Uyu\u015fmazl\u0131k \u00e7\u00f6zu\u0308m mekanizmas\u0131n\u0131n i\u015fletilmesine ili\u015fkin usul ve esaslar Kurum taraf\u0131ndan du\u0308zenlenir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Uyu\u015fmazl\u0131k \u00c7\u00f6z\u00fcm Hizmet Sa\u011flay\u0131c\u0131 <\/h2>\n\n\n\n<p>Madde 24 \u2013<\/p>\n\n\n\n<p> (1) Kurum, U\u00c7HS\u2019lerin ta\u015f\u0131mas\u0131 gereken asgari nitelikleri, uymas\u0131 gereken kura lar\u0131 ve di\u011fer hususlar\u0131 tespit eder ve bunlar\u0131 internet sitesinden ve gerek oldu\u011fu ha lerde di\u011fer uygun ara\u00e7larla kamuoyuna duyurur. <\/p>\n\n\n\n<p>(2) U\u00c7HS olmak isteyen taraflar Kurum\u2019a ba\u015fvuruda bulunurlar. Kurum taraf\u0131ndan gerekli \u015fartlar\u0131 ta\u015f\u0131d\u0131\u011f\u0131 tespit edilen taraflara U\u00c7HS olarak faaliyette bulunabilmelerini teminen faaliyet belgesi d\u00fczenlenir. (Ek c\u00fcmle:RG-20\/4\/2021-31460) Kurum, \u0130nternet alan adlar\u0131na ili\u015fkin pazar ko\u015fular\u0131, uyu\u015fmazl\u0131k say\u0131lar\u0131 gibi hususlar\u0131 dikkate alarak faaliyet g\u00f6sterecek U\u00c7HS say\u0131s\u0131na \u00fcst s\u0131n\u0131r getirebilir. <\/p>\n\n\n\n<p>(3) U\u00c7HS\u2019lerin, ihtilaflar\u0131n \u00e7\u00f6z\u00fcm\u00fc s\u00fcrecini ba\u015far\u0131yla y\u00f6netebilecek, idari ve teknik yetkinli\u011fi haiz olmalar\u0131 ve olas\u0131 ihtilaf konular\u0131nda uzman yeterli say\u0131da hakemi listelerinde bulundurabilmeleri gerekir. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Uyu\u015fmazl\u0131k \u00c7\u00f6z\u00fcm Mekanizmas\u0131na Ba\u015fvuru <\/h2>\n\n\n\n<p>Uyu\u015fmazl\u0131k \u00e7\u00f6z\u00fcm mekanizmas\u0131na ba\u015fvuru i\u00e7in; <\/p>\n\n\n\n<p class=\"has-text-align-justify\">a) \u0130htilaf konusu alan ad\u0131n\u0131n, sahip olunan ya da ticarette kulan\u0131lan marka, ticaret unvan\u0131, i\u015fletme ad\u0131 ya da di\u011fer tan\u0131t\u0131c\u0131 i\u015faretlerle benzer ya da ayn\u0131 olmas\u0131 ve <\/p>\n\n\n\n<p class=\"has-text-align-justify\">b) Alan ad\u0131n\u0131 tahsis ettiren taraf\u0131n bu alan ad\u0131 ile ilgili yasal bir hakk\u0131 ya da ba\u011flant\u0131s\u0131n\u0131n olmamas\u0131 ve <\/p>\n\n\n\n<p class=\"has-text-align-justify\">c) Bu alan ad\u0131n\u0131n alan ad\u0131 sahibi taraf\u0131ndan k\u00f6t\u00fc niyetle tahsis ettirilmesi veya kulan\u0131lmas\u0131 gerekmektedir.  (Madde 25)<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Hakemler <\/h2>\n\n\n\n<p class=\"has-text-align-justify\">U\u00c7HS listelerinde yer alacak hakemlerin fikri m\u00fclkiyet haklar\u0131 hukuku, marka hukuku, ticaret hukuku veya bili\u015fim hukuku alanlar\u0131nda uzman olmas\u0131 gerekecektir. <\/p>\n\n\n\n<p class=\"has-text-align-justify\">U\u00c7HS&#8217;ler nezdinde aksi gerekmedik\u00e7e yaz\u0131l\u0131 inceleme ger\u00e7ekle\u015ftirilecek olup; taraflar \u015fahsen dinlenmeyecektir. (Madde 26)<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Karar\u0131n Al\u0131nmas\u0131 <\/h2>\n\n\n\n<p class=\"has-text-align-justify\">S\u00f6z konusu y\u00f6netmelik kapsam\u0131nda Hakem veya heyet, yasal mevzuat ve i\u00e7tihatlar\u0131 g\u00f6zeterek \u015fikayet\u00e7i talebi do\u011frultusunda alan adlar\u0131n\u0131n iptaline, \u015fikayet\u00e7i tarafa devrine veya talebin reddine karar verebilecektir.
