Uygun \u0130lliyet Ba\u011f\u0131n\u0131n Olmas\u0131<\/p>\n\n\n\n<p>\u0130lliyet Ba\u011f\u0131n\u0131 Kesen Durumlar:<\/p>\n\n\n\n<p>1) \u0130\u015f\u00e7inin a\u011f\u0131r kusuru<\/p>\n\n\n\n<p>2) 3. ki\u015finin a\u011f\u0131r kusuru<\/p>\n\n\n\n<p>3) M\u00fccbir sebep (Tahmin edilemeyen ve engellenmesi m\u00fcmk\u00fcn olmayan durumlar)<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u0130\u015f kazas\u0131 meydana geldi\u011finde ne yap\u0131lmal\u0131?<\/h2>\n\n\n\n<p class=\"has-text-align-justify\">\u0130\u015fveren taraf\u0131ndan, o yer yetkili kolluk kuvvetlerine derhal ve SGK\u2019ya da en ge\u00e7 kazadan sonraki \u00fc\u00e7 i\u015fg\u00fcn\u00fc i\u00e7inde,<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Sigortal\u0131 bak\u0131m\u0131ndan ise; kendisi taraf\u0131ndan, bir ay\u0131 ge\u00e7memek \u015fart\u0131yla rahats\u0131zl\u0131\u011f\u0131n\u0131n bildirim yapmaya engel olmad\u0131\u011f\u0131 g\u00fcnden sonra \u00fc\u00e7 i\u015fg\u00fcn\u00fc i\u00e7inde, i\u015f kazas\u0131 bildirgesi ile do\u011frudan ya da taahh\u00fctl\u00fc posta ile SGK\u2019ya bildirilmesi zorunludur.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">E\u011fer i\u015f kazas\u0131 i\u015fverenin kontrol\u00fc d\u0131\u015f\u0131ndaki yerlerde meydana gelmi\u015f ise, bildirim s\u00fcreleri i\u015f kazas\u0131n\u0131n \u00f6\u011frenildi\u011fi tarihten itibaren ba\u015flar.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Kuruma bildirilen olay\u0131n i\u015f kazas\u0131 say\u0131l\u0131p say\u0131lmayaca\u011f\u0131 hakk\u0131nda bir karara var\u0131labilmesi i\u00e7in gerekti\u011finde, Kurumun denetim ve kontrol ile yetkilendirilen memurlar\u0131 taraf\u0131ndan veya \u00c7al\u0131\u015fma Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131 i\u015f m\u00fcfetti\u015fleri vas\u0131tas\u0131yla soru\u015fturma yap\u0131labilir. Bu soru\u015fturma sonunda yaz\u0131l\u0131 olarak bildirilen hususlar\u0131n ger\u00e7e\u011fe uymad\u0131\u011f\u0131 ve olay\u0131n i\u015f kazas\u0131 olmad\u0131\u011f\u0131 anla\u015f\u0131l\u0131rsa, Kurumca bu olay i\u00e7in yersiz olarak yap\u0131lm\u0131\u015f bulunan \u00f6demeler, \u00f6demenin yap\u0131ld\u0131\u011f\u0131 tarihten itibaren ger\u00e7e\u011fe ayk\u0131r\u0131 bildirimde bulunanlardan tahsil edilir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u0130\u015f G\u00f6remezlik T\u00fcrleri<\/h2>\n\n\n\n<p class=\"has-text-align-justify\"><strong>Ge\u00e7ici \u0130\u015f G\u00f6remezlik: <\/strong>Bir i\u015f kazas\u0131 veya meslek hastal\u0131\u011f\u0131 sonucu bedensel veya ruhsal bir zarara u\u011frayan i\u015f\u00e7inin ge\u00e7ici olarak \u00e7al\u0131\u015famamas\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"has-text-align-justify\"><strong>Kal\u0131c\u0131 \u0130\u015f G\u00f6remezlik: <\/strong>\u0130\u015f\u00e7inin i\u015f kazas\u0131 veya meslek hastal\u0131\u011f\u0131 sonucu u\u011frad\u0131\u011f\u0131 bedensel veya ruhsal zarar sebebiyle meslekte kazanma ve \u00e7al\u0131\u015fma g\u00fcc\u00fcnde s\u00fcrekli nitelikte bir azalman\u0131n do\u011fmas\u0131 halidir. \u00d6rne\u011fin: Gitar \u00e7alan ki\u015finin bir parma\u011f\u0131n\u0131 kaybetti\u011fi zaman \u00e7al\u0131\u015fma g\u00fcc\u00fc daha az oranda azal\u0131rken, ki\u015fi meslekte kazanma g\u00fcc\u00fcn\u00fc \u00e7ok b\u00fcy\u00fck oranda kaybeder.<\/p>\n\n\n\n<p>Relevant Supreme Court Decisions:<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Bir i\u015f yerinde y\u0131kanma yerleri, yani sigortal\u0131lar\u0131n ki\u015fisel v\u00fccut temizli\u011finin yap\u0131ld\u0131\u011f\u0131 yerlerin i\u015fyeri olarak kabul edildi\u011fine g\u00f6re, i\u015fverenin i\u015fyerinde \u00e7al\u0131\u015fan ve geceleri de i\u015fyerinde kalan sigortal\u0131lar i\u00e7in \u00f6zel y\u0131kanma yerleri haz\u0131rlamad\u0131\u011f\u0131 bu nedenle kazal\u0131 sigortal\u0131n\u0131n zorunlu olarak i\u015fyerinin yak\u0131n\u0131nda bulunan \u201cdereye\u201d girerek y\u0131kand\u0131\u011f\u0131 yeri i\u015fyeri eklentisi saym\u0131\u015f ve derede meydana gelen olay\u0131 i\u015f kazas\u0131 saym\u0131\u015ft\u0131r. GHK. 6.07.2005 tarih ve 2005\/10-444, 2005\/449 say\u0131l\u0131 karar\u0131)<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Makina \u015fefi ve y\u00f6netici olan sigortal\u0131n\u0131n,i\u015f\u00e7ilere gerekli talimat\u0131 verip kendisinin de oca\u011fa do\u011fru gitti\u011fi, \u00f6l\u00fcs\u00fcn\u00fcn yakla\u015f\u0131k bir saat kadar sonra derede bulundu\u011fu, \u00f6l\u00fcm\u00fcn\u00fcn ba\u015f\u0131n al\u0131n b\u00f6lgesine \u00e7eki\u00e7le vurulmu\u015f iki darbenin sonucu beyin kanamas\u0131ndan oldu\u011fu, \u00f6lmeden \u00f6nce 25 metre uzakl\u0131ktaki dereye kadar y\u00fcr\u00fcd\u00fc\u011f\u00fc, otopsi raporunda \u00fcst\u00fcn olas\u0131l\u0131\u011f\u0131n, ba\u015fka bir \u015fah\u0131s\u00e7a yap\u0131lm\u0131\u015f olabilece\u011fi fenni kan\u0131 olarak tespit edilmi\u015ftir. Savc\u0131l\u0131k soru\u015fturmas\u0131, olay\u0131n intihar m\u0131 yoksa, cinayet mi oldu\u011fu konusuna a\u00e7\u0131kl\u0131k getirememi\u015ftir. Var\u0131lan bu sonuca g\u00f6re;sigortal\u0131n\u0131n i\u015fyerindeyken, kendisini hemen veya sonradan beden veya ruh\u00e7a ar\u0131zaya u\u011fratan bir olay, ba\u015fkaca hi\u00e7bir ko\u015ful aranmaks\u0131z\u0131n Sosyal Sigortalar a\u00e7\u0131s\u0131ndan i\u015f kazas\u0131 say\u0131lacakt\u0131r. (Yarg.9.H.D.78\/8413E.)<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Bunun d\u0131\u015f\u0131nda,nas\u0131l i\u015fyerinde meydana gelen kazalar\u0131n nedenleri \u00fczerinde durulmuyorsa, i\u015fveren taraf\u0131ndan y\u00fcr\u00fct\u00fclmekte olan i\u015f dolay\u0131s\u0131yla i\u015fyerinin d\u0131\u015f\u0131na \u00e7\u0131kan i\u015f\u00e7i de, herhangi bir nedenle kazaya u\u011frarsa bu kazan\u0131n da i\u015f kazas\u0131 olarak nitelendirilmesi gerekir.
