Evlilik nedeniyle i\u015f akdinin feshine ili\u015fkin olarak 4857 Say\u0131l\u0131<a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.4857.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"> Labor Law |<\/a>\u2019nun 120. Maddesinin atf\u0131 ile 1475 say\u0131l\u0131 m\u00fclga \u0130\u015f Kanunu\u2019nun 14. maddesi ise y\u00fcr\u00fcrl\u00fcktedir. Bu madde uyar\u0131nca kad\u0131n i\u015f\u00e7i evlendikten sonra 1 y\u0131l i\u00e7erisinde i\u015f akdini feshedilebilecek ve i\u015fverenden baz\u0131 i\u015f\u00e7ilik haklar\u0131n\u0131 talep edebilecektir.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">1475 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 14. maddesinin (e) bendinde; \u201cKad\u0131n\u0131n evlendi\u011fi tarihten itibaren bir y\u0131l i\u00e7erisinde kendi r\u0131zas\u0131 ile i\u015f s\u00f6zle\u015fmesini sona erdirmesi durumunda\u201d k\u0131dem tazminat\u0131na hak kazanaca\u011f\u0131 h\u00fckme ba\u011flanm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">A\u00e7\u0131k kanun h\u00fckm\u00fc uyar\u0131nca kad\u0131n i\u015f\u00e7iler, evlendikten sonra bir y\u0131l i\u00e7inde i\u015f s\u00f6zle\u015fmesini feshetmeleri halinde evlenme nedeniyle tazminata ( k\u0131dem tazminat\u0131na ) hak kazanmaktad\u0131rlar. Bu hak, sadece kad\u0131n i\u015f\u00e7iye verilmi\u015ftir. \u0130\u015fverenin veya erkek i\u015f\u00e7inin bu h\u00fckme dayanarak i\u015f s\u00f6zle\u015fmesini feshetme hakk\u0131 yoktur.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Bu d\u00fczenlemeye istinaden kad\u0131n i\u015f\u00e7inin k\u0131dem tazminat\u0131 alabilmesi i\u00e7in \u00f6ncelikle, kad\u0131n i\u015f\u00e7inin i\u015f s\u00f6zle\u015fmesinin devam etmekte olmas\u0131 gerekmektedir. Ba\u015fka bir ifadeyle, i\u015f\u00e7inin i\u015ften ayr\u0131ld\u0131ktan (i\u015f s\u00f6zle\u015fmesi k\u0131dem tazminat\u0131 almas\u0131n\u0131 hak etmeyecek \u015fekilde sona erdikten) bir s\u00fcre sonra evlenmesi halinde k\u0131dem tazminat\u0131 \u00f6denmesi s\u00f6z konusu olmayacakt\u0131r.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Bu sebeple, ilk ko\u015ful i\u015f\u00e7inin i\u015f s\u00f6zle\u015fmesinin devam etmesi ve ikinci ko\u015ful ise, i\u015f s\u00f6zle\u015fmesi devam eden kad\u0131n i\u015f\u00e7inin evlenmesi halinde, bir y\u0131l i\u00e7inde medeni kanuna g\u00f6re evlendi\u011fini belirterek i\u015fverenden k\u0131dem tazminat\u0131n\u0131 istemesi gerekmektedir. Evlendi\u011fi tarihten itibaren bir y\u0131l i\u00e7inde i\u015f s\u00f6zle\u015fmesinin feshedilmemesi ve i\u015fverenden k\u0131dem tazminat\u0131 istenmemesi halinde i\u015f\u00e7inin bu hakk\u0131 ortadan kalkar. \u00dc\u00e7\u00fcnc\u00fc ko\u015ful ise, k\u0131dem tazminat\u0131na hak kazanma ko\u015fulu olan i\u015f\u00e7inin en az bir y\u0131ll\u0131k \u00e7al\u0131\u015fmas\u0131n\u0131n olmas\u0131d\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Evlenme Nedeniyle Tazminat\u0131n \u0130stenece\u011fi S\u00fcre Ne Zaman Ba\u015flar?<\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Bir y\u0131ll\u0131k s\u00fcrenin ba\u015flang\u0131\u00e7 tarihi resmi nik\u00e2h\u0131n yap\u0131ld\u0131\u011f\u0131 g\u00fcn olarak kabul edilir. Evlenme nedeniyle kad\u0131n\u0131n i\u015ften ayr\u0131lmas\u0131 durumunda i\u015fveren hak edilmi\u015f k\u0131dem tazminat\u0131n\u0131 \u00f6demekle y\u00fck\u00fcml\u00fcd\u00fcr. Ancak \u00f6denen tazminat, yaln\u0131zca k\u0131dem tazminat\u0131d\u0131r. \u0130\u015f\u00e7inin evlilik nedeniyle i\u015ften ayr\u0131lmas\u0131 halinde ihbar tazminat\u0131 isteme hakk\u0131 bulunmamaktad\u0131r. \u00d6te yandan, kad\u0131n i\u015f\u00e7inin de ihbar s\u00fcresinde \u00e7al\u0131\u015fma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc yoktur. Yani kad\u0131n i\u015f\u00e7i, evlendikten sonraki bir y\u0131l i\u00e7inde istedi\u011fi zaman ayr\u0131lma talebinde bulunarak i\u015ften ayr\u0131labilir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Talep \u0130\u00e7in Gerekli Evraklar Nelerdir?<\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Evlilik nedeniyle i\u015f s\u00f6zle\u015fmesini sona erdirmek isteyen kad\u0131n i\u015f\u00e7inin, i\u015fverene dilek\u00e7e ve ekinde evlenme c\u00fczdan fotokopisini i\u00e7erecek \u015fekilde ba\u015fvurmas\u0131 ve k\u0131dem tazminat\u0131n\u0131 talep etmesi yeterlidir. K\u0131dem tazminat\u0131n\u0131n \u00f6denmesi i\u00e7in i\u015f s\u00f6zle\u015fmesinin son buldu\u011fu tarihte, k\u0131dem tazminat\u0131n\u0131n \u00f6denmesi \u015fartlar\u0131ndan biri olan \u00e7al\u0131\u015f\u0131lm\u0131\u015f s\u00fcrelerin toplam 1 y\u0131l\u0131 ge\u00e7mi\u015f olmas\u0131 \u015fart\u0131 da yukar\u0131da bahsetti\u011fimiz \u00fczere k\u0131dem tazminat\u0131na ili\u015fkin \u015fartt\u0131r.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">E\u011fer, kad\u0131n\u0131n evlenme nedeniyle hizmet akdini feshetmesi, i\u015fverenle aras\u0131nda anla\u015fmazl\u0131klara sebep olacaksa i\u015f\u00e7inin hizmet akdini evlenme nedeniyle feshetti\u011fini noter arac\u0131l\u0131\u011f\u0131yla i\u015fverene bildirmesi hak kayb\u0131na sebebiyet vermemesi a\u00e7\u0131s\u0131ndan daha yararl\u0131 olacakt\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Evlilik Sebebiyle \u0130\u015ften Ayr\u0131lan \u0130\u015f\u00e7i Ba\u015fka Yerde \u00c7al\u0131\u015fabilir Mi?<\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Evlenme nedeniyle tazminat\u0131n\u0131n alarak i\u015ften ayr\u0131lan kad\u0131n i\u015f\u00e7inin, ba\u015fka bir yerde yeniden \u00e7al\u0131\u015fmas\u0131na herhangi bir engel yoktur.
