Fesih, s\u00f6zle\u015fmenin taraflar\u0131ndan birinin s\u00f6zle\u015fmeyi sona erdirmeye ili\u015fkin irade a\u00e7\u0131klamas\u0131d\u0131r. Bir di\u011fer ifade ile s\u00f6zle\u015fme, taraflardan birinin&nbsp; irade a\u00e7\u0131klamas\u0131yla gelece\u011fe y\u00f6nelik olarak ve kar\u015f\u0131 taraf\u0131n kabul\u00fcne gerek olmadan ortadan kalkar. &nbsp;\u0130\u015fte bu noktada i\u015f s\u00f6zle\u015fmesinin sona ermesi ile, ibraname imzalanmas\u0131 g\u00fcndeme gelecektir. Bu yaz\u0131m\u0131zda ibraname nedir, ibranamenin ge\u00e7erlilik \u015fartlar\u0131 nelerdir, hangi durumlarda ibraname ge\u00e7ersiz say\u0131l\u0131r gibi ba\u015fl\u0131klar\u0131n \u00fczerinde duraca\u011f\u0131z.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>1. \u0130braname Nedir?<\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Hukukta ibra; aklanma, temize \u00e7\u0131kma gibi anlamlara gelmektedir. \u0130\u015f hukuku anlam\u0131nda ibraname ise alacakl\u0131 durumunda bulunan i\u015f\u00e7inin veya i\u015fverenin bor\u00e7lu durumundaki i\u015f\u00e7i veya i\u015fverene &nbsp;kar\u015f\u0131 sahip oldu\u011fu bir veya birden fazla alaca\u011f\u0131n\u0131 ortadan kald\u0131ran; onu ge\u00e7mi\u015fe d\u00f6n\u00fck olarak ibra etti\u011fini g\u00f6steren belgedir.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Bir ba\u015fka anlat\u0131mla ibraname, i\u015f\u00e7i ile i\u015fveren aras\u0131ndaki i\u015f ili\u015fkisi sebebiyle do\u011fan bor\u00e7lar\u0131n s\u00f6zle\u015fme ile sona erdirilmesidir. Buna &#8221;ibra s\u00f6zle\u015fmesi&#8221; denir. \u0130braname imzalayan i\u015f\u00e7i dava a\u00e7abilir ve k\u0131dem tazminat\u0131 ile eksik \u00f6denen i\u015f\u00e7ilik alacaklar\u0131 varsa bunlar\u0131 daha sonra da alabilir. \u0130bra s\u00f6zle\u015fmesi, bor\u00e7 ili\u015fkisinden do\u011fan belirli bir borca ili\u015fkin yap\u0131l\u0131r. \u00d6rne\u011fin i\u015f s\u00f6zle\u015fmesinde i\u015fverenin i\u015f\u00e7iye \u00fccret \u00f6deme borcu varsa, i\u015fveren i\u015f\u00e7iyle \u00f6denmeyen \u00fccret alacaklar\u0131na ili\u015fkin ibraname imzalayabilir ve bu durumda belirlenen bor\u00e7lar ortadan kalkar. Ancak, bu durum i\u015f\u00e7inin k\u0131dem tazminat\u0131n\u0131 veya fazla mesai alacaklar\u0131n\u0131 etkilemez.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>2. \u0130branamenin Ge\u00e7erlilik Ko\u015fullar\u0131 Nelerdir?<\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u0130branamenin ge\u00e7erlili\u011fi <a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.6098.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">TBK <\/a>420\/2 maddesinde d\u00fczelenmi\u015ftir. Buna g\u00f6re d\u00fczenlenecek ibranamenin h\u00fck\u00fcm do\u011furabilmesi i\u00e7in belli ba\u015fl\u0131 \u015fartlar\u0131 sa\u011flamas\u0131 gerekir. \u0130nceleyecek olursak:<\/p>\n\n\n\n<ul class=\"has-black-color has-text-color wp-block-list\"><li>\u0130braname yaz\u0131l\u0131 olmal\u0131d\u0131r. Bunun anlam\u0131, yaz\u0131l\u0131 bir metnin olmas\u0131 gerekti\u011fi ve bu metnin alt\u0131nda i\u015f\u00e7inin imzas\u0131n\u0131n yer al\u0131yor olmas\u0131d\u0131r. \u0130\u015f\u00e7inin herhangi bir ortamda alacaklar\u0131n\u0131 ald\u0131\u011f\u0131n\u0131 beyan etmesi sms, telefon kamera kayd\u0131 vs. hukuken bir anlam ifade etmez.<\/li><li>\u0130\u015f s\u00f6zle\u015fmesinin sona erdi\u011fi tarihi takip eden bir ayl\u0131k s\u00fcre sonras\u0131nda imzalanm\u0131\u015f olmal\u0131d\u0131r. Yani, i\u015f\u00e7inin i\u015ften ayr\u0131lmas\u0131 ile ibraname vermesi aras\u0131nda en az bir ay olmal\u0131d\u0131r. Bunun amac\u0131, i\u015f\u00e7inin ibra s\u00f6zle\u015fmesi yapt\u0131\u011f\u0131 s\u0131rada i\u015fverene olan muhta\u00e7l\u0131k durumunun sona ermi\u015f olmas\u0131d\u0131r.<\/li><li>\u0130branameye konu olan alaca\u011f\u0131n t\u00fcr\u00fc ve miktar\u0131 ilgili metinde a\u00e7\u0131k ve net bir \u015fekilde yer almal\u0131d\u0131r. \u00d6rne\u011fin \u2018\u00e7al\u0131\u015ft\u0131\u011f\u0131m s\u00fcre boyunca her t\u00fcrl\u00fc hakk\u0131m\u0131 ald\u0131m, hi\u00e7bir hak ve alaca\u011f\u0131m yoktur. \u015eeklindeki beyanlar ge\u00e7erli say\u0131lmayacakt\u0131r. Her hak t\u00fcr\u00fc, kalem kalem ve miktar miktar yaz\u0131lmal\u0131d\u0131r.<\/li><\/ul>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u0130\u015f\u00e7iye yap\u0131lmas\u0131 gereken \u00f6demeler hak tutar\u0131na nazaran eksiksiz ve banka arac\u0131l\u0131\u011f\u0131yla yap\u0131lm\u0131\u015f olmal\u0131d\u0131r. Banka hesab\u0131 metinde yazd\u0131\u011f\u0131 \u015fekli ile bizzat i\u015f\u00e7i ad\u0131na a\u00e7\u0131lm\u0131\u015f bir hesap olmal\u0131d\u0131r. Bu \u00f6zellikleri ta\u015f\u0131mayan \u00f6demelerin ibraname ile \u00f6denmi\u015f say\u0131lmas\u0131 m\u00fcmk\u00fcn olmaz<strong>. <\/strong>B\u00fct\u00fcn \u015fartlar sa\u011fland\u0131\u011f\u0131 taktirde, ibra s\u00f6zle\u015fmesinde aksine bir h\u00fck\u00fcm de yoksa as\u0131l alacak ile faiz, rehin, ceza ko\u015fulu gibi fer&#8217;i haklar da sona erer. Ancak alacakl\u0131, i\u015flemi\u015f faiz veya ger\u00e7ekle\u015fmi\u015f cezai \u015fart alaca\u011f\u0131n\u0131 sakl\u0131 tutmu\u015fsa, ibraya ra\u011fmen bunlar varl\u0131klar\u0131n\u0131 s\u00fcrd\u00fcr\u00fcr.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>3. <\/strong><strong>\u0130braname \u0130mzalayan \u0130\u015f\u00e7i Ne Yapabilir?<\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Yukar\u0131da say\u0131lan \u015fartlarda eksiklik olmas\u0131 durumunda, ibraname imzalayan i\u015f\u00e7i ibraname ile ba\u011fl\u0131 de\u011fildir. \u0130branamenin tutar i\u00e7ermesi ancak belirtilen tutar\u0131n ger\u00e7ek alaca\u011f\u0131 g\u00f6stermemesi h\u00e2linde ise ibraname i\u00e7erdi\u011fi miktarla s\u0131n\u0131rl\u0131 olarak makbuz niteli\u011finde say\u0131lacakt\u0131r. \u0130\u015f\u00e7inin hak etti\u011fi tutar\u0131n tam olarak \u00f6denmemesi h\u00e2linde makbuz niteli\u011findeki ibraname, i\u015f\u00e7inin \u00f6denmeyen veya eksik \u00f6denen tutar\u0131 talep etmesine engel te\u015fkil etmeyecektir. Bu kapsamda i\u015f\u00e7i, yasal haklar\u0131n\u0131 i\u015fverenden talep edebilir. K\u0131dem tazminat\u0131, ihbar tazminat\u0131 ve di\u011fer i\u015f\u00e7ilik alacaklar\u0131 i\u00e7in noterden ihtarname \u00e7ekerek \u00f6deme i\u00e7in makul bir s\u00fcre verilmeli, tan\u0131nan m\u00fchlet i\u00e7inde i\u015fveren \u00f6deme yapmazsa i\u015f mahkemesinde dava a\u00e7\u0131lmal\u0131d\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>4. \u0130lgili Yarg\u0131tay Kararlar\u0131:<\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">A. \u0130\u015f ili\u015fkisi devam ederken d\u00fczenlenen ibra s\u00f6zle\u015fmeleri ge\u00e7ersizdir. \u0130\u015f\u00e7i bu d\u00f6nemde tamamen i\u015fverene ba\u011f\u0131ml\u0131 durumdad\u0131r ve i\u015f g\u00fcvencesi h\u00fck\u00fcmlerine ra\u011fmen i\u015f ili\u015fkisinin devam\u0131n\u0131 sa\u011flamak veya bir k\u0131s\u0131m i\u015f\u00e7ilik alacaklar\u0131na bir an \u00f6nce kavu\u015fabilmek i\u00e7in iradesi d\u0131\u015f\u0131nda ibra s\u00f6zle\u015fmesi imzalamaya y\u00f6nelmesi m\u00fcmk\u00fcnd\u00fcr <em>(Yarg\u0131tay 9. H.D. 13.01.2014, E. 2011\/51524, K.)<\/em><\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">B. \u0130branamenin tarih i\u00e7ermemesi ve i\u00e7eri\u011finden de fesih tarihinden sonra d\u00fczenlendi\u011finin anla\u015f\u0131lamamas\u0131 durumunda ibranameye de\u011fer verilemez <em>(Yarg\u0131tay 9.
