H\u00fck\u00fcml\u00fc, Ceza Hukukunun temel kavramlar\u0131ndan biridir ve \u015fu \u015fekilde tan\u0131mlanmaktad\u0131r: H\u00fck\u00fcml\u00fc, i\u015flemi\u015f oldu\u011fu herhangi bir su\u00e7tan dolay\u0131, su\u00e7u sabit g\u00f6r\u00fclen ve mahkumiyet karar\u0131 kesinle\u015ferek ceza infaz kurumlar\u0131nda s\u00f6z konusu cezas\u0131 infaz edilen kimsedir. Eski h\u00fck\u00fcml\u00fc ise, tahliye edilen h\u00fck\u00fcml\u00fcye verilen isimdir.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u00d6nceki ya\u015fam\u0131nda k\u00f6t\u00fc bir sab\u0131kas\u0131 bulunan bu kimselerin istihdam\u0131n\u0131n, \u00f6zellikle i\u015fyerinde ve i\u015f\u00e7i-i\u015fveren ili\u015fkilerinde g\u00fcvensizli\u011fe, tedirginli\u011fe ve teredd\u00fcde yol a\u00e7t\u0131\u011f\u0131 sosyal bir ger\u00e7ektir. Ancak t\u00fcm olumsuzluklara kar\u015f\u0131n, i\u015f bulmakta g\u00fc\u00e7l\u00fck \u00e7eken bu ki\u015filerin, ellerine ge\u00e7en her f\u0131rsat\u0131 en iyi \u015fekilde de\u011ferlendirmek ve haklar\u0131ndaki \u00f6nyarg\u0131lardan kurtulabilmek i\u00e7in, sadakat ve \u00f6zen borcunu di\u011fer \u00e7al\u0131\u015fanlara nazaran daha iyi \u015fekilde yerine getirmeye \u00e7al\u0131\u015facaklard\u0131r. \u00d6te yandan eski h\u00fck\u00fcml\u00fclerin \u00e7al\u0131\u015fma hayat\u0131nda yer almalar\u0131, ulusal ekonomiye katk\u0131da bulunaca\u011f\u0131 gibi, b\u00f6yle bir imkan\u0131n sa\u011flanmas\u0131, onlar\u0131 topluma y\u00fck olmaktan kurtaracakt\u0131r.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u00d6nemle belirtmek gerekir ki, 4857 say\u0131l\u0131<a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuatmetin\/1.5.4857.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"> Labor Law |<\/a>\u2019nun 30. maddesi en son 5763 say\u0131l\u0131 Kanun ile ciddi bir de\u011fi\u015fikli\u011fe u\u011fram\u0131\u015ft\u0131r. Yap\u0131lan de\u011fi\u015fiklikle, i\u015fg\u00fcc\u00fc piyasas\u0131nda dezavantajl\u0131 gruplar aras\u0131nda say\u0131lan eski h\u00fck\u00fcml\u00fc ve ter\u00f6r ma\u011fdurlar\u0131 i\u00e7in \u00f6zel sekt\u00f6rdeki i\u015fverenlere y\u00fcklenen \u00e7al\u0131\u015ft\u0131rma zorunlulu\u011fu kald\u0131r\u0131lm\u0131\u015ft\u0131r. \u015e\u00f6yle ki; daha \u00f6nce \u00f6z\u00fcrl\u00fc, eski h\u00fck\u00fcml\u00fc ve ter\u00f6r ma\u011fduru \u00e7al\u0131\u015ft\u0131rma zorunlulu\u011fu ba\u015fl\u0131\u011f\u0131n\u0131 ta\u015f\u0131yan bu madde ba\u015fl\u0131\u011f\u0131, yap\u0131lan yeni d\u00fczenleme ile \u201c\u00f6z\u00fcrl\u00fc ve eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131rma zorunlulu\u011fu\u201d olarak de\u011fi\u015ftirilmi\u015ftir. Ancak, yeni madde h\u00fckm\u00fcnde 50 veya daha fazla i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran \u00f6zel sekt\u00f6re ait i\u015f yerlerinde eski h\u00fck\u00fcml\u00fc ve ter\u00f6r ma\u011fduru \u00e7al\u0131\u015ft\u0131r\u0131lma zorunlulu\u011fu tamamen kald\u0131r\u0131lm\u0131\u015f, sadece \u00f6z\u00fcrl\u00fc i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rma oran\u0131 % 3 olarak h\u00fckme ba\u011flanm\u0131\u015ft\u0131r. Buna kar\u015f\u0131l\u0131k kamu i\u015fyerlerinde % 4 oran\u0131nda \u00f6z\u00fcrl\u00fc ve % 2 oran\u0131nda da eski h\u00fck\u00fcml\u00fc i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rma zorunlulu\u011fu benimsenmi\u015ftir. Sonu\u00e7 itibariyle, eski h\u00fck\u00fcml\u00fc i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rma zorunlulu\u011fu tamamen kamu kurum ve kurulu\u015flar\u0131n\u0131n y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne b\u0131rak\u0131lm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Yap\u0131lan de\u011fi\u015fiklik sonras\u0131 \u0130\u015f Kanunu\u2019nun 30. maddesine g\u00f6re,<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Kamu i\u015fverenleri, 50 veya daha fazla i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rd\u0131klar\u0131, kamu kurum ve kurulu\u015flar\u0131nda (kamu i\u015fyerlerinde) % 2 oran\u0131nda eski h\u00fck\u00fcml\u00fc i\u015f\u00e7iyi, mesleklerine uygun i\u015flerde \u00e7al\u0131\u015ft\u0131rmakla y\u00fck\u00fcml\u00fcd\u00fcrler. Ayn\u0131 il s\u0131n\u0131rlar\u0131 i\u00e7inde birden fazla i\u015fyeri bulunan i\u015fverenin bu kapsamda \u00e7al\u0131\u015ft\u0131rmakla y\u00fck\u00fcml\u00fc oldu\u011fu i\u015f\u00e7i say\u0131s\u0131, toplam i\u015f\u00e7i say\u0131s\u0131na g\u00f6re hesaplan\u0131r.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">\u00d6zel d\u00fczenlemeler:<\/p>\n\n\n\n<ul class=\"has-black-color has-text-color wp-block-list\"><li>\u0130\u015fyerinin i\u015f\u00e7isi iken sakatlanan, eski h\u00fck\u00fcml\u00fc ya da ter\u00f6r ma\u011fduru olanlara \u00f6ncelik tan\u0131n\u0131r.<\/li><li>\u0130\u015fverenler \u00e7al\u0131\u015ft\u0131rmakla y\u00fck\u00fcml\u00fc olduklar\u0131 i\u015f\u00e7ileri T\u00fcrkiye \u0130\u015f Kurumu arac\u0131l\u0131\u011f\u0131 ile sa\u011flarlar.<\/li><li>Bu kapsamda \u00e7al\u0131\u015ft\u0131r\u0131lacak i\u015f\u00e7ilerin nitelikleri, hangi i\u015flerde \u00e7al\u0131\u015ft\u0131r\u0131labilecekleri, bunlar\u0131n i\u015fyerlerinde genel h\u00fck\u00fcmler d\u0131\u015f\u0131nda ba\u011fl\u0131 olacaklar\u0131 \u00f6zel \u00e7al\u0131\u015fma ile mesle\u011fe y\u00f6neltilmeleri, mesleki y\u00f6nden i\u015fverence nas\u0131l i\u015fe al\u0131nacaklar\u0131, Adalet Bakanl\u0131\u011f\u0131 ile<\/li><li>\u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131nca birlikte \u00e7\u0131kar\u0131lacak y\u00f6netmelikle d\u00fczenlenir.<\/li><li>Yer alt\u0131 ve su alt\u0131 i\u015flerinde \u00f6z\u00fcrl\u00fc i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131r\u0131lamaz ve yukar\u0131daki h\u00fck\u00fcmler uyar\u0131nca i\u015fyerlerindeki i\u015f\u00e7i say\u0131s\u0131n\u0131n tespitinde yer alt\u0131 ve su alt\u0131 i\u015flerinde \u00e7al\u0131\u015fanlar hesaba kat\u0131lmaz.<\/li><\/ul>\n\n\n\n<p class=\"has-black-color has-text-color\">Engellilerin \u00c7al\u0131\u015fmas\u0131 : Tan\u0131mlamadan anla\u015f\u0131laca\u011f\u0131 \u00fczere, bir engellinin gerek kamuda gerekse \u00f6zel sekt\u00f6rde i\u015f\u00e7i olarak zorunlu istihdam kontenjan\u0131ndan yararlanabilmesi i\u00e7in maddede say\u0131lan engel durumlar\u0131ndan dolay\u0131 en az y\u00fczde k\u0131rk oran\u0131nda t\u00fcm v\u00fccut fonksiyon kayb\u0131n\u0131n olmas\u0131 ve bunun sa\u011fl\u0131k kurulu raporu ile belgelendirilmi\u015f olmas\u0131 gerekmektedir.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">\u201cEngelli Kamu Personel Se\u00e7me S\u0131nav\u0131 ve Engellilerin Devlet Memurlu\u011funa Al\u0131nmalar\u0131 Hakk\u0131nda Y\u00f6netmelik\u201d 4\/\u00e7 Maddesinde Kamu Personeli Olarak \u00c7al\u0131\u015ft\u0131r\u0131lacak Engelli Tan\u0131m\u0131 : Do\u011fu\u015ftan veya sonradan; bedensel, zihinsel, ruhsal, duyusal ve sosyal yetenekleri bak\u0131m\u0131ndan engel oran\u0131n\u0131n y\u00fczde k\u0131rk veya \u00fczerinde ve \u00e7al\u0131\u015fabilir durumda oldu\u011funu mevzuat h\u00fck\u00fcmlerine g\u00f6re al\u0131nacak sa\u011fl\u0131k kurulu raporu ile belgeleyenleri\u201d \u015feklinde yap\u0131lmaktad\u0131r.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Kamu kurum ve kurulu\u015flar\u0131nda \u00e7al\u0131\u015ft\u0131r\u0131lacak i\u015f\u00e7ilerin, 18 ya\u015f\u0131n\u0131 doldurmu\u015f T\u00fcrk vatanda\u015f\u0131 olmas\u0131, affa u\u011fram\u0131\u015f olsa bile baz\u0131 su\u00e7lardan dolay\u0131 mahkumiyeti bulunmamas\u0131, kamu kurum ve kurulu\u015funun \u00f6zel kanunlar\u0131ndaki \u015fartlar\u0131 ta\u015f\u0131yor olmas\u0131 da gerekmektedir (Kamu Kurum ve Kurulu\u015flar\u0131 Y\u00f6netmelik m. 4)<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u00d6zel i\u015fyerlerinde istihdam edilecek engellilerin T\u00fcrkiye \u0130\u015f Kurumu\u2019na kay\u0131t yapt\u0131rmalar\u0131 ve engellilikle ilgili belgelerini sunmas\u0131 gerekmektedir. Kamu i\u015fyerleri i\u00e7in ise ayr\u0131ca Engelli Kamu Personeli Seviye S\u0131nav\u0131 uygulanmaktad\u0131r. \u201cEngelli Kamu Personel Se\u00e7me S\u0131nav\u0131 ve Engellilerin Devlet Memurlu\u011funa Al\u0131nmalar\u0131 Hakk\u0131nda Y\u00f6netmelik\u201d gere\u011fi, devlet memuru olarak istihdam edilecek engelliler EKPSS veya kura ile memurlu\u011fa yerle\u015ftirileceklerdir. Devlet memurlu\u011funa yerle\u015ftirmede orta\u00f6\u011fretim, \u00f6n lisans ve lisans mezunu engellilerde EKPSS\u2019den al\u0131nan puan; ilk, orta, ilk\u00f6\u011fretim ve \u00f6zel e\u011fitim i\u015f uygulama merkezi veya okulu mezunu engellilerde ise kura usul\u00fc uygulanacakt\u0131r (Y\u00f6netmelik m. 13.)<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Bahsi ge\u00e7en maddeler birlikte de\u011ferlendirildi\u011finde, gerek \u0130\u015f Kanunu\u2019na g\u00f6re, gerekse Deniz \u0130\u015f Kanununa g\u00f6re \u00f6zel sekt\u00f6r i\u015fverenleri elli ve \u00fczerinde i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rd\u0131klar\u0131 i\u015fyerlerinde y\u00fczde \u00fc\u00e7 oran\u0131nda engelli i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rmak zorundad\u0131rlar. Kamuya ait i\u015fverenler ise elli ve \u00fczerinde i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rd\u0131klar\u0131 i\u015fyerlerinde y\u00fczde d\u00f6rt oran\u0131nda engelli i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rmak durumundad\u0131rlar.
