Bunun d\u0131\u015f\u0131nda i\u015f kazas\u0131n\u0131n meydana gelmesi ile \u00fc\u00e7 g\u00fcn i\u00e7erisinde de SGK ya bildirim yap\u0131lmal\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">\u0130\u015f\u00e7i taraf\u0131ndan ise,&nbsp; hastanede muayene olurken i\u015f kazas\u0131 oldu\u011funun \u00f6zellikle bildirilmesi, i\u015fveren taraf\u0131ndan g\u00f6t\u00fcr\u00fclen \u00f6zel hastanede hasta yat\u0131\u015f i\u015flemlerinin hukuka uygun bir \u015fekilde yap\u0131ld\u0131\u011f\u0131n\u0131 kontrol edilmesi, i\u015f kazas\u0131 kayd\u0131n\u0131n olu\u015fturulup olu\u015fturulmad\u0131\u011f\u0131n\u0131 kontrol edilmesi, taburcu olurken hasta dosyas\u0131ndan bir suret al\u0131nmas\u0131 \u00f6nemlidir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\"><strong>\u0130\u015f Kazas\u0131 Nedeni \u0130le Tazminat Davas\u0131nda Yarg\u0131lama Usul\u00fc :<\/strong> \u0130\u015f kazas\u0131 nedeniyle a\u00e7\u0131lacak tazminat davalar\u0131nda ilk olarak sigorta bildiriminin yap\u0131lm\u0131\u015f olmas\u0131 beklenir. \u0130\u015f kazas\u0131 SGK ya bildirilmemi\u015fse hakim taraf\u0131ndan uygun bir s\u00fcre verilerek gerekli bildirimin yap\u0131lmas\u0131 istenir. Akabinde tam te\u015fekk\u00fcll\u00fc e\u011fitim ve ara\u015ft\u0131rma hastanesinden i\u015f\u00e7inin muayene edilmesi ve rapor almas\u0131 talep edilir. Rapora itiraz edilmesini gerektirecek hususlar mevcutsa dosyan\u0131n adli t\u0131p kurumunca incelenmesi davac\u0131 vekili taraf\u0131ndan istenir. Dosyada i\u015f\u00e7inin sa\u011fl\u0131k rapor ve muayeneleri tamamland\u0131ktan sonra ise, dosya kusur derecelerinin hesaplanmas\u0131 i\u00e7in hesap bilirki\u015fisine g\u00f6nderilir. Burada bilirki\u015fi, i\u015f kazas\u0131n\u0131n meydana gelmesindeki i\u015f\u00e7i ve i\u015fverenin kusur derecelerini olay\u0131n meydana geli\u015f \u015fekline, i\u015f\u00e7iye i\u015fveren taraf\u0131ndan gerekli e\u011fitimlerin verilip verilmemesine, gerekli \u00f6nlemlerin al\u0131n\u0131p al\u0131nmamas\u0131na g\u00f6re titizlikle inceleyecektir. Dosyada kusur oranlar\u0131 da tespit edildikten sonra dosya hesap bilirki\u015fisine g\u00f6nderilerek talep edilen tazminat tutar\u0131 ve maddi , manevi kay\u0131plar incelenir daha sonra da karara \u00e7\u0131kar.<\/p>\n\n\n\n<p><strong>Ger\u00e7ekle\u015fen Kazan\u0131n \u0130\u015f Kazas\u0131 Say\u0131lman\u0131n Ko\u015fullar\u0131 :<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\"><li>Sigortal\u0131n\u0131n \u0130\u015fyerinde yahut i\u015fyeri say\u0131lan yerde bulunmas\u0131 s\u0131ras\u0131nda,<\/li><li>Kazan\u0131n i\u015fveren taraf\u0131ndan y\u00fcr\u00fct\u00fclmekte olan i\u015f nedeniyle meydana gelmesi,<\/li><li>Kaza ile sonu\u00e7 aras\u0131nda illiyet ( Nedensellik ) ba\u011f\u0131n\u0131n bulunmas\u0131,<\/li><li>Kaza sonucu bedence ve ruh\u00e7a bir zarara u\u011framas\u0131 gerekmektedir.<\/li><\/ol>\n\n\n\n<p><strong>Maddi ve Manevi Tazminat Davas\u0131nda \u0130stenebilecek&nbsp; Zararlar<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-justify\"><strong>1. Manevi Tazminat<\/strong>: Kanunda, manevi tazminat miktar\u0131n\u0131n teknik olarak hesaplanmas\u0131n\u0131 sa\u011flayan bir metot yoktur. Manevi tazminat miktar\u0131, baz\u0131 kriterler de\u011ferlendirilerek somutla\u015ft\u0131r\u0131l\u0131r. Manevi tazminat miktar\u0131n\u0131 belirleyen kriterler \u015funlard\u0131r (BK md. 47): Somut durumun \u00f6zellikleri, taraflar\u0131n mali durumlar\u0131, taraflar\u0131n olaydaki kusurlar\u0131n\u0131n a\u011f\u0131rl\u0131\u011f\u0131 (kusur oranlar\u0131),meydana gelen manevi zarar\u0131n b\u00fcy\u00fckl\u00fc\u011f\u00fc (\u00d6rne\u011fin, \u00f6l\u00fcm, yaralanma veya sadece \u00fcz\u00fcnt\u00fc duyulmas\u0131), olay tarihi itibariyle paran\u0131n sat\u0131n alma g\u00fcc\u00fc belirleme kriterleri olarak \u00f6rneklenebilir.<\/p>\n\n\n\n<p class=\"has-text-align-justify\"><strong>2. &nbsp;Maddi Tazminat: <\/strong>Maddi tazminat miktar\u0131n\u0131n hesaplanmas\u0131nda i\u015f kazas\u0131 ge\u00e7iren i\u015f\u00e7inin ya\u015f\u0131, ayl\u0131k \u00fccreti, i\u015f g\u00fcc\u00fc kay\u0131p oran\u0131, SGK taraf\u0131ndan sa\u011flanan yard\u0131mlar, i\u015f kazas\u0131 ge\u00e7iren i\u015f\u00e7inin kusur oran\u0131, i\u015fverenin kusur oran\u0131 ve sair hususlar g\u00f6z \u00f6n\u00fcnde bulundurulmaktad\u0131r.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Ge\u00e7ici i\u015f g\u00f6remezlik nedeniyle olu\u015fan kay\u0131plar; ki\u015finin olay nedeniyle kal\u0131c\u0131 bir sakatl\u0131\u011f\u0131 olmad\u0131\u011f\u0131 halde ge\u00e7ici bir \u015fekilde, iyile\u015finceye kadar \u201c\u00e7al\u0131\u015famad\u0131\u011f\u0131 s\u00fcre\u201d nedeniyle u\u011frad\u0131\u011f\u0131 maddi zarard\u0131r.Tedavi giderleri ve tedavi boyunca yap\u0131lan her t\u00fcrl\u00fc masraflar ile ekonomik gelece\u011fin sars\u0131lmas\u0131ndan do\u011fan maddi kay\u0131plar maddi talepler olarak \u00f6rneklenebilir.<\/p>\n\n\n\n<p><strong>\u0130\u015f Kazas\u0131 Say\u0131lan Haller Nelerdir?<\/strong><\/p>\n\n\n\n<p>5510 say\u0131l\u0131 <a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuatmetin\/1.5.5510.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Sosyal Sigortalar Ka<\/a>nunu\u2019nun 13. maddesine g\u00f6re i\u015f kazas\u0131 say\u0131lan ve tazminat davas\u0131 a\u00e7\u0131labilecek \u00f6rnek haller \u015funlard\u0131r:<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\"><li>\u0130\u015f\u00e7inin i\u015fverene ait i\u015fyerinde bulundu\u011fu s\u0131rada u\u011frad\u0131\u011f\u0131 her t\u00fcrl\u00fc bedensel veya ruhsal zararlar i\u015f kazas\u0131 say\u0131l\u0131r. \u0130\u015f\u00e7inin ne \u015fekilde yaraland\u0131\u011f\u0131 veya \u00f6ld\u00fc\u011f\u00fcn\u00fcn \u00f6nemi yoktur. \u0130\u015f\u00e7inin maruz kald\u0131\u011f\u0131 olay i\u015fyerinde ger\u00e7ekle\u015fmi\u015fse, i\u015f kazas\u0131 olarak kabul edilir ve tazminat davas\u0131na konu edilebilir. \u00d6rne\u011fin, kalp krizi i\u015fyerinde ger\u00e7ekle\u015fti\u011fi takdirde Yarg\u0131tay taraf\u0131ndan, sadece bu nedenle i\u015f kazas\u0131 olarak kabul edilmektedir.<\/li><li>Bir i\u015fverene ba\u011fl\u0131 olarak \u00e7al\u0131\u015fan i\u015f\u00e7inin g\u00f6revli olarak i\u015fyeri d\u0131\u015f\u0131nda ba\u015fka bir yere g\u00f6nderilmesi nedeniyle as\u0131l i\u015fini yapmaks\u0131z\u0131n ge\u00e7en zamanlarda i\u015f\u00e7inin maruz kald\u0131\u011f\u0131 fiiller i\u015f kazas\u0131 olup tazminat davas\u0131na konu olabilir.<\/li><li>\u0130\u015fveren taraf\u0131ndan y\u00fcr\u00fct\u00fclmekte olan i\u015f nedeniyle i\u015f\u00e7i kendi ad\u0131na ve hesab\u0131na ba\u011f\u0131ms\u0131z \u00e7al\u0131\u015f\u0131yorsa y\u00fcr\u00fctmekte oldu\u011fu i\u015f nedeniyle ger\u00e7ekle\u015fen her t\u00fcrl\u00fc olay i\u015f kazas\u0131 olarak tazminat davas\u0131na konu olabilir.<\/li><li>\u0130\u015f\u00e7inin, i\u015fverence sa\u011flanan bir ta\u015f\u0131tla i\u015fin yap\u0131ld\u0131\u011f\u0131 yere gidi\u015f geli\u015fi s\u0131ras\u0131nda meydana gelen her t\u00fcrl\u00fc kaza i\u015f kazas\u0131d\u0131r. Uygulamada, bu tarz kazalara trafik i\u015f kazas\u0131 denilmektedir.<\/li><\/ol>\n\n\n\n<p class=\"has-text-align-justify\"><strong>\u0130\u015f Kazas\u0131 Tazminat Davas\u0131 i\u00e7in Uygulanan Faiz : <\/strong>\u0130\u015f kazas\u0131 nedeniyle &nbsp;tazminat davas\u0131 genel olarak haks\u0131z fiil sorumlulu\u011funa dayanmaktad\u0131r. Bu nedenlerle haks\u0131z fiillere uygulanacak faiz uygulanacakt\u0131r. K\u0131saca ifade edilmesi gerekirse i\u015f kazas\u0131 tarihinden ba\u015flamak \u00fczere kanuni faiz uygulanacakt\u0131r.<\/p>\n\n\n\n<p><strong>\u00d6rnek Yarg\u0131tay Kararlar\u0131 \u015eu \u015eekildedir:<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-justify\">Ehliyeti olmayan i\u015f\u00e7inin i\u015fverenin talimat\u0131 ile kulland\u0131\u011f\u0131 ara\u00e7 ile trafik kazas\u0131 ge\u00e7irmesi sonucu yaralanmas\u0131 ( Yarg\u0131tay 10. Hukuk Dairesi 2015\/5642 Esas ve 2016\/7323 karar say\u0131l\u0131 Karar\u0131 )<\/p>\n\n\n\n<p class=\"has-text-align-justify\">\u0130\u015f\u00e7inin bah\u00e7e d\u00fczenlemesi i\u015fini yaparken i\u015f kazas\u0131 nedeniyle sol g\u00f6z\u00fcn\u00fcn k\u00f6r olmas\u0131 ( Yarg\u0131tay 21. Hukuk Dairesi 2018\/6589 Esas ve 2019\/4013 Karar say\u0131l\u0131 Karar\u0131 )<\/p>\n\n\n\n<p class=\"has-text-align-justify\">\u0130\u015f yeri taraf\u0131ndan tahsis edilmi\u015f servis arac\u0131 ile i\u015fe giderken kaza ge\u00e7irmesi sonucu yaralanmas\u0131 ( Yarg\u0131tay 21.
