Maddesinde, i\u015fverenin hakl\u0131 nedenle fesih hakk\u0131n\u0131n kullanmas\u0131n\u0131n \u015fartlar\u0131 ise ayn\u0131 kanunun 25. Maddesinde belirtilmi\u015ftir. Bu olay ve durumlar, bu yolla fesih hakk\u0131n\u0131 kullanan taraf i\u00e7in i\u015f akdinin devam\u0131n\u0131 objektif d\u00fcr\u00fcstl\u00fck kurallar\u0131 uyar\u0131nca kendisinden beklenilemeyecek \u015fekilde \u00e7ekilmez k\u0131lmal\u0131d\u0131r. Bu hallerde kanun, taraflara hakl\u0131 nedenle fesih hakk\u0131n\u0131 kullanma olana\u011f\u0131 sa\u011flayarak \u00e7ekilmez hale gelen s\u00fcrekli bor\u00e7 ili\u015fkisini sonland\u0131rma imkan\u0131 tan\u0131m\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">4857 say\u0131l\u0131 \u0130\u015f Kanunu fesih konusunu her a\u00e7\u0131dan ele alm\u0131\u015f, i\u015f\u00e7i ve i\u015fverenin hangi durumlarda, hangi gerek\u00e7elerle i\u015f akdini feshedebilece\u011fini a\u00e7\u0131k\u00e7a anlatm\u0131\u015ft\u0131r. \u0130\u015f Kanunu i\u015f\u00e7inin i\u015f akdini derhal ve k\u0131dem tazminat\u0131na hak kazanarak feshedebilece\u011fi durumlar\u0131 a\u00e7\u0131k\u00e7a belirtmi\u015ftir. \u0130lgili maddede belirtilen durumlardan en az birinin ger\u00e7ekle\u015fmesi durumunda i\u015f\u00e7i ihbar s\u00fcresi ve ihbar tazminat\u0131 s\u00f6z konusu olmadan, k\u0131dem tazminat\u0131n\u0131 almay\u0131 hak ederek derhal i\u015f akdini feshedebilir.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\"><strong>4857 Say\u0131l\u0131<a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuatmetin\/1.5.4857.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"> Labor Law |<\/a> Madde 24:<\/strong><\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Kanun koyucu, i\u015f\u00e7inin hakl\u0131 nedenle derhal fesih hakk\u0131na ili\u015fkin durumlar\u0131 3 sebep alt\u0131nda \u015fu \u015fekilde s\u0131ralam\u0131\u015ft\u0131r:<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>1. Sa\u011fl\u0131k Sebepleri:<\/strong><\/h2>\n\n\n\n<p class=\"has-black-color has-text-color\">Sa\u011fl\u0131k sebeplerine ili\u015fkin hakl\u0131 nedenle derhal fesih hakk\u0131, ikiye ayr\u0131larak \u015fu \u015fekilde incelenmi\u015ftir.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">a) \u0130\u015f s\u00f6zle\u015fmesinin konusu olan i\u015fin yap\u0131lmas\u0131 i\u015fin niteli\u011finden do\u011fan bir sebeple i\u015f\u00e7inin sa\u011fl\u0131\u011f\u0131 veya ya\u015fay\u0131\u015f\u0131 i\u00e7in tehlikeli olursa: Burada dikkat edilmesi gereken husus; sa\u011fl\u0131k sebebi herhangi bir sa\u011fl\u0131k sebebi olmamal\u0131, i\u015f s\u00f6zle\u015fmesinin konusu olan i\u015fin yap\u0131lmas\u0131 ile ilgili bir sa\u011fl\u0131k sebebi olmal\u0131d\u0131r. Netice itibariyle o i\u015fin yap\u0131lmas\u0131, i\u015f\u00e7inin ya\u015fay\u0131\u015f\u0131 bak\u0131m\u0131ndan tehlike arz ederse, bu bir hakl\u0131 neden olu\u015fturur.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">b) \u0130\u015f\u00e7inin s\u00fcrekli olarak yak\u0131ndan ve do\u011frudan bulu\u015fup g\u00f6r\u00fc\u015ft\u00fc\u011f\u00fc i\u015fveren yahut ba\u015fka bir i\u015f\u00e7i bula\u015f\u0131c\u0131 veya i\u015f\u00e7inin i\u015fi ile ba\u011fda\u015fmayan bir hastal\u0131\u011fa tutulursa. \u0130\u015f\u00e7inin sa\u011fl\u0131k sebepleriyle i\u015f s\u00f6zle\u015fmesini hakl\u0131 olarak feshedebilmesi i\u00e7in, i\u015fin niteli\u011finden kaynaklanan bir tehlikenin varl\u0131\u011f\u0131 ve bu durumun i\u015f\u00e7inin sa\u011fl\u0131\u011f\u0131 ve ya\u015fay\u0131\u015f\u0131 i\u00e7in tehdit olu\u015fturmas\u0131 gerekir. Burada i\u015f\u00e7inin hastal\u0131\u011fa yakalanm\u0131\u015f olmas\u0131 \u015fart de\u011fildir. Sa\u011fl\u0131\u011f\u0131 tehdit eden bir tehlikenin varl\u0131\u011f\u0131 ve bunun i\u015fin niteli\u011finden do\u011fmas\u0131 yeterlidir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>2. Ahlak ve iyi niyet kurallar\u0131na uymayan haller ve benzerleri:<\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">a)\u0130\u015fveren i\u015f s\u00f6zle\u015fmesi yap\u0131ld\u0131\u011f\u0131 s\u0131rada bu s\u00f6zle\u015fmenin esasl\u0131 noktalar\u0131ndan biri hakk\u0131nda yanl\u0131\u015f vas\u0131flar veya \u015fartlar g\u00f6stermek yahut ger\u00e7e\u011fe uygun olmayan bilgiler vermek veya s\u00f6zler s\u00f6ylemek suretiyle i\u015f\u00e7iyi yan\u0131lt\u0131rsa<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">b) \u0130\u015fveren i\u015f\u00e7inin veya ailesi \u00fcyelerinden birinin \u015feref ve namusuna dokunacak \u015fekilde s\u00f6zler s\u00f6yler, davran\u0131\u015flarda bulunursa veya i\u015f\u00e7iye cinsel tacizde bulunursa hakl\u0131 sebeple feshi olu\u015fur. Yarg\u0131tay, bu gibi durumlar i\u00e7in belge aranamayaca\u011f\u0131n\u0131 kabul etmektedir. Ki\u015fi olaylar\u0131n kronolojik gidi\u015fat\u0131na g\u00f6re, inand\u0131r\u0131c\u0131 bir \u015fekilde yukar\u0131daki bentte bulunan fiillerden birine maruz kald\u0131\u011f\u0131n\u0131, ortaya koyabiliyorsa ve tan\u0131klar da bunu destekler nitelikte beyanda bulunuyorsa, ispat\u0131n sa\u011fland\u0131\u011f\u0131n\u0131 kabul etmektedir.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">c) \u0130\u015fveren i\u015f\u00e7iye veya ailesi \u00fcyelerinden birine kar\u015f\u0131 sata\u015fmada bulunur veya g\u00f6zda\u011f\u0131 verirse, yahut i\u015f\u00e7iyi veya ailesi \u00fcyelerinden birini kanuna kar\u015f\u0131 davran\u0131\u015fa \u00f6zendirir, k\u0131\u015fk\u0131rt\u0131r, s\u00fcr\u00fckler, yahut i\u015f\u00e7iye ve ailesi \u00fcyelerinden birine kar\u015f\u0131 hapsi gerektiren bir su\u00e7 i\u015flerse yahut i\u015f\u00e7i hakk\u0131nda \u015feref ve haysiyet k\u0131r\u0131c\u0131 as\u0131ls\u0131z a\u011f\u0131r isnat veya ithamlarda bulunursa,<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Yukar\u0131daki fiillerden biri veya birka\u00e7\u0131, i\u015f\u00e7i veya ailesi \u00fcyelerinden herhangi birine kar\u015f\u0131 i\u015flendi\u011finde i\u015fbu hakl\u0131 sebep olu\u015facakt\u0131r.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">d) \u0130\u015f\u00e7inin di\u011fer bir i\u015f\u00e7i veya \u00fc\u00e7\u00fcnc\u00fc ki\u015filer taraf\u0131ndan i\u015fyerinde cinsel tacize u\u011framas\u0131 ve bu durumu i\u015fverene bildirmesine ra\u011fmen gerekli \u00f6nlemler al\u0131nmazsa,<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi kapsam\u0131nda de\u011ferlendirebilece\u011fimiz bir benttir. \u0130\u015fveren i\u015f\u00e7inin beden ve ruh sa\u011fl\u0131\u011f\u0131n\u0131n korunmas\u0131 i\u00e7in gerekli \u00f6nlemleri almakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">e) \u0130\u015fveren taraf\u0131ndan i\u015f\u00e7inin \u00fccreti kanun h\u00fck\u00fcmleri veya s\u00f6zle\u015fme \u015fartlar\u0131na uygun olarak hesap edilmez veya \u00f6denmezse,<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u00d6denmeyen \u00fccretin az veya \u00e7ok olmas\u0131n\u0131n bir \u00f6nemi yoktur. \u00dccretin tam olarak \u00f6denmesi as\u0131ld\u0131r. \u0130\u015fveren i\u015f\u00e7inin \u00fccretini eksik \u00f6deyemeyece\u011fi gibi 62.madde gere\u011fi yaz\u0131l\u0131 muvafakat olmad\u0131k\u00e7a \u00fccretten kesinti de yapamaz.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u00d6rne\u011fin, i\u015fverenin i\u015f\u00e7iye fazla mesai \u00fccretini \u00f6dememesi durumunda kar\u015f\u0131m\u0131za \u00e7\u0131kmaktad\u0131r. \u0130\u015fveren, i\u015f\u00e7iye fazla mesai \u00fccretini \u00f6demedi\u011finde i\u015f\u00e7inin de i\u015f s\u00f6zle\u015fmesini hakl\u0131 sebeple feshetme hakk\u0131 vard\u0131r.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">f) \u00dccretin par\u00e7a ba\u015f\u0131na veya i\u015f tutar\u0131 \u00fczerinden \u00f6denmesi kararla\u015ft\u0131r\u0131l\u0131p da i\u015fveren taraf\u0131ndan i\u015f\u00e7iye yapabilece\u011fi say\u0131 ve tutardan az i\u015f verildi\u011fi hallerde, aradaki \u00fccret fark\u0131 zaman esas\u0131na g\u00f6re \u00f6denerek i\u015f\u00e7inin eksik ald\u0131\u011f\u0131 \u00fccret kar\u015f\u0131lanmazsa, yahut \u00e7al\u0131\u015fma \u015fartlar\u0131 uygulanmazsa<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u0130\u015fverenin i\u015f\u00e7iye \u00fccretini zaman\u0131nda ve kararla\u015ft\u0131r\u0131lan tutarda \u00f6demesi gere\u011finin bir sonucu olarak, i\u015f\u00e7iye kararla\u015ft\u0131r\u0131lan \u00fccretin kar\u015f\u0131l\u0131\u011f\u0131 olan i\u015f verilmelidir. Verilmedi\u011fi takdirde, bu gerek\u00e7e ile i\u015f\u00e7inin \u00fccretinden kesinti yap\u0131lamaz. Ve i\u015f\u00e7iye, i\u015f yerinde ge\u00e7erli \u00e7al\u0131\u015fma \u015fartlar\u0131 uygulanmal\u0131d\u0131r. Bu iki sebepten herhangi biri var oldu\u011fu takdirde i\u015fbu hakl\u0131 sebep olu\u015facakt\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>3. Zorlay\u0131c\u0131 sebepler:<\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u0130\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015fyerinde bir haftadan fazla s\u00fcre ile i\u015fin durmas\u0131n\u0131 gerektirecek zorlay\u0131c\u0131 sebepler ortaya \u00e7\u0131karsa, i\u015f\u00e7i hakl\u0131 sebeple derhal fesih hakk\u0131n\u0131 kullanabilir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Employee <\/strong><strong>H<\/strong><strong>akl\u0131 <\/strong><strong>N<\/strong><strong>edenle <\/strong><strong>D<\/strong><strong>erhal <\/strong><strong>F<\/strong><strong>esih <\/strong><strong>H<\/strong><strong>akk\u0131n\u0131 <\/strong><strong>H<\/strong><strong>angi <\/strong><strong>S<\/strong><strong>\u00fcrede <\/strong><strong>K<\/strong><strong>ullanmal\u0131d\u0131r?<\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 26.maddesi\u2019nde derhal fesih hakk\u0131n\u0131 kullanma s\u00fcresi d\u00fczenlenmi\u015ftir. \u0130\u015f\u00e7inin, ahlak ve iyi niyet kurallar\u0131na uymayan hallere dayanarak hakl\u0131 nedenle derhal fesih hakk\u0131, bu \u00e7e\u015fit davran\u0131\u015flarda bulunuldu\u011funun \u00f6\u011frenilmesinden ba\u015flayarak 6 i\u015f g\u00fcn\u00fc ve herhalde fiilin ger\u00e7ekle\u015fmesinden itibaren 1 y\u0131l sonra sona ermektedir.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Kanun koyucu, burada i\u015f\u00e7inin hakl\u0131 nedenle fesih hakk\u0131n\u0131, i\u015fverene kar\u015f\u0131 tehdit vas\u0131tas\u0131 olarak kullan\u0131lmas\u0131n\u0131n \u00f6n\u00fcne ge\u00e7mek istemi\u015ftir. Zira i\u015f\u00e7i hakl\u0131 nedenle fesih hakk\u0131n\u0131 kullanmak istiyorsa s\u00fcresi i\u00e7erisinde kullanmal\u0131d\u0131r. Aksi halde fesih hakk\u0131 d\u00fc\u015fer ve mahkeme resen g\u00f6z \u00f6n\u00fcnde bulundurur.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Yarg\u0131tay, cinsel taciz sebebi ile i\u015f s\u00f6zle\u015fmesinin feshedilmesi durumlar\u0131 bak\u0131m\u0131ndan, tacize u\u011frayan ki\u015finin bu durumu hemen s\u00f6yleyebilmesinin m\u00fcmk\u00fcn olamayabilece\u011fini kabul etmektedir. Ki\u015finin e\u015finden, \u00e7evresinden korkabilece\u011fi ihtimalinin de\u011ferlendirilmesi gerekti\u011fini kabul etmektedir. Dolay\u0131s\u0131yla 6 i\u015f g\u00fcnl\u00fck s\u00fcrenin bu gibi hallerde dikkate al\u0131nmamas\u0131 gerekti\u011fini kabul etmektedir.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u0130\u015f\u00e7i, feshi ger\u00e7ekle\u015ftirirken hakl\u0131 bir nedene dayanmam\u0131\u015f ve ge\u00e7erli bir sebebi de olmadan i\u015f s\u00f6zle\u015fmesini feshetmi\u015f ise, bu takdirde i\u015f\u00e7inin istifa etmi\u015f olmas\u0131 durumu olarak de\u011ferlendirilmektedir. \u0130stifa iradesinin kar\u015f\u0131 tarafa ula\u015fmas\u0131yla birlikte i\u015f ili\u015fkisi sona erer. \u0130stifan\u0131n i\u015fverence kabul\u00fc zorunlu de\u011filse de, i\u015fverence dilek\u00e7enin i\u015fleme konulmam\u0131\u015f olmas\u0131 ve i\u015f\u00e7inin de i\u015fyerinde \u00e7al\u0131\u015fmaya devam etmesi halinde ger\u00e7ek bir istifadan s\u00f6z edilemez. Bununla birlikte istifaya ra\u011fmen taraflar\u0131n belirli bir s\u00fcre daha \u00e7al\u0131\u015fma y\u00f6n\u00fcnde iradelerinin birle\u015fmesi halinde kararla\u015ft\u0131r\u0131lan s\u00fcrenin sonunda i\u015f s\u00f6zle\u015fmesinin ikale yoluyla sona erdi\u011fi kabul edilmektedir.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">&nbsp;Makalemizdeki bilgiler sadece bilgilendirme ama\u00e7l\u0131d\u0131r. \u00d6nemle bilinmesi gerekir ki i\u015f davalar\u0131 teknik davalar olup, ma\u011fdur olmamak ad\u0131na yarg\u0131laman\u0131n alan\u0131nda tecr\u00fcbeli bir avukat ile takibi b\u00fcy\u00fck \u00f6nem ta\u015f\u0131maktad\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Relevant Supreme Court Decisions:<\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\"><strong>Yarg\u0131tay 9. HD 2005\/1443 E. 2005\/4551 K Say\u0131l\u0131 karar\u0131nda <\/strong>\u201c\u0130ncelenen dosya ve bilgilere g\u00f6re davac\u0131 i\u015f\u00e7inin tespit edilen farkl\u0131 iki tarihte ayl\u0131k ziyaret plan\u0131ndaki \u00fcnitelere gitmesi gerekirken gitmedi\u011fi anla\u015f\u0131lm\u0131\u015ft\u0131r. Bu durum i\u015f\u00e7inin kusurlu davran\u0131\u015f\u0131ndan kaynaklanm\u0131\u015f ancak \u0130\u015f Kanununun 25. Maddesinde belirtilen derhal fesih hakk\u0131 veren sebeplerden olmamakla birlikte i\u015f\u00e7inin ve i\u015fyerinin normal y\u00fcr\u00fcy\u00fc\u015f\u00fcn\u00fc olumsuz etkileyen hallerden olup i\u015f ili\u015fkisinin s\u00fcrd\u00fcr\u00fclmesini i\u015fveren a\u00e7\u0131s\u0131ndan \u00f6nemli ve makul \u00f6l\u00e7\u00fcler i\u00e7inde beklenemeyece\u011finden feshin ge\u00e7erli sebeplere dayand\u0131\u011f\u0131 kabul edilerek davac\u0131 i\u015f\u00e7inin i\u015fe iade talebinin reddine karar vermi\u015ftir.\u201d G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere i\u015f\u00e7inin davran\u0131\u015f\u0131na bir de\u011fer bi\u00e7ilmi\u015f ve hakl\u0131 neden a\u011f\u0131rl\u0131\u011f\u0131nda olmasa da ge\u00e7erli neden olarak kabul edilmi\u015f ve i\u015f\u00e7inin i\u015fe iade talebinin reddine karar verilmi\u015ftir.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\"><strong>Yarg\u0131tay 22.
