K\u0131dem tazminat\u0131, i\u015f\u00e7inin y\u0131llar s\u00fcren eme\u011finin kar\u015f\u0131l\u0131\u011f\u0131 niteli\u011finde olup, yasal g\u00fcvence alt\u0131nda bir hakt\u0131r. Bu hakka ili\u015fkin taleplerin do\u011fru \u015fekilde de\u011ferlendirilmesi, s\u00fcresinde ve eksiksiz \u015fekilde ileri s\u00fcr\u00fclmesi, i\u015f\u00e7i bak\u0131m\u0131ndan b\u00fcy\u00fck \u00f6nem ta\u015f\u0131r.<\/p>\n\n\n\n<p><strong>K\u0131dem Tazminat\u0131na Hak Kazanma Ko\u015fullar\u0131<\/strong><\/p>\n\n\n\n<p>1475 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 14. maddesi uyar\u0131nca i\u015f\u00e7inin k\u0131dem tazminat\u0131na hak kazanabilmesi i\u00e7in a\u015fa\u011f\u0131daki \u015fartlar\u0131n birlikte ger\u00e7ekle\u015fmesi gerekmektedir:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>\u0130\u015f Kanunu\u2019na tabi olarak \u00e7al\u0131\u015fmak,<\/strong><\/li>\n\n\n\n<li><strong>Ayn\u0131 i\u015fveren nezdinde en az bir y\u0131l s\u00fcreyle \u00e7al\u0131\u015fm\u0131\u015f olmak,<\/strong><\/li>\n\n\n\n<li>\u0130\u015f s\u00f6zle\u015fmesinin;\n<ul class=\"wp-block-list\">\n<li>By the employer <strong>hakl\u0131 neden olmaks\u0131z\u0131n feshedilmesi<\/strong> (4857 say\u0131l\u0131 Kanun m.25\/II d\u0131\u015f\u0131),<\/li>\n\n\n\n<li>\u0130\u015f\u00e7i taraf\u0131ndan <strong>hakl\u0131 nedenle feshedilmesi<\/strong> (m.24),<\/li>\n\n\n\n<li>The worker <strong>askerlik hizmeti<\/strong> sebebiyle i\u015ften ayr\u0131lmas\u0131,<\/li>\n\n\n\n<li>Kad\u0131n i\u015f\u00e7inin <strong>evlendi\u011fi<\/strong> tarihten itibaren 1 y\u0131l i\u00e7inde kendi iste\u011fiyle i\u015ften ayr\u0131lmas\u0131,<\/li>\n\n\n\n<li>The worker <strong>emeklilik<\/strong>, ya\u015f d\u0131\u015f\u0131ndaki \u015fartlar\u0131 sa\u011flamas\u0131 ya da SGK\u2019dan yaz\u0131 alarak ayr\u0131lmas\u0131,<\/li>\n\n\n\n<li>The worker <strong>\u00f6l\u00fcm\u00fc<\/strong> nedeniyle sona ermesi.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p>Bu haller d\u0131\u015f\u0131nda, \u00f6rne\u011fin i\u015f\u00e7inin istifa etmesi ya da i\u015fverenin hakl\u0131 nedenle feshi durumlar\u0131nda kural olarak k\u0131dem tazminat\u0131na hak kazan\u0131lamaz.<\/p>\n\n\n\n<p><strong>K\u0131dem Tazminat\u0131 Hesaplamas\u0131<\/strong><\/p>\n\n\n\n<p>K\u0131dem tazminat\u0131, i\u015f\u00e7inin hizmet s\u00fcresi ve i\u015f\u00e7inin fesih tarihi itibar\u0131yla ge\u00e7erli olan son <strong>giydirilmi\u015f br\u00fct \u00fccret<\/strong> esas al\u0131narak hesaplanmaktad\u0131r. \u0130\u015f\u00e7inin giydirilmi\u015f \u00fccreti hesaplan\u0131rken yol yard\u0131m\u0131, yemek yard\u0131m\u0131 vb. t\u00fcm ayni veya nakdi s\u00fcreklilik arz eden sosyal yard\u0131mlar\u0131n dikkate al\u0131nmas\u0131 gerekir.<\/p>\n\n\n\n<p>Ancak hesaplamada dikkate al\u0131nmas\u0131 gereken bir\u00e7ok teknik unsur (\u00f6rne\u011fin k\u0131dem tazminat\u0131 tavan\u0131, yan haklar, s\u00fcre hesaplamas\u0131, faiz uygulamas\u0131 vs.) bulundu\u011fundan, bu konuda profesyonel destek al\u0131nmas\u0131 \u00f6nem arz etmektedir.<\/p>\n\n\n\n<p>Taraf\u0131n\u0131za ait k\u0131dem tazminat\u0131 tutar\u0131n\u0131n do\u011fru ve g\u00fcncel mevzuata uygun \u015fekilde hesaplanmas\u0131 i\u00e7in hukuk b\u00fcromuzdan dan\u0131\u015fmanl\u0131k alabilirsiniz.<\/p>\n\n\n\n<p><strong>K\u0131dem Tazminat\u0131 Tavan\u0131 Nedir?<\/strong><\/p>\n\n\n\n<p>K\u0131dem tazminat\u0131n\u0131n hesaplanmas\u0131nda esas al\u0131nacak en y\u00fcksek br\u00fct \u00fccret, her y\u0131l (veya alt\u0131 ayda bir) Hazine ve Maliye Bakanl\u0131\u011f\u0131 taraf\u0131ndan belirlenen k\u0131dem tazminat\u0131 tavan\u0131 ile s\u0131n\u0131rl\u0131d\u0131r.<\/p>\n\n\n\n<p>1475 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 14. maddesi uyar\u0131nca, i\u015f\u00e7iye \u00f6denecek k\u0131dem tazminat\u0131, i\u015f\u00e7inin her tam y\u0131l i\u00e7in ald\u0131\u011f\u0131 30 g\u00fcnl\u00fck br\u00fct \u00fccret esas al\u0131narak hesaplan\u0131r. Ancak bu \u00fccret, k\u0131dem tazminat\u0131 tavan\u0131n\u0131 a\u015famaz.<\/p>\n\n\n\n<p>Tavan uygulamas\u0131, \u00f6zellikle y\u00fcksek \u00fccretli \u00e7al\u0131\u015fanlar i\u00e7in olduk\u00e7a \u00f6nemlidir. Bu s\u00fcre, i\u015f s\u00f6zle\u015fmesinin sona erdi\u011fi tarihten itibaren i\u015flemeye ba\u015flar. S\u00fcresi i\u00e7inde ileri s\u00fcr\u00fclmeyen alacak talepleri zamana\u015f\u0131m\u0131na u\u011frar.<\/p>\n\n\n\n<p><strong>Arabuluculu\u011fa Ba\u015fvurmak Zorunlu Mudur?<\/strong><\/p>\n\n\n\n<p>K\u0131dem tazminat\u0131na ili\u015fkin uyu\u015fmazl\u0131klarda, <strong>dava a\u00e7\u0131lmadan \u00f6nce zorunlu arabuluculuk<\/strong> s\u00fcrecine ba\u015fvurulmas\u0131 gerekmektedir. Taraflar arabuluculuk s\u00fcrecinde anla\u015famazsa, i\u015f\u00e7i i\u015f mahkemesinde dava a\u00e7abilir.
