Madde | \u0130zmir Avukat<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u0130\u015f s\u00f6zle\u015fmesinin bildirimsiz olarak feshine imkan veren hakl\u0131 sebeplerin ortaya \u00e7\u0131kmas\u0131 durumunda i\u015f s\u00f6zle\u015fmesi kendili\u011finden sona ermedi\u011finden, i\u015f s\u00f6zle\u015fmesini fesih hakk\u0131 kazanan taraf\u0131n bu hakk\u0131n\u0131 kullanarak s\u00f6zle\u015fmeyi sona erdirmesi gerekmektedir. Feshin \u201cbildirimsiz\u201d olmas\u0131n\u0131n nedeni, bu bildirimin i\u015f s\u00f6zle\u015fmesini an\u0131nda (derhal) sona erdirmesidir. Bildirimsiz fesih, taraflardan birinin i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenlerle derhal sona erdirmesidir. Bu fesih t\u00fcr\u00fc, belirli nedenlerin ortaya \u00e7\u0131kmas\u0131 sonucunda s\u00f6zle\u015fmeyi s\u00fcrd\u00fcrmesi kendisinden beklenemeyecek olan taraf\u0131n s\u00f6zle\u015fmeden kurtulmas\u0131na imkan sa\u011flamaktad\u0131r. Belirli veya belirsiz s\u00fcreli i\u015f s\u00f6zle\u015fmeleri s\u0131n\u0131rl\u0131 say\u0131daki baz\u0131 nedenlerin ger\u00e7ekle\u015fmesi durumlarda i\u015fveren taraf\u0131ndan bildirimsiz olarak (derhal) feshedebilir. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">4857 Say\u0131l\u0131 Kanun Madde 25<\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Kanun maddesini inceleyecek olursak:<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\"><strong><em><a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuat?MevzuatNo=4857&amp;MevzuatTur=1&amp;MevzuatTertip=5\" target=\"_blank\" rel=\"noreferrer noopener\">4857 Say\u0131l\u0131 Kanun<\/a> Madde 25 <\/em><\/strong>&#8211; S\u00fcresi belirli olsun veya olmas\u0131n i\u015fveren, a\u015fa\u011f\u0131da yaz\u0131l\u0131 hallerde i\u015f s\u00f6zle\u015fmesini s\u00fcrenin bitiminden \u00f6nce veya bildirim s\u00fcresini beklemeksizin feshedebilir:<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\"><strong>I- Sa\u011fl\u0131k sebepleri:<\/strong><\/p>\n\n\n\n<ul class=\"has-black-color has-text-color wp-block-list\"><li>a) \u0130\u015f\u00e7inin kendi kast\u0131ndan veya derli toplu olmayan ya\u015fay\u0131\u015f\u0131ndan yahut i\u00e7kiye d\u00fc\u015fk\u00fcnl\u00fc\u011f\u00fcnden do\u011facak bir hastal\u0131\u011fa yakalanmas\u0131 veya engelli h\u00e2le gelmesi durumunda, bu sebeple do\u011facak devams\u0131zl\u0131\u011f\u0131n ard\u0131 ard\u0131na \u00fc\u00e7 i\u015f g\u00fcn\u00fc veya bir ayda be\u015f i\u015f g\u00fcn\u00fcnden fazla s\u00fcrmesi. (1)<\/li><li>b) \u0130\u015f\u00e7inin tutuldu\u011fu hastal\u0131\u011f\u0131n tedavi edilemeyecek nitelikte oldu\u011fu ve i\u015fyerinde \u00e7al\u0131\u015fmas\u0131nda sak\u0131nca bulundu\u011funun sa\u011fl\u0131k kurulunca saptanmas\u0131 durumunda.<\/li><li>(a) alt bendinde say\u0131lan sebepler d\u0131\u015f\u0131nda i\u015f\u00e7inin hastal\u0131k, kaza, do\u011fum ve gebelik gibi hallerde i\u015fveren i\u00e7in i\u015f s\u00f6zle\u015fmesini bildirimsiz fesih hakk\u0131; belirtilen hallerin i\u015f\u00e7inin i\u015fyerindeki \u00e7al\u0131\u015fma s\u00fcresine g\u00f6re 17 nci maddedeki bildirim s\u00fcrelerini alt\u0131 hafta a\u015fmas\u0131ndan sonra do\u011far. Do\u011fum ve gebelik hallerinde bu s\u00fcre 74 \u00fcnc\u00fc maddedeki s\u00fcrenin bitiminde ba\u015flar. Ancak i\u015f\u00e7inin i\u015f s\u00f6zle\u015fmesinin ask\u0131da kalmas\u0131 nedeniyle i\u015fine gidemedi\u011fi s\u00fcreler i\u00e7in \u00fccret i\u015flemez.<\/li><\/ul>\n\n\n\n<p class=\"has-black-color has-text-color\"><strong>II- Ahlak ve iyi niyet kurallar\u0131na uymayan haller ve benzerleri:<\/strong><\/p>\n\n\n\n<ul class=\"has-black-color has-text-color wp-block-list\"><li>a) \u0130\u015f s\u00f6zle\u015fmesi yap\u0131ld\u0131\u011f\u0131 s\u0131rada bu s\u00f6zle\u015fmenin esasl\u0131 noktalar\u0131ndan biri i\u00e7in gerekli vas\u0131flar veya \u015fartlar kendisinde bulunmad\u0131\u011f\u0131 halde bunlar\u0131n kendisinde bulundu\u011funu ileri s\u00fcrerek, yahut ger\u00e7e\u011fe uygun olmayan bilgiler veya s\u00f6zler s\u00f6yleyerek i\u015f\u00e7inin i\u015fvereni yan\u0131ltmas\u0131.<\/li><li>b) \u0130\u015f\u00e7inin, i\u015fveren yahut bunlar\u0131n aile \u00fcyelerinden birinin \u015feref ve namusuna dokunacak s\u00f6zler sarfetmesi veya davran\u0131\u015flarda bulunmas\u0131, yahut i\u015fveren hakk\u0131nda \u015feref ve haysiyet k\u0131r\u0131c\u0131 as\u0131ls\u0131z ihbar ve isnadlarda bulunmas\u0131.<\/li><li>c) \u0130\u015f\u00e7inin i\u015fverenin ba\u015fka bir i\u015f\u00e7isine cinsel tacizde bulunmas\u0131.<\/li><li>d) \u0130\u015f\u00e7inin i\u015fverene yahut onun ailesi \u00fcyelerinden birine yahut i\u015fverenin ba\u015fka i\u015f\u00e7isine sata\u015fmas\u0131, i\u015fyerine sarho\u015f yahut uyu\u015fturucu madde alm\u0131\u015f olarak gelmesi ya da i\u015fyerinde bu maddeleri kullanmas\u0131.<\/li><li>e) \u0130\u015f\u00e7inin, i\u015fverenin g\u00fcvenini k\u00f6t\u00fcye kullanmak, h\u0131rs\u0131zl\u0131k yapmak, i\u015fverenin meslek s\u0131rlar\u0131n\u0131 ortaya atmak gibi do\u011fruluk ve ba\u011fl\u0131l\u0131\u011fa uymayan davran\u0131\u015flarda bulunmas\u0131.<\/li><li>f) \u0130\u015f\u00e7inin, i\u015fyerinde, yedi g\u00fcnden fazla hapisle cezaland\u0131r\u0131lan ve cezas\u0131 ertelenmeyen bir su\u00e7 i\u015flemesi.<\/li><li>g) \u0130\u015f\u00e7inin i\u015fverenden izin almaks\u0131z\u0131n veya hakl\u0131 bir sebebe dayanmaks\u0131z\u0131n ard\u0131 ard\u0131na iki i\u015fg\u00fcn\u00fc veya bir ay i\u00e7inde iki defa herhangi bir tatil g\u00fcn\u00fcnden sonraki i\u015f g\u00fcn\u00fc, yahut bir ayda \u00fc\u00e7 i\u015fg\u00fcn\u00fc i\u015fine devam etmemesi.<\/li><li>h) \u0130\u015f\u00e7inin yapmakla \u00f6devli bulundu\u011fu g\u00f6revleri kendisine hat\u0131rlat\u0131ld\u0131\u011f\u0131 halde yapmamakta \u0131srar etmesi.<\/li><li>\u0131) \u0130\u015f\u00e7inin kendi iste\u011fi veya savsamas\u0131 y\u00fcz\u00fcnden i\u015fin g\u00fcvenli\u011fini tehlikeye d\u00fc\u015f\u00fcrmesi, i\u015fyerinin mal\u0131 olan veya mal\u0131 olmay\u0131p da eli alt\u0131nda bulunan makineleri, tesisat\u0131 veya ba\u015fka e\u015fya ve maddeleri otuz g\u00fcnl\u00fck \u00fccretinin tutar\u0131yla \u00f6deyemeyecek derecede hasara ve kayba u\u011fratmas\u0131.<\/li><\/ul>\n\n\n\n<p class=\"has-black-color has-text-color\"><strong>III- Zorlay\u0131c\u0131 sebepler<\/strong>: \u0130\u015f\u00e7iyi i\u015fyerinde bir haftadan fazla s\u00fcre ile \u00e7al\u0131\u015fmaktan al\u0131koyan zorlay\u0131c\u0131 bir sebebin ortaya \u00e7\u0131kmas\u0131.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\"><strong>IV- \u0130\u015f\u00e7inin g\u00f6zalt\u0131na al\u0131nmas\u0131 veya tutuklanmas\u0131 halinde devams\u0131zl\u0131\u011f\u0131<\/strong>n 17 nci maddedeki bildirim s\u00fcresini a\u015fmas\u0131.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u0130\u015f\u00e7i feshin yukar\u0131daki bentlerde \u00f6ng\u00f6r\u00fclen sebeplere uygun olmad\u0131\u011f\u0131 iddias\u0131 ile 18, 20 ve 21 inci madde h\u00fck\u00fcmleri \u00e7er\u00e7evesinde kanun yoluna ba\u015fvurabilir. 24 ve 25 inci maddelerde g\u00f6sterilen ahlak ve iyi niyet kurallar\u0131na uymayan hallere dayanarak i\u015f\u00e7i veya i\u015fveren i\u00e7in tan\u0131nm\u0131\u015f olan s\u00f6zle\u015fmeyi fesih yetkisi, iki taraftan birinin bu \u00e7e\u015fit davran\u0131\u015flarda bulundu\u011funu di\u011fer taraf\u0131n \u00f6\u011frendi\u011fi g\u00fcnden ba\u015flayarak alt\u0131 i\u015f g\u00fcn\u00fc ge\u00e7tikten ve her halde fiilin ger\u00e7ekle\u015fmesinden itibaren bir y\u0131l sonra kullan\u0131lamaz. Ancak i\u015f\u00e7inin olayda maddi \u00e7\u0131kar sa\u011flamas\u0131 halinde bir y\u0131ll\u0131k s\u00fcre uygulanmaz. Bu haller sebebiyle i\u015f\u00e7i yahut i\u015fverenden i\u015f s\u00f6zle\u015fmesini yukar\u0131daki f\u0131krada \u00f6ng\u00f6r\u00fclen s\u00fcre i\u00e7inde feshedenlerin di\u011fer taraftan tazminat haklar\u0131 sakl\u0131d\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>\u0130\u015f Arama \u0130zni<\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u0130\u015fverenin hakl\u0131 nedenle derhal fesih hakk\u0131nda i\u015fveren i\u00e7in hakl\u0131 bir sebebin varl\u0131\u011f\u0131 oldu\u011fu gibi tan\u0131mdan da anla\u015f\u0131laca\u011f\u0131 \u00fczere bildirim s\u00fcrelerine uymaks\u0131z\u0131n derhal fesih yetkisi vard\u0131r. Bu sebeple, derhal feshe sebep olacak durumlarda i\u015f\u00e7iye i\u015f arama izni verilmesine gerek yoktur. Fakat kanun her ne kadar, i\u015fverene derhal fesih yetkisi vermi\u015f olsa dahi, i\u015f\u00e7inin savunma hakk\u0131n\u0131n k\u0131s\u0131tlanmamas\u0131 amac\u0131yla yap\u0131lacak fesih bildiriminin yaz\u0131l\u0131 olarak yap\u0131larak i\u015f\u00e7iye makul bir savunma hakk\u0131 tan\u0131nmas\u0131 gereklidir.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u0130\u015f s\u00f6zle\u015fmesinin i\u015fveren taraf\u0131ndan ge\u00e7erli sebeple feshi s\u00f6z konusu oldu\u011funda ise, t\u0131pk\u0131 i\u015f\u00e7i gibi i\u015fveren de bildirim s\u00fcrelerine uymal\u0131d\u0131r. \u0130\u015fverenin burada bir ba\u015fka y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc ise i\u015f\u00e7iye i\u015f arama izni verme noktas\u0131ndad\u0131r. \u0130\u015f arama izni , 27. Maddede d\u00fczenlenmi\u015f olup, bildirim s\u00fcreleri i\u00e7inde i\u015fveren, i\u015f\u00e7iye yeni bir i\u015f bulmas\u0131 i\u00e7in gerekli olan i\u015f arama iznini i\u015f saatleri i\u00e7inde ve \u00fccret kesintisi yapmadan vermeye mecburdur. \u0130\u015f arama izninin s\u00fcresi g\u00fcnde iki saatten az olamaz ve i\u015f\u00e7i isterse i\u015f arama izin saatlerini birle\u015ftirerek toplu kullanabilir. Ancak i\u015f arama iznini toplu kullanmak isteyen i\u015f\u00e7i, bunu i\u015ften ayr\u0131laca\u011f\u0131 g\u00fcnden evvelki g\u00fcnlere rastlatmak ve bu durumu i\u015fverene bildirmek zorundad\u0131r. \u0130\u015fveren yeni i\u015f arama iznini vermez veya eksik kulland\u0131r\u0131rsa o s\u00fcreye ili\u015fkin \u00fccret i\u015f\u00e7iye \u00f6denir. \u0130\u015fveren, i\u015f arama izni esnas\u0131nda i\u015f\u00e7iyi \u00e7al\u0131\u015ft\u0131r\u0131r ise i\u015f\u00e7inin izin kullanarak bir \u00e7al\u0131\u015fma kar\u015f\u0131l\u0131\u011f\u0131 olmaks\u0131z\u0131n alaca\u011f\u0131 \u00fccrete ilaveten, \u00e7al\u0131\u015ft\u0131rd\u0131\u011f\u0131 s\u00fcrenin \u00fccretini y\u00fczde y\u00fcz zaml\u0131 \u00f6der<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\"><strong>S\u00f6zle\u015fmenin feshine ra\u011fmen baz\u0131 durumlarda ihbar \u00f6neli ve tazminat\u0131 uygulanmamaktad\u0131r.<\/strong><\/p>\n\n\n\n<ul class=\"has-black-color has-text-color wp-block-list\"><li>Yasan\u0131n tan\u0131d\u0131\u011f\u0131 hak gere\u011fi 24 ve 25. maddeler gere\u011fi ger\u00e7ekle\u015fen fesihler ile<\/li><li>Askerlik,<\/li><li>Emeklilik,<\/li><li>Kad\u0131n i\u015f\u00e7inin evlilik nedeniyle bir y\u0131l i\u00e7inde i\u015ften ayr\u0131lma hallerinde yaln\u0131zca k\u0131dem tazminat\u0131 do\u011fmakta olup taraflar\u0131n ihbar \u00f6neline uymas\u0131 gerekmemektedir<strong>.<\/strong><\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Yarg\u0131tay Karar\u0131 \u00d6rnekleri:<\/strong><\/h2>\n\n\n\n<ol type=\"1\" class=\"has-black-color has-text-color wp-block-list\"><li>\u201cHasta olmad\u0131\u011f\u0131 halde topluca viziteye \u00e7\u0131kma eylemine kat\u0131lan i\u015f\u00e7inin hizmet akdinin i\u015fverence ihbars\u0131z ve tazminats\u0131z olarak feshinde yasaya ayk\u0131r\u0131l\u0131k yoktur.\u201d Yarg\u0131tay 9. Hukuk Dairesi\u2019nin 12.11.1991 tarih ve E.1991\/12613, K.1991\/14228 say\u0131l\u0131 karar\u0131.<\/li><li>\u201c\u0130\u015fverenin a\u00e7\u0131k\u00e7a izin vermedi\u011fi durumda, i\u015f\u00e7inin izin verilmi\u015f gibi i\u015fyerinden ayr\u0131lmas\u0131 i\u015f akdinin hakl\u0131 nedenlerle feshini gerektirir.\u201d Yarg\u0131tay 9. Hukuk Dairesi 30.11.1998 tarih ve E.1998\/15055, K.1998\/16955 say\u0131l\u0131 karar\u0131.<\/li><li>\u201cBir k\u0131s\u0131m i\u015f\u00e7ilerin i\u015fi yava\u015flatma, verilen i\u015fi yapmama gibi eylemlerde bulunduklar\u0131 m\u00fcteaddit defalar noterlik taraf\u0131ndan yap\u0131lan tespitlerle, i\u015fyeri kay\u0131tlar\u0131yla ve tutanaklarla anla\u015f\u0131lmas\u0131 durumunda i\u015fveren taraf\u0131ndan ger\u00e7ekle\u015ftirilen feshin hakl\u0131 nedene dayand\u0131\u011f\u0131 kabul edilmelidir.\u201d Yarg\u0131tay 9. Hukuk Dairesi\u2019nin 14.03.2002 tarih ve E.2002\/5209, K. 2002\/4183 say\u0131l\u0131 karar\u0131.<\/li><li>\u00a0\u201c\u0130\u015f\u00e7inin, i\u015fverenin i\u015fi ve i\u015fyeri ile ilgili hukuken hakl\u0131 menfaatlerini korumak, zarar verici veya risk alt\u0131na sokabilecek davran\u0131\u015flar\u0131ndan ka\u00e7\u0131nmak sadakat borcunun bir gere\u011fidir. Bu borca ayk\u0131r\u0131 davranmak \u201chakl\u0131 nedenle fesih\u201d halini olu\u015fturur.\u201d Yarg\u0131tay 9. Hukuk Dairesi\u2019nin 04.04.2000 tarih ve E. 2000\/2465, K. 2000\/4716 say\u0131l\u0131 karar\u0131.<\/li><li>\u00a0\u201cG\u00f6rev yerini terk eden gece bek\u00e7isinin i\u015f s\u00f6zle\u015fmesinin feshi, hakl\u0131 bir nedene dayan\u0131r; kendisinin fazla \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131, ara dinlenmesi yapmamas\u0131 bu olguyu ortadan kald\u0131rmaz.\u201d Yarg\u0131tay 9.
