Bu y\u00fck\u00fcml\u00fcl\u00fcklerin amac\u0131, i\u015f ili\u015fkisinin devam\u0131n\u0131 sa\u011flamak ve taraflar\u0131n haklar\u0131n\u0131 ve menfaatlerini g\u00f6zetmektir. Bunlardan biri olan e\u015fit davranma ikesi ise mevcut bulunan b\u00fct\u00fcn hukuk alanlar\u0131nda ge\u00e7erli olup \u0130\u015f Hukuku bak\u0131m\u0131ndan i\u015fverene i\u015fyerinde \u00e7al\u0131\u015fan i\u015f\u00e7iler aras\u0131nda \u00fccret, mesai saatleri , dini inan\u00e7, engellilik durumu, siyasi d\u00fc\u015f\u00fcncesi gibi hususlarda farkl\u0131 davranmama borcu y\u00fcklemektedir.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u0130\u015f Hukuku, ekonomik y\u00f6nden zay\u0131f, g\u00fc\u00e7s\u00fcz olan i\u015f\u00e7inin daha g\u00fc\u00e7l\u00fc olan i\u015fverenin keyfi say\u0131labilecek davran\u0131\u015flar\u0131na kar\u015f\u0131 korunmas\u0131 ihtiyac\u0131ndan do\u011fan bir hukuk dal\u0131d\u0131r. Bu koruma i\u015fverenlerin i\u015f\u00e7ileri aras\u0131nda ayr\u0131mc\u0131l\u0131k yapmama ve e\u015fit davranma borcuna uygun davranarak e\u015fitlik ilkesini hayata ge\u00e7irmeleriyle de yak\u0131ndan ili\u015fkilidir. Genel bir hukuk ilkesi olarak e\u015fitlik ilkesi, \u0130\u015f Hukuku bak\u0131m\u0131ndan da i\u015fverene, i\u015fyerinde \u00e7al\u0131\u015fan i\u015f\u00e7iler aras\u0131nda hakl\u0131 ve objektif bir neden olmad\u0131k\u00e7a farkl\u0131 davranmama borcu y\u00fcklemektedir. Bu temel ilke \u0130\u015f Hukuku alan\u0131nda e\u015fit i\u015flem, e\u015fit davranma ilkesi olarak i\u015fverenin y\u00f6netim yetkisini s\u0131n\u0131rlayan ve bi\u00e7imlendiren bir kurum olarak somutla\u015fmaktad\u0131r.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">E\u015fit davranma ilkesi <a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuatmetin\/1.5.4857.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Labor Law No. 4857<\/a>n 5. Maddesinde d\u00fczenlenmi\u015ftir. Bu madde e\u015fit davranma borcunu \u2018\u2019\u0130\u015f ili\u015fkisinde dil, \u0131rk, renk, cinsiyet, engellilik, siyasal d\u00fc\u015f\u00fcnce, felsef\u00ee inan\u00e7, din ve mezhep ve benzeri sebeplere dayal\u0131 ayr\u0131m yap\u0131lamaz.\u2019\u2019 \u015eeklinde d\u00fczenlenmi\u015ftir.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u00b7 Madde h\u00fckm\u00fc ile i\u015fveren esasl\u0131 sebepler olmad\u0131k\u00e7a, tam s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7i kar\u015f\u0131s\u0131nda k\u0131sm\u00ee s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7iye, belirsiz s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7i kar\u015f\u0131s\u0131nda belirli s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7iye farkl\u0131 i\u015flem yapamaz.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u00b7 \u0130\u015fveren, biyolojik veya i\u015fin niteli\u011fine ili\u015fkin sebepler zorunlu k\u0131lmad\u0131k\u00e7a, bir i\u015f\u00e7iye, i\u015f s\u00f6zle\u015fmesinin yap\u0131lmas\u0131nda, \u015fartlar\u0131n\u0131n olu\u015fturulmas\u0131nda, uygulanmas\u0131nda ve sona ermesinde, cinsiyet veya gebelik nedeniyle do\u011frudan veya dolayl\u0131 farkl\u0131 uygulama yapamaz.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u00b7 Ayn\u0131 veya e\u015fit de\u011ferde bir i\u015f i\u00e7in cinsiyet nedeniyle daha d\u00fc\u015f\u00fck \u00fccret kararla\u015ft\u0131r\u0131lamaz. \u0130\u015f\u00e7inin cinsiyeti nedeniyle \u00f6zel koruyucu h\u00fck\u00fcmlerin uygulanmas\u0131, daha d\u00fc\u015f\u00fck bir \u00fccretin uygulanmas\u0131n\u0131 hakl\u0131 k\u0131lmaz. Bu \u00f6rnekleri artt\u0131rmak m\u00fcmk\u00fcn olup, somut olaya g\u00f6re de\u011ferlendirmek gerekmektedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"isverenin-esit-davranma-yukumlulugune-aykirilik\">\u0130\u015fverenin E\u015fit Davranma Y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne Ayk\u0131r\u0131l\u0131k :<\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">E\u015fit davranma ilkesinin ihlalini \u00f6ne s\u00fcren ve bunu kan\u0131tlayan i\u015f\u00e7i yasal bak\u0131mdan korunmu\u015ftur. \u0130\u015f ili\u015fkisinde veya sona ermesinde yukar\u0131daki f\u0131kra h\u00fck\u00fcmlerine ayk\u0131r\u0131 davran\u0131ld\u0131\u011f\u0131nda i\u015f\u00e7i, d\u00f6rt aya kadar \u00fccreti tutar\u0131ndaki uygun bir tazminattan ba\u015fka, yoksun b\u0131rak\u0131ld\u0131\u011f\u0131 haklar\u0131n\u0131 da talep edebilir. S\u00f6z konusu f\u0131kra metni emredici nitelikte oldu\u011fundan, an\u0131lan h\u00fckme ayk\u0131r\u0131 olan s\u00f6zle\u015fme kurallar\u0131 ge\u00e7ersizdir. G\u00f6r\u00fclece\u011fi \u00fczere burada ayr\u0131ma u\u011frad\u0131\u011f\u0131n\u0131n d\u00fc\u015f\u00fcnen i\u015f\u00e7i \u00fczerinde ispat y\u00fck\u00fc bulunmaktad\u0131r.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">K\u0131saca, yapt\u0131r\u0131mlar \u015f\u00f6yle s\u0131ralanabilir:<\/p>\n\n\n\n<ul class=\"has-black-color has-text-color wp-block-list\"><li>Yoksun b\u0131rak\u0131ld\u0131\u011f\u0131 haklar\u0131 talep edebilir,<\/li><li>\u0130\u015f\u00e7i i\u00e7in hakl\u0131 fesih nedeni ortaya \u00e7\u0131kar,<\/li><li>\u0130\u015f\u00e7i bu maddede \u00f6ng\u00f6r\u00fclen tazminata hak kazan\u0131r (4 aya kadar \u00fccreti tutar\u0131nda tazminat)<\/li><li>\u0130\u015f K m.99\/a uyar\u0131nca, bu Kanunun \u201c5 inci maddesinde \u00f6ng\u00f6r\u00fclen ilke ve y\u00fck\u00fcml\u00fcl\u00fcklere ayk\u0131r\u0131 davranan i\u015fveren veya i\u015fveren vekiline bu durumdaki her i\u015f\u00e7i i\u00e7in\u201d bir idar\u00ee para cezas\u0131 verilir.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"esit-davranma-ilkesinin-uygulanabilmesi-icin-gerekli-olan-sartlar-nelerdir\">E\u015fit Davranma \u0130lkesinin Uygulanabilmesi \u0130\u00e7in Gerekli Olan \u015eartlar Nelerdir?<\/h2>\n\n\n\n<p class=\"has-black-color has-text-color\">E\u015fit davranma ilkesi her i\u015f yerinde ve her durumda uygulanmas\u0131 m\u00fcmk\u00fcn olmayan bir sorumluluktur. E\u015fit davranma ilkesinin s\u00f6z konusu olabilmesi i\u00e7in belli unsurlar\u0131n ger\u00e7ekle\u015fmi\u015f olmas\u0131 gerekir. E\u015fit davranma ilkesinin uygulanabilmesi i\u00e7in Yarg\u0131tay kararlar\u0131nda ifade edildi\u011fi \u015fekliyle;<\/p>\n\n\n\n<ul class=\"has-black-color has-text-color wp-block-list\"><li> \u0130\u015f\u00e7ilerin ayn\u0131 i\u015f yerinin i\u015f\u00e7ileri olmas\u0131,<\/li><li> \u0130\u015fyerinde topluluk olmas\u0131,<\/li><li> Kolektif bir uygulaman\u0131n varl\u0131\u011f\u0131,<\/li><li> Zamanda birlik olmas\u0131,<\/li><li> \u0130\u015f\u00e7ilerin i\u015f s\u00f6zle\u015fmesiyle \u00e7al\u0131\u015f\u0131yor olmas\u0131 gerekmektedir.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"isverenin-esit-davranma-yukumlulugunun-istisnasi\">\u0130\u015fverenin E\u015fit Davranma Y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn \u0130stisnas\u0131 :<\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Bu borcun istisnas\u0131 yap\u0131lacak i\u015fin niteli\u011fine g\u00f6re de\u011fi\u015febilece\u011fi i\u00e7in her olaya \u00f6zg\u00fc ayr\u0131 ayr\u0131 incelenmelidir. \u00d6rne\u011fin i\u015fverenin a\u011f\u0131r i\u015fte \u00e7al\u0131\u015fan i\u015f\u00e7isine daha azla \u00fccret \u00f6demesi e\u015fit davranma borcuna ayk\u0131r\u0131l\u0131k te\u015fkil etmeyecektir. Bir ba\u015fka \u00f6rnekle de, hamile olan i\u015f\u00e7iye daha esnek sa\u011flanan \u00e7al\u0131\u015fma saatleri, di\u011fer i\u015f\u00e7iler a\u00e7\u0131s\u0131ndan da bu konuda talep hakk\u0131 do\u011furmayacakt\u0131r. Bu hususa \u00f6rnek olan Yarg\u0131tay uygulamas\u0131na bakacak olursak:<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Yarg\u0131tay Kararlar\u0131ndan baz\u0131lar\u0131n\u0131 inceledi\u011fimizde de; belli baz\u0131 durumlarda i\u015fverenin e\u015fit davranma borcunun varl\u0131\u011f\u0131ndan s\u00f6z edilmi\u015f, ancak \u201c esasl\u0131 nedenler olmad\u0131k\u00e7a\u201d ve \u201c biyolojik veya i\u015fin niteli\u011fine ili\u015fkin sebepler zorunlu k\u0131lmad\u0131k\u00e7a\u201d bu y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn bulunmad\u0131\u011f\u0131 vurgulanm\u0131\u015ft\u0131r (Yarg\u0131tay 9.HD. 25.7.2008 g\u00fcn 2008\/ 27310 E, 2008\/ 22095 K.).<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Y<strong>arg\u0131tay 9.HD. 2.12.2009 g\u00fcn, 2009\/33837 E, 2009\/ 32939 K : <\/strong><br>\u2018\u2019\u0130\u015fverence, i\u015f\u00e7iler aras\u0131nda farkl\u0131 uygulamaya gidilmesi y\u00f6n\u00fcnden nesnel nedenlerin varl\u0131\u011f\u0131 halinde e\u015fit i\u015flem borcuna ayk\u0131r\u0131l\u0131ktan s\u00f6z edilemez.\u2019\u2019 \u015eeklindedir.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\"><strong>Yarg\u0131tay 9. Hukuk Dairesi 2016\/24041 E. 2017\/15069 K. say\u0131l\u0131 ilam\u0131nda;<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Ayn\u0131 durumdaki i\u015f\u00e7ilere objektif ve farkl\u0131 davranmay\u0131 hakl\u0131 k\u0131lacak nedenler bulunmad\u0131k\u00e7a e\u015fit davran\u0131lmas\u0131 zorunludur. K\u0131saca ayn\u0131 durumdaki i\u015f\u00e7iler aras\u0131nda farkl\u0131l\u0131k yarat\u0131lmamal\u0131d\u0131r. \u0130\u015f\u00e7ilerin ki\u015fisel niteliklerinden ba\u011f\u0131ms\u0131z olarak \u00f6nceden belirlenmi\u015f bir esasa g\u00f6re \u00fccret \u00f6demesi yap\u0131l\u0131yor ise, bu g\u00f6reve atanan i\u015f\u00e7ilere \u00f6nceden belirlenen esasa g\u00f6re \u00f6ng\u00f6r\u00fclen \u00fccretin \u00f6denmesi gerekir.
