Bunlar\u0131 s\u0131ras\u0131 ile inceleyecek olursak;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-1-kidem-tazminati\">1. K\u0131dem Tazminat\u0131:<\/h3>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">The employee&#039;s severance pay is calculated based on their last gross salary (including all benefits). The total gross salary is obtained by adding regular social benefits and similar payments such as transportation allowance, meal allowance, bonuses, etc., to the employee&#039;s last gross salary, and this gross salary is used as the basis for calculating severance pay.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">K\u0131dem tazminat\u0131nda faiz ba\u015flang\u0131c\u0131 hep ayn\u0131 olup, ilk davada oldu\u011fu gibi, ek davada veya dava de\u011ferini (\u0131slah yoluyla) art\u0131rmada da faiz ba\u015flang\u0131c\u0131: i\u015f s\u00f6zle\u015fmesinin k\u0131dem tazminat\u0131n\u0131 hak edecek bi\u00e7imde sona erdi\u011fi tarihtir. \u00a0(K\u0131dem tazminat\u0131 ile ilgili detayl\u0131 bilgi almak i\u00e7in Kar\u015f\u0131yaka Avukat &#8211; K\u0131dem tazminat\u0131 adl\u0131 yaz\u0131m\u0131z\u0131 inceleyebilirsiniz.) <\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\"><em>The ruling of the 9th Civil Chamber of the Supreme Court of Appeals, numbered 2017\/5554 E., 2018\/7618 K., dated 04.04.2018;<\/em><em>&nbsp; <\/em>\u201d&quot;...According to Article 11 of Article 14 of Law No. 1475, which is currently in force, by virtue of Article 120 of the Labor Law No. 4857, if severance pay is not paid on time, the highest interest rate applied to deposits should be awarded...&quot; Therefore, the interest rate to be applied to severance pay is the highest interest rate applied to deposits by banks.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-2-ihbar-tazminati\">2. Severance Pay <\/h3>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Severance pay is compensation that the party terminating an indefinite-term employment contract without just cause and without providing proper notice must pay to the other party. Unlike seniority and annual leave, severance pay is not tied to a one-year employment requirement. Even if the contract lasted less than six months, the employee has the right to receive severance pay.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u0130hbar tazminat\u0131na yasal faiz uygulanmaktad\u0131r. If a different type of interest is stipulated in an individual or collective labor agreement, the agreed interest rate shall be applied, provided it is not lower than the legal interest rate...&quot;.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Di\u011fer alacaklardan farkl\u0131 olarak bu alacak kalemine yasal faiz uygulanmaktad\u0131r. \u0130\u015f\u00e7ilik alacaklar\u0131nda faiz t\u00fcr\u00fc ve zamana\u015f\u0131m\u0131 s\u00fcresi somut olaya g\u00f6re farkl\u0131l\u0131k g\u00f6sterebildi\u011finden, hak kayb\u0131 ya\u015fanmamas\u0131 ad\u0131na s\u00fcrecin bir uzman taraf\u0131ndan y\u00fcr\u00fct\u00fclmesi \u00f6nemlidir. Bu kapsamda, <strong>Izmir Kar\u015f\u0131yaka lawyer<\/strong> deste\u011fi ile ihbar tazminat\u0131, faiz ve zamana\u015f\u0131m\u0131 s\u00fcre\u00e7lerinin do\u011fru \u015fekilde de\u011ferlendirilmesi m\u00fcmk\u00fcn olacakt\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-3-yillik-izin-ucreti-alacagi\">3. Annual Leave Pay Entitlement<\/h3>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Y\u0131ll\u0131k izin \u00fccreti, i\u015f\u00e7inin kullanmad\u0131\u011f\u0131 y\u0131ll\u0131k izin s\u00fcrelerine kar\u015f\u0131l\u0131k hak kazand\u0131\u011f\u0131 bir i\u015f\u00e7ilik alaca\u011f\u0131d\u0131r. 4857 say\u0131l\u0131 \u0130\u015f Kanunu uyar\u0131nca, i\u015f s\u00f6zle\u015fmesinin herhangi bir nedenle sona ermesi halinde, i\u015f\u00e7inin hak edip de kullanmad\u0131\u011f\u0131 y\u0131ll\u0131k izin s\u00fcrelerine ili\u015fkin \u00fccretinin kendisine \u00f6denmesi zorunludur. Bu alacak, i\u015f s\u00f6zle\u015fmesinin devam\u0131 s\u0131ras\u0131nda talep edilemez; ancak fesih ile birlikte muaccel hale gelir.<\/p>\n\n\n\n<p>Y\u0131ll\u0131k izin \u00fccreti alaca\u011f\u0131na uygulanacak faiz bak\u0131m\u0131ndan, uygulamada kabul g\u00f6ren g\u00f6r\u00fc\u015f do\u011frultusunda, fesih tarihi itibariyle alacak muaccel hale geldi\u011finden, ayr\u0131ca temerr\u00fcde d\u00fc\u015f\u00fcrmeye gerek olmaks\u0131z\u0131n bu tarihten itibaren faiz i\u015fletilmektedir. Faiz t\u00fcr\u00fc ise kural olarak yasal faiz olmakla birlikte, somut olay\u0131n \u00f6zelliklerine g\u00f6re farkl\u0131 de\u011ferlendirmeler yap\u0131labilmektedir.<\/p>\n\n\n\n<p>Y\u0131ll\u0131k izin \u00fccreti alaca\u011f\u0131nda zamana\u015f\u0131m\u0131 s\u00fcresi 7036 say\u0131l\u0131 \u0130\u015f Mahkemeleri Kanunu uyar\u0131nca 5 y\u0131l olup, bu s\u00fcre i\u015f s\u00f6zle\u015fmesinin sona erdi\u011fi tarihten itibaren i\u015flemeye ba\u015flar. \u0130\u015f\u00e7inin bu s\u00fcre i\u00e7erisinde talepte bulunmamas\u0131 halinde alacak zamana\u015f\u0131m\u0131na u\u011frayacakt\u0131r.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u0130\u015f\u00e7ilik alacaklar\u0131 kapsam\u0131nda y\u0131ll\u0131k izin \u00fccreti, \u00e7o\u011fu zaman hatal\u0131 hesaplamalara konu olabildi\u011finden, hak kayb\u0131 ya\u015fanmamas\u0131 ad\u0131na s\u00fcrecin hukuki destek al\u0131narak y\u00fcr\u00fct\u00fclmesi \u00f6nem arz etmektedir. Bu kapsamda \u00f6zellikle \u0130zmir Kar\u015f\u0131yaka b\u00f6lgesinde bir avukat arac\u0131l\u0131\u011f\u0131yla s\u00fcrecin takip edilmesi, alaca\u011f\u0131n do\u011fru \u015fekilde hesaplanmas\u0131 ve tahsil edilmesi a\u00e7\u0131s\u0131ndan \u00f6nemlidir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-4-ulusal-bayram-genel-tatil-ve-fazla-mesai-alacagi\">4. National Holiday, Public Holiday and Overtime Pay<\/h3>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u0130\u015f\u00e7inin dini ve milli bayramlar ile resmi tatillerde yapt\u0131\u011f\u0131 \u00e7al\u0131\u015fmalar\u0131n kar\u015f\u0131l\u0131\u011f\u0131 olan <strong>UBGT (Ulusal Bayram ve Genel Tatil) \u00fccreti alaca\u011f\u0131na, kural olarak i\u015fverenin temerr\u00fcde d\u00fc\u015f\u00fcr\u00fcld\u00fc\u011f\u00fc tarihten ya da dava ve \u0131slah\/talep art\u0131r\u0131m tarihlerinden itibaren yasal faiz<\/strong> uygulanmaktad\u0131r. Hak kayb\u0131na u\u011framamak ad\u0131na bu hesaplamalar\u0131n titizlikle yap\u0131lmas\u0131 ve s\u00fcrecin uzman bir vekil arac\u0131l\u0131\u011f\u0131yla takibi b\u00fcy\u00fck \u00f6nem arz etti\u011finden; \u0130zmir Kar\u015f\u0131yaka b\u00f6lgesinde faaliyet g\u00f6steren hukuk b\u00fcromuzla ileti\u015fime ge\u00e7ebilir, hak etti\u011finiz UBGT ve di\u011fer i\u015f\u00e7ilik alacaklar\u0131n\u0131z\u0131n do\u011fru faiz i\u015fletilerek tahsili i\u00e7in <strong>Izmir Kar\u015f\u0131yaka lawyer<\/strong> kadromuzdan profesyonel hukuki destek alabilirsiniz.r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-5-fazla-calisma-alacagi\">5. Overtime Pay <\/h3>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u0130\u015f hukukunda en s\u0131k uyu\u015fmazl\u0131k ya\u015fanan kalemlerden biri olan fazla \u00e7al\u0131\u015fma (fazla mesai) \u00fccreti alaca\u011f\u0131na, <strong>4857 say\u0131l\u0131 \u0130\u015f Kanunu&#8217;nun 34. maddesi<\/strong> gere\u011fi <mark>bankalarca mevduata uygulanan <strong>en y\u00fcksek faiz oran\u0131<\/strong><\/mark> uygulanmakta; faiz ba\u015flang\u0131c\u0131 ise i\u015fverenin usul\u00fcne uygun bir ihtarla temerr\u00fcde d\u00fc\u015f\u00fcr\u00fcld\u00fc\u011f\u00fc tarih veya dava ve \u0131slah\/talep art\u0131r\u0131m tarihleri esas al\u0131narak belirlenmektedir.
