This is done after deducting Family Allowance, Minimum Living Allowance, and Child Allowance from the net salary (received).<\/p>\n\n\n\n<h2 class=\"has-black-color has-text-color wp-block-heading\">Which Assets Cannot Be Seized?<\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">First, regarding the general process of seizure, after the payment order becomes final, enforcement proceedings do not automatically continue. The creditor must exercise their right to request seizure within one year of the notification of the payment order, and the enforcement office must initiate the seizure within three days of this exercise. Seizure is placed on the debtor&#039;s movable and immovable property, as well as their receivables and rights, to the extent sufficient to cover the creditor&#039;s claim. The value of the seized assets is assessed and recorded in the seizure report. If it is determined that no assets can be seized, and this finding is also recorded in the report, then the seizure report will serve as a definitive certificate of insolvency.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">It should also be clearly stated that the right of attachment granted to the creditor does not mean that all of the debtor&#039;s assets can be seized. Elements that allow the debtor to maintain at least a minimum standard of living cannot be seized. The main purpose here is to prevent the debtor from becoming dependent on society and to protect their economic well-being, even within minimal limits.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">The relevant articles clearly state which goods cannot be seized. Any other type of goods that have monetary value can be seized.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Furthermore, essential personal belongings cannot be seized. To elaborate, these are items necessary for a person&#039;s livelihood. For example, if the debtor is a farmer, the land, livestock, vehicles, and other equipment and agricultural tools necessary for his and his family&#039;s livelihood cannot be seized. In other professions, the tools, equipment, and books necessary for the debtor&#039;s trade or profession cannot be seized. Vehicles used by individuals such as cart drivers, boatmen, and porters to earn their living are also not subject to seizure. However, goods produced by these individuals that generate income can be seized.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">So, kitchen appliances are not among those that can be seized. In fact, these appliances are often the primary items seized during home seizures. However, it is also possible to seize any other items of economic value from homes, such as sofa sets, TVs, music systems, satellite receivers, DVD players, carpets, and vacuum cleaners.<\/p>\n\n\n\n<h4 class=\"has-black-color has-text-color wp-block-heading\">The following items are exempt from seizure:<\/h4>\n\n\n\n<p class=\"has-black-color has-text-color\">With the latest changes, the assets that cannot be seized are as follows:;<\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<ul id=\"block-815382a5-491e-421a-922e-0ea1259eb95d\" class=\"has-black-color has-text-color wp-block-list\"><li>Rights and entitlements prohibited from being transferred by the state: family housing, old-age pension, orphan&#039;s allowance, etc.<\/li><li>The debtor&#039;s clothes, work clothes, bedding,<\/li><li>Essential household appliances such as a washing machine, refrigerator, dishwasher, small kitchen appliances, and kitchen utensils are subject to seizure. (If there is more than one appliance, the excess may be seized.)<\/li><li>Clothing, tools, and equipment necessary for the debtor to perform their profession.<\/li><li>The indebted farmer loses the land, animals, machinery, and agricultural tools that provide for himself and his family.,<\/li><\/ul>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<ul class=\"wp-block-list\" id=\"block-815382a5-491e-421a-922e-0ea1259eb95d\"><li>Animals, feed, and shelters that provide for the family&#039;s livelihood,<\/li><li>The debtor&#039;s food and fuel, if he is a farmer, his seeds,<\/li><li>The pensions of those who retired due to disability from the military and police force,<\/li><li>Social Security Institution (SGK) retirement pensions,<\/li><li>Maternity benefit and death benefit,<\/li><li>Unemployment benefit,<\/li><li>Scholarships, loans, and grants provided by the Higher Education Credit and Dormitories Institution,<\/li><li>Savings in the individual retirement system,<\/li><\/ul>\n<\/div>\n<\/div>\n\n\n\n<p class=\"has-black-color has-text-color\">Almost all goods other than those mentioned above can be seized. This includes goods considered luxuries, items that are not essential for a person&#039;s livelihood and can be considered necessities.<\/p>\n\n\n\n<h2 class=\"has-black-color has-text-color wp-block-heading\">What happens if a forced execution order is not paid?<\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">If the enforcement proceedings against you are finalized and the debt is not paid, the relevant enforcement office will seize your assets and sell them to collect the debts included in the enforcement file.<\/p>\n\n\n\n<h2 class=\"has-black-color has-text-color wp-block-heading\">Court Decisions<\/h2>\n\n\n\n<p class=\"has-text-align-center has-black-color has-text-color\"><em>&#8220;Limited \u015eirketler Meslek Sahibi Olarak Kabul Edilemezler. It was not determined through on-site inspection or expert examination whether the lands subject to the exemption from seizure were used for agricultural purposes, and if so, the amount of land necessary for the income generated from the property and the livelihood of the debtor and his family.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Therefore, the court should have ordered an on-site inspection with the participation of agricultural and cadastral experts, commissioned a detailed expert report, investigated whether the debtor was engaged in agriculture through relevant institutions, and if it was determined that he practiced farming, calculated his annual living expenses. This calculation should have assessed his income from all his properties, both seized and unseized, taking into account his retirement pension, and determined whether the seized agricultural land was essential for his and his family&#039;s livelihood, or to what extent it was essential. A decision should have been made based on the resulting findings.
