusur veya birlikte sebebiyet verme durumu, manevi tazminat h\u00fck\u00fcm edilmesine engel de\u011fildir; ancak, m\u00fcterafik kusur veya birlikte sebebiyet verme nispeti, manevi tazminat h\u00fckmedilmesini haks\u0131z ve yersiz k\u0131lacak derecede a\u011f\u0131r ve b\u00fcy\u00fck olursa, hakim manevi tazminataa h\u00fckmetmeyebilir. Becker (1942, madde 47, No. 8) ve K. Oftinger&#8217;in (1985 cilt: 1, Sh. 269) eserlerinde i\u015faret ettikleri gibi hakim manevi tazminata h\u00fckmederken para de\u011ferini de d\u00fc\u015f\u00fcnmelidir. H\u00fckmetti\u011fi mebla\u011f, bir sadaka niteli\u011fi ta\u015f\u0131mamal\u0131, k\u0131smen de olsa bir manevi tatmin fonksiyonu ifa etmelidir. Mamarif di\u011fer taraf\u0131n m\u00fczayaka haline d\u00fc\u015fmesine, onun mahv\u0131na da meydan vermemelidir.<\/p>\n\n\n\n<p>Esasen manevi tazminat, ne bir ceza, ne de ger\u00e7ek manas\u0131nda bir tazminatt\u0131r. Ceza de\u011fildir; \u00e7\u00fcnk\u00fc, davac\u0131n\u0131n menfaati d\u00fc\u015f\u00fcn\u00fclmeksizin, sorumlu olana hukukun ihlalinden dolay\u0131 yap\u0131lan bir k\u00f6t\u00fcl\u00fck de\u011fildir. Mamelek hukukuna ili\u015fkin bir zarar\u0131n kar\u015f\u0131lanmas\u0131 ama\u00e7 edinmedi\u011fi i\u00e7in de , ger\u00e7ek manas\u0131nda bir tazminat, ma\u011fdurda veya zarara u\u011frayanda bir huzur hissi, bir tatmin duygusu tevlit etmelidir (H.
