Deneme s\u00fcresi ile i\u015fveren i\u015f\u00e7inin i\u015fe ve i\u015fin niteliklerine uyum sa\u011flay\u0131p sa\u011flayamayaca\u011f\u0131 y\u00f6n\u00fcnde kanaat edinir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"deneme-sureli-calisma-nedir\">Deneme S\u00fcreli \u00c7al\u0131\u015fma Nedir?<\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u0130\u015f\u00e7i ile i\u015fveren aras\u0131ndaki i\u015f s\u00f6zle\u015fmesinin, s\u00f6zle\u015fmeyi devam ettirip ettirmeme karar\u0131n\u0131n belirli bir s\u00fcre sonras\u0131nda verilmesine imk\u00e2n sa\u011flanan s\u00f6zle\u015fmelere deneme s\u00fcreli i\u015f s\u00f6zle\u015fmesi olarak isimlendirilmektedir.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">4857 say\u0131l\u0131<a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuatmetin\/1.5.4857.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"> Labor Law |<\/a>\u2019nun 15. Maddesinde d\u00fczenlenmi\u015f olup Kanun\u2019un ilgili maddesi \u015fu \u015fekildedir: \u2018\u2019Taraflarca i\u015f s\u00f6zle\u015fmesine bir deneme kayd\u0131 konuldu\u011funda, bunun s\u00fcresi en \u00e7ok iki ay olabilir. Ancak deneme s\u00fcresi toplu i\u015f s\u00f6zle\u015fmeleriyle d\u00f6rt aya kadar uzat\u0131labilir. Deneme s\u00fcresi i\u00e7inde taraflar i\u015f s\u00f6zle\u015fmesini bildirim s\u00fcresine gerek olmaks\u0131z\u0131n ve tazminats\u0131z feshedebilir. \u0130\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131\u011f\u0131 g\u00fcnler i\u00e7in \u00fccret ve di\u011fer haklar\u0131 sakl\u0131d\u0131r.\u201d<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Deneme s\u00fcresi, i\u015f s\u00f6zle\u015fmesine konulacak bir h\u00fck\u00fcmle; i\u015f\u00e7inin \u00e7al\u0131\u015fma \u015fartlar\u0131n\u0131 g\u00f6rmesi, s\u00f6zle\u015fme ile \u00fcstlenilen i\u015fin somut duruma uygunlu\u011fu ve i\u015fi yapabilme becerisini anlamas\u0131, i\u015fverenin ise i\u015f\u00e7inin s\u00f6zle\u015fme ile \u00fcstlendi\u011fi i\u015fi yapabilme yetene\u011fini ve verimini \u00f6l\u00e7en bir s\u00fcredir. Yarg\u0131tay, i\u015f s\u00f6zle\u015fmesi taraflar aras\u0131nda kar\u015f\u0131l\u0131kl\u0131 g\u00fcvene dayal\u0131 s\u00fcrekli bor\u00e7 ili\u015fkisi kurdu\u011fu i\u00e7in i\u015f\u00e7inin meslek\u00ee bilgi ve becerisini, \u00e7al\u0131\u015fma \u015fekli ile i\u015fyerine uyumu ve davran\u0131\u015flar\u0131n\u0131 \u00f6\u011frenme bak\u0131m\u0131ndan belli bir s\u00fcre denenmesinde i\u015fverenin korunmaya de\u011fer bir menfaati bulundu\u011fu g\u00f6r\u00fc\u015f\u00fcn\u00fc benimsemektedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"deneme-sureli-calismanin-sartlari-nelerdir\">Deneme S\u00fcreli \u00c7al\u0131\u015fman\u0131n \u015eartlar\u0131 Nelerdir ?<\/h2>\n\n\n\n<ul class=\"wp-block-list\"><li>1. Deneme s\u00fcresinde dahi olsa i\u015f\u00e7inin sigortas\u0131 yap\u0131lmal\u0131d\u0131r.<\/li><li>2. Deneme s\u00fcresi i\u015f s\u00f6zle\u015fmesinde a\u00e7\u0131k\u00e7a belirtilmelidir.<\/li><li>3. Deneme s\u00fcresi sonunda i\u015f ili\u015fkisi kurulmazsa i\u015f\u00e7i bir g\u00fcn dahi \u00e7al\u0131\u015fm\u0131\u015f olursa olsun \u00fccret alaca\u011f\u0131 \u00f6denmelidir.<\/li><li>4. Deneme s\u00fcresi en fazla 2 ay olarak d\u00fczenlenebilir. Toplu i\u015f s\u00f6zle\u015fmelerinde bu s\u00fcre 4 ayd\u0131r.<\/li><li>5. Her iki taraf da deneme s\u00fcresi i\u00e7erisinde s\u00f6zle\u015fmeyi tazminats\u0131z ve cezai \u015farts\u0131z fesih edebilir.<\/li><li>6. Deneme s\u00fcreli i\u015f s\u00f6zle\u015fmesi i\u00e7erisinde belirtilen deneme s\u00fcresi i\u00e7erisinde t\u00fcm haklar\u0131 ge\u00e7erli olmaktad\u0131r.<\/li><\/ul>\n\n\n\n<p class=\"has-black-color has-text-color\">Deneme s\u00fcreli i\u015f s\u00f6zle\u015fmesi, deneme s\u00fcresinin sonunda kendili\u011finden sona erer. Ancak i\u015f\u00e7i, deneme s\u00fcresi sonras\u0131 \u00e7al\u0131\u015ft\u0131r\u0131lmaya devam ettiriliyorsa, bu s\u00f6zle\u015fme belirsiz s\u00fcreli i\u015f s\u00f6zle\u015fmesi niteli\u011finde ba\u015f\u0131ndan itibaren tek bir s\u00f6zle\u015fmeye d\u00f6n\u00fc\u015fecektir (BK m.430\/f.2)<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Deneme s\u00fcresi boyunca \u00e7al\u0131\u015fan t\u00fcm i\u015f\u00e7iler kendilerine verilen \u00f6zl\u00fck ve i\u015f\u00e7ilik haklar\u0131ndan faydalanabilirler. Yap\u0131lan \u00e7al\u0131\u015fmalar kar\u015f\u0131l\u0131\u011f\u0131nda \u00fccret alma, istedi\u011fi bir sendikaya \u00fcye olmak, izin haklar\u0131ndan yararlanmak gibi haklar\u0131n\u0131 kullanabilirler.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Deneme s\u00fcresi ba\u015flad\u0131ktan sonra, i\u015f\u00e7inin \u00e7e\u015fitli nedenlerle \u00e7al\u0131\u015famamas\u0131 durumunda deneme s\u00fcresi amac\u0131na ula\u015fmam\u0131\u015f oldu\u011fundan, i\u015f\u00e7inin mazeretli olarak i\u015fe devam etmedi\u011fi s\u00fcreler kadar deneme s\u00fcresi uzat\u0131labilir. Bu durum yasal bir zorunluluk olmay\u0131p, s\u00f6zle\u015fmelerde taraflar\u0131n bu h\u00fckm\u00fc eklemeleri halinde ge\u00e7erli olacakt\u0131r.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">\u0130\u015f\u00e7inin i\u015fe ba\u015flad\u0131\u011f\u0131 ilk g\u00fcnden itibaren bir y\u0131ll\u0131k s\u00fcrenin doldurulmas\u0131 halinde y\u0131ll\u0131k izin hakk\u0131 elde edilece\u011finden, deneme s\u00fcresi de bu bir y\u0131ll\u0131k s\u00fcreye dahil edilerek hesaplama yap\u0131lacakt\u0131r. Ayr\u0131ca deneme s\u00fcresi i\u015f\u00e7inin k\u0131demi y\u00f6n\u00fcnden de dikkate al\u0131nd\u0131\u011f\u0131ndan, k\u0131dem tazminat\u0131 hesaplamalar\u0131nda bu s\u00fcrenin de hizmet s\u00fcresine dahil edilerek hesaplama yap\u0131lmas\u0131 gerekmektedir.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Deneme s\u00fcreli i\u015f s\u00f6zle\u015fmesi; yaz\u0131l\u0131 olarak d\u00fczenlenmesi gereken s\u00f6zle\u015fmeler aras\u0131nda say\u0131lmam\u0131\u015ft\u0131r. Bir ba\u015fka deyi\u015fle, deneme s\u00fcreli i\u015f s\u00f6zle\u015fmesinin yaz\u0131l\u0131 olarak d\u00fczenlenmesi \u015fart de\u011fildir. Ancak ispat bak\u0131m\u0131ndan, deneme s\u00fcresinin yaz\u0131l\u0131 olarak belirlenmesi m\u00fchimdir. Bunun d\u0131\u015f\u0131nda deneme s\u00fcresi taraflara i\u015f ili\u015fkisinin nas\u0131l olaca\u011f\u0131 y\u00f6n\u00fcnde fikir verir.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Yarg\u0131tay Kararlar\u0131nda Deneme S\u00fcresinin Yaz\u0131l\u0131 Belirlenmesi:<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Zira, kurala ayk\u0131r\u0131 bir durumu iddia eden, iddias\u0131n\u0131 ispatla y\u00fck\u00fcml\u00fcd\u00fcr. Deneme s\u00fcreli i\u015f s\u00f6zle\u015fmesinin \u015fekli konusunda yasada a\u00e7\u0131k bir h\u00fck\u00fcm bulunmamaktad\u0131r. Ancak \u00f6zellikle ispat y\u00fck\u00fc a\u00e7\u0131s\u0131ndan yaz\u0131l\u0131 yap\u0131lmas\u0131 gerekir. Yaz\u0131l\u0131 yap\u0131lmas\u0131 ge\u00e7erlilik \u015fart\u0131 de\u011fil, ispat \u015fart\u0131d\u0131r\u2026\u201d (9 Hukuk, 2009\/13019 K.)<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">\u201c\u2026 Dosya i\u00e7eri\u011fine g\u00f6re davac\u0131 ile daval\u0131 i\u015fveren aras\u0131nda belirli s\u00fcreli 6 ayl\u0131k i\u015f s\u00f6zle\u015fmesi imzaland\u0131\u011f\u0131 ve s\u00f6zle\u015fmenin 7. Maddesinde 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 15. Maddesi ko\u015fullar\u0131na uygun deneme s\u00fcresi konuldu\u011fu anla\u015f\u0131lmaktad\u0131r. Davac\u0131n\u0131n i\u015f s\u00f6zle\u015fmesi deneme s\u00fcresi sona ermeden feshedilmi\u015ftir.
