Yani kira s\u00f6zle\u015fmesi taraflar i\u00e7in ba\u011flay\u0131c\u0131d\u0131r. <a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.6098.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Turkish Code of Obligations<\/a> madde 325 d\u00fczenlemesine g\u00f6re kira s\u00f6zle\u015fmesi bitmeden evden \u00e7\u0131kmak m\u00fcmk\u00fcnd\u00fcr ancak burada kirac\u0131n\u0131n hukuki sorumlulu\u011fu do\u011far. Kirac\u0131 s\u00fcresinden \u00f6nce bildirimde bulunup evi bo\u015faltmakla ba\u011flay\u0131c\u0131l\u0131k ortadan kalkmaz.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Buna g\u00f6re kira s\u00fcresi sona ermeden veya s\u00f6zle\u015fmede belirlenen fesih d\u00f6nemi d\u0131\u015f\u0131nda kiralanan tahliye edildi\u011fi takdirde, m\u00fclk sahibinin ta\u015f\u0131nmaz\u0131 yeniden kiraya verebilece\u011fi uygun bir s\u00fcre i\u00e7in kirac\u0131n\u0131n s\u00f6zle\u015fmeden do\u011fan borcu devam eder. Bu, s\u00f6zle\u015fme dolmadan tahliye m\u00fcmk\u00fcn olsa da kirac\u0131 bir s\u00fcre daha kira borcunu, aidat\u0131, ortak giderler varsa bunlar vb. yan giderleri \u00f6demek zorunda kalaca\u011f\u0131 anlam\u0131na gelmektedir.<\/p>\n\n\n\n<p><strong>Kanuni d\u00fczenleme incelenecek olursa:<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-justify\">Bor\u00e7lar Kanunu&nbsp; MADDE 325- Kirac\u0131, s\u00f6zle\u015fme s\u00fcresine veya fesih d\u00f6nemine uymaks\u0131z\u0131n kiralanan\u0131 geri verdi\u011fi takdirde, kira s\u00f6zle\u015fmesinden do\u011fan bor\u00e7lar\u0131, <strong>kiralanan\u0131n benzer ko\u015fullarla kiraya verilebilece\u011fi makul bir s\u00fcre i\u00e7in devam eder. <\/strong>Kirac\u0131n\u0131n bu s\u00fcrenin ge\u00e7mesinden \u00f6nce kiraya verenden kabul etmesi beklenebilecek, \u00f6deme g\u00fcc\u00fcne sahip ve kira ili\u015fkisini devralmaya haz\u0131r yeni bir kirac\u0131 bulmas\u0131 h\u00e2linde, kirac\u0131n\u0131n kira s\u00f6zle\u015fmesinden do\u011fan bor\u00e7lar\u0131 sona erer.&#8221;<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Kiraya verene kiralanan\u0131n benzer ko\u015fullarda kiraya verece\u011fi makul s\u00fcre denilerek bu makul s\u00fcre kiralanan\u0131n bulundu\u011fu konum \u015fehir ve di\u011fer fakt\u00f6rlere g\u00f6re de\u011fi\u015fkenlik g\u00f6sterebilir. Kirac\u0131lar\u0131n haklar\u0131 yasalarla koruma alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Ayn\u0131 \u015fekilde ev sahiplerinin haklar\u0131 da koruma alt\u0131ndad\u0131r. Nas\u0131l ki ev sahibi kirac\u0131y\u0131 belli kurallar \u00e7er\u00e7evesinde evden \u00e7\u0131karabiliyorsa ayn\u0131 \u015fekilde kirac\u0131 da istedi\u011fi zaman evden ayr\u0131lamaz. Ayr\u0131l\u0131rsa da s\u00f6zle\u015fmeyi feshinden kaynakl\u0131 zarar\u0131 tazmin etmek zorundad\u0131r.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Kanun maddesinde belirtilen \u201cmakul s\u00fcre\u201d kavram\u0131 somut olaya g\u00f6re belirlenecektir. Ancak Yarg\u0131tay uygulamas\u0131nda 2-4 ay aras\u0131nda bir s\u00fcre ile kirac\u0131n\u0131n y\u00fck\u00fcml\u00fcl\u00fcklerinin devam edece\u011fi y\u00f6n\u00fcnde kararlar verilmektedir. Ayr\u0131ca kirac\u0131n\u0131n; kiraya verenin kabul edebilece\u011fi, benzer ko\u015fullar\u0131 oldu\u011fu de\u011ferlendirilebilecek yeni bir kirac\u0131 bulmas\u0131 halinde y\u00fck\u00fcml\u00fcl\u00fcklerinin makul s\u00fcrenin sonunun beklenmesi aranmadan sona erecektir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Uygulamada kira kontrat\u0131 genellikle belirli s\u00fcreli yap\u0131lmaktad\u0131r. Sonras\u0131nda yaz\u0131l\u0131 olarak yenilenmemekte ve s\u00f6zl\u00fc olarak uzat\u0131lmaktad\u0131r. Kirac\u0131n\u0131n kira s\u00f6zle\u015fmesine 15 g\u00fcn kala s\u00f6zle\u015fmeyi fesih etmemesi durumunda s\u00f6zle\u015fme ayn\u0131 \u015fartlarda 1 y\u0131l uzat\u0131lm\u0131\u015f olur .<\/p>\n\n\n\n<p><strong>Belirli s\u00fcreli yani kira kontrat\u0131 yap\u0131l\u0131p uzat\u0131lmayan s\u00f6zle\u015fmelerde kirac\u0131n\u0131n erken \u00e7\u0131kmas\u0131 durumunda ne olur ?<\/strong><\/p>\n\n\n\n<p>Bu konuda T\u00fcrk Bor\u00e7lar Kanunu \u015f\u00f6yle demektedir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">MADDE 347-Konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda kirac\u0131, belirli s\u00fcreli s\u00f6zle\u015fmelerin s\u00fcresinin bitiminden en az onbe\u015f g\u00fcn \u00f6nce bildirimde bulunmad\u0131k\u00e7a, s\u00f6zle\u015fme ayn\u0131 ko\u015fullarla bir y\u0131l i\u00e7in uzat\u0131lm\u0131\u015f say\u0131l\u0131r. Kiraya veren, s\u00f6zle\u015fme s\u00fcresinin bitimine dayanarak s\u00f6zle\u015fmeyi sona erdiremez. Ancak, on y\u0131ll\u0131k uzama s\u00fcresi sonunda kiraya veren, bu s\u00fcreyi izleyen her uzama y\u0131l\u0131n\u0131n bitiminden en az \u00fc\u00e7 ay \u00f6nce bildirimde bulunmak ko\u015fuluyla, herhangi bir sebep g\u00f6stermeksizin s\u00f6zle\u015fmeye son verebilir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Yani belirli s\u00fcreli kira s\u00f6zle\u015fmelerinde s\u00f6zle\u015fme bitmesinden 15 g\u00fcn \u00f6nce bildirimde bulunulmas\u0131 halinde&nbsp; kirac\u0131 kira s\u00f6zle\u015fmesini fesih edebilir aksi halde bir y\u0131l daha uzam\u0131\u015f say\u0131l\u0131r. Burada kirac\u0131 bildirimi yaz\u0131l\u0131 \u015fekilde yapmal\u0131d\u0131r.<\/p>\n\n\n\n<p>MADDE 348- Konut ve \u00e7at\u0131l\u0131 i\u015f yeri kiralar\u0131nda fesih bildiriminin ge\u00e7erlili\u011fi, yaz\u0131l\u0131 \u015fekilde yap\u0131lmas\u0131na ba\u011fl\u0131d\u0131r.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">&nbsp;Relevant Supreme Court Decisions:<\/h4>\n\n\n\n<p class=\"has-text-align-justify\">\u201cHal b\u00f6yle olunca, mahkemece; yukar\u0131da a\u00e7\u0131klanan maddi ve hukuki olgular \u00e7er\u00e7evesinde, daval\u0131 kirac\u0131n\u0131n, s\u00f6zle\u015fme s\u00fcresi sona ermeden, 18\/11\/2013 tarihinde ta\u015f\u0131nmaz\u0131 erken tahliye etti\u011fi dikkate al\u0131narak, tahliye tarihine kadar \u00f6denmeyen kira bedelleri ile birlikte tahliye tarihinden itibaren belirlenen makul s\u00fcre kira tazminat\u0131ndan sorumlu oldu\u011fu g\u00f6zetilerek, buna g\u00f6re hesaplama ve de\u011ferlendirme yap\u0131lmas\u0131 y\u00f6n\u00fcnden uzman bilirki\u015fiden Yarg\u0131tay ve taraf denetimine elveri\u015fli rapor al\u0131nmas\u0131; bundan sonra \u00f6denen kira bedeli ve depozito bedeli mahsup edilmek suretiyle a\u015fan k\u0131sm\u0131n h\u00fck\u00fcm alt\u0131na al\u0131nmas\u0131 gerekirken; eksik inceleme ve yan\u0131lg\u0131l\u0131 de\u011ferlendirme ile yaz\u0131l\u0131 \u015fekilde h\u00fck\u00fcm tesisi de hatal\u0131 olmu\u015ftur.\u201d <strong>(Yarg\u0131tay 3. HD., E. 2020\/10885 K. 2020\/7857 T. 16.12.2020)<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-justify\">\u201cKirac\u0131, s\u00f6zle\u015fme s\u00fcresine veya fesih d\u00f6nemine uymaks\u0131z\u0131n kiralanan\u0131 erken tahliye etti\u011fi durumda; kural olarak T\u00fcrk Bor\u00e7lar Kanununun 325. maddesine g\u00f6re, anahtar teslim tarihine kadar kira bedelinden, anahtar teslim tarihinden itibaren ise kiralanan\u0131n ayn\u0131 \u015fartlarda kiraya verilebilece\u011fi makul s\u00fcre kira bedeli ile sorumludur. Bununla birlikte, TBK\u2019n\u0131n 112. maddesi g\u00f6ndermesi ile ayn\u0131 kanunun 52. maddesi uyar\u0131nca, <em>kiraya verenin bu yerin yeniden kiralanmas\u0131 konusunda gayret g\u00f6stermesi, b\u00f6ylece zarar\u0131n artmas\u0131n\u0131 \u00f6nlemesi i\u00e7in kendisine d\u00fc\u015fen \u00f6devi yapmas\u0131 gerekir. <\/em>Bu durumda kiraya verenin zarar\u0131, tahliye tarihinden kiralanan\u0131n ayn\u0131 ko\u015fullarla yeniden kiraya verilebilece\u011fi tarihe kadar bo\u015f kald\u0131\u011f\u0131 s\u00fcreye ili\u015fkin kira bedelinden ibarettir.\u201d <strong>(Yarg\u0131tay 3.
