Burada dikkat edilmesi gereken \u00f6nemli bir husus da zamana\u015f\u0131m\u0131 s\u00fcresinin i\u015f akdinin feshinden itibaren i\u015flemeye ba\u015flayacak oldu\u011fudur. \u0130\u015f\u00e7inin \u00fccret alacaklar\u0131na ili\u015fkin zamana\u015f\u0131m\u0131 s\u00fcresi de 5 (be\u015f) y\u0131l olarak belirlenmi\u015f olmakla birlikte, burada zamana\u015f\u0131m\u0131 s\u00fcresi bahse konu \u00fccret hakk\u0131n\u0131n muaccel olmas\u0131 ile ba\u015flayacakt\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"has-inline-color has-vivid-cyan-blue-color\">Legal Regulations<\/span><\/h2>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><span class=\"has-inline-color has-black-color\"><strong>\u00dccret ve \u00dccretin \u00d6denmesi<\/strong><\/span><\/p><p><span class=\"has-inline-color has-black-color\"><strong>Madde 32-<\/strong><\/span><\/p><p><span class=\"has-inline-color has-black-color\">&#8230;<em>\u00dccret alacaklar\u0131nda zamana\u015f\u0131m\u0131 s\u00fcresi<\/em><\/span><em><span class=\"has-inline-color has-vivid-red-color\"> <strong>5 (be\u015f) y\u0131ld\u0131r.<\/strong><\/span><\/em><\/p><cite><strong><a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.4857.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Labor Law No. 4857<\/a><\/strong><\/cite><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><span class=\"has-inline-color has-black-color\"><strong>Zamana\u015f\u0131m\u0131 S\u00fcresi<br>Ek Madde 3- <\/strong><em>\u0130\u015f s\u00f6zle\u015fmesinden kaynaklanmak kayd\u0131yla hangi kanuna tabi olursa olsun, <strong>y\u0131ll\u0131k izin \u00fccreti<\/strong> ve a\u015fa\u011f\u0131da belirtilen tazminatlar\u0131n zamana\u015f\u0131m\u0131 s\u00fcresi <\/em><\/span><span class=\"has-inline-color has-vivid-red-color\"><em><strong>5 (<\/strong><\/em><\/span><strong><em><span class=\"has-inline-color has-vivid-red-color\">be\u015f) y\u0131ld\u0131r.<\/span><\/em><\/strong><span class=\"has-inline-color has-black-color\"><em><br>a)<strong> K\u0131dem tazminat\u0131.<\/strong><br>b) \u0130\u015f s\u00f6zle\u015fmesinin bildirim \u015fart\u0131na uyulmaks\u0131z\u0131n feshinden kaynaklanan <strong>compensation<\/strong>.<br>c) <strong>K\u00f6t\u00fcniyet tazminat\u0131.<\/strong><br>d) \u0130\u015f s\u00f6zle\u015fmesinin<strong> e\u015fit davranma ilkesine uyulmaks\u0131z\u0131n feshinden kaynaklanan tazminat.<\/strong><\/em><\/span><\/p><cite><strong><a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.4857.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Labor Law No. 4857<\/a><\/strong><\/cite><\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"has-inline-color has-vivid-cyan-blue-color\">Court Decisions<\/span><\/h2>\n\n\n\n<p class=\"has-text-align-center\"><strong><span class=\"has-inline-color has-black-color\">Yarg\u0131tay Hukuk Genel Kurulu 2018\/999 E., &nbsp;2019\/1049 K.<\/span><\/strong><\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">&#8220;&#8230;. \u0130\u015f Kanununda, gerekse Bor\u00e7lar Kanununda, k\u0131dem ve ihbar tazminat\u0131 alacaklar\u0131 i\u00e7in \u00f6zel bir&nbsp;zamana\u015f\u0131m\u0131&nbsp;s\u00fcresi \u00f6ng\u00f6r\u00fclmemi\u015ftir.<br>Uygulama ve \u00f6\u011fretide k\u0131dem tazminat\u0131 ve ihbar tazminat\u0131na ili\u015fkin davalar, hakk\u0131n do\u011fumundan itibaren, eski 818 say\u0131l\u0131 Bor\u00e7lar Kanununun 125 inci maddesi uyar\u0131nca on y\u0131ll\u0131k&nbsp;zamana\u015f\u0131m\u0131na&nbsp;tabi tutulmu\u015ftur. 01.07.2012 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe giren yeni 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 146 \u0131nc\u0131 maddesinde de genel&nbsp;zamana\u015f\u0131m\u0131&nbsp;10 y\u0131l olarak belirlenmi\u015ftir.<br>Tazminat niteli\u011finde olmalar\u0131 nedeni ile sendikal tazminat, k\u00f6t\u00fcniyet tazminat\u0131, i\u015fe ba\u015flatmama tazminat\u0131, 4857 say\u0131l\u0131 \u0130\u015f Kanununun; 5 inci maddesindeki e\u015fit i\u015flem borcuna ayk\u0131r\u0131l\u0131k nedeni ile tazminat, 26\/2 maddesindeki maddi ve manevi tazminat, 28 inci maddedeki belgenin zaman\u0131nda verilmemesinden kaynaklanan tazminat, 31\/son maddesi uyar\u0131nca askerlik sonras\u0131 i\u015fe almama nedeni ile \u00f6ng\u00f6r\u00fclen tazminat istekleri on y\u0131ll\u0131k&nbsp;zamana\u015f\u0131m\u0131na&nbsp;tabidir.<br>Bu noktada,&nbsp;zamana\u015f\u0131m\u0131&nbsp;ba\u015flang\u0131c\u0131na esas al\u0131nan k\u0131dem tazminat\u0131 ve ihbar tazminat\u0131 hakk\u0131n\u0131n do\u011fumu ise, i\u015f\u00e7i a\u00e7\u0131s\u0131ndan hizmet aktinin feshedildi\u011fi tarihtir.<br>Zamana\u015f\u0131m\u0131, harekete ge\u00e7ememek, istemde bulunamamak durumunda bulunan kimsenin aleyhine i\u015flemez. Bir hakk\u0131n, bu ba\u011flamda \u00f6dence isteminin do\u011fmad\u0131\u011f\u0131 bir tarihte,&nbsp;zamana\u015f\u0131m\u0131n\u0131n&nbsp;ba\u015flat\u0131lmas\u0131 hakk\u0131n istenmesini ve elde edilmesini g\u00fc\u00e7le\u015ftirir, hatta olanaks\u0131z k\u0131lar.<br>\u0130\u015fveren ve i\u015f\u00e7i aras\u0131ndaki hukuki ili\u015fki i\u015f s\u00f6zle\u015fmesine dayanmaktad\u0131r. \u0130\u015f\u00e7inin s\u00f6zle\u015fmeye ayk\u0131r\u0131 \u015fekilde i\u015fverene zarar vermesi halinde, i\u015fverenin zarar\u0131n\u0131n tazmini amac\u0131 ile a\u00e7aca\u011f\u0131 dava da tazminat niteli\u011finde oldu\u011fundan on y\u0131ll\u0131k zaman a\u015f\u0131m\u0131na tabidir.<br>4857 say\u0131l\u0131 Kanundan daha \u00f6nce y\u00fcr\u00fcrl\u00fckte bulunan 1475 say\u0131l\u0131 Yasada \u00fccret alacaklar\u0131yla ilgili olarak \u00f6zel bir&nbsp;zamana\u015f\u0131m\u0131&nbsp;s\u00fcresi \u00f6ng\u00f6r\u00fclmedi\u011fi halde, <strong>4857 say\u0131l\u0131 \u0130\u015f Kanunun 32\/8 maddesinde, i\u015f\u00e7i \u00fccretinin be\u015f y\u0131ll\u0131k \u00f6zel bir&nbsp;zamana\u015f\u0131m\u0131&nbsp;s\u00fcresine tabi oldu\u011fu a\u00e7\u0131k\u00e7a belirtilmi\u015ftir<\/strong>. <strong>Ancak bu Kanundan \u00f6nce tazminat niteli\u011finde olmayan, \u00fccret niteli\u011fi a\u011f\u0131r basan i\u015f\u00e7ilik alacaklar\u0131 ise 818 say\u0131l\u0131 Bor\u00e7lar Kanununun 126\/1 maddesi uyar\u0131nca be\u015f y\u0131ll\u0131k&nbsp;zamana\u015f\u0131m\u0131na&nbsp;tabidir. <\/strong>01.06.2012 tarihinden sonra y\u00fcr\u00fcrl\u00fc\u011fe giren 6098 Say\u0131l\u0131 TBK.\u2019un 147. Maddesi ise \u00fccret gibi d\u00f6nemsel nitelikte \u00f6denen alacaklar\u0131n be\u015f y\u0131ll\u0131k&nbsp;zamana\u015f\u0131m\u0131na&nbsp;tabi olaca\u011f\u0131n\u0131 belirtmi\u015ftir.<br>Kanundaki&nbsp;zamana\u015f\u0131m\u0131&nbsp;s\u00fcreleri, 6098 Say\u0131l\u0131 TBK 148. Maddesi gere\u011fince taraflar\u0131n iradeleri ile de\u011fi\u015ftirilemez.<br>\u0130\u015f s\u00f6zle\u015fmesi devam ederken kullan\u0131lmas\u0131 gereken ve i\u015f s\u00f6zle\u015fmesinin feshi ile alacak niteli\u011fi do\u011fan <strong>y\u0131ll\u0131k izin \u00fccreti alaca\u011f\u0131n\u0131n&nbsp;zamana\u015f\u0131m\u0131&nbsp;s\u00fcresinin&nbsp;fesih tarihinden ba\u015flat\u0131lmas\u0131 gerekir <\/strong>(HGK. 05.07.2000 g\u00fcn ve 2000\/9-1079 E, 2000\/1103 K).<br>S\u00f6zle\u015fmeden do\u011fan alacaklarda,&nbsp;zamana\u015f\u0131m\u0131&nbsp;alaca\u011f\u0131n muaccel oldu\u011fu tarihten ba\u015flar. (TBK. m. 149(818.BK.128). T\u00fcrk Bor\u00e7lar Kanununun 117 inci maddesi uyar\u0131nca, borcun muaccel olmas\u0131, ifa zaman\u0131n\u0131n gelmi\u015f olmas\u0131n\u0131 ifade eder. Borcun ifas\u0131&nbsp;hen\u00fcz&nbsp;istenemiyorsa muaccel bir bor\u00e7tan da s\u00f6z edilemez.<br>6098 Say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 151 inci maddesinde&nbsp;zamana\u015f\u0131m\u0131n\u0131n&nbsp;nas\u0131l hesaplanaca\u011f\u0131 belirtilmi\u015ftir. Bu maddenin birinci f\u0131kras\u0131,&nbsp;zamana\u015f\u0131m\u0131n\u0131n&nbsp;alaca\u011f\u0131n muaccel oldu\u011fu anda ba\u015flayaca\u011f\u0131 kural\u0131n\u0131 getirmi\u015ftir(818 say\u0131l\u0131 BK.128). Ayn\u0131 y\u00f6nde d\u00fczenleme 01.07.2012 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe giren 6098 Say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 151 inci maddesinde yer almaktad\u0131r.<br>6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 152. maddesi gere\u011fince, as\u0131l alacak zaman a\u015f\u0131m\u0131na u\u011frad\u0131\u011f\u0131nda faiz ve di\u011fer ek haklar da&nbsp;zamana\u015f\u0131m\u0131na, u\u011frar. Di\u011fer bir deyi\u015fle faiz alaca\u011f\u0131 as\u0131l alaca\u011f\u0131n tabi oldu\u011fu&nbsp;zamana\u015f\u0131m\u0131na&nbsp;tabi olur(818 say\u0131l\u0131 BK.131).<br>T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 154. maddesi (818 Say\u0131l\u0131 BK 133\/2) uyar\u0131nca, alacakl\u0131n\u0131n dava a\u00e7mas\u0131yla&nbsp;zamana\u015f\u0131m\u0131&nbsp;kesilir. Ancak zaman a\u015f\u0131m\u0131n\u0131n kesilmesi sadece dava konusu alacak i\u00e7in s\u00f6z konusudur.<br>6098 Say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 153\/4 maddesinde \u201cHizmet ili\u015fkisi s\u00fcresince, ev hizmetlilerinin onlar\u0131 \u00e7al\u0131\u015ft\u0131ranlardan olan alacaklar\u0131 i\u00e7in&#8221;&nbsp;zamana\u015f\u0131m\u0131n\u0131n&nbsp;i\u015flemeyece\u011fi ve duraca\u011f\u0131 belirtilmi\u015ftir. Bu maddenin i\u015f s\u00f6zle\u015fmesiyle ba\u011fl\u0131 her ki\u015fiye uygulanmas\u0131 olana\u011f\u0131 bulunmamaktad\u0131r. Hizmet\u00e7iden kastedilen, kendisine ev i\u015fleri i\u00e7in \u00fccret \u00f6denen, i\u015f sahibiyle ayn\u0131 evde yat\u0131p kalkan, aileden biriymi\u015f gibi ev halk\u0131 ile s\u0131k\u0131 ili\u015fkileri olan kimsedir(818 say\u0131l\u0131 BK.
