Bu durumda i\u015f\u00e7inin yapt\u0131\u011f\u0131 i\u015fin niteli\u011fi, hizmet s\u00fcresi, i\u015f tecr\u00fcbesi ile i\u015fyerinin \u00f6zellikleri, ayn\u0131 veya benzer i\u015flerde \u00e7al\u0131\u015fan i\u015f\u00e7ilere \u00f6denen \u00fccretler g\u00f6z \u00f6n\u00fcne al\u0131narak, alabilece\u011fi \u00fccretle ilgili meslek odas\u0131 veya kurulu\u015fundan yahut i\u015f\u00e7i veya i\u015fveren sendikalar\u0131ndan sorularak ve t\u00fcm deliller birlikte de\u011ferlendirilerek i\u015f\u00e7inin ger\u00e7ek \u00fccretinin belirlenmesi gerekir.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Kay\u0131t d\u0131\u015f\u0131 istihdam olarak nitelendirilen s\u00f6z konusu \u00e7al\u0131\u015ft\u0131rma, iki \u015fekilde ortaya \u00e7\u0131kabilmektedir. Bunlardan birincisi, i\u015f\u00e7inin tamamen kay\u0131t d\u0131\u015f\u0131 \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131d\u0131r. Buna g\u00f6re i\u015fveren, fiilen i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rmas\u0131na ra\u011fmen bu \u00e7al\u0131\u015fmaya ili\u015fkin olarak herhangi bir beyanda bulunmamakta ve sistemde fiilen \u00e7al\u0131\u015fmakta olan i\u015f\u00e7i \u00e7al\u0131\u015fan olarak de\u011fil&nbsp; i\u015fsiz olarak g\u00f6r\u00fcnmektedir. Di\u011fer bir ifadeyle, i\u015fveren taraf\u0131ndan kay\u0131t d\u0131\u015f\u0131 \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015f\u00e7i her ne kadar hukuken \u201ci\u015f\u00e7i\u201d ve \u201csigortal\u0131\u201d olarak nitelendirilse de devlet nezdinde i\u015f\u00e7i ve i\u015fveren aras\u0131nda herhangi bir ili\u015fki g\u00f6r\u00fcnmemektedir. Bu \u015fekilde \u00e7al\u0131\u015fma \u015fekli ku\u015fkusuz hukuka ayk\u0131r\u0131 olup i\u015fveren a\u00e7\u0131s\u0131ndan hem para cezalar\u0131n\u0131n ve belirli devlet bor\u00e7lar\u0131n\u0131n hem de tazminat bor\u00e7lar\u0131n\u0131n do\u011fmas\u0131na sebebiyet verecektir.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Her ne kadar k\u0131sa vadede i\u015fveren a\u00e7\u0131s\u0131ndan \u00e7ok cazip bir tercih olarak g\u00f6z\u00fckse de i\u015f\u00e7inin \u00fccretinin eksik beyan edilmesi, i\u015fverene uzun vadede \u00e7ok daha fazla y\u00fck ve maliyet yaratacakt\u0131r. \u0130\u015fverenin bu hukuksuz uygulamas\u0131n\u0131n herhangi bir \u015fekilde ortaya \u00e7\u0131kmas\u0131 durumunda, i\u015fverenin \u00f6demek zorunda kalaca\u011f\u0131 idari para cezalar\u0131 ile prim bor\u00e7lar\u0131, k\u0131sa vadede elde etmeye \u00e7al\u0131\u015ft\u0131\u011f\u0131 k\u00e2r\u0131, ciddi bir zarara d\u00f6n\u00fc\u015ft\u00fcrecektir<strong>.<\/strong>&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-justify\">\u0130\u015f\u00e7inin sosyal g\u00fcvenlik primlerinin eksik yat\u0131r\u0131lmas\u0131, i\u015f\u00e7i a\u00e7\u0131s\u0131ndan hakl\u0131 nedenle fesih sebebi te\u015fkil eder. \u0130\u015f\u00e7inin i\u015f s\u00f6zle\u015fmesini bu sebebe ba\u011fl\u0131 olarak feshetmesi durumunda i\u015f\u00e7i, varsa di\u011fer zararlar\u0131n\u0131n tazmini yan\u0131nda, bir y\u0131ll\u0131k k\u0131dem \u015fart\u0131n\u0131 tamamlam\u0131\u015fsa ayr\u0131ca k\u0131dem tazminat\u0131na da hak kazan\u0131r.&nbsp;<\/p>\n\n\n\n<p><strong>Yarg\u0131tay Kararlar\u0131:<\/strong>&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Ger\u00e7ek \u00fccretin ise, i\u015f\u00e7inin k\u0131demi, yapt\u0131\u011f\u0131 i\u015fin \u00f6zelli\u011fi ve niteli\u011fine g\u00f6re i\u015f\u00e7iye \u00f6denmesi gereken \u00fccret oldu\u011fu, i\u015fyeri veya sigorta kay\u0131tlar\u0131na ge\u00e7mi\u015f \u00fccret olmad\u0131\u011f\u0131 Yarg\u0131tay\u2019\u0131n yerle\u015fmi\u015f g\u00f6r\u00fc\u015flerindendir. (21.HD.26.09.2000, 5270-6115)&nbsp;<\/li><li>Nitelikli olmayan i\u015f\u00e7iler a\u00e7\u0131s\u0131ndan imzal\u0131 bordrolar\u0131n davac\u0131y\u0131 ba\u011flay\u0131c\u0131l\u0131\u011f\u0131 kabul edilmekte ise de, nitelikli i\u015f\u00e7iler i\u00e7in bu ba\u011flay\u0131c\u0131l\u0131ktan s\u00f6z edilemez. (9.HD.01.02.1999, 18841-1158) (\u0130BD.1999\/2-463)&nbsp;<\/li><li><strong><em>Usta i\u015f\u00e7inin ger\u00e7ek \u00fccretinin ara\u015ft\u0131r\u0131lmas\u0131 gerekir<\/em><\/strong>. Ustal\u0131k isteyen bir i\u015fte asgari \u00fccretin \u00fcst\u00fcnde bir \u00fccretle \u00e7al\u0131\u015fan i\u015f\u00e7inin tazminat\u0131 ve \u00fccret alaca\u011f\u0131n\u0131n asgari \u00fccret \u00fczerinden de\u011fil, ger\u00e7ek \u00fccreti \u00fczerinden hesaplanmas\u0131 gerekir.(9.HD.22.10.1987, 8912-9447) (\u0130\u015f ve Hukuk,1988\/189-24,no:1983)&nbsp;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong><em>Nitelikli i\u015fler a\u00e7\u0131s\u0131ndan, imzal\u0131 dahi olsa, \u00fccret bordrolar\u0131 ba\u011flay\u0131c\u0131 de\u011fildir. <\/em><\/strong>Davac\u0131 i\u015f\u00e7i uzun s\u00fcreden beri ayn\u0131 i\u015fyerinde ustaba\u015f\u0131 olarak \u00e7al\u0131\u015ft\u0131\u011f\u0131na g\u00f6re, \u00fccret ve tazminat hesaplar\u0131n\u0131n asgari \u00fccret \u00fczerinden yap\u0131lmas\u0131 isabetsizdir. Asgari \u00fccret \u00fczerinden d\u00fczenlenen bordrolarda davac\u0131n\u0131n imzas\u0131n\u0131n bulunmas\u0131n\u0131n, nitelikli i\u015f\u00e7iler a\u00e7\u0131s\u0131ndan ba\u011flay\u0131c\u0131l\u0131\u011f\u0131 s\u00f6z konusu olamaz.(9.HD. 03.10.2000, 8614-13106, no: 71) (Yasa H.D.2001\/1-163,no:71)\u00a0<\/li><li><strong><em>\u0130\u015f\u00e7inin yapt\u0131\u011f\u0131 i\u015fe ve k\u0131demine g\u00f6re, bordrolara yans\u0131mayan ger\u00e7ek \u00fccreti ara\u015ft\u0131r\u0131lmal\u0131d\u0131r. <\/em><\/strong>Zararland\u0131r\u0131c\u0131 sigorta olay\u0131na maruz kalan i\u015f\u00e7inin vas\u0131fl\u0131 i\u015f\u00e7i oldu\u011fu dosya i\u00e7erisinden anla\u015f\u0131lmaktad\u0131r. \u00d6te yandan i\u015f\u00e7inin ya\u015f\u0131, yapt\u0131\u011f\u0131 i\u015fin niteli\u011fi ve k\u0131demi nazara al\u0131nd\u0131\u011f\u0131nda, asgari \u00fccretle \u00e7al\u0131\u015fmas\u0131 hayat\u0131n ola\u011fan ak\u0131\u015f\u0131na ve ya\u015fam deneyimlerine uygun olmayaca\u011f\u0131ndan, bordrodaki \u00fccretin ger\u00e7ek \u00fccreti yans\u0131tt\u0131\u011f\u0131 s\u00f6ylenemez. Hal b\u00f6yle olunca davac\u0131n\u0131n yapt\u0131\u011f\u0131 i\u015f, k\u0131demi ve ya\u015f\u0131 nazara al\u0131narak emsalinin ald\u0131\u011f\u0131 \u00fccretin ilgili meslek kurulu\u015flar\u0131ndan saptanarak buna g\u00f6re tazminat\u0131n hesaplanmas\u0131 gerekir.
