E\u011fer i\u015f\u00e7i \u00f6lm\u00fc\u015fse murisin hak sahipleri de bu davay\u0131 a\u00e7abilmektedir. Hizmet tespit davas\u0131na dair hak d\u00fc\u015f\u00fcr\u00fcc\u00fc s\u00fcre murisin \u00f6l\u00fcm tarihinden ba\u015flamaktad\u0131r. Bu davay\u0131 a\u00e7abilmek i\u00e7in zamana\u015f\u0131m\u0131 mevcut olup,&nbsp; i\u015f\u00e7inin sigortas\u0131z \u015fekilde \u00e7al\u0131\u015ft\u0131\u011f\u0131 son y\u0131l\u0131n bitiminden itibaren be\u015f y\u0131l i\u00e7erisinde bu davan\u0131n a\u00e7\u0131lmas\u0131 gerekir.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\"><strong><em>Kanuni D\u00fczenleme <\/em><\/strong>: 5510 say\u0131l\u0131 <a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5510.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Sosyal Sigortalar ve GSS Kanunu<\/a>\u2019nun 86. maddesinin 9. f\u0131kras\u0131na g\u00f6re; \u201cSigortal\u0131n\u0131n \u00e7al\u0131\u015ft\u0131\u011f\u0131 bir veya birden fazla i\u015fte, bu Kanunda yaz\u0131l\u0131 \u015fartlar\u0131 yerine getirmi\u015f olmas\u0131na ra\u011fmen, kendisi i\u00e7in verilmesi gereken ayl\u0131k prim ve hizmet belgesinin veya muhtasar ve prim hizmet beyannamesinin i\u015fveren taraf\u0131ndan verilmedi\u011fi veya verilen ayl\u0131k prim ve hizmet belgesinde veya muhtasar ve prim hizmet beyannamesinde kazan\u00e7lar\u0131n ya da prim \u00f6deme g\u00fcn say\u0131lar\u0131n\u0131n eksik g\u00f6sterildi\u011fi Kurum taraf\u0131ndan tespit edilirse, hastal\u0131k ve anal\u0131k sigortalar\u0131ndan gerekli \u00f6demeler yap\u0131l\u0131r.\u201d \u015eeklindedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Hizmet Tespit Davas\u0131 A\u00e7abilmek \u0130\u00e7in Gerekli \u015eartlar Nelerdir?<\/strong><\/h2>\n\n\n\n<ol class=\"has-black-color has-text-color wp-block-list\"><li>\u0130\u015fverenin i\u015f\u00e7iyi \u00e7al\u0131\u015ft\u0131rm\u0131\u015f oldu\u011fu i\u015fyerini kanuni y\u00fck\u00fcml\u00fcl\u00fckleri sa\u011flayan i\u015f yerlerinden olmas\u0131 gerekir.<\/li><li>\u0130\u015f\u00e7inin, yapm\u0131\u015f oldu\u011fu bir hizmeti olmal\u0131 ve hizmet ili\u015fkisi de i\u015fverene ait olan i\u015fyerinde ger\u00e7ekle\u015fmelidir.<\/li><li>Durumun SGK taraf\u0131ndan daha \u00f6ncesinde tespit edilmemi\u015f olmas\u0131 gerekir.<\/li><li>\u0130\u015f\u00e7i davay\u0131 be\u015f y\u0131ll\u0131k s\u00fcresi i\u00e7erisinde a\u00e7mal\u0131d\u0131r.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>H<\/strong><strong>izmet<\/strong><strong> T<\/strong><strong>espit<\/strong><strong> D<\/strong><strong>avas\u0131nda<\/strong><strong> <\/strong><strong>&nbsp;Yetkili ve <\/strong><strong>G\u00f6<\/strong><strong>revli <\/strong><strong>&nbsp;M<\/strong><strong>ahkeme<\/strong><strong> N<\/strong><strong>edir<\/strong><strong> ?<\/strong><\/h2>\n\n\n\n<p class=\"has-black-color has-text-color\">Hizmet tespit davas\u0131nda g\u00f6revli mahkeme \u0130\u015f Mahkemeleridir. \u0130\u015f mahkemelerinin bulunmad\u0131\u011f\u0131 yerlerde ise Asliye Hukuk Mahkemelerinde tespit davas\u0131 a\u00e7\u0131lacakt\u0131r.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Yetki bak\u0131m\u0131ndan ise 7036 Say\u0131l\u0131 \u0130\u015f Mahkemeleri Kanunu\u2019nun 6. Maddesinin uygulanmas\u0131 gerekmektedir. Maddeye g\u00f6re yetkinin belirlenmesinde daval\u0131n\u0131n yerle\u015fim yeri, daval\u0131lar birden fazla ise birinin yerle\u015fim yeri veya i\u015fin yap\u0131ld\u0131\u011f\u0131 yer mahkemesi de yetkilidir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>H<\/strong><strong>izmet<\/strong><strong> T<\/strong><strong>espit<\/strong><strong> D<\/strong><strong>avas\u0131nda<\/strong><strong> N<\/strong><strong>eler<\/strong><strong> D<\/strong><strong>elil<\/strong><strong> O<\/strong><strong>larak<\/strong><strong> K<\/strong><strong>ullan\u0131labilir<\/strong><strong> ?<\/strong><\/h2>\n\n\n\n<p class=\"has-black-color has-text-color\">Sigortal\u0131n\u0131n i\u015f yeri sicil dosyas\u0131, tan\u0131k, i\u015fveren nezdindeki i\u015f yeri dosyas\u0131, i\u015fverenin mesleki kurulu\u015f kayd\u0131, dernek ve esnaf sicil kayd\u0131, sanayi ve ticaret odas\u0131 kay\u0131tlar\u0131, imzal\u0131 \u00fccret bordrolar\u0131, bilirki\u015fi ve yemin delili ispat i\u00e7in kullan\u0131labilecek olan ara\u00e7lard\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Hizmet Tespit Davas\u0131 A\u00e7\u0131lmadan \u00d6nce Arabulucuya Ba\u015fvuru Zorunlulu\u011fu Var M\u0131d\u0131r?<\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u0130\u015f Hukukunda 01.01.2018 tarihinden itibaren; Kanuna, bireysel veya toplu i\u015f s\u00f6zle\u015fmesine dayanan i\u015f\u00e7i veya i\u015fveren alaca\u011f\u0131 ve tazminat\u0131 ile i\u015fe iade talebiyle a\u00e7\u0131lan davalarda, arabulucuya ba\u015fvurulmu\u015f olmas\u0131 dava \u015fart\u0131d\u0131r. Bununla birlikte hizmet tespit davalar\u0131 niteli\u011fi itibariyle kamu d\u00fczenini ilgilendirdi\u011fi i\u00e7in arabulucuya ba\u015fvuru zorunlulu\u011fu olmadan do\u011frudan dava a\u00e7\u0131labilecektir. Yine ba\u015fka bir istisna olarak hizmet tespit davas\u0131 a\u00e7\u0131lmadan \u00f6nce SGK\u2019ya ba\u015fvuru zorunlulu\u011fu da bulunmamaktad\u0131r. K\u0131saca, hak iddia eden i\u015f\u00e7i, SGK veya arabulucuya ba\u015fvurmadan do\u011frudan bu davay\u0131 a\u00e7ma hakk\u0131na sahiptir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Relevant Supreme Court Decisions:<\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">&nbsp;&nbsp; \u201c\u2026\u0130\u015fverence Kuruma verilecek belgeler; i\u015fe giri\u015f bildirgesi, ayl\u0131k sigorta primleri bildirgesi, d\u00f6nem bordrosu vs. \u015feklinde s\u0131ralanm\u0131\u015ft\u0131r. Bu belgelerden birisinin dahi Kuruma verilmi\u015f olmas\u0131 veya Kurumca, fiilen ya da kayden sigortal\u0131 \u00e7al\u0131\u015fma olgusunun tespiti halinde hak d\u00fc\u015f\u00fcr\u00fcc\u00fc s\u00fcreden s\u00f6z edilemeyecektir\u2026\u201d (Yarg\u0131tay 21. HD. 2008\/9842 E., 2009\/7830 K.)<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">&nbsp;\u201c\u2026Kuruma bildirilmeyen hizmetlerin sigortal\u0131 hizmet olarak de\u011ferlendirilmesine ili\u015fkin davan\u0131n, tespiti istenen hizmetin ge\u00e7ti\u011fi y\u0131l\u0131n sonundan ba\u015flayarak 5 y\u0131l i\u00e7inde a\u00e7\u0131lmas\u0131 gerekir. Sigortal\u0131ya ili\u015fkin olarak i\u015fe giri\u015f bildirgesi, d\u00f6nem bordrosu gibi y\u00f6netmelikte belirtilen belgelerin Kuruma verilmesi ya da \u00e7al\u0131\u015fmalar\u0131n Kurumca tespit edilmesi halinde; Kurumca \u00f6\u011frenilen ve sonras\u0131nda kesintisiz bi\u00e7imde devam eden \u00e7al\u0131\u015fmalar bak\u0131m\u0131ndan hak d\u00fc\u015f\u00fcr\u00fcc\u00fc s\u00fcrenin ge\u00e7ti\u011finden s\u00f6z edilemez. Ne var ki; sigortal\u0131n\u0131n Kuruma bildiriminin i\u015fe giri\u015f tarihinden sonra yap\u0131lmas\u0131, bir ba\u015fka ifade ile sigortal\u0131n\u0131n hizmet s\u00fcresinin ba\u015flang\u0131\u00e7taki bir b\u00f6l\u00fcm\u00fcn\u00fcn Kuruma bildirilmeyerek sonras\u0131n\u0131n bildirilmesi ve Kuruma bildirimin yap\u0131ld\u0131\u011f\u0131 tarihten \u00f6nceki \u00e7al\u0131\u015fmalar\u0131n, bildirgelerin verildi\u011fi tarihide kapsar bi\u00e7imde kesintisiz devam etmi\u015f olmas\u0131 halinde, Kuruma bildirilmeyen \u00e7al\u0131\u015fma s\u00fcresi y\u00f6n\u00fcnden hak d\u00fc\u015f\u00fcr\u00fcc\u00fc s\u00fcrenin hesaplanmas\u0131nda; bildirim d\u0131\u015f\u0131 tutulan s\u00fcrenin sonu de\u011fil, kesintisiz olarak ge\u00e7en \u00e7al\u0131\u015fmalar\u0131n sona erdi\u011fi y\u0131l\u0131n sonu ba\u015flang\u0131\u00e7 al\u0131nmal\u0131d\u0131r\u2026\u201d (Yarg\u0131tay 10. HD. 2015\/17274 E., 2015\/18794 K.)<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">&nbsp;&nbsp; Yarg\u0131tay m\u00fcstekar kararlar\u0131yla i\u015fe giri\u015f bildirgesinin kuruma verilmi\u015f olmas\u0131n\u0131n tek ba\u015f\u0131na eylemli \u00e7al\u0131\u015fmay\u0131 ispatlamad\u0131\u011f\u0131n\u0131 bunun yan\u0131nda i\u015f\u00e7inin (davac\u0131n\u0131n) i\u015fveren (daval\u0131) yan\u0131nda fiilen \u00e7al\u0131\u015fmas\u0131n\u0131n bulunup bulunmad\u0131\u011f\u0131n\u0131n ara\u015ft\u0131r\u0131lmas\u0131n\u0131, davac\u0131n\u0131n talep etti\u011fi tarihteki \u00e7al\u0131\u015fmas\u0131n\u0131n mevcut tan\u0131klar ve gerekti\u011finde kom\u015fu i\u015fyerleri \u00e7al\u0131\u015fanlar\u0131 oldu\u011fu kay\u0131tlarla veya kolluk\/zab\u0131ta marifetiyle yap\u0131lacak ara\u015ft\u0131rmalar sonucunda belirlenen ki\u015filerin beyanlar\u0131na ba\u015fvurulmas\u0131 gerekti\u011fini ifade etmi\u015ftir. Hatta davan\u0131n niteli\u011fi ve kabul\u00fc halinde davac\u0131ya sa\u011flayaca\u011f\u0131 haklar g\u00f6z \u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda kamu d\u00fczenini ilgilendirdi\u011finden ara\u015ft\u0131rman\u0131n geni\u015fletilerek sonucuna g\u00f6re karar verilmesi gerekti\u011fi hususuna vurgulam\u0131\u015ft\u0131r. HD. 2019\/1642 E., 2019\/7952 K.)<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Yukar\u0131da payla\u015fan yarg\u0131tay yerle\u015fik uygulamar\u0131na g\u00f6re tespit davalar\u0131 a\u00e7\u0131l\u0131rken i\u015f\u00e7inin fiilen \u00e7al\u0131\u015fmas\u0131n\u0131n olup olmad\u0131\u011f\u0131n\u0131n tespiti a\u00e7\u0131s\u0131ndan; i\u015f\u00e7inin \u00f6zellikle i\u015fyerinde ne i\u015f yapt\u0131\u011f\u0131, ba\u015fka \u00e7al\u0131\u015fan olup olmad\u0131\u011f\u0131, idarecilerin kim veya kimler &nbsp;oldu\u011fu, i\u015fyerinin nerede oldu\u011fu belirtilmi\u015f olmal\u0131d\u0131r.
