Kirac\u0131 kira bedelini tam olarak \u00f6dese dahi zaman\u0131nda \u00f6demiyorsa bu durum kiraya veren y\u00f6n\u00fcnden kira s\u00f6zle\u015fmesini feshetmek i\u00e7in bir sebeptir. Kanunun bu h\u00fckm\u00fc ile korunan hukuki menfaat kiraya verenin kira bedelini eksiksiz ve zaman\u0131nda elde edebilmesinin sa\u011flanmas\u0131d\u0131r.\u00a0<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">6098 Say\u0131l\u0131 <a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuat?MevzuatNo=6098&amp;MevzuatTur=1&amp;MevzuatTertip=5\" target=\"_blank\" rel=\"noreferrer noopener\">Turkish Code of Obligations<\/a> Madde 352\/2 uyar\u0131nca; kiraya veren, kirac\u0131ya kira bedelini \u00f6demedi\u011fi i\u00e7in yaz\u0131l\u0131 olarak iki hakl\u0131 ihtar g\u00f6ndermi\u015f ise, a\u00e7aca\u011f\u0131 dava ile kira s\u00f6zle\u015fmesini sona erdirebilir. Kiraya veren, kira bedelinin \u00f6denmemesi ya da ge\u00e7 \u00f6denmesi nedeni ile bir y\u0131l i\u00e7erisinde iki defa hakl\u0131 yaz\u0131l\u0131 ihtarname g\u00f6nderdi\u011fi kirac\u0131 aleyhine tahliye davas\u0131 a\u00e7ma hakk\u0131na sahiptir. <\/p>\n\n\n\n<p>S\u00f6z konusu ihtarlar\u0131n noter \u00fczerinden yap\u0131lm\u0131\u015f olma \u015fart\u0131 bulunmamaktad\u0131r. Kirac\u0131 aleyhine icra takibi a\u00e7\u0131lmas\u0131 da ihtar yerine ge\u00e7mektedir. Uygulamada icra takibi a\u00e7man\u0131n bedeli daha d\u00fc\u015f\u00fck olup, bu icra takibi neticesinde kira borcunun \u00f6denmemesi halinde ise tahliye i\u015flemi m\u00fcmk\u00fcnd\u00fcr. Bu minvalde kira uyu\u015fmazl\u0131klar\u0131nda avukat ile s\u00fcrecin y\u00fcr\u00fct\u00fclmesi hem maddi olarak hem de s\u00fcre bak\u0131m\u0131ndan kay\u0131plar\u0131n \u00f6n\u00fcne ge\u00e7ecektir.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\"><strong>Turkish Code of Obligations <\/strong><\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\"><strong>MADDE 352-&nbsp;<\/strong>Kirac\u0131, kiralanan\u0131n teslim edilmesinden sonra, kiraya verene kar\u015f\u0131, kiralanan\u0131 belli bir tarihte bo\u015faltmay\u0131 yaz\u0131l\u0131 olarak \u00fcstlendi\u011fi h\u00e2lde bo\u015faltmam\u0131\u015fsa kiraya veren, kira s\u00f6zle\u015fmesini bu tarihten ba\u015flayarak bir ay i\u00e7inde icraya ba\u015fvurmak veya dava a\u00e7mak suretiyle sona erdirebilir. Kirac\u0131, bir y\u0131ldan k\u0131sa s\u00fcreli kira s\u00f6zle\u015fmelerinde kira s\u00fcresi i\u00e7inde; bir y\u0131l ve daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde ise bir kira y\u0131l\u0131 veya bir kira y\u0131l\u0131n\u0131 a\u015fan s\u00fcre i\u00e7inde kira bedelini \u00f6demedi\u011fi i\u00e7in kendisine yaz\u0131l\u0131 olarak iki hakl\u0131 ihtarda bulunulmas\u0131na sebep olmu\u015fsa kiraya veren, kira s\u00fcresinin ve bir y\u0131ldan uzun s\u00fcreli kiralarda ihtarlar\u0131n yap\u0131ld\u0131\u011f\u0131 kira y\u0131l\u0131n\u0131n bitiminden ba\u015flayarak bir ay i\u00e7inde, dava yoluyla kira s\u00f6zle\u015fmesini sona erdirebilir. Kirac\u0131n\u0131n veya birlikte ya\u015fad\u0131\u011f\u0131 e\u015finin ayn\u0131 il\u00e7e veya belde belediye s\u0131n\u0131rlar\u0131 i\u00e7inde oturmaya elveri\u015fli bir konutu bulunmas\u0131 durumunda kiraya veren, kira s\u00f6zle\u015fmesinin kurulmas\u0131 s\u0131ras\u0131nda bunu bilmiyorsa, s\u00f6zle\u015fmenin bitiminden ba\u015flayarak bir ay i\u00e7inde s\u00f6zle\u015fmeyi dava yoluyla sona erdirebilir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-kiraciya-gonderilen-ihtarnamede-nelere-dikkat-edilmelidir\"><strong> <\/strong>Kirac\u0131ya G\u00f6nderilen \u0130htarnamede Nelere Dikkat Edilmelidir?<\/h2>\n\n\n\n<p>TBK m.352\/2 uyar\u0131nca a\u00e7\u0131lacak olan tahliye davalar\u0131nda\u00a0<em>\u201chakl\u0131 ihtar\u201d<\/em>\u00a0kavram\u0131 ile ne anla\u015f\u0131lmas\u0131 gerekti\u011fi \u00f6nem arz etmektedir. Kiraya veren taraf\u0131ndan kirac\u0131ya g\u00f6nderilen ihtar\u0131n hakl\u0131 ihtar olarak kabul edilebilmesi i\u00e7in a\u015fa\u011f\u0131daki \u015fartlar\u0131n somut durumda mevcut olmas\u0131 gerekmektedir.<\/p>\n\n\n\n<p><strong>1-) <\/strong>Kirac\u0131ya ihtar yaz\u0131l\u0131 olarak g\u00f6nderilmelidir. Uygulamada ispat kolayl\u0131\u011f\u0131 sa\u011flamas\u0131 a\u00e7\u0131s\u0131ndan genellikle Noterlikler arac\u0131l\u0131\u011f\u0131yla ihtar g\u00f6nderildi\u011fi g\u00f6r\u00fclmektedir. Avukat taraf\u0131ndan a\u00e7\u0131lacak icra takibi de hakl\u0131 ihtar yerine ge\u00e7er. Tahliye i\u00e7in daha h\u0131zl\u0131 ve ekonomik olan se\u00e7enektir.<\/p>\n\n\n\n<p><strong>2-)<\/strong> Muaccel olan (vadesi gelen) kira bedeli tutar\u0131, kiran\u0131n hangi aya ait oldu\u011fu ve geciken kiran\u0131n \u00f6denmesi talebi ihtarnamede veya icra takibinde belirtilmelidir.\u00a0<\/p>\n\n\n\n<p><strong>3-) <\/strong>Kira s\u00fcresi i\u00e7erisinde veya kira s\u00fcresi bir y\u0131ldan fazlaysa son kira y\u0131l\u0131 i\u00e7erisinde geciken kira bedelleri ihtara konu edilmelidir.\u00a0<\/p>\n\n\n\n<p><strong>4-)<\/strong>\u00a0\u0130htar kirac\u0131ya usul\u00fcne uygun olarak tebli\u011f edilmi\u015f olmal\u0131d\u0131r.<strong>\u00a0<\/strong>Dolay\u0131s\u0131yla ihtar kirac\u0131ya g\u00f6nderilmesine ra\u011fmen tebli\u011f edilmemi\u015fse hakl\u0131 ihtar olarak kabul edilmeyecektir. Ki\u015filerin burada ihtar g\u00f6nderildikten sonra tebli\u011f mazbatas\u0131n\u0131 edinerek kontrol etmesi faydal\u0131 olacakt\u0131r.\u00a0<\/p>\n\n\n\n<p><strong>5-)\u00a0<\/strong>Kirac\u0131ya g\u00f6nderilen ihtarlar farkl\u0131 kira aylar\u0131na ili\u015fkin olmal\u0131d\u0131r.\u00a0Ayn\u0131 kira ay\u0131na ili\u015fkin olarak birden fazla ihtar g\u00f6nderilmesi hakl\u0131 ihtar olarak de\u011ferlendirilmeyecektir.\u00a0<\/p>\n\n\n\n<p><strong>6-)\u00a0<\/strong>\u0130htar\u0131n g\u00f6nderilme ve\u00a0kirac\u0131ya tebli\u011f tarihi\u00a0kira bedelinde gecikme yap\u0131lan kira aylar\u0131n\u0131n bulundu\u011fu kira d\u00f6nemi\/y\u0131l\u0131 i\u00e7erisinde olmal\u0131d\u0131r.<\/p>\n\n\n\n<p><strong>7-)<\/strong>\u00a0Yerle\u015fik Yarg\u0131tay uygulamas\u0131na g\u00f6re ihtar\u0131n g\u00f6nderilmesinden sonra fakat tebli\u011finden \u00f6nce kirac\u0131 taraf\u0131ndan geciken kira bedeli \u00f6denirse ihtar hakl\u0131 olarak de\u011ferlendirilmeyecektir.\u00a0Bir ba\u015fka deyi\u015fle \u00f6denmeyen kira bedeli ihtar\u0131n tebli\u011finden sonra \u00f6denirse ihtar hakl\u0131 olacakt\u0131r.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-iki-hakli-ihtar-sebebiyle-tahliye-davasi\">\u0130ki Hakl\u0131 \u0130htar Sebebiyle Tahliye Davas\u0131 <\/h2>\n\n\n\n<p id=\"h-iki-hakli-ihtar-sebebiyle-tahliye-davasi-tahliye-davasini-ise-soyle-tanimlayabiliriz-kira-sozlesmesinin-mahkeme-karari-ile-sona-erdirilmesine-yonelik-olarak-acilan-kiraya-verenin-kanunda-belirtilen-nedenlerle-tasinmazin-bosaltilmasi-icin-acmis-oldugu-davadir-tahliye-davasi-sonucunda-mahkeme-tarafindan-davanin-kabulune-ve-kiracinin-tahliyesi-yonunde-karar-vermesi-halinde-kiraya-veren-kiraci-aleyhine-ilamli-icra-takibi-baslatabilecektir-kiraya-veren-mahkemenin-vermis-oldugu-ilam-ile-birlikte-icra-takibi-baslatarak-kiracinin-tasinmazdan-cikarilmasini-talep-edebilecektir-tasinmazin-tahliyesi-yonunde-verilmis-bir-karar-tasinmazin-ayni-haklarina-dair-hukum-olmadigindan-karar-kesinlesmeden-icra-takibine-konulabilecektir-kiraci-ilamli-icra-takibine-karsi-itiraz-etse-dahi-icra-takibini-durduramayacaktir-tahliye-davasi-icin-hukuki-destek-almanizi-tavsiye-ederiz\">Tahliye davas\u0131n\u0131 ise \u015f\u00f6yle tan\u0131mlayabiliriz. Kira s\u00f6zle\u015fmesinin mahkeme karar\u0131 ile sona erdirilmesine y\u00f6nelik olarak a\u00e7\u0131lan, kiraya verenin kanunda belirtilen nedenlerle ta\u015f\u0131nmaz\u0131n bo\u015falt\u0131lmas\u0131 i\u00e7in a\u00e7m\u0131\u015f oldu\u011fu davad\u0131r. Tahliye davas\u0131 sonucunda mahkeme taraf\u0131ndan davan\u0131n kabul\u00fcne ve kirac\u0131n\u0131n tahliyesi y\u00f6n\u00fcnde karar vermesi halinde kiraya veren, kirac\u0131 aleyhine ilaml\u0131 icra takibi ba\u015flatabilecektir. Kiraya veren, mahkemenin vermi\u015f oldu\u011fu ilam ile birlikte icra takibi ba\u015flatarak kirac\u0131n\u0131n ta\u015f\u0131nmazdan \u00e7\u0131kar\u0131lmas\u0131n\u0131 talep edebilecektir. Ta\u015f\u0131nmaz\u0131n tahliyesi y\u00f6n\u00fcnde verilmi\u015f bir karar ta\u015f\u0131nmaz\u0131n ayni haklar\u0131na dair h\u00fck\u00fcm olmad\u0131\u011f\u0131ndan karar kesinle\u015fmeden icra takibine konulabilecektir. Kirac\u0131 ilaml\u0131 icra takibine kar\u015f\u0131 itiraz etse dahi icra takibini durduramayacakt\u0131r. Bu tarihten itibaren 1 ay sonra tahliye davas\u0131 a\u00e7\u0131labilir. \u00d6rne\u011fin kira s\u00f6zle\u015fmesi 20.05.2026 tarihinde sona eriyorsa mal sahibinin 20.06.2026 tarihine kadar tahliye
