S\u00f6z konusu d\u00fczenlemelerin baz\u0131lar\u0131 ki\u015filik haklar\u0131n\u0131n korunmas\u0131, haber sitelerinin i\u00e7erik saklama y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc, yasa d\u0131\u015f\u0131 i\u00e7erikler hakk\u0131nda bilgilendirilme konular\u0131nda yararl\u0131 olsa da s\u00f6z konusu d\u00fczenlemenin <a href=\"https:\/\/www.resmigazete.gov.tr\/eskiler\/2022\/10\/20221018-1.htm\" target=\"_blank\" rel=\"noreferrer noopener\">29. Maddesi sebebi<\/a> ile sosyal medyada b\u00fcy\u00fck yank\u0131 uyand\u0131rd\u0131. Sosyal medya yasas\u0131 ismi ile bilinen yasa maddelerinin d\u00fczenlemeleri \u00f6zetle;<\/p>\n\n\n\n<p class=\"has-text-align-justify\">\u00c7ocuklar\u0131n, gen\u00e7lerin ve ailenin, internetin yasa d\u0131\u015f\u0131 i\u00e7erikleri hakk\u0131nda bilin\u00e7lendirilmesi ve g\u00fcvenli kullan\u0131m\u0131 konusunda bilgilendirilmesi i\u00e7in Eri\u015fim Sa\u011flay\u0131c\u0131lar\u0131 Birli\u011fi&#8217;ne ilave g\u00f6revler verilecek.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">T\u00fcm haber siteleri, yay\u0131nlad\u0131klar\u0131 i\u00e7erikleri saklamak zorunda olacak. B\u00f6ylelikle hukuka ayk\u0131r\u0131 i\u00e7eriklerin yok edilmesi ve keyfi olarak ortadan kald\u0131r\u0131lmas\u0131n\u0131n \u00f6n\u00fcne ge\u00e7ilmi\u015f olacak.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Ki\u015filik hakk\u0131n\u0131n zedelenmesi \u015fikayeti ile mahkemeye ba\u015fvuru yap\u0131p i\u00e7eri\u011fin kald\u0131r\u0131lmas\u0131 talebinde bulunan ve talebi mahkemece kabul edilen ki\u015filer art\u0131k di\u011fer siteler i\u00e7in ba\u015fvuru yapt\u0131\u011f\u0131nda mevcut karar bu adresler i\u00e7in de uygulanacak. Her site i\u00e7in ayr\u0131 karar \u00e7\u0131kar\u0131lmas\u0131 gerekmeyecek.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Yeni yasa ile k\u00fcnye belirtmeksizin internet habercili\u011fi yapmak m\u00fcmk\u00fcn olmayacak. TBMM Genel Kurulu&#8217;nda, Bas\u0131n Kanunu ve Baz\u0131 Kanunlarda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Yasa Teklifi&#8217;nin g\u00f6r\u00fc\u015fmelerine 29&#8217;uncu maddeden ba\u015fland\u0131. Yasan\u0131n 29. Maddesinin Meclis\u2019te kabul edilmesinin ard\u0131ndan ise sosyal medya kullan\u0131c\u0131lar\u0131 maddenin \u00f6zelliklerini ara\u015ft\u0131rmaya ba\u015flad\u0131. Dezenformasyonla m\u00fccadele yasas\u0131 kapsam\u0131nda kabul edilen ve halk aras\u0131nda tart\u0131\u015fmalara sebebiyet veren 29. maddeyle; &#8221; Halk aras\u0131nda endi\u015fe, korku veya panik yaratma saikiyle \u00fclkenin i\u00e7 ve d\u0131\u015f g\u00fcvenli\u011fi, kamu d\u00fczeni ve genel sa\u011fl\u0131\u011f\u0131 ile ilgili ger\u00e7e\u011fe ayk\u0131r\u0131 bir bilgiyi, kamu bar\u0131\u015f\u0131n\u0131 bozmaya elveri\u015fli \u015fekilde alenen yay\u0131n yapan kimseye, bir y\u0131ldan \u00fc\u00e7 y\u0131la kadar hapis cezas\u0131&#8221; \u00f6ng\u00f6r\u00fcl\u00fcyor.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Yeni yasayla beraber &#8220;halk\u0131 yan\u0131lt\u0131c\u0131 bilgiyi alenen yayma&#8221; su\u00e7u tan\u0131mlan\u0131yor. Su\u00e7un olu\u015fmas\u0131 i\u00e7in \u015fu 5 \u015fart aranacak : Yay\u0131lan haber ger\u00e7ek de\u011filse, \u00fclkenin g\u00fcvenli\u011fi ve kamu sa\u011fl\u0131\u011f\u0131n\u0131 ilgilendiriyorsa, halk aras\u0131nda korku, panik ve endi\u015fe olu\u015fturma kast\u0131 varsa , kamu bar\u0131\u015f\u0131n\u0131 bozmaya y\u00f6nelik ise aleni ise (yani ilgisi olmayan ki\u015filere ula\u015fabilecekse) ki\u015filere 1 y\u0131ldan 3 y\u0131la kadar hapis cezas\u0131 verilebilecek. Sosyal medya yasas\u0131 ile adli merciler taraf\u0131ndan talep edilen bilgiler verilmezse , sosyal a\u011f sa\u011flay\u0131c\u0131lar\u0131n\u0131n internet trafi\u011fi bant geni\u015fli\u011fi de y\u00fczde 90 oran\u0131nda daralt\u0131labilecek. Bu minvalde bakt\u0131\u011f\u0131m\u0131zda \u00f6zellikle su\u00e7un unsurlar\u0131 bak\u0131m\u0131ndan pek \u00e7ok durumun bu maddeye sokulabilece\u011fi kan\u0131s\u0131 ile sosyal medyada b\u00fcy\u00fck tepki toplad\u0131. Zira bilin\u00e7li olarak yap\u0131lan yalan haberlerin yan\u0131 s\u0131ra, pek \u00e7ok bilgi ve haber sosyal medyada kullan\u0131c\u0131lar taraf\u0131ndan s\u0131kl\u0131kla payla\u015f\u0131lmakta. Bu payla\u015f\u0131mlar zaman zaman ekonomik, siyasi, g\u00fcndeme y\u00f6nelik bilgilendirme ve yard\u0131m arama amac\u0131 i\u00e7eriyor. \u00d6rne\u011fin bir istismar\u0131 duyurmaya y\u00f6nelik haber yap\u0131ld\u0131\u011f\u0131nda, yalan haber oldu\u011fu taktirde bu haberi yapan ve payla\u015fanlara ceza verilece\u011finden bahsediliyor. Peki kullan\u0131c\u0131, bu haberlerin do\u011frulu\u011funu tespit edebilir mi? Veya nas\u0131l tespit edecek? Burada sosyal medya kullan\u0131c\u0131lar\u0131n\u0131n &#8221;halk\u0131 yan\u0131lt\u0131c\u0131 bilgiyi alenen yayma su\u00e7u&#8221; tan\u0131m\u0131n\u0131n mu\u011flakl\u0131\u011f\u0131 da tedirgin ediyor. Zira yalan haber ve yan\u0131lt\u0131c\u0131 bilginin kime ve neye g\u00f6re tan\u0131mlanaca\u011f\u0131 belli de\u011fil. <\/p>\n\n\n\n<p class=\"has-text-align-justify\">Bir ba\u015fka tart\u0131\u015fma yaratan zorunluluk ise whatsapp, instagram, facebook, youtube gibi yakla\u015f\u0131k iki milyondan fazla kullan\u0131c\u0131s\u0131 olan fakat T\u00fcrkiye&#8217;de genel merkezi bulunmayan bu uygulamalara da genel merkez a\u00e7ma zorunlulu\u011fu getirilmesi y\u00f6n\u00fcnde. D\u00fczenlemede T\u00fcrkiye&#8217;de ofis a\u00e7ma ile birlikte T\u00fcrkiye temsilcisi bulundurma zorunlulu\u011fu da mevcut. Temsilcinin ger\u00e7ek ki\u015fi olmas\u0131 halinde, bu ki\u015finin T\u00fcrkiye&#8217;de ikamet etmesi ve T\u00fcrk vatanda\u015f\u0131 olmas\u0131 gerekecek. Bu uygulamalar T\u00fcrkiye&#8217;de merkez a\u00e7may\u0131 kabul edecek mi sorusu ak\u0131llarda. T\u00fcrkiye&#8217;de genel merkez a\u00e7\u0131lmamas\u0131 durumunda da ba\u015fta reklam k\u0131s\u0131tlamalar\u0131, akabinde ise uygulamalara yap\u0131lacak k\u0131s\u0131tlamalarla uygulamalar\u0131n yava\u015fl\u0131k sebebi ile kullan\u0131lamaz hale gelece\u011fi tedirginlik yarat\u0131yor.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Here are some similar works
