 In this study, we will specifically address legislation and court decisions regarding the use of photographs found on the internet. First and foremost, it is crucial to warn that using a photograph obtained from the internet can lead to numerous violations under the Law on Intellectual and Artistic Works, the Turkish Penal Code, and the Law on the Protection of Personal Data; you may face administrative and criminal sanctions. In other words, photographs and visual content obtained through search engines or third-party websites cannot be used without the consent of the content's owner. Contrary to common practice, visual content obtained from Google Images is not a database of images that you can use as you wish. <\/p>\n\n\n\n

Legal Regulations<\/h2>\n\n\n\n

Law on Intellectual and Artistic Works (FSEK)<\/a><\/h3>\n\n\n\n

FSEK kapsam\u0131nda foto\u011fraflar i\u00e7erdikleri unsurlara g\u00f6re; “ilim ve edebiyat eserleri”(Md. 2\/3) veya “g\u00fczel sanat eseri” (Md. 4\/5) kabul edilebilir. Ki\u015filerin portreleri ise Madde 86 kapsam\u0131nda ayr\u0131ca d\u00fczenlenmi\u015ftir. FSEK kapsam\u0131nda hen\u00fcz alenile\u015fmemi\u015f bir eserden her ne \u015fekil ve tarzda olursa olsun faydalanma hakk\u0131 m\u00fcnhas\u0131ran eser sahibine aittir. (Madde 20). Ayr\u0131ca yine FSEK kapsam\u0131nda esere ili\u015fkin ger\u00e7ekle\u015ftirilen haks\u0131z fiil neticesinde uygulanacak cezalar Madde 71 kapsam\u0131nda d\u00fczenlenmi\u015ftir.<\/p>\n\n\n\n

Personal Data Protection Law (KVKK)<\/a><\/h3>\n\n\n\n

When examining a photograph obtained from the internet under the Personal Data Protection Law (KVKK), an investigation must be conducted in parallel with other legislation, taking into account the specific elements of the case. In any case, processing publicly available visual content containing personal data for purposes other than its intended public disclosure may result in substantial administrative fines under Article 18 of the KVKK.<\/p>\n\n\n\n

Turkish Penal Code (TCK)<\/a><\/h3>\n\n\n\n

Considering the personal data contained in visual content obtained via the internet, Article 134 and subsequent articles of the Turkish Penal Code concern the privacy of private life and personal data.  giving or obtaining unlawfully<\/em> The possibility of crimes being committed should be taken into consideration.<\/p>\n\n\n\n

… Ancak, davac\u0131 taraf\u00e7a s\u00f6z konusu foto\u011fraf eser niteli\u011finde olmasa dahi, kendisine ait internet sitesinden izinsiz olarak al\u0131narak, daval\u0131n\u0131n internet sitesi ve dergi n\u00fcshalar\u0131nda \u00e7o\u011falt\u0131l\u0131p yay\u0131nlanmas\u0131n\u0131n haks\u0131z rekabet olu\u015fturdu\u011fu da iddia edilmi\u015ftir. 5846 say\u0131l\u0131 FSEK<\/a><\/em>.nun 84\/1 ve 3 \u00fcnc\u00fc f\u0131kralar\u0131na g\u00f6re; eser mahiyetinde olmayan her nevi foto\u011fraf\u0131 nakle yarayan bir alet \u00fczerine tespit eden veya ticari maksatla hakl\u0131 olarak \u00e7o\u011faltan yahut yayan kimse, ayn\u0131 foto\u011fraf\u0131n \u00fc\u00e7\u00fcnc\u00fc bir ki\u015fi taraf\u0131ndan ayn\u0131 vas\u0131tadan faydalan\u0131lmak suretiyle \u00e7o\u011falt\u0131lmas\u0131n\u0131 veya yay\u0131nlanmas\u0131n\u0131 men edebilir. Bu madde ile korunan foto\u011fraf\u0131 kayda yarayan bir vas\u0131ta \u00fczerine tespit eden veya ticari maksatla hakl\u0131 olarak \u00e7o\u011faltan yahut yayan kimse olup, koruma tespit ve \u00e7o\u011faltma \u00fczerindedir. Somut uyu\u015fmazl\u0131kta, davac\u0131n\u0131n k\u0131z\u0131na ait foto\u011fraf\u0131 kendisinin \u00e7ekti\u011fine ve yine pikselart konusunda dersler verdi\u011fi “www.yasamdersleri.com” adl\u0131 internet sitesinde yay\u0131nlay\u0131p \u00e7o\u011faltt\u0131\u011f\u0131na dair iddias\u0131na kar\u015f\u0131l\u0131k, daval\u0131 taraf\u00e7a s\u00f6z konusu foto\u011fraf\u0131n aleniyet kazand\u0131\u011f\u0131, telif tazminat\u0131 talep edilebilmesi i\u00e7in eser niteli\u011finde olmas\u0131 gerekti\u011fi, foto\u011fraf\u0131n “www.google.com” sitesinden elde edilip copyright ( telif hakk\u0131 ) uyar\u0131s\u0131 bulunmad\u0131\u011f\u0131 savunmalar\u0131nda bulunulmu\u015ftur. O halde, foto\u011fraf\u0131n davac\u0131 taraf\u0131ndan tespit edilip kendi internet sitesinde yay\u0131nland\u0131\u011f\u0131 hususlar\u0131 yanlar aras\u0131nda \u00e7eki\u015fme konusu de\u011fildir. Nitekim, foto\u011fraf\u0131 \u00e7ekilen davac\u0131n\u0131n k\u0131z\u0131 taraf\u0131ndan daval\u0131 aleyhine a\u00e7\u0131lan manevi tazminat davas\u0131n\u0131n g\u00f6r\u00fc\u015f\u00fcld\u00fc\u011f\u00fc \u0130stanbul 2.Fikri ve S\u0131nai Haklar Hukuk Mahkemesi’nce verilen 11.07.2006 tarih ve 941\/204 say\u0131l\u0131 kararda da davac\u0131n\u0131n k\u0131z\u0131n\u0131n foto\u011fraf\u0131n\u0131n davac\u0131ya ait internet sitesinde bulundu\u011fu belirtildi\u011fi gibi, davac\u0131 da bu hususta gerekti\u011fi takdirde k\u0131z\u0131n\u0131n tan\u0131k olarak dinlenebilece\u011fini belirtmi\u015ftir. Taraflar aras\u0131ndaki uyu\u015fmazl\u0131\u011f\u0131n 5846 say\u0131l\u0131 FSEK.nun 84 \u00fcnc\u00fc maddesi y\u00f6n\u00fcnden de\u011ferlendirilmeksizin, bu davada uygulama yeri bulunmayan ayn\u0131 Yasa’n\u0131n 86 nc\u0131 maddesine dayal\u0131 olarak davac\u0131n\u0131n foto\u011fraf \u00fczerinde hak sahipli\u011finin kan\u0131tlanamad\u0131\u011f\u0131na ili\u015fkin mahkeme g\u00f6r\u00fc\u015f\u00fcnde isabet bulunmamaktad\u0131r.<\/p>\n\n\n\n
