Oysa T\u00fcrk Bor\u00e7lar Kanunu\u2019nda (TBK)&nbsp;kira s\u00f6zle\u015fmesi, malikin de\u011fi\u015fmesiyle kendili\u011finden sona ermez. Yeni malik, kirac\u0131y\u0131 ancak kanunda say\u0131lan sebepler ve s\u00fcreler i\u00e7inde hareket ederek tahliye edebilir. Uygulamada en \u00e7ok kullan\u0131lan yol,&nbsp;TBK m.351&nbsp;kapsam\u0131nda&nbsp;ihtiya\u00e7 nedeniyle tahliye&nbsp;hakk\u0131d\u0131r. Bunun yan\u0131nda&nbsp;tahliye taahh\u00fcd\u00fcne dayal\u0131 tahliye,&nbsp;kira bedelinin \u00f6denmemesi,&nbsp;10 y\u0131ll\u0131k uzama s\u00fcresi&nbsp;gibi farkl\u0131 tahliye mekanizmalar\u0131 da bulunmaktad\u0131r. Kirac\u0131\u2013ev sahibi uyu\u015fmazl\u0131klar\u0131nda s\u00fcrelerin ka\u00e7\u0131r\u0131lmas\u0131, ihtar\u0131n usuls\u00fcz g\u00f6nderilmesi veya arabuluculuk \u015fart\u0131n\u0131n atlanmas\u0131 davan\u0131n reddi gibi sonu\u00e7lar do\u011furabilir. Bu nedenle<strong> <\/strong>tahliye davalar\u0131 a\u00e7\u0131s\u0131ndan s\u00fcre\u00e7 plan\u0131 avukatla belirlenmelidir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-satin-alinan-evden-kiracinin-cikartilmasi-hakkindaki-kanuni-duzenlemeler\">Sat\u0131n Al\u0131nan Evden Kirac\u0131n\u0131n \u00c7\u0131kart\u0131lmas\u0131 Hakk\u0131ndaki Kanuni D\u00fczenlemeler<\/h2>\n\n\n\n<p class=\"has-text-align-justify\"><a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.6098.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">TBK<\/a> m. 310 gere\u011fince konutun yeni sahibi; eski malikle yap\u0131lan kira s\u00f6zle\u015fmesinin kendili\u011finden taraf\u0131 haline gelecektir. Hakl\u0131 bir sebep olmad\u0131k\u00e7a (kirac\u0131n\u0131n kira bedelini \u00f6dememesi, kom\u015fulara rahats\u0131zl\u0131k vermesi, vs.) yeni ev sahibi kirac\u0131 kabul etmedi\u011fi s\u00fcrece kira s\u00f6zle\u015fmesini feshedemez, kirac\u0131y\u0131 konuttan \u00e7\u0131kmaya zorlayamaz.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Fakat yeni ev sahibinin kirac\u0131y\u0131 ne zaman \u00e7\u0131karabilir sorusu ile kastedilenin \u201cYeni malikin gereksinimi\u201d ba\u015fl\u0131kl\u0131 TBK m. 351 h\u00fckm\u00fc olmas\u0131 sebebiyle s\u00f6z konusu tahliye nedeninden de bahsetmemiz gerekmektedir:<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Bor\u00e7lar Kanununun 351. maddesinde; \u201cKiralanan\u0131 sonradan edinen ki\u015fi, onu kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut veya i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa, edinme tarihinden ba\u015flayarak bir ay i\u00e7inde durumu kirac\u0131ya yaz\u0131l\u0131 olarak bildirmek ko\u015fuluyla, kira s\u00f6zle\u015fmesini alt\u0131 ay sonra a\u00e7aca\u011f\u0131 bir davayla sona erdirebilir. Kiralanan\u0131 sonradan edinen ki\u015fi, dilerse gereksinim sebebiyle s\u00f6zle\u015fmeyi sona erdirme hakk\u0131n\u0131, s\u00f6zle\u015fme s\u00fcresinin bitiminden ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava yoluyla da kullanabilir.\u201d denmektedir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Yeni ev sahibinin veya yak\u0131nlar\u0131n\u0131n konut ihtiyac\u0131n\u0131n bulunmas\u0131n\u0131 kanunumuz kira s\u00f6zle\u015fmesini sonland\u0131rabilmek i\u00e7in ge\u00e7erli bir neden olarak kabul etmi\u015ftir. Fakat bu halde de kanun \u015fekli baz\u0131 \u015fartlar aram\u0131\u015f ve her halde dava a\u00e7\u0131lmas\u0131 zorunlulu\u011fu \u00f6ng\u00f6rm\u00fc\u015ft\u00fcr. Bir ba\u015fka deyi\u015fle yeni ev sahibi TBK m.351 h\u00fckm\u00fcndeki ko\u015fullar\u0131 sa\u011flasa dahi tahliye davas\u0131 a\u00e7madan kira s\u00f6zle\u015fmesini feshedemeyecektir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-justify\" id=\"h-yeni-ev-sahibinin-ihtiyaci-sebebiyle-kira-sozlesmesini-sonlandirabilmesi-icin-gerekli-olan-sartlar\">Yeni Ev Sahibinin \u0130htiyac\u0131 Sebebiyle Kira S\u00f6zle\u015fmesini Sonland\u0131rabilmesi \u0130\u00e7in Gerekli Olan \u015eartlar<\/h2>\n\n\n\n<p class=\"has-text-align-justify\">1-) Ki\u015fi konutu (kiralanan\u0131) sat\u0131n alma, ba\u011f\u0131\u015flama vs. bir hukuki nedenle edinmi\u015f olmal\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">2-) Yeni ev sahibi; konutu edindi\u011fi tarihte i\u00e7erisinde kirac\u0131 bulunmal\u0131d\u0131r. Yani \u00f6nceki ev sahibi ile kirac\u0131 aras\u0131nda; konutun sahibinin de\u011fi\u015fti\u011fi tarihte devam eden bir kira s\u00f6zle\u015fmesi bulunmal\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">3-) Yeni Ev Sahibinin kendisi, e\u015fi, altsoyu (\u00e7ocuklar\u0131, torunlar\u0131), \u00fcstsoyu (anne-babas\u0131, dedesi vs.) veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu ki\u015filerin konut ihtiyac\u0131 sebebiyle kiralanan\u0131 kullanma zorunlulu\u011fu bulunmal\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Burada belirtmemiz gereken bir husus; yeni ev sahibinin kira s\u00f6zle\u015fmesini sonland\u0131rabilmesi i\u00e7in yukar\u0131da belirtti\u011fimiz ki\u015filerden herhangi birisinin konut ihtiyac\u0131 bulunmal\u0131d\u0131r. S\u00f6z konusu ki\u015filer d\u0131\u015f\u0131ndaki yeni ev sahibinin yak\u0131nlar\u0131n\u0131n konut ihtiyac\u0131n\u0131n bulunmas\u0131 sebebiyle kirac\u0131dan konutu tahliye etmesi istenemeyece\u011fi gibi kanunda belirtilen bu ki\u015filerinde d\u00fcr\u00fcstl\u00fck kural\u0131 \u00e7er\u00e7evesinde bir konut ihtiyac\u0131n\u0131n oldu\u011fundan bahsedilemiyorsa yine kirac\u0131dan konuttan \u00e7\u0131kmas\u0131 hususunda bir talepte bulunulamaz.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">4-) Kanun koyucu kiraya verene burada iki ihtimal \u00f6ng\u00f6rm\u00fc\u015ft\u00fcr ve iki durumda da yeni ev sahibi belirtilen \u015fartlar\u0131 sa\u011flad\u0131ktan sonra tahliye davas\u0131 a\u00e7mak zorundad\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-satin-alinan-evden-kiracinin-cikartilmasi-hakkindaki-surecte-dikkat-edilmesi-gerekenler\">Sat\u0131n Al\u0131nan Evden Kirac\u0131n\u0131n \u00c7\u0131kart\u0131lmas\u0131 Hakk\u0131ndaki S\u00fcre\u00e7te Dikkat Edilmesi Gerekenler<\/h3>\n\n\n\n<p class=\"has-text-align-justify\">a-) Yeni Ev Sahibi konutu edindikten (sat\u0131n ald\u0131ktan) sonra bir ay i\u00e7erisinde kirac\u0131ya yaz\u0131l\u0131 bildirimde bulunmal\u0131d\u0131r. \u0130spat kolayl\u0131\u011f\u0131 a\u00e7\u0131s\u0131ndan yaz\u0131l\u0131 bildirimin noter arac\u0131l\u0131\u011f\u0131yla yap\u0131lmas\u0131 faydal\u0131 olacakt\u0131r. Yeni malik yaz\u0131l\u0131 bildiriminin i\u00e7eri\u011finde; kiralanan\u0131 hangi tarihte edindi\u011fini (sat\u0131n ald\u0131\u011f\u0131n\u0131), kiralanana kendisinin\/kanunda belirtilen ki\u015filerin ihtiyac\u0131n\u0131n bulundu\u011funu ve kanuni d\u00fczenlemeler \u00e7er\u00e7evesinde kira s\u00f6zle\u015fmesini sonland\u0131rma iradesinde oldu\u011funu belirtmesi gerekir. Daha sonra konutu edindi\u011fi tarihten itibaren alt\u0131 ay sonra a\u00e7aca\u011f\u0131 tahliye davas\u0131 ile kira s\u00f6zle\u015fmesini sonland\u0131rabilir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">b-) Ya da yeni malik kirac\u0131ya yaz\u0131l\u0131 bir bildirimde bulunmas\u0131na gerek olmaks\u0131z\u0131n; \u00f6nceki ev sahibi ile kirac\u0131 aras\u0131nda yap\u0131lan kira s\u00f6zle\u015fmesinin bitti\u011fi tarihten itibaren bir ay i\u00e7erisinde tahliye davas\u0131 a\u00e7arak kira s\u00f6zle\u015fmesinin sonland\u0131r\u0131lmas\u0131n\u0131 talep edebilir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Yeni ev sahibinin ihtiya\u00e7 sebebiyle tahliye davas\u0131 a\u00e7abilmesi i\u00e7in yukar\u0131da belirtilen s\u00fcreler hakk\u0131nda TBK m. 353\u2019te; \u201c<em>Kiraya veren, en ge\u00e7 davan\u0131n a\u00e7\u0131lmas\u0131 i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrede dava a\u00e7aca\u011f\u0131n\u0131 kirac\u0131ya yaz\u0131l\u0131 olarak bildirmi\u015fse, dava a\u00e7ma s\u00fcresi bir kira y\u0131l\u0131 i\u00e7in uzam\u0131\u015f say\u0131l\u0131r.\u201d <\/em>denmektedir. Buna g\u00f6re yeni ev sahibinin s\u00f6z konusu nedenle tahliye davas\u0131 a\u00e7ma s\u00fcresini uzatma imkan\u0131 da bulunmaktad\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-yeni-mulk-sahibinin-takip-etmesi-gereken-prosedur\">Yeni M\u00fclk Sahibinin Takip Etmesi Gereken Prosed\u00fcr<\/h3>\n\n\n\n<p>Kanun gere\u011fince yeni m\u00fclk sahibi, e\u011fer kira kontrat\u0131na istinaden tapuda \u015ferh yoksa, tapu devri yap\u0131ld\u0131ktan sonra bir ay i\u00e7inde kirac\u0131ya ihtarname g\u00f6ndermelidir.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u0130htarname g\u00f6nderildikten sonra e\u011fer kira s\u00f6zle\u015fmesinin bitimi 6 aydan uzun s\u00fcreli ise kirac\u0131 6 ay i\u00e7inde evi bo\u015faltmal\u0131d\u0131r. Kirac\u0131 evden \u00e7\u0131kmay\u0131 kabul etmiyorsa dava yoluyla tahliye edilebilir.<\/li>\n\n\n\n<li>Tapu devri yap\u0131ld\u0131ktan sonra 1 ay i\u00e7inde ihtarname yollanmazsa yeni ev sahibi, kiray\u0131 verene ait kira s\u00f6zle\u015fmesinin \u015fartlar\u0131n\u0131 kabul etmi\u015f say\u0131l\u0131r.<\/li>\n\n\n\n<li>Kirac\u0131 bu s\u00fcre\u00e7 dahilinde kira s\u00f6zle\u015fmesi \u015fartlar\u0131n\u0131 bozarsa -\u00f6rnek olarak kira bedelini belirli s\u00fcrede \u00f6demezse- daha erken s\u00fcrede tahliye edilebilir.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-yeni-satin-alinan-evde-oturan-kiraci-ile-anlasma\">Yeni Sat\u0131n Al\u0131nan Evde Oturan Kirac\u0131 ile Anla\u015fma<\/h2>\n\n\n\n<p class=\"has-text-align-justify\">Sat\u0131n almadan \u00f6nce evde bulunan kirac\u0131 ile anla\u015fma yoluna gitmek, en ideal y\u00f6ntemlerden biridir. Bu durumda kirac\u0131 ve kiraya veren, anla\u015farak kira s\u00f6zle\u015fmesini feshedebilir. B\u00f6ylece kirac\u0131n\u0131n evden \u00e7\u0131kmas\u0131 i\u00e7in beklemeye gerek kalmaz. Uygulamada genellikle kirac\u0131lardan tahliye taahh\u00fcd\u00fc al\u0131nmaktad\u0131r. Kirac\u0131 taahh\u00fcde yana\u015fmazsa, ihtiya\u00e7 sebebi s\u00f6z konusu ise yukar\u0131daki prosed\u00fcr uygulan\u0131r. \u0130laveten, sat\u0131n al\u0131nacak evde kirac\u0131 oturuyorsa dikkat edilecek durumlar aras\u0131nda yer alan depozito, kirac\u0131n\u0131n ev sahibine teminat bedeli alt\u0131nda \u00f6dedi\u011fi miktar\u0131 ifade eder. Ev sat\u0131n al\u0131nacaksa eski ev sahibinden bu depozito temin edilmeli veya evin bedelinden bu miktar d\u00fc\u015f\u00fclmelidir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Konut ihtiyac\u0131na dayanarak dava a\u00e7\u0131labilmesi i\u00e7in konutun bulundu\u011fu yerin TMK\u2019n\u0131n 19\u2019uncu maddesi kapsam\u0131nda ikametg\u00e2h adresi olmas\u0131 da gerekmez (6.HD. 13.9.1979; 3619\/6381)<\/p>\n\n\n\n<p class=\"has-text-align-justify\">\u00d6\u011fretide kalp hastas\u0131 veya y\u00fcr\u00fcme engeli bulunan bir kiraya verenin, asans\u00f6rs\u00fcz bir binan\u0131n \u00fcst kat\u0131nda oturmakta, kendi dairesi de asans\u00f6rl\u00fc bir binada veya asans\u00f6rs\u00fcz olmakla birlikte bu binan\u0131n giri\u015f veya birinci kat\u0131nda bulunmakta ise tahliye davas\u0131 a\u00e7t\u0131\u011f\u0131 takdirde ortada ger\u00e7ek bir tahliye talep ve sebebi bulundu\u011funa dair g\u00f6r\u00fc\u015f mevcuttur. Yine doktrinde kiraya verenin e\u015finin ayr\u0131 ya\u015famay\u0131 talep etmesi durumunda h\u00e2kimin hakl\u0131 g\u00f6rmesi \u00fczerine ayr\u0131 ya\u015famaya karar vermesi halinde kiraya verenin, e\u015finin ihtiyac\u0131 i\u00e7in tahliye davas\u0131 a\u00e7abilece\u011fi, kiraya verenin \u00e7ocuklar\u0131n\u0131n ni\u015fanlanma, evlenme, \u00f6\u011frenim, sa\u011fl\u0131k ya da memuriyet gibi bir sebeple babalar\u0131ndan ayr\u0131 ya\u015famalar\u0131 gere\u011finin ortaya \u00e7\u0131kt\u0131\u011f\u0131 durumlar\u0131nda da ta\u015f\u0131nmaz ihtiyac\u0131 sebebiyle
