Ancak \u00c7al\u0131\u015fma S\u00fcreleri Y\u00f6netmeli\u011fi\u2019nin 3. Maddesi, \u00e7al\u0131\u015fma s\u00fcresi kavram\u0131n\u0131 \u201c\u00c7al\u0131\u015fma s\u00fcresi, i\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015fte ge\u00e7irdi\u011fi s\u00fcredir. <a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuatmetin\/1.5.4857.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Labor Law |<\/a>\u2019nun 66. maddesinin birinci f\u0131kras\u0131ndaki s\u00fcrelerde \u00e7al\u0131\u015fma s\u00fcrelerinden say\u0131l\u0131r.\u201d \u015feklinde ifade etmi\u015ftir. Bu minvalde, sabah ak\u015fam belirli saatlerde yap\u0131lan i\u015f faaliyeti a\u015fa\u011f\u0131da ve s\u0131n\u0131rl\u0131 say\u0131lan haller durumunda \u00e7al\u0131\u015fma s\u00fcresinden say\u0131lan haller olarak kar\u015f\u0131m\u0131za \u00e7\u0131kmaktad\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00c7al\u0131\u015fma S\u00fcresinden Say\u0131lan Durumlar<\/h2>\n\n\n\n<p class=\"has-text-align-justify\">\u0130\u015f Kanunu\u2019nun 66. maddesi \u201cHangi durumda i\u015f\u00e7i fiilen \u00e7al\u0131\u015fmasa bile haftal\u0131k \u00e7al\u0131\u015fma s\u00fcre hesab\u0131 yap\u0131l\u0131rken, i\u015f\u00e7inin \u00e7al\u0131\u015fm\u0131\u015f say\u0131laca\u011f\u0131n\u0131 d\u00fczenlemi\u015ftir\u201d. Taraflar s\u00f6zle\u015fme kurulurken i\u015f\u00e7i lehine, hangi s\u00fcrelerin \u00e7al\u0131\u015fma s\u00fcrelerinden say\u0131laca\u011f\u0131n\u0131 belirleme hakk\u0131na sahiptir. \u00d6rne\u011fin; baz\u0131 toplu i\u015f s\u00f6zle\u015fmelerinde \u00f6\u011fle yeme\u011fi haricinde g\u00fcnde iki kez \u00e7ay molas\u0131 gibi s\u00fcrelerin \u00e7al\u0131\u015fma s\u00fcresinden say\u0131larak kararla\u015ft\u0131r\u0131ld\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. Bu s\u00fcrelere \u00f6rnekleri incelersek :<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">1) \u0130\u015f\u00e7inin i\u015fe haz\u0131r halde bekledi\u011fi s\u00fcre<\/h3>\n\n\n\n<p>\u0130\u015f\u00e7inin i\u015finde ve her an i\u015f g\u00f6rmeye haz\u0131r halde bulunmakla beraber \u00e7al\u0131\u015ft\u0131r\u0131lmaks\u0131z\u0131n, \u00e7\u0131kacak i\u015fi bekleyerek ge\u00e7irdi\u011fi s\u00fcreler, i\u015f\u00e7i fiilen \u00e7al\u0131\u015fmasa bile kanun gere\u011fi \u00e7al\u0131\u015fma s\u00fcresinden say\u0131lm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">\u00d6rne\u011fin; kasiyerin bo\u015f d\u00fckkanda m\u00fc\u015fteri gelmesini beklemesi, \u015fof\u00f6r\u00fcn kamyonun y\u00fcklenmesini beklemesi gibi i\u015f\u00e7inin fiilen \u00e7al\u0131\u015fmamas\u0131 bu s\u00fcrelerin de \u00e7al\u0131\u015fma s\u00fcresinden say\u0131lacak olmas\u0131 sonucuna \u00e7\u0131kmaktad\u0131r. Belirtmek gerekir ki, bu durum sadece i\u015fin niteli\u011finden de\u011fil, mal veya hizmet \u00fcretimi kesintiye u\u011frad\u0131\u011f\u0131 zamanda g\u00fcndeme gelecektir. Mesela, i\u015fveren ar\u0131za nedeniyle \u00e7al\u0131\u015ft\u0131rd\u0131\u011f\u0131 i\u015f\u00e7isini i\u015fyerinde tutmak yerine evine g\u00f6ndermi\u015fse, \u00e7al\u0131\u015fma s\u00fcresinin bitimine kadar evinde ge\u00e7irdi\u011fi s\u00fcre i\u015f s\u00fcresinden say\u0131l\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2) Yer ve sualt\u0131na inip \u00e7\u0131kmak i\u00e7in ge\u00e7en s\u00fcre<\/h3>\n\n\n\n<p class=\"has-text-align-justify\">Baz\u0131 i\u015f\u00e7iler madenlerde, ta\u015f ocaklar\u0131nda veya her ne \u015fekilde olursa olsun yeralt\u0131nda veya su alt\u0131nda \u00e7al\u0131\u015fmaktad\u0131r. Bu tarz yerlerde \u00e7al\u0131\u015fan i\u015f\u00e7ilerin k\u0131y\u0131lara, dehlizlere veya as\u0131l \u00e7al\u0131\u015fma yerlerine inmeleri ve \u00e7al\u0131\u015ft\u0131klar\u0131 yerlerden \u00e7\u0131kmalar\u0131 i\u00e7in belli bir s\u00fcre ge\u00e7mesi gerekmektedir. \u0130\u015fin niteli\u011finden kaynaklanan bu s\u00fcreler i\u015f\u00e7i aleyhine olarak i\u015f\u00e7i fiilen \u00e7al\u0131\u015fm\u0131yor gerek\u00e7esiyle \u00e7al\u0131\u015fma s\u00fcresine dahil etmemek, ahlaka ve vicdana ayk\u0131r\u0131l\u0131k te\u015fkil edecektir. Bu y\u00fczden \u0130\u015f Hukuku kanuni bir korumayla, bu s\u00fcreleri \u00e7al\u0131\u015fma s\u00fcrelerine dahil ederek i\u015f\u00e7i lehine bir h\u00fck\u00fcm getirmi\u015ftir. Ancak maddenin kapsam\u0131 yer veya sualt\u0131nda \u00e7al\u0131\u015fan t\u00fcm i\u015f\u00e7ileri kapsarken, y\u00fcksek irtifa gereken i\u015fler bu madde kapsam\u0131na dahil edilmemi\u015ftir. Ama\u00e7sal yorum yaparak; y\u00fcksek k\u00f6pr\u00fc in\u015faat\u0131 ya da r\u00fczgar trib\u00fcn\u00fc in\u015faatlar\u0131 da bu madde kapsam\u0131na dahil edilmelidir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3) Emzirme izni s\u00fcresi<\/h3>\n\n\n\n<p class=\"has-text-align-justify\">\u0130\u015f Hukuku, gebe ve anne kad\u0131nlar i\u00e7in bir\u00e7ok \u00f6zel d\u00fczenleme getirmi\u015ftir. Bu d\u00fczenlemelerden biri de, \u00e7ocuk emziren kad\u0131nlar\u0131n \u00e7ocuklar\u0131na s\u00fct vermek i\u00e7in belirtilen s\u00fcreyi, \u00e7al\u0131\u015fma s\u00fcresine dahil edilmesidir. \u0130\u015f Kanunu\u2019nun 74. maddesinin son f\u0131kras\u0131nda; kad\u0131n i\u015f\u00e7iye, \u00e7ocu\u011fu bir ya\u015f\u0131na gelinceye kadar her g\u00fcn bir bu\u00e7uk saat emzirme izni verilmesi gerekti\u011fini d\u00fczenlemi\u015ftir. Kad\u0131n i\u015f\u00e7inin, bir bu\u00e7uk saat \u00e7ocu\u011funu emzirmek i\u00e7in belirlenen g\u00fcnl\u00fck saati, \u00e7al\u0131\u015fma s\u00fcresinden say\u0131lm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4) Yolda ge\u00e7en s\u00fcreler<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">a. \u00c7al\u0131\u015fmak \u00fczere g\u00f6nderme halinde<\/h4>\n\n\n\n<p class=\"has-text-align-justify\">\u0130\u015fverenler, i\u015f g\u00f6rme borcu alt\u0131nda olan i\u015f\u00e7ilerin i\u015fin niteli\u011finden veya ba\u015fka bir sebepten dolay\u0131 i\u015f\u00e7ilerini, i\u015fyerinin d\u0131\u015f\u0131na \u00e7al\u0131\u015fmak \u00fczere g\u00f6nderebilmektedir. Bu sebeple kanun, i\u015f\u00e7ilerin i\u015fveren taraf\u0131ndan ba\u015fka bir yerde \u00e7al\u0131\u015ft\u0131r\u0131lmak \u00fczere g\u00f6nderilmeleri halinde, yolda ge\u00e7en s\u00fcrelerin i\u015f s\u00fcresinden say\u0131lmas\u0131 gerekti\u011fini ifade etmi\u015ftir. \u00d6rne\u011fin; yolda kaza ge\u00e7iren arac\u0131n tamiri i\u00e7in g\u00f6nderilen i\u015f\u00e7inin, arac\u0131n bulundu\u011fu mahale giderken yolda ge\u00e7irdi\u011fi s\u00fcre \u00e7al\u0131\u015fma s\u00fcresinden say\u0131lacakt\u0131r.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">b. \u00c7al\u0131\u015f\u0131lacak yere birlikte ta\u015f\u0131ma s\u00fcresi<\/h4>\n\n\n\n<p class=\"has-text-align-justify\">\u0130\u015fin niteli\u011fi gere\u011fi i\u015f\u00e7ilerin toplu olarak getirilmesi ve g\u00f6t\u00fcr\u00fclmesi gereken \u00e7al\u0131\u015fmalarda i\u015f\u00e7inin i\u015fi g\u00f6rmek i\u00e7in g\u00f6t\u00fcr\u00fcld\u00fc\u011f\u00fc alana gidi\u015f ve geli\u015f s\u00fcresi \u00e7al\u0131\u015fma s\u00fcresinden say\u0131lm\u0131\u015ft\u0131r. Konu hakk\u0131nda d\u00fczenleme getiren \u0130\u015f Kanunu\u2019nun 66. Maddesinin 1. F\u0131kras\u0131n\u0131n (f) f\u0131kras\u0131 \u201cDemiryollar\u0131, karayollar\u0131 ve k\u00f6pr\u00fclerin yap\u0131lmas\u0131, korunmas\u0131 ya da onar\u0131m ve tadili gibi, i\u015f\u00e7ilerin yerle\u015fim yerlerinden uzak bir mesafede bulunan i\u015fyerlerine hep birlikte getirilip g\u00f6t\u00fcr\u00fclmeleri gereken her t\u00fcrl\u00fc i\u015flerde bunlar\u0131n toplu ve d\u00fczenli bir \u015fekilde g\u00f6t\u00fcr\u00fcl\u00fcp getirilmeleri esnas\u0131nda ge\u00e7en s\u00fcreler\u201d \u015feklinde ifade etmi\u015ftir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Yukar\u0131da ifade edilen madde kapsam\u0131na girmek i\u00e7in i\u015fyerinin maddede ifade edildi\u011fi gibi; demiryolu, karayolu gibi yerle\u015fim yerinden uzak olan ve toplu ula\u015f\u0131m ara\u00e7lar\u0131yla ula\u015f\u0131m\u0131n\u0131n zor oldu\u011fu yerlerde bulunmas\u0131 gerekmektedir. \u00d6zellikle bu t\u00fcr ta\u015f\u0131ma, i\u015f\u00e7i i\u00e7in sosyal yard\u0131m ama\u00e7l\u0131 yap\u0131lan ta\u015f\u0131malardan ayr\u0131lmas\u0131 gerekmektedir. Temel nokta, bu ta\u015f\u0131man\u0131n yap\u0131lmas\u0131 i\u015fin niteli\u011finden kaynakl\u0131yor olmas\u0131d\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5) \u0130\u015fverenin talimat\u0131yla g\u00f6nderme halinde as\u0131l i\u015fini yapmaks\u0131z\u0131n ge\u00e7en s\u00fcre<\/h3>\n\n\n\n<p class=\"has-text-align-justify\">\u0130\u015f Kanunu\u2019nun 66. maddesinin 1. f\u0131kras\u0131n\u0131n (d) bendi, \u201c\u0130\u015f\u00e7inin i\u015fveren taraf\u0131ndan ba\u015fka bir yere g\u00f6nderilmesi veya i\u015fveren evinde veya b\u00fcrosunda yahut i\u015fverenle ilgili herhangi bir yerde me\u015fgul edilmesi suretiyle as\u0131l i\u015fini yapmaks\u0131z\u0131n ge\u00e7irdi\u011fi s\u00fcreler\u201d \u015feklinde d\u00fczenleme getirmi\u015ftir. \u0130\u015fverenin talimat\u0131 sonucu, as\u0131l i\u015fini yapmak i\u00e7in bir yere g\u00f6nderilen i\u015f\u00e7inin o i\u015fi icra edebilmek i\u00e7in ge\u00e7irdi\u011fi s\u00fcreler \u00e7al\u0131\u015fma s\u00fcresinden say\u0131lm\u0131\u015ft\u0131r. Ayr\u0131ca kanun maddesi, i\u015f\u00e7inin i\u015f g\u00f6rmek i\u00e7in g\u00f6nderildi\u011fi yer ifadesini a\u00e7arak i\u015f\u00e7inin evinde veya b\u00fcrosunda ge\u00e7irdi\u011fi s\u00fcreyi de \u00e7al\u0131\u015fma s\u00fcresinden say\u0131lmas\u0131 gerekti\u011fini ifade etmi\u015ftir. Burada temel nokta, i\u015f\u00e7inin i\u015fveren taraf\u0131ndan herhangi bir i\u015f ile me\u015fgul edilmesidir. Kanun, bu me\u015fguliyet s\u0131ras\u0131nda ge\u00e7irilen s\u00fcrelerin i\u015f s\u00fcresinden say\u0131lmas\u0131n\u0131 h\u00fckme ba\u011flam\u0131\u015ft\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6) \u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi e\u011fitimlerinde ge\u00e7en s\u00fcreler<\/h3>\n\n\n\n<p class=\"has-text-align-justify\">\u0130\u015fverenlerin, i\u015f\u00e7iler i\u00e7in ayarlanan i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi e\u011fitimleri i\u00e7in i\u015fyeri d\u0131\u015f\u0131nda veya i\u00e7inde ge\u00e7irdikleri s\u00fcrenin de \u00e7al\u0131\u015fma s\u00fcresinden say\u0131laca\u011f\u0131n\u0131, \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Y\u00f6netmeli\u011fi\u2019nin 8. maddesinde h\u00fckme ba\u011flanm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>\u00c7al\u0131\u015fma S\u00fcresinini A\u015f\u0131lmas\u0131<\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-justify\">Yarg\u0131tay\u2019a g\u00f6re, 4857 say\u0131l\u0131 Kanun\u2019un 63. maddesi h\u00fckm\u00fcne g\u00f6re, g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcresi 11 saati a\u015famayaca\u011f\u0131ndan, 68. maddenin belirledi\u011fi 7.5 saati a\u015fan \u00e7al\u0131\u015fmalar y\u00f6n\u00fcnden en az bir saatlik ara dinlenmesi s\u00fcresinin, g\u00fcnl\u00fck en \u00e7ok 11 saate kadar olan \u00e7al\u0131\u015fmalarla ilgili oldu\u011fu kabul edilmelidir.
