Yenilik; yap\u0131lan faaliyet neticesinde eskiye oranla daha iyi ve nitelikli hale getirmektir. Bu tan\u0131mdan yap\u0131lan faaliyetin nitelikle ba\u011flant\u0131l\u0131 oldu\u011fu g\u00f6r\u00fcnmektedir.\u00a0 \u00d6rnek olarak ; pencerelerin, \u0131s\u0131tma cihaz\u0131n\u0131n daha iyi olanla de\u011fi\u015ftirilmesi olabilir.\u00a0\u00a0<\/p>\n\n\n\n<p><strong>A- Ev Sahibinin De\u011fi\u015fiklik Yapmas\u0131<\/strong>&nbsp;<\/p>\n\n\n\n<p><strong>1)Yap\u0131lacak De\u011fi\u015fiklik Kira S\u00f6zle\u015fmesinin Feshini Gerektirmemeli<\/strong>&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-justify\">&nbsp;Kanunumuzda yer alan \u201ckira s\u00f6zle\u015fmesinin feshini gerektirmeyen\u201d k\u0131sm\u0131n\u0131n \u201ckira ili\u015fkisi feshedilmemi\u015fse\u201d \u015feklinde okunmas\u0131 gerekti\u011fi savunulmaktad\u0131r.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-justify\">&nbsp;\u00d6rne\u011fin TBK. 350 b.2\u2019de yer alan yeniden in\u015fa esasl\u0131 onar\u0131mlar b\u00f6yledir. E\u011fer kiralanan ta\u015f\u0131nmazda tadilat ve yap\u0131lacak de\u011fi\u015fiklikler kira s\u00f6zle\u015fmesini sona erdirecek nitelikte ise kiraya veren s\u00f6zle\u015fme s\u00fcresi bitmeden bu de\u011fi\u015fiklik ve yenilikleri yapamaz.&nbsp;<\/p>\n\n\n\n<p><strong>2) Kirac\u0131n\u0131n Katlanabilece\u011fi \u015eekilde Olmal\u0131<\/strong>&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Kiraya verinin yapaca\u011f\u0131 yenilik ve de\u011fi\u015fikliklerin, kirac\u0131 taraf\u0131ndan katlanabilir nitelikte olmas\u0131 gerekmektedir. Kiraya verence yap\u0131lan yenilik ve de\u011fi\u015fikliklerin kirac\u0131 taraf\u0131ndan katlan\u0131l\u0131p katlan\u0131lamayaca\u011f\u0131n\u0131n de\u011ferlendirmesinin objektif \u00f6l\u00e7\u00fclere g\u00f6re yap\u0131lmas\u0131 gerekti\u011fi savunulmaktad\u0131r. Yani burada bak\u0131lacak olan husus kirac\u0131n\u0131n bu yenilik ve de\u011fi\u015fiklikler kar\u015f\u0131s\u0131ndaki durumudur. Bu durum incelenirken, giri\u015filen faaliyetin s\u00fcresi, kirac\u0131n\u0131n d\u00fc\u015fece\u011fi durum, etkileme alan\u0131 ve g\u00f6rece\u011fi ekonomik kar\u015f\u0131l\u0131k gibi hususlara bak\u0131lmas\u0131 gerekmektedir. Bunun gibi kriterler incelendikten sonra ise sonu\u00e7 olarak kirac\u0131n\u0131n kullan\u0131m hakk\u0131 ola\u011fan\u00fcst\u00fc s\u0131n\u0131rlanmakta ise kirac\u0131n\u0131n katlanabilirlik durumu ger\u00e7ekle\u015fmemi\u015f demektir.&nbsp;<\/p>\n\n\n\n<p><strong>3. D\u00fcr\u00fcstl\u00fck Kural\u0131na Uygun Olmal\u0131<\/strong>&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Kanunda yer alan \u201cKirac\u0131n\u0131n menfaatlerinin g\u00f6zetmekle y\u00fck\u00fcml\u00fc olunmas\u0131\u201d k\u0131sm\u0131 TMK. 2 de yer alan d\u00fcr\u00fcstl\u00fck kural\u0131n\u0131n somutla\u015fm\u0131\u015f hali olarak ele al\u0131nmaktad\u0131r. Yani kiraya veren kiralanan ta\u015f\u0131nmazda tadilat ve yapaca\u011f\u0131 de\u011fi\u015fikliklerde d\u00fcr\u00fcstl\u00fck kural\u0131 gere\u011fi olarak kirac\u0131n\u0131n menfaatlerini g\u00f6zetecektir. \u00d6rne\u011fin uygulamada kira ili\u015fkisinin sonland\u0131rmak i\u00e7in ev sahiplerinin, kiralanan ta\u015f\u0131nmazdaki kombiyi kendisi kullanaca\u011f\u0131 i\u00e7in alarak yerine eski veya sorunlu bir kombi cihaz\u0131 koydu\u011fu g\u00f6r\u00fclmektedir. Bu gibi uygulamalar, d\u00fcr\u00fcstl\u00fck kural\u0131na ayk\u0131r\u0131 olaca\u011f\u0131 gibi kirac\u0131n\u0131n da katlanmas\u0131n\u0131 imkans\u0131z hale getirmektedir.&nbsp;<\/p>\n\n\n\n<p><strong>B-Olu\u015fan Zarar\u0131n Tazmini<\/strong>&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Kiral\u0131k bir i\u015fyerinde bu kiralanan ta\u015f\u0131nmazda tadilat ve yapaca\u011f\u0131 de\u011fi\u015fiklikler s\u0131ras\u0131nda gelirde bir azalma olmu\u015fsa bu miktarda zarar kapsam\u0131nda istenebilecektir. Ayr\u0131ca, yap\u0131lan yenilik ve de\u011fi\u015fiklikler sonradan ortaya \u00e7\u0131kt\u0131\u011f\u0131ndan kiralananda de\u011fer art\u0131\u015f\u0131 olsa da aksi as\u0131l s\u00f6zle\u015fmede belirtilmedik\u00e7e kirac\u0131dan ek bir bedel istenemez.&nbsp;<\/p>\n\n\n\n<p><strong>C-Kirac\u0131n\u0131n R\u0131zas\u0131<\/strong>&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Kiraya verenin verece\u011fi r\u0131za, yenilik ve de\u011fi\u015fiklik \u00e7al\u0131\u015fmalar\u0131ndan \u00f6nce verilebilece\u011fi gibi, \u00e7al\u0131\u015fmalar s\u0131ras\u0131nda ve \u00e7al\u0131\u015fmalar bittikten sonra da verilebilir. Yaz\u0131l\u0131 \u015fekil \u015fart\u0131, taraflara da ispat kolayl\u0131\u011f\u0131 sa\u011flamaktad\u0131r. Kira s\u00f6zle\u015fmesi herhangi bir \u015fekle tabi olmad\u0131\u011f\u0131 halde, kiralananda de\u011fi\u015fiklik ve yenilik yap\u0131lmas\u0131 yaz\u0131l\u0131 \u015fekle tabidir. Bu durumda, kira s\u00f6zle\u015fmesi s\u00f6zl\u00fc yap\u0131lm\u0131\u015f bile olsa, kiralananda tadilat,&nbsp; yenilik ve de\u011fi\u015fiklik yap\u0131lmas\u0131 i\u00e7in yaz\u0131l\u0131 \u015fekil \u015fart\u0131 aranmaktad\u0131r. Kiraya veren onay verip vermeme hususunda serbest oldu\u011fundan, yenilik ve de\u011fi\u015fikli\u011fin kapsam\u0131n\u0131 da kendisi belirler. Yenilik ve de\u011fi\u015fiklik i\u00e7in verilen onay\u0131n kapsam\u0131n\u0131n kirac\u0131 taraf\u0131ndan a\u015f\u0131lmamas\u0131 gerekir. Dolay\u0131s\u0131yla kiraya veren, vermi\u015f oldu\u011fu onay\u0131 belirli \u015fartlara ba\u011flayabilir. Kirac\u0131, kiraya verenin bu \u015fartlar\u0131na uymak zorundad\u0131r<strong>.<\/strong>&nbsp;<\/p>\n\n\n\n<p><strong>D- Kirac\u0131n\u0131n De\u011fi\u015fiklik Yapma Hakk\u0131<\/strong>&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Kirac\u0131, kiraya verenin r\u0131zas\u0131 d\u0131\u015f\u0131nda yenilik ve de\u011fi\u015fiklikler yapmas\u0131 halinde masraflar\u0131 kendisine ait olmak \u00fczere, kiralanan\u0131 s\u00f6zle\u015fmeye uygun \u015fekilde eski durumuna getirmek zorundad\u0131r. Kiraya veren fesih hakk\u0131ndan ayr\u0131 olarak, kiraya veren r\u0131za d\u0131\u015f\u0131 yap\u0131lan yenilik ve de\u011fi\u015fikliklere nedeniyle genel h\u00fck\u00fcmlere g\u00f6re tazminat isteyebilir.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Kiraya verenin onay\u0131 ve kabul\u00fc i\u00e7in, adi yaz\u0131l\u0131 sekil \u015fart\u0131n\u0131n yerine getirilmesi yeterlidir. Kirac\u0131, yaln\u0131zca kiraya verenin yaz\u0131l\u0131 r\u0131zas\u0131yla kiralananda yenilik ve de\u011fi\u015fiklik yapabilir. Bu h\u00fck\u00fcm emredici olup yaz\u0131l\u0131 sekil \u015fart\u0131 bir ge\u00e7erlilik \u015fart\u0131 olmaktad\u0131r.&nbsp;<\/p>\n\n\n\n<p><strong>E- R\u0131za D\u0131\u015f\u0131 Yap\u0131lan De\u011fi\u015fiklik Sonras\u0131 De\u011fer Art\u0131\u015f\u0131<\/strong>&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-justify\">\u00a0R\u0131za d\u0131\u015f\u0131 yap\u0131lan yenilik ve de\u011fi\u015fiklik nedeniyle kiralanan e\u015fyada bir de\u011fer art\u0131s\u0131 meydana gelmi\u015fse, kirac\u0131 bundan dolay\u0131 herhangi bir hak talep edemez. Buna kar\u015f\u0131l\u0131k yap\u0131lan yenilik ve de\u011fi\u015fiklik nedeniyle, kiralananda bir de\u011fer azalmas\u0131 meydan gelmi\u015fse, kirac\u0131 bunu tazmin etmek zorundad\u0131r. Buna kar\u015f\u0131l\u0131k, yenilik ve de\u011fi\u015fikliklere r\u0131za g\u00f6steren kiraya veren, aksi yaz\u0131l\u0131 olarak kararla\u015ft\u0131r\u0131lmad\u0131k\u00e7a kiralanan\u0131n eski durumuyla geri verilmesini isteyemez. Bu, kirac\u0131y\u0131 kiralanan\u0131 hangi durumda teslim alm\u0131\u015fsa o durumda teslim etme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcnden kurtar\u0131r. Ancak taraflar, aralar\u0131nda yaz\u0131l\u0131 olarak anla\u015fmak \u015fart\u0131yla kirac\u0131n\u0131n kiralananda ortaya \u00e7\u0131kan de\u011fer art\u0131s\u0131n\u0131 isteyebilece\u011fini kararla\u015ft\u0131rabilirler.
