Bu hakk\u0131n kullan\u0131lmas\u0131n\u0131n ve i\u015fverenin lokavta ba\u015fvurmas\u0131n\u0131n usul ve \u015fartlar\u0131 ile kapsam ve istisnalar\u0131 kanunla d\u00fczenlenir. Grev hakk\u0131 ve lokavt iyiniyet kurallar\u0131na ayk\u0131r\u0131 tarzda, toplum zarar\u0131na ve milli serveti tahrip edecek \u015fekilde kullan\u0131lamaz.&#8221;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is a lockout?<\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\"><strong>\u0130\u015fyerinde faaliyetin tamamen durmas\u0131na neden olacak tarzda, i\u015fveren veya i\u015fveren vekili taraf\u0131ndan kendi karar\u0131yla veya bir kurulu\u015fun verdi\u011fi karara uyarak, i\u015f\u00e7ilerin topluca i\u015ften uzakla\u015ft\u0131r\u0131lmas\u0131na<\/strong> lokavt denir. <a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.6356.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">(Sendikalar Ve Toplu \u0130\u015f S\u00f6zle\u015fmesi Kanunu Madde 59)<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kanuni Lokavt Nedir?<\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Toplu i\u015f s\u00f6zle\u015fmesinin yap\u0131lmas\u0131 s\u0131ras\u0131nda uyu\u015fmazl\u0131k \u00e7\u0131kmas\u0131 ve i\u015f\u00e7i sendikas\u0131 taraf\u0131ndan grev karar\u0131 al\u0131nmas\u0131 h\u00e2linde bu Kanun h\u00fck\u00fcmlerine uygun olarak yap\u0131lan lokavta kanuni lokavt denir. Kanuni lokavt i\u00e7in aranan \u015fartlar ger\u00e7ekle\u015fmeden yap\u0131lan lokavt kanun d\u0131\u015f\u0131d\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Kanuni Lokavt Karar\u0131n\u0131n Al\u0131nmas\u0131 ve Uygulamaya Konulmas\u0131<\/strong><\/h2>\n\n\n\n<p class=\"has-black-color has-text-color\">Bir uyu\u015fmazl\u0131\u011f\u0131n taraf\u0131 olan i\u015fveren, grev karar\u0131n\u0131n kendisine tebli\u011finden itibaren altm\u0131\u015f g\u00fcn i\u00e7inde lokavt karar\u0131 alabilir ve bu s\u00fcre i\u00e7erisinde alt\u0131 i\u015f g\u00fcn\u00fc \u00f6nceden kar\u015f\u0131 tarafa bildirilecek tarihte uygulamaya koyabilir. Lokavt kararlar\u0131, karar\u0131 alan i\u015fveren taraf\u0131ndan i\u015fyeri veya i\u015fyerlerinde derh\u00e2l ilan edilir. Bildirilen tarihte ba\u015flamayan lokavt d\u00fc\u015fer.(<a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.6356.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Sendikalar Ve Toplu \u0130\u015f S\u00f6zle\u015fmesi Kanunu Madde 60)<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Lokavt Yasaklar\u0131<\/strong><\/h2>\n\n\n\n<ul class=\"has-black-color has-text-color wp-block-list\"><li>Can ve mal kurtarma i\u015flerinde; <strong>cenaze i\u015flerinde ve mezarl\u0131klarda; \u015fehir \u015febeke suyu, elektrik, do\u011fal gaz, petrol \u00fcretimi, tasfiyesi ve da\u011f\u0131t\u0131m\u0131 ile nafta veya do\u011falgazdan ba\u015flayan petrokimya i\u015flerinde; Mill\u00ee Savunma Bakanl\u0131\u011f\u0131 ile Jandarma Genel Komutanl\u0131\u011f\u0131 ve Sahil G\u00fcvenlik Komutanl\u0131\u011f\u0131nca do\u011frudan i\u015fletilen i\u015fyerlerinde; kamu kurulu\u015flar\u0131nca y\u00fcr\u00fct\u00fclen itfaiye<sup> <\/sup>ve hastanelerde <\/strong>grev ve lokavt yap\u0131lamaz.<\/li><li>Cumhurba\u015fkan\u0131, genel hayat\u0131 \u00f6nemli \u00f6l\u00e7\u00fcde etkileyen do\u011fa olaylar\u0131n\u0131n ger\u00e7ekle\u015fti\u011fi yerlerde bu durumun devam\u0131 s\u00fcresince y\u00fcr\u00fcrl\u00fckte kalmak kayd\u0131yla gerekli g\u00f6rd\u00fc\u011f\u00fc i\u015fyerlerinde grev ve lokavt\u0131 yasaklayabilir. Yasa\u011f\u0131n kalkmas\u0131ndan itibaren altm\u0131\u015f g\u00fcn i\u00e7inde alt\u0131 i\u015f g\u00fcn\u00fc \u00f6nce kar\u015f\u0131 tarafa bildirilmek kayd\u0131yla grev ve lokavt uygulamas\u0131na devam edilir.<\/li><li>Ba\u015flad\u0131\u011f\u0131 yolculu\u011fu yurt i\u00e7indeki var\u0131\u015f yerlerinde bitirmemi\u015f deniz, hava, demir ve kara ula\u015ft\u0131rma ara\u00e7lar\u0131nda grev ve lokavt yap\u0131lamaz.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Lokavt\u0131n Ertelenmesi<\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Karar verilmi\u015f veya ba\u015flanm\u0131\u015f olan kanuni bir grev veya lokavt; genel sa\u011fl\u0131\u011f\u0131 veya mill\u00ee g\u00fcvenli\u011fi, bozucu nitelikte ise <strong>Cumhurba\u015fkan\u0131 bu uyu\u015fmazl\u0131kta grev ve lokavt\u0131 altm\u0131\u015f g\u00fcn s\u00fcre ile erteleyebilir.<\/strong> Erteleme s\u00fcresi, karar\u0131n yay\u0131m\u0131 tarihinde ba\u015flar. Erteleme karar\u0131n\u0131n y\u00fcr\u00fcrl\u00fc\u011fe girmesi \u00fczerine, yetkili arabulucu, uyu\u015fmazl\u0131\u011f\u0131n \u00e7\u00f6z\u00fcm\u00fc i\u00e7in erteleme s\u00fcresince her t\u00fcrl\u00fc \u00e7abay\u0131 g\u00f6sterir. Erteleme s\u00fcresi i\u00e7erisinde taraflar aralar\u0131nda anla\u015farak uyu\u015fmazl\u0131\u011f\u0131 \u00f6zel hakeme de g\u00f6t\u00fcrebilir. Erteleme s\u00fcresinin sonunda anla\u015fma sa\u011flanamazsa, alt\u0131 i\u015f g\u00fcn\u00fc i\u00e7inde taraflardan birinin ba\u015fvurusu \u00fczerine uyu\u015fmazl\u0131k Y\u00fcksek Hakem Kurulunca \u00e7\u00f6z\u00fcl\u00fcr. Aksi takdirde i\u015f\u00e7i sendikas\u0131n\u0131n yetkisi d\u00fc\u015fer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Lokavt\u0131n Uygulanmas\u0131<\/strong><\/h2>\n\n\n\n<p class=\"has-black-color has-text-color\">Lokavta maruz kalan i\u015f\u00e7ilerin, i\u015fyerine giri\u015f \u00e7\u0131k\u0131\u015f\u0131 engellemeleri yasakt\u0131r. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Lokavta Kat\u0131lamayacak \u0130\u015f\u00e7iler<\/strong><\/h2>\n\n\n\n<ul class=\"has-black-color has-text-color wp-block-list\"><li> Hi\u00e7bir surette \u00fcretim veya sat\u0131\u015fa y\u00f6nelik olmamak kayd\u0131yla niteli\u011fi bak\u0131m\u0131ndan s\u00fcrekli olmas\u0131nda teknik zorunluluk bulunan i\u015flerde faaliyetin devaml\u0131l\u0131\u011f\u0131n\u0131 veya i\u015fyeri g\u00fcvenli\u011fini, makine ve demirba\u015f e\u015fyalar\u0131n\u0131n, gere\u00e7lerinin, hammadde, yar\u0131 mamul ve mamul maddelerin bozulmamas\u0131n\u0131 ya da hayvan ve bitkilerin korunmas\u0131n\u0131 sa\u011flayacak say\u0131da i\u015f\u00e7i, kanuni lokavt s\u0131ras\u0131nda \u00e7al\u0131\u015fmak, i\u015fveren de bunlar\u0131 \u00e7al\u0131\u015ft\u0131rmak zorundad\u0131r.<\/li><li>Lokavt d\u0131\u015f\u0131nda kalacak i\u015f\u00e7ilerin niteli\u011fi, say\u0131s\u0131 ve yedekleri, i\u015fveren veya i\u015fveren vekili taraf\u0131ndan toplu g\u00f6r\u00fc\u015fmenin ba\u015flamas\u0131ndan itibaren alt\u0131 i\u015f g\u00fcn\u00fc i\u00e7inde i\u015fyerinde yaz\u0131 ile ilan edilir ve bu ilan\u0131n bir \u00f6rne\u011fi taraf i\u015f\u00e7i sendikas\u0131na tebli\u011f edilir. Bu tebli\u011fden itibaren alt\u0131 i\u015f g\u00fcn\u00fc i\u00e7inde i\u015f\u00e7i sendikas\u0131 mahkemeye itirazda bulunmazsa ilan h\u00fck\u00fcmleri kesinle\u015fir. \u0130tiraz h\u00e2linde mahkeme alt\u0131 i\u015f g\u00fcn\u00fc i\u00e7inde kesin olarak karar verir.<\/li><li>Lokavta kat\u0131lamayacak i\u015f\u00e7iler her ne sebeple olursa olsun kanuni s\u00fcre i\u00e7inde tespit edilmemi\u015f ise i\u015fveren veya i\u015f\u00e7i sendikas\u0131 \u00e7al\u0131\u015facak i\u015f\u00e7i say\u0131s\u0131n\u0131n tespitini s\u00fcre ge\u00e7tikten sonra da g\u00f6revli makamdan isteyebilir. G\u00f6revli makam bu tespiti en k\u0131sa zamanda yaparak taraflara tebli\u011f eder. Gerekli h\u00e2llerde g\u00f6revli makam resen tespitte bulunabilir. G\u00f6revli makam\u0131n tespitine kar\u015f\u0131, taraflardan her biri mahkemeye alt\u0131 i\u015f g\u00fcn\u00fc i\u00e7inde itiraz edebilir. Mahkeme alt\u0131 i\u015f g\u00fcn\u00fc i\u00e7inde kesin olarak karar verir.<\/li><li>Lokavt\u0131n uygulanaca\u011f\u0131 d\u00f6nemde hangi i\u015f\u00e7ilerin i\u015fyerinde \u00e7al\u0131\u015fmaya devam edecekleri g\u00f6revli makamca lokavt karar\u0131n\u0131n bildirilmesinden itibaren \u00fc\u00e7 i\u015f g\u00fcn\u00fc i\u00e7inde resen tespit edilerek ilgili i\u015fverene ve i\u015f\u00e7ilere yaz\u0131 ile bildirilir. O i\u015fyerinde \u00e7al\u0131\u015fan ve toplu g\u00f6r\u00fc\u015fmede taraf olan i\u015f\u00e7i sendikas\u0131 ve \u015fubesinin y\u00f6neticileri bu h\u00fckme tabi tutulamaz.<\/li><li>\u0130\u015fveren, lokavta kat\u0131lamayacak i\u015f\u00e7ilerden herhangi bir nedenle \u00e7al\u0131\u015fmayanlar\u0131n yerine g\u00f6revli makam\u0131n yaz\u0131l\u0131 izni ile yeni i\u015f\u00e7i alabilir.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Lokavt\u0131n G\u00fcvencesi<\/strong><\/h2>\n\n\n\n<p class=\"has-black-color has-text-color\">Toplu i\u015f s\u00f6zle\u015fmelerine ve i\u015f s\u00f6zle\u015fmelerine lokavttan vazge\u00e7ilmesine veya bunlar\u0131n k\u0131s\u0131tlanmas\u0131na dair konulacak h\u00fck\u00fcmler ge\u00e7ersizdir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Kanuni Lokavt\u0131n \u0130\u015f S\u00f6zle\u015fmelerine Etkisi<\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Kanuni lokavta maruz kalan i\u015f\u00e7ilerin i\u015f s\u00f6zle\u015fmeleri lokavt s\u00fcresince ask\u0131da kal\u0131r. \u0130\u015fveren, lokavt nedeniyle i\u015f s\u00f6zle\u015fmeleri ask\u0131da kalan i\u015f\u00e7ilerin <strong>lokavt\u0131n ba\u015flamas\u0131ndan \u00f6nce i\u015fleyen \u00fccretlerini ve eklerini ola\u011fan \u00f6deme g\u00fcn\u00fcnde \u00f6demek zorundad\u0131r. <\/strong>\u00d6demeyi yapacak personel de bunun i\u00e7in \u00e7al\u0131\u015fmakla y\u00fck\u00fcml\u00fcd\u00fcr. Lokavt s\u00fcresince i\u015f s\u00f6zle\u015fmeleri ask\u0131da kalan i\u015f\u00e7ilere bu d\u00f6nem i\u00e7in i\u015fverence \u00fccret ve sosyal yard\u0131mlar \u00f6denemez, <strong>bu s\u00fcre k\u0131dem tazminat\u0131 hesab\u0131nda dikkate al\u0131nmaz.<\/strong> Toplu i\u015f s\u00f6zle\u015fmelerine ve i\u015f s\u00f6zle\u015fmelerine bunlar\u0131n aksine h\u00fck\u00fcm konulamaz.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>\u0130\u015f\u00e7i Alma ve Ba\u015fka \u0130\u015fe Girme Yasa\u011f\u0131<\/strong><\/h2>\n\n\n\n<p class=\"has-black-color has-text-color\">\u0130\u015fveren, kanuni bir lokavt s\u00fcresince, i\u015f s\u00f6zle\u015fmeleri ask\u0131da kalan i\u015f\u00e7ilerin yerine, s\u00fcrekli ya da ge\u00e7ici olarak ba\u015fka i\u015f\u00e7i alamaz veya ba\u015fkalar\u0131n\u0131 \u00e7al\u0131\u015ft\u0131ramaz. Ancak lokavta maruz b\u0131rak\u0131lamayacak i\u015f\u00e7ilerden, \u00f6len, kendi iste\u011fi ile ayr\u0131lan veya i\u015f s\u00f6zle\u015fmesi i\u015fveren taraf\u0131ndan hakl\u0131 nedenle feshedilenlerin yerine yeni i\u015f\u00e7i al\u0131nabilir. \u0130\u015fverenin bu yasa\u011fa ayk\u0131r\u0131 hareketi, taraf sendikan\u0131n yaz\u0131l\u0131 ba\u015fvurusu h\u00e2linde g\u00f6revli makamca denetlenir.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color\">Kanuni bir lokavt dolay\u0131s\u0131yla i\u015f s\u00f6zle\u015fmeleri ask\u0131da kalan<strong> i\u015f\u00e7iler, lokavt s\u00fcresince ba\u015fka bir i\u015fverenin yan\u0131nda \u00e7al\u0131\u015famaz.<\/strong> Aksi h\u00e2lde i\u015f\u00e7inin i\u015f s\u00f6zle\u015fmesi i\u015fverence hakl\u0131 nedenle feshedilebilir. Ancak k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmesi ile \u00e7al\u0131\u015fan i\u015f\u00e7iler, kanuni haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresini tamamlayacak s\u00fcreyi a\u015fmamak \u00fczere ba\u015fka bir i\u015fverenin i\u015fyerinde \u00e7al\u0131\u015fabilir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Kanuni Lokavt\u0131n Konut Haklar\u0131na Etkisi<\/strong><\/h2>\n\n\n\n<p class=\"has-black-color has-text-color\">\u0130\u015fveren, kanuni bir lokavt s\u00fcresince lokavta u\u011frayan i\u015f\u00e7ilerin oturduklar\u0131 ve kendisi taraf\u0131ndan sa\u011flanm\u0131\u015f olan konutlardan \u00e7\u0131kmalar\u0131n\u0131 isteyemez. \u0130\u015fveren, bu konutlarda oturan i\u015f\u00e7ilerden, lokavt s\u00fcresi i\u00e7inde konutlar\u0131n onar\u0131m\u0131, su, gaz, ayd\u0131nlatma ve \u0131s\u0131tma giderleri ile rayi\u00e7 kiray\u0131 talep edebilir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Kanun D\u0131\u015f\u0131 Lokavt\u0131n Sonu\u00e7lar\u0131<\/strong><\/h2>\n\n\n\n<p class=\"has-black-color has-text-color\">Kanun d\u0131\u015f\u0131 lokavt yap\u0131lmas\u0131 h\u00e2linde i\u015f\u00e7iler i\u015f s\u00f6zle\u015fmelerini hakl\u0131 nedenle feshedebilir. \u0130\u015fveren, bu i\u015f\u00e7ilerin lokavt s\u00fcresine ili\u015fkin i\u015f s\u00f6zle\u015fmesinden do\u011fan b\u00fct\u00fcn haklar\u0131n\u0131 bir i\u015f kar\u015f\u0131l\u0131\u011f\u0131 olmaks\u0131z\u0131n \u00f6demek ve u\u011frad\u0131klar\u0131 zararlar\u0131 tazmin etmekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Lokavt\u0131n K\u00f6t\u00fcye Kullan\u0131lmas\u0131<\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Taraflardan birinin veya \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakan\u0131n\u0131n ba\u015fvurusu \u00fczerine mahkemece, lokavt\u0131n iyi niyet kurallar\u0131na ayk\u0131r\u0131 tarzda toplum zarar\u0131na veya mill\u00ee servete zarar verecek \u015fekilde kullan\u0131ld\u0131\u011f\u0131n\u0131n tespit edilmesi h\u00e2linde, uygulanmakta olan lokavt\u0131n durdurulmas\u0131na karar verilir.
