Bu ta\u015f\u0131nmaz\u0131 satmak istemesi halinde zorluk \u00e7\u0131karan ve evi muhtemel al\u0131c\u0131lara g\u00f6stermekten ka\u00e7\u0131nan kirac\u0131lara kar\u015f\u0131 ne yaz\u0131k ki salt bu nedenle tahliye davas\u0131 a\u00e7mak hem hak hem de zaman kayb\u0131na neden olmaktad\u0131r. \u00d6zellikle \u00fclkemizde uzun s\u00fcren yarg\u0131lamalar nedeniyle ev sahipleri \u00e7o\u011fu zaman tahliye davalar\u0131yla u\u011fra\u015fmak yerine evlerini satmay\u0131 dahi d\u00fc\u015f\u00fcnmektedir. Hukuk \u00f6n\u00fcnde dezavantajl\u0131 konumda olan kirac\u0131lar\u0131n haklar\u0131 bilinmekte ancak kiraya verenler haklar\u0131ndan haberdar olmamaktad\u0131r. Bu nedenle emsali az g\u00f6r\u00fclen bir dava t\u00fcr\u00fcne de\u011finmekte fayda g\u00f6r\u00fcyoruz.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Ta\u015f\u0131nmaz\u0131n sat\u0131\u015f\u0131n\u0131n ger\u00e7ekle\u015fmesi durumunda yeni malik, kira s\u00f6zle\u015fmesinin taraf\u0131 haline gelir. Kiralanan\u0131 sonradan edinen ki\u015fi, onu kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut veya i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa, edinme tarihinden ba\u015flayarak bir ay i\u00e7inde durumu kirac\u0131ya yaz\u0131l\u0131 olarak bildirmek ko\u015fuluyla, kira s\u00f6zle\u015fmesini alt\u0131 ay sonra a\u00e7aca\u011f\u0131 bir davayla sona erdirebilir. Bu s\u00fcre\u00e7leri ya\u015famak istemeyen kirac\u0131lar i\u015fi yoku\u015fa s\u00fcrmek i\u00e7in ya da ba\u015fka sebeplerden dolay\u0131 al\u0131c\u0131 adaylar\u0131na evi g\u00f6stermek istemeyebiliyor. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Peki, kirac\u0131 evi g\u00f6stermiyorsa ne yap\u0131l\u0131r? Kirac\u0131n\u0131n evi g\u00f6sterme zorunlulu\u011fu var m\u0131?<\/h2>\n\n\n\n<p class=\"has-text-align-justify\">Kira s\u00f6zle\u015fmesi kapsam\u0131nda kirac\u0131n\u0131n bor\u00e7lar\u0131ndan birisi de <a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.6098.pdf\">Turkish Code of Obligations<\/a> m.319\u2019da d\u00fczenlenen &#8221;kiralanan\u0131n g\u00f6sterilmesine katlan\u0131lmas\u0131na&#8221; ili\u015fkindir. Uygulamada \u00f6zellikle konut kiralar\u0131nda; kiraya verenin, kiralanan evin g\u00f6sterilmesi talebinin ard\u0131ndan taraflar aras\u0131nda uyu\u015fmazl\u0131klar ya\u015fand\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">T\u00fcrk Bor\u00e7lar Kanunu m.319\/2-3 Maddesi gere\u011fince; Kirac\u0131, bak\u0131m, sat\u0131\u015f ya da sonraki kiralama i\u00e7in zorunlu oldu\u011fu \u00f6l\u00e7\u00fcde, kiraya verenin ve onun belirledi\u011fi \u00fc\u00e7\u00fcnc\u00fc ki\u015finin kiralanan\u0131 gezip g\u00f6rmesine izin vermekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Madde 319\/3- Kiraya veren, \u00e7al\u0131\u015fmalar\u0131 ve kiralanan\u0131n gezilip g\u00f6r\u00fclece\u011fini uygun bir s\u00fcre \u00f6nce kirac\u0131ya bildirmek ve bunlar\u0131n yap\u0131ld\u0131\u011f\u0131 s\u0131rada kirac\u0131n\u0131n yararlar\u0131n\u0131 g\u00f6z \u00f6n\u00fcnde tutmak zorundad\u0131r. Kanun maddesinden de a\u00e7\u0131k\u00e7a anla\u015f\u0131laca\u011f\u0131 \u00fczere kiralanan\u0131 bak\u0131m, sat\u0131\u015f ve sonraki kiralama i\u00e7in gerektirdi\u011fi \u00f6l\u00e7\u00fcde kiraya veren ve onun belirledi\u011fi \u00fc\u00e7\u00fcnc\u00fc ki\u015filere kirac\u0131n\u0131n evi g\u00f6sterme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc bulunmaktad\u0131r. Bir ba\u015fka deyi\u015fle kiraya veren taraf\u0131ndan usul\u00fcne uygun olarak yap\u0131lan bir kiralanan\u0131n g\u00f6sterilmesi talebinin kabul edilmemesi hukuka ayk\u0131r\u0131 olacakt\u0131r. Kirac\u0131, kiralanan\u0131 sat\u0131n almak ya da kendisi \u00e7\u0131kt\u0131ktan sonra kiralamak isteyenlerin g\u00f6rmesine ve gezmesine izin vermekle y\u00fck\u00fcml\u00fcd\u00fcr. Ancak bu yap\u0131l\u0131rken kirac\u0131ya en uygun zaman se\u00e7ilmeli, bu ba\u011flamda kirac\u0131n\u0131n \u00e7\u0131karlar\u0131 hakkaniyete uygun olarak g\u00f6z\u00f6n\u00fcnde bulundurulmal\u0131d\u0131r. Bu itibarla kirac\u0131ya y\u00fcklenecek bu y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn taraflar\u0131n yararlar\u0131 ve hakkaniyete uygun olarak saptanmas\u0131 zorunludur. <\/p>\n\n\n\n<p class=\"has-text-align-justify\">Davan\u0131n g\u00f6r\u00fclmesi a\u015famas\u0131nda incelenen durumlar \u015f\u00f6yledir: Ta\u015f\u0131nmaz\u0131n niteli\u011fi bulundu\u011fu mevki g\u00f6z \u00f6n\u00fcnde tutularak muhtemel sat\u0131labilme s\u00fcresi tespit edilmelidir. Bu s\u00fcre i\u00e7esinde de hangi g\u00fcn ve saatlerde g\u00f6sterilmesinin uygun olaca\u011f\u0131, hem kirac\u0131 hem de ev sahibinin menfaati g\u00f6z \u00f6n\u00fcne al\u0131narak  belirlenmelidir. Kirac\u0131n\u0131n i\u015f ve be\u015feri ili\u015fkileri de g\u00f6z \u00f6n\u00fcne al\u0131narak g\u00fcn ve saatin belirlenmesi gerekir. Hakim davay\u0131 duru\u015fmal\u0131 olarak y\u00fcr\u00fctmelidir. Taraf delillerinin toplanmas\u0131 a\u00e7\u0131s\u0131ndan bu durum \u00f6nemlidir.  Mahkemece, duru\u015fma a\u00e7\u0131larak taraf delilleri birlikte de\u011ferlendirilerek neticesine g\u00f6re bir karar verilmesi gerekir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Evi g\u00f6stermeyen kirac\u0131 veya ev sahibi ve kirac\u0131n\u0131n hangi g\u00fcn ve saatlerde evin g\u00f6sterilece\u011fi hususunda anla\u015famamas\u0131 halinde ise ev sahibinin Sulh Hukuk Mahkemesi&#8217;nde Kiralanan\u0131 G\u00f6stermeye \u0130zin \u0130stemli dava a\u00e7abilecektir. Ba\u015fvurunun ard\u0131ndan mahkeme ta\u015f\u0131nmaz\u0131n muhtemel sat\u0131\u015f s\u00fcreci, konumu, kirac\u0131n\u0131n i\u015f ve \u00e7al\u0131\u015fma saatleri gibi hususlar\u0131 inceleyerek belli bir s\u00fcre i\u00e7in haftan\u0131n belli g\u00fcn ve saatinde evi al\u0131c\u0131lara gezdirme konusunda tedbir karar\u0131 verir. \u00d6rne\u011fin \u00fc\u00e7 ay s\u00fcre ile cuma ya da cumartesi g\u00fcnleri saat 12-18 aras\u0131nda ta\u015f\u0131nmaz\u0131n g\u00f6sterilmesi y\u00f6n\u00fcnde karar verilir. Uygulamada kirac\u0131n\u0131n evi g\u00f6sterme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne ili\u015fkin dava a\u00e7\u0131labilece\u011fi bilinmedi\u011fi i\u00e7in genelde e\u015fitli sebeplerle tahliye davalar\u0131<br>a\u00e7\u0131l\u0131yor. Fakat tahliye hususunda ge\u00e7erli bir tahliye sebebi olmaks\u0131z\u0131n a\u00e7\u0131lacak dava madden ve zaman olarak kay\u0131p olaca\u011f\u0131 gibi; uzun s\u00fcren yarg\u0131lama s\u00fcre\u00e7leri sebebi ile ta\u015f\u0131nmazdan al\u0131nacak fayday\u0131 da d\u00fc\u015f\u00fcr\u00fcyor.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Relevant Supreme Court Decisions:<\/p>\n\n\n\n<p class=\"has-text-align-justify\">T.C. Yarg\u0131tay 13. Hukuk Dairesi\u2019nin E. 2006\/14139, K. 2007\/822 say\u0131l\u0131 30.1.2007 tarihli karar\u0131nda, uyu\u015fmazl\u0131k, daval\u0131ya kiralanan ancak davac\u0131 taraf\u00e7a sat\u0131lmak istenen mecurun m\u00fc\u015fterilere g\u00f6sterilmesi konusunda \u00e7\u0131kan muarazan\u0131n meni talebinden kaynaklanmaktad\u0131r. Mahkemece, mahallinde ke\u015fif ve bilirki\u015fi incelemesi yap\u0131larak, ekonomik ko\u015fullar, ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer, ta\u015f\u0131nmaz\u0131n nitelikleri vs. \u00f6zellikler de\u011ferlendirilerek ne kadar s\u00fcrede sat\u0131labilece\u011fi tespit edilerek, mecurun g\u00f6sterimine bu s\u00fcre ile s\u0131n\u0131rl\u0131 olarak izin verilmesi gerekti\u011fi\u2019 h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Bu durum kar\u015f\u0131s\u0131nda ( g\u00f6revli olmas\u0131 halinde ) mahkemece yap\u0131lacak i\u015f; uzman bilirki\u015fi arac\u0131l\u0131\u011f\u0131 ile yerinde inceleme yap\u0131lmak, kiralanan\u0131n niteli\u011fi, bulundu\u011fu mevki, dairenin sat\u0131labilme s\u00fcresine etkili sosyal, ekonomik ko\u015fullar, di\u011fer \u00f6zel ve genel fakt\u00f6rler ile birlikte taraflar\u0131n yararlar\u0131 de\u011ferlendirilmek,  hakkaniyete uygun denge kurmak suretiyle sat\u0131\u015f\u0131n yap\u0131labilece\u011fi muhtemel, makul ve m\u00fcnasip bir s\u00fcre ile ayr\u0131ca bu s\u00fcre i\u00e7inde de hangi g\u00fcn ve saatlerde kiralanan\u0131n g\u00f6sterilmesine izin verilmesinin uygun  olaca\u011f\u0131 saptanmak ve has\u0131l olacak uygun sonu\u00e7 \u00e7er\u00e7evesinde karar vermekten ibaret olmal\u0131d\u0131r (3 HD, 09.10.2001 T.,
