Radiation leave can be defined as a four-week vacation granted to healthcare personnel working in departments of healthcare facilities where they are exposed to or at high risk of exposure to radiological radiation, in addition to their annual leave entitlement.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Radiation Permit within the Scope of Legal Regulations<\/strong><\/h2>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><span style=\"font-size: inherit;\"><span class=\"has-inline-color has-black-color\"><strong>Article 103 <\/strong>\u2013 &#8220;<\/span><\/span><em style=\"font-size: inherit;\"><span class=\"has-inline-color has-black-color\">Personnel who work with radioactive radiation during their service are granted one month of health leave in addition to their annual leave each year.<\/span><\/em><span style=\"font-size: inherit;\"><span class=\"has-inline-color has-black-color\">\u201c<\/span><\/span><\/p><cite><span class=\"has-inline-color has-black-color\"><strong><a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.657.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Civil Servants Law No. 657<br><\/a><\/strong><\/span><\/cite><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><span style=\"font-size: inherit;\"><span class=\"has-inline-color has-black-color\"><strong>Article 24 <\/strong>\u2013<\/span><\/span><em style=\"font-size: inherit;\"><span class=\"has-inline-color has-black-color\"> &#8220;Bu gibi m\u00fcesseselerde, her r\u00f6ntgen m\u00fctahass\u0131s\u0131n\u0131n veya r\u00f6ntgen ve radyom ile i\u015ftigal eden kimsenin senede d\u00f6rt hafta muntazaman devaml\u0131 tatil yapmas\u0131 mecburidir.&#8221;<\/span><\/em><\/p><cite><span class=\"has-inline-color has-black-color\"><strong><a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/2.3.210857.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Regulations Concerning Radiology, Radium and Electrotherapy and Other Physiotherapy Establishments<\/a><\/strong><\/span><\/cite><\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\">Who can benefit from the Radiation Leave?<\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">The Regulation on Radiology, Radium and Electrotherapy and Other Physiotherapy Establishments does not differentiate between private and public institutions regarding working conditions and leave; it includes the concept of &quot;all specialists and employees working in X-ray and radium laboratories.&quot; Thus, the Regulation covers all healthcare personnel. Therefore, radiology physicians working in radiology laboratories in private institutions, subject to the Labor Law, are also required to use sick leave\/radiation leave as defined in Article 24 of the aforementioned Regulation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Court Decisions<\/h2>\n\n\n\n<p class=\"has-text-align-center has-black-color has-text-color\"><strong>SUPREME COURT<\/strong> <strong>9th LAW DIVISION<\/strong> <strong>E. 2012\/26612<\/strong> <strong>K. 2014\/22311<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">&#8230;3153 say\u0131l\u0131 Kanuna dayan\u0131larak, Bakanlar Kurulunun 2\/10857 say\u0131 27.04.1939 tarihli Kararnamesiyle y\u00fcr\u00fcrl\u00fc\u011fe konulan, 06.05.1939 tarih 42013 say\u0131l\u0131 Resmi Gazete&#8217;de yay\u0131mlanan Radyoloji, Radyom ve Elektrikle Tedavi M\u00fcesseseleri Hakk\u0131nda T\u00fcz\u00fck 21. maddesinde &#8220;R\u00f6ntgen ve radyom ile daimi olarak g\u00fcnde be\u015f saatten fazla \u00e7al\u0131\u015f\u0131lamaz. R\u00f6ntgen muayenehanelerinde pazardan maada ayr\u0131ca bir g\u00fcn daha \u00f6\u011fleden sonra tatil yap\u0131lmal\u0131d\u0131r.&#8221; h\u00fckm\u00fc; 24. maddesinde, &#8220;Bu gibi m\u00fcesseselerde, her r\u00f6ntgen m\u00fctahass\u0131s\u0131n\u0131n veya r\u00f6ntgen ve radyom ile i\u015ftigal eden kimsenin senede d\u00f6rt hafta muntazaman devaml\u0131 tatil yap\u0131lmas\u0131 mecburidir.&#8221; h\u00fckm\u00fc d\u00fczenlenmi\u015ftir.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">30.01.2010 tarih ve 27478 say\u0131l\u0131 Resmi Gazete&#8217;de yay\u0131mlanarak y\u00fcr\u00fcrl\u00fc\u011fe giren, 5947 say\u0131l\u0131 \u00dcniversite ve Sa\u011fl\u0131k Personelinin Tam G\u00fcn \u00c7al\u0131\u015fmas\u0131na ve Baz\u0131 Kanunlarda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanunun 9. maddesiyle, 3153 say\u0131l\u0131 Kanuna eklenen, ek madde 1 h\u00fckm\u00fcnde &#8220;\u0130yonla\u015ft\u0131r\u0131c\u0131 radyasyonla te\u015fhis, tedavi veya ara\u015ft\u0131rman\u0131n yap\u0131ld\u0131\u011f\u0131 yerler ile bu i\u015f veya i\u015flemlerde \u00e7al\u0131\u015fan personelin haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresi 35 saattir.&#8221; \u015feklinde d\u00fczenleme yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Somut olayda, dava dilek\u00e7esinde davac\u0131 i\u015f\u00e7inin, daval\u0131ya ait hastanede, anjiyo laboratuvar\u0131 sa\u011fl\u0131k memuru olarak \u00e7al\u0131\u015ft\u0131\u011f\u0131 iddia edilmi\u015f; daval\u0131 taraf\u00e7a davac\u0131n\u0131n KVC personeli oldu\u011fu savunulmu\u015ftur. \u0130\u015f s\u00f6zle\u015fmesinde, davac\u0131n\u0131n g\u00f6revi KVC personeli olarak belirlenmi\u015ftir. Davac\u0131 tan\u0131klar\u0131nca, davac\u0131n\u0131n hastanede anjiyo laboratuar\u0131nda personel olarak g\u00f6rev yapt\u0131\u011f\u0131 beyan edilmi\u015f; daval\u0131 tan\u0131klar\u0131nca ise, davac\u0131n\u0131n anjiyo b\u00f6l\u00fcm\u00fcnde \u00e7al\u0131\u015ft\u0131\u011f\u0131 bildirilmi\u015ftir. Mahkemece davac\u0131n\u0131n mesle\u011fi ve i\u015fyerinde fiilen yapt\u0131\u011f\u0131 i\u015f yeterli derecede ayd\u0131nlat\u0131lmaks\u0131z\u0131n, davac\u0131n\u0131n 3153 say\u0131l\u0131 Kanun ve ilgili t\u00fcz\u00fc\u011f\u00fc uyar\u0131nca fazla \u00e7al\u0131\u015fma&nbsp;\u00fccretine ve \u015fua y\u0131ll\u0131k izin&nbsp;\u00fccretine hak kazand\u0131\u011f\u0131n\u0131n kabul\u00fc hatal\u0131d\u0131r. \u00d6ncelikle, <strong>davac\u0131n\u0131n mesle\u011fine ili\u015fkin,&nbsp;diploma&nbsp;ve sair mesleki yetkinlik belgesinin davac\u0131 taraftan celp edilmesi gereklidir. Ard\u0131ndan, taraf tan\u0131klar\u0131n\u0131n beyanlar\u0131na yeniden ba\u015fvurularak, davac\u0131n\u0131n hastanede fiilen yapt\u0131\u011f\u0131 i\u015f ve i\u015flemler hakk\u0131ndaki bilgi ve g\u00f6rg\u00fcleri ayr\u0131nt\u0131l\u0131 \u015fekilde tespit edilmelidir. <\/strong>Eksiklikler giderildikten sonra, alan\u0131nda uzman ki\u015filerden olu\u015fturulacak bilirki\u015fi kurulu arac\u0131l\u0131\u011f\u0131yla yap\u0131lacak incelemeyle, davac\u0131n\u0131n hastanede yapt\u0131\u011f\u0131 i\u015f de\u011ferlendirilerek, 3153 say\u0131l\u0131 Kanun ve Radyoloji, Radyom ve Elektrikle Tedavi M\u00fcesseseleri Hakk\u0131nda T\u00fcz\u00fc\u011f\u00fcn yukar\u0131da a\u00e7\u0131klanan maddeleri kapsam\u0131nda bulunup bulunmad\u0131\u011f\u0131 ku\u015fkuya yer vermeyecek \u015fekilde belirlenmelidir. Neticeye g\u00f6re, dava konusu alacaklara hak kazan\u0131p kazanmad\u0131\u011f\u0131 de\u011ferlendirilmelidir. An\u0131lan nedenle, eksik ara\u015ft\u0131rma ve incelemeyle yaz\u0131l\u0131 \u015fekilde karar verilmesi hatal\u0131 olup, bozmay\u0131 gerektirmi\u015ftir&#8230;<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-text-align-center has-black-color has-text-color\"><strong>SUPREME COURT<\/strong> <strong>9th LAW DIVISION<\/strong> <strong>E.&nbsp;2010\/3062<\/strong> <strong>K. 2012\/9626<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u015eua izni alaca\u011f\u0131na yasal faiz yerine mevduat faizi y\u00fcr\u00fct\u00fclmesi hatal\u0131d\u0131r. Fazla \u00e7al\u0131\u015fma ve \u015fua izni alaca\u011f\u0131ndan sigorta primleri kesilmez. Ancak 1.10.2008 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe giren 5510 Say\u0131l\u0131 Kanunun&nbsp;80\/c ve&nbsp;105. maddeleri uyar\u0131nca \u00fccretin eki niteli\u011findeki bu \u00f6demeler, 1.10.2008 tarihinden itibaren sigorta prim kesintisine tabidir.
