Maddesinin d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131 uyar\u0131nca halen y\u00fcr\u00fcrl\u00fckte bulunan Yabanc\u0131lar\u0131n \u00c7al\u0131\u015fma \u0130zinleri Hakk\u0131nda Kanunun Uygulama Y\u00f6netmeli\u011finin 13\u2019\u00fcnc\u00fc Maddesi Uyar\u0131nca Belirlenen Yabanc\u0131lar\u0131n \u00c7al\u0131\u015fma \u0130zin Taleplerine \u0130li\u015fkin Olarak Ba\u015fvuru Sahibi \u0130\u015fyerlerinin ve Yabanc\u0131lar\u0131n Kar\u015f\u0131lamas\u0131 Zorunlu Olan De\u011ferlendirme Kriterleri A\u015fa\u011f\u0131da Belirtilmi\u015ftir;<\/p>\n\n\n\n<ol type=\"1\" class=\"has-black-color has-text-color wp-block-list\"><li>\u00c7al\u0131\u015fma izni talep edilen i\u015fyerinde en az be\u015f T.C. vatanda\u015f\u0131n\u0131n istihdam\u0131 zorunludur. \u0130zin isteyen yabanc\u0131n\u0131n \u015firket orta\u011f\u0131 olmas\u0131 halinde be\u015f ki\u015filik istihdam \u015fart\u0131, Bakanl\u0131k\u00e7a verilecek bir y\u0131ll\u0131k \u00e7al\u0131\u015fma izninin son alt\u0131 ay\u0131 i\u00e7in aran\u0131r. Ayn\u0131 i\u015fyerinde birden fazla yabanc\u0131 i\u00e7in \u00e7al\u0131\u015fma izni talebinde bulunulmas\u0131 durumunda, \u00e7al\u0131\u015fma izni verilen ilk yabanc\u0131dan sonraki her bir yabanc\u0131 i\u00e7in ayr\u0131 ayr\u0131 be\u015f T.C. vatanda\u015f\u0131 istihdam\u0131 aranacakt\u0131r.<\/li><li>\u0130\u015fyerinin \u00f6denmi\u015f sermayesinin en az 100.000 TL veya br\u00fct sat\u0131\u015flar\u0131n\u0131n en az 800.000 TL veya son y\u0131l ihracat tutar\u0131n\u0131n en az 250.000 ABD Dolar\u0131 olmas\u0131 gerekmektedir.<\/li><li>Dernek ve vak\u0131flarda \u00e7al\u0131\u015facak yabanc\u0131lara ili\u015fkin izin taleplerinde 2 nci madde, yabanc\u0131 devlet havayollar\u0131n\u0131n T\u00fcrkiye temsilciliklerinde, e\u011fitim sekt\u00f6r\u00fc ve ev hizmetlerinde \u00e7al\u0131\u015facak yabanc\u0131lar\u0131n \u00e7al\u0131\u015fma izni ba\u015fvurular\u0131n\u0131n de\u011ferlendirilmesinde ise, 1 inci ve 2 nci maddeler uygulanmayacakt\u0131r.<\/li><li>\u0130zin isteyen \u015firket orta\u011f\u0131 yabanc\u0131n\u0131n, 40.000 TL\u2019den az olmamak \u00fczere sermaye pay\u0131n\u0131n en az y\u00fczde 20 olmas\u0131 zorunludur.<\/li><li>\u0130\u015fveren taraf\u0131ndan yabanc\u0131ya \u00f6denece\u011fi beyan edilen ayl\u0131k \u00fccret miktar\u0131n\u0131n yabanc\u0131n\u0131n g\u00f6rev ve yetkinli\u011fi ile ba\u011fda\u015f\u0131r seviyede olmas\u0131 zorunludur. Buna g\u00f6re, ba\u015fvuru tarihi itibariyle y\u00fcr\u00fcrl\u00fckte bulunan asgari \u00fccret tutar\u0131 dikkate al\u0131nmak suretiyle yabanc\u0131ya \u00f6denecek \u00fccretin en az;<\/li><li>\u00dcst d\u00fczey y\u00f6neticiler ve pilotlar i\u00e7in asgari \u00fccretin 6,5 kat\u0131,<\/li><li>Birim veya \u015fube m\u00fcd\u00fcrleri ile m\u00fchendis ve mimarlar i\u00e7in asgari \u00fccretin 4 kat\u0131,<\/li><li>Uzmanl\u0131k ve ustal\u0131k gerektiren i\u015flerde \u00e7al\u0131\u015facaklar ile \u00f6\u011fretmenler i\u00e7in asgari \u00fccretin 3 kat\u0131,<\/li><li>Ev hizmetlerinde \u00e7al\u0131\u015ft\u0131r\u0131lacak yabanc\u0131lar i\u00e7in en az asgari \u00fccret, di\u011fer mesleklerde \u00e7al\u0131\u015facak yabanc\u0131lar i\u00e7in asgari \u00fccretin 1,5 kat\u0131,<\/li><li>Turizm-animasyon organizasyon firmalar\u0131nda akrobat ve benzeri unvanlarda \u00e7al\u0131\u015facak yabanc\u0131lar ile mas\u00f6r, mas\u00f6z ve SPA terapisti gibi i\u015flerde&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00e7al\u0131\u015facak yabanc\u0131lar i\u00e7in asgari \u00fccretin 2 kat\u0131, olmas\u0131 gerekmektedir<\/li><li>B\u00fcnyelerinde;<\/li><li>\u0130zinli masaj salonu bulundu\u011funu kan\u0131tlayan K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131ndan belgeli en az \u00fc\u00e7 y\u0131ld\u0131zl\u0131 turizm i\u015fletmelerinin, belgeli tatil k\u00f6ylerinin, resmi makamlardan al\u0131nm\u0131\u015f faaliyet&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; izni bulunan termal otellerin,<\/li><li>Hamam-sauna-SPA vb. kompleksi bulunduran belgeli turizm i\u015fletmeleriyle anla\u015fmal\u0131 (s\u00f6zle\u015fme bulunan) tesislerin,<\/li><li>En az yirmi (20) T\u00fcrk vatanda\u015f\u0131 \u00e7al\u0131\u015ft\u0131ran resmi makamlardan izinli spor merkezlerinin,<\/li><li>&#8211; Mas\u00f6r, mas\u00f6z ve SPA terapisti gibi uzmanl\u0131k ve ustal\u0131k gerektiren i\u015flerdeki yabanc\u0131 \u00e7al\u0131\u015ft\u0131rma talepleri de\u011ferlendirmeye al\u0131nacak, bu kapsamda bulunmayan i\u015fletme ve i\u015fyerlerinin&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; talepleri ise uygun bulunmayacakt\u0131r.<\/li><li>E\u011flence sekt\u00f6r\u00fcn\u00fcn ve turizm-animasyon organizasyon firmalar\u0131n\u0131n uzmanl\u0131k ve ustal\u0131k gerektiren i\u015flerinde istihdam edilecek yabanc\u0131lar i\u00e7in en az 10 T.C. vatanda\u015f\u0131 \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 halinde her bir yabanc\u0131 i\u00e7in ayr\u0131 ayr\u0131 be\u015f T.C. vatanda\u015f\u0131 istihdam\u0131na ili\u015fkin kota ayr\u0131ca uygulanmayacakt\u0131r.<\/li><li>T\u00fcrkiye\u2019nin taraf oldu\u011fu ikili ya da \u00e7ok tarafl\u0131 s\u00f6zle\u015fmelerde h\u00fck\u00fcm bulunan haller ile kamu kurum ve kurulu\u015flar\u0131nca s\u00f6zle\u015fme veya ihale usulleriyle mal ve hizmet al\u0131m\u0131 i\u015flerinde \u00e7al\u0131\u015ft\u0131r\u0131lacak yabanc\u0131lara ili\u015fkin \u00e7al\u0131\u015fma izin taleplerinin de\u011ferlendirilmesinde 1 inci ve 2 nci maddelerde belirlenen kriterler uygulanmayacakt\u0131r.<\/li><li>\u0130leri teknoloji gerektiren i\u015flerde veya ayn\u0131 vas\u0131flarda T\u00fcrk uzman\u0131n bulunmad\u0131\u011f\u0131 hallerde Genel M\u00fcd\u00fcrl\u00fck Makam\u0131nca verilecek onay \u00fczerine 1 inci ve 2&#8217;nci maddelerle belirlenen kriterler uygulanmayacakt\u0131r.<\/li><li>\u00d6zellik Arzeden Do\u011frudan Yabanc\u0131 Yat\u0131r\u0131m ko\u015fullar\u0131n\u0131 ta\u015f\u0131yan i\u015fletmelerde kilit personel d\u0131\u015f\u0131nda istihdam edilecek yabanc\u0131lar i\u00e7in, 1 inci madde ile belirlenen kriter, i\u015fletmenin \u00fclke \u00e7ap\u0131ndaki t\u00fcm i\u015fyerlerinde \u00e7al\u0131\u015fan T.C. vatanda\u015f\u0131 say\u0131s\u0131 esas al\u0131narak uygulan\u0131r.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><strong>Ba\u015fvurular\u0131nda Kriter Uygulanmayacak Durumlar<\/strong><\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Yabanc\u0131lar\u0131n \u00c7al\u0131\u015fma \u0130zinleri Hakk\u0131nda Kanunun Uygulama Y\u00f6netmeli\u011fi h\u00fck\u00fcmlerince \u00e7al\u0131\u015fma izni de\u011ferlendirme kriterlerine tabi olmayan yabanc\u0131lar a\u015fa\u011f\u0131da belirtilmi\u015f olup, burada belirtilen yabanc\u0131lar\u0131n \u00e7al\u0131\u015fabilmeleri i\u00e7in \u00e7al\u0131\u015fma izni almalar\u0131 zorunludur. \u00c7al\u0131\u015fma izin ba\u015fvurular\u0131 \u00e7al\u0131\u015fma izni de\u011ferlendirme kriterlerine tabi tutulmaks\u0131z\u0131n sonu\u00e7land\u0131r\u0131lan s\u00f6z konusu yabanc\u0131lar\u0131n bu kapsamda bulunduklar\u0131n\u0131 T.C. resmi makamlar\u0131ndan al\u0131nm\u0131\u015f belgelerle kan\u0131tlamalar\u0131 zorunludur.<\/p>\n\n\n\n<ul
