Konu hakk\u0131nda 6769 say\u0131l\u0131 <a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.6769.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">S\u0131nai M\u00fclkiyet Kanunu<\/a>nda ise sadece \u00e7al\u0131\u015fan bulu\u015flar\u0131 de\u011fil,  \u00e7al\u0131\u015fan  tasar\u0131mlar\u0131na ili\u015fkin \u00f6zel h\u00fck\u00fcmler de bulunmaktad\u0131r. Kanunda \u201c\u00e7al\u0131\u015fan bulu\u015fu\u201d kavram\u0131na yer verilmekle birlikte, i\u015f hukuku ve i\u015f yarg\u0131lamas\u0131 bak\u0131m\u0131nda \u201ci\u015f\u00e7i bulu\u015fu\u201d, \u201ci\u015f\u00e7i tasar\u0131m\u0131\u201d ibareleri kullan\u0131labilecektir.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">6769 say\u0131l\u0131 Kanunda  \u00e7al\u0131\u015fan bulu\u015flar\u0131 iki \u015fekilde d\u00fczenlenmi\u015ftir. Buna&nbsp; g\u00f6re, hizmet bulu\u015fu,  \u00e7al\u0131\u015fan\u0131n, bir \u015firket kapsam\u0131nda y\u00fck\u00fcml\u00fc oldu\u011fu faaliyeti gere\u011fi ger\u00e7ekle\u015ftirdi\u011fi ya da b\u00fcy\u00fck \u00f6l\u00e7\u00fcde i\u015fletmenin deneyim ve \u00e7al\u0131\u015fmalar\u0131na dayanarak, i\u015f ili\u015fkisi s\u0131ras\u0131nda yapt\u0131\u011f\u0131 bulu\u015ftur (m.113\/1). Hizmet bulu\u015fu d\u0131\u015f\u0131nda kalan bulu\u015flar ise, \u201cserbest bulu\u015f\u201d olarak kabul edilir (m.113\/2).<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u0130\u015f ili\u015fkisi s\u0131ras\u0131nda ger\u00e7ekle\u015ftirilen bulu\u015fun serbest bulu\u015f mu yoksa hizmet bulu\u015fu mu oldu\u011fu konusunda ortaya \u00e7\u0131kabilecek teredd\u00fctleri gidermek amac\u0131yla kanuna getirien d\u00fczenleme ile i\u015f\u00e7i, i\u015f s\u00f6zle\u015fmesi ili\u015fkisi i\u00e7indeyken serbest bir bulu\u015f yapmas\u0131 halinde de bunu geciktirmeden i\u015fverene bildirmekle y\u00fck\u00fcml\u00fc tutulmu\u015ftur. Kanuna g\u00f6re, bildirimde, bulu\u015f ve gerekiyorsa bulu\u015fun ger\u00e7ekle\u015ftirilme \u015fekli hakk\u0131nda bilgi vermek suretiyle, bulu\u015fun ger\u00e7ek bir serbest bulu\u015f say\u0131l\u0131p say\u0131lmayaca\u011f\u0131 konusunda i\u015fverenin bir kanaate varabilmesi sa\u011flan\u0131r (m.119\/1).<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">\u0130\u015f s\u00f6zle\u015fmesinden veya i\u015fin mahiyetinden aksi anla\u015f\u0131lmad\u0131k\u00e7a i\u015f\u00e7ilerin bir i\u015fletmede y\u00fck\u00fcml\u00fc oldu\u011fu faaliyeti gere\u011fi ger\u00e7ekle\u015ftirdi\u011fi ya da b\u00fcy\u00fck \u00f6l\u00e7\u00fcde i\u015fletmenin deneyim ve \u00e7al\u0131\u015fmalar\u0131na dayanarak i\u015f ili\u015fkisi s\u0131ras\u0131nda yapt\u0131\u011f\u0131 tasar\u0131mlar\u0131n hak sahibi i\u015fverendir (m.73\/1). Buna kar\u015f\u0131l\u0131k, i\u015f\u00e7ilerin bulundu\u011fu i\u015fyerindeki genel faaliyet konusu bilgi ve ara\u00e7lardan faydalanmak suretiyle birinci f\u0131kra kapsam\u0131 d\u0131\u015f\u0131nda yapt\u0131\u011f\u0131 tasar\u0131mlar\u0131n hak sahibi ise, talep edilmesi h\u00e2linde, i\u015fverenleridir (m.73\/2).<\/p>\n\n\n\n<h2 class=\"has-black-color has-text-color wp-block-heading\">\u0130\u015fverenin \u00e7al\u0131\u015fana bir bedel \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc<\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">6769 say\u0131l\u0131 Kanunun m. 114\/I h\u00fckm\u00fcne g\u00f6re, \u201c<em>\u00c7al\u0131\u015fan, bir hizmet bulu\u015fu yapt\u0131\u011f\u0131nda, bu bulu\u015funu yaz\u0131l\u0131 olarak ve geciktirmeksizin i\u015fverene bildirmekle y\u00fck\u00fcml\u00fcd\u00fcr. Bulu\u015f birden \u00e7ok \u00e7al\u0131\u015fan taraf\u0131ndan ger\u00e7ekle\u015ftirilmi\u015fse, bu bildirim birlikte yap\u0131labilir. \u0130\u015fveren, bildirimin kendisine ula\u015ft\u0131\u011f\u0131 tarihi, bildirimde bulunan ki\u015fi veya ki\u015filere gecikmeksizin ve yaz\u0131l\u0131 olarak bildirir\u201d<\/em>. <\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Yarg\u0131tay\u2019a g\u00f6re aksi kan\u0131tlanmad\u0131\u011f\u0131 s\u00fcrece bulu\u015fun bildirimde belirtilen ki\u015fiye ait oldu\u011funun kabul\u00fc gerekir (Yarg.11. HD, 24.4.2017, E.2015\/14065 K.2017\/2349).<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u0130\u015fveren hizmet bulu\u015fu \u00fczerinde tam hak talep ederse, \u00e7al\u0131\u015fan makul bir bedelin kendisine \u00f6denmesini i\u015fverenden isteyebilir. Kanunda i\u015fverenin hizmet bulu\u015fu \u00fczerinde k\u0131smi hak talep etmesine ili\u015fkin olarak, i\u015fveren e\u011fer bulu\u015fu kullan\u0131rsa bu durumda i\u015f\u00e7inin makul bir bedelin kendisine \u00f6denmesini isteme hakk\u0131 do\u011faca\u011f\u0131 h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r. (m. 115\/6).<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u0130\u015fverenin hizmet bulu\u015funa ili\u015fkin k\u0131smi veya tam hak talebinde bulunmas\u0131n\u0131 takiben bedel ve \u00f6deme \u015fekl\u00ee, i\u015fveren ile \u00e7al\u0131\u015fan aras\u0131nda imzalanan s\u00f6zle\u015fme veya benzeri bir hukuk ili\u015fkisi h\u00fck\u00fcmlerince belirlenir (m.115\/9). Hizmet bulu\u015fu birden \u00e7ok \u00e7al\u0131\u015fan taraf\u0131ndan ger\u00e7ekle\u015ftirilmi\u015fse, bedel ve \u00f6deme \u015fekli her biri i\u00e7in ayr\u0131 ayr\u0131 belirlenir (m.115\/10). \u0130\u015f\u00e7inin, i\u015fg\u00f6rme edimi gere\u011fi ya da b\u00fcy\u00fck \u00f6l\u00e7\u00fcde i\u015fletmenin deneyim ve \u00e7al\u0131\u015fmalar\u0131na dayanarak yapm\u0131\u015f oldu\u011fu tasar\u0131m\u0131n \u00f6nemi de dikkate al\u0131narak tespit edilecek bir bedel isteme hakk\u0131 bulunmaktad\u0131r. Taraflar bu bedel konusunda anla\u015famad\u0131klar\u0131 takdirde s\u00f6z konusu bedel mahkeme taraf\u0131ndan tespit edilir (m.74\/1).<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">6769 say\u0131l\u0131 Kanunda \u00e7al\u0131\u015fan bulu\u015flar\u0131na ili\u015fkin h\u00fck\u00fcmler i\u015f hukukunun yap\u0131s\u0131na uygun olacak \u015fekilde nispi emredici olarak d\u00fczenlenmi\u015f olup, bunlara ayk\u0131r\u0131 olacak \u015fekilde \u00e7al\u0131\u015fanlar\u0131n aleyhine d\u00fczenleme ve uygulama yap\u0131lamaz. Bu ba\u011flamda taraflar\u0131n i\u015f\u00e7i bulu\u015flar\u0131na ili\u015fkin s\u00f6zle\u015fme yapma serbestli\u011fi, hizmet bulu\u015flar\u0131nda patent verilmesi i\u00e7in yap\u0131lacak ba\u015fvurudan; serbest bulu\u015flarda ise \u00e7al\u0131\u015fan\u0131n i\u015fverene yapaca\u011f\u0131 bildirim y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcnden sonra ba\u015flar (m.117\/1). Ayr\u0131ca i\u015f\u00e7i ve i\u015fveren aras\u0131nda hizmet bulu\u015flar\u0131 ile serbest bulu\u015flara ili\u015fkin olarak yap\u0131lan s\u00f6zle\u015fmeler, \u00e7al\u0131\u015fan bulu\u015flar\u0131yla ilgili emredici h\u00fck\u00fcmlere ayk\u0131r\u0131 olmasa dahi, \u00f6nemli \u00f6l\u00e7\u00fcde hakkaniyetle ba\u011fda\u015fm\u0131yorsa ge\u00e7ersiz say\u0131l\u0131r. Ayn\u0131 husus belirlenen bedel i\u00e7in de ge\u00e7erlidir (m.117\/2).<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Kanunda s\u00f6zle\u015fmenin veya belirlenmi\u015f olan bedelin hakkaniyete ayk\u0131r\u0131 oldu\u011funa ili\u015fkin itirazlar hakk\u0131nda bir s\u00fcre \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr.
